Abstract

Manpower as an important element in a company requires protection, maintenance and security in carrying out its work. The protection of workers still has to be improved, including improving working conditions, improving welfare and implementing work safety and welfare that is integrated with all workforce development programs accompanied by law enforcement efforts. The Environment Office Tabanan Regency did not register its workers because of existing regulations, in addition to the insufficient budget for The Social Security Administration Agency payments. The inhibiting factor in the implementation of legal protection for workers in the Tabanan Regency The Environment Office was internal factors regarding legal awareness of workers not knowing about the Legislation, external factors, namely not the existence of supervision and guidance on entrepreneurs and workers by the Manpower Office so that the implementation of legal protection does not run in accordance with the statutory regulations.

Abstract

Dalam praktik perbankan penggunaan jaminan berupa hak milik atas tanah sebagai jaminan untuk perolehan fasilitas kredit biasa terjadi. Nasabah demikian atau yang secara hukum biasa disebut debitur wajib untuk melengkapi syarat dan ketentuan yang disuguhkan oleh pihak bank atau yang dalam hal ini disebut sebagai kreditur. Syarat dan ketentuan perolehan fasilitas kredit sekiranya sudah dibakukan disetiap lembaga perbankan baik itu di bank umum (bank Badan Usaha Milik Negara, Milik Daerah, maupun swasta nasional) tak luput juga pada di Bank Perkreditan Rakyat. Syarat inti secara umum adalah berupa identitas debitur seperti Kartu Tanda Penduduk, Kartu Keluarga, Nomor Pokok Wajib Pajak, data pekerjaan seperti slip gaji atau kelengkapan usaha milik debitur, dan tentunya jaminan berupa hak milik atas tanah (prioritas penelitian) dengan ketentuan penandatanganan perjanjian kredit serta akta pemberian hak tanggungan dihadapan Pejabat Pembuat Akta Tanah. Namun, adakalanya ketika debitur mengalami wanprestasi (kredit macet) tiap-tiap bank memiliki strategi yang berbeda dalam menindaklanjutinya termasuk didalamnya mengenai eksekusi jaminan milik debitur yakni berupa hak milik atas tanah sebagaimana tersebut diatas. Seperti halnya yang dilakukan PT. Bank Perkeditan Rakyat Tish (obyek penelitian) ketika ada debitur yang mengarah ke wanprestasi, maka akan dilakukan berbagai sarana pendekatan kepada debitur, sebelum dinyatakan benar-benar mengalami wanprestasi baik itu restrukturisasi kredit, reschedule jangka waktu, dan lain sebagainya. Ketika debitur telah dinyatakan mengalami wanprestasi maka akan dilakukan eksekusi hak tanggungan dengan metode parate eksekusi berdasarkan titel eksekutorial terhadap jaminan hak milik atas tanah milik debitur, yang mana pelaksanaannya disesuaikan dengan situasi dan kondisi yang terjadi dilapangan.

Abstract

Tourism undergoes a cycle of change that affects the culture-based Balinese tourism model by strengthening local wisdom. Tourism can run optimally if it has guarantees and cultural resilience. In addition to functioning as a tourist attraction, tourism is considered a medium to reap large profits, so tourism activities often shift cultural values and change people's lifestyles. For this reason, to control the influence of globalization on industrialization investment in tourism which has begun to follow the changes in the civilization of the industrial revolution 4.0, Badung Regency has become the rule model for the transformation of the implementation of culture-based tourism investment. This research study is descriptive-analytical, a type of research that does not stop at mere descriptions but also comes to an effort to study the characteristics of solving cases of tourism investment problems using qualitative research methods. The results of this study indicate that the people of Badung Regency's understanding of the importance of local wisdom in applying a culture-based investment model is very high. So investment activities in the tourism sector emphasize aspects of the national economy and preserve local wisdom. In addition, applying a culture-based investment model with strengthening local wisdom requires good synergy between the Government, Indigenous Village communities, tourism businesses, and investors to truly develop the concept of sustainable cultural tourism in Bali.

Abstract

This research aims explicitly to explain the authority and role of the traditional village in utilizing customary village land for investment activities for tourism areas based on local wisdom in the Kerobokan Customary Village. This study used an empirical research type, with the research subjects of the Bendesa Adat and the village Prajuru. The data collection techniques used in this study were observation, a document study, in-depth interviews, purposively selected informants, namely each of the Indigenous Prajuru in the Kerobokan Customary Village, and Focus Group Discussion. The finding showed that the Kerobokan Customary Village has a role in the use of land for investment in tourism areas. The use of customary land for tourism investment activities was carried out with a lease agreement under the supervision of the Bendesa Adat. The finding showed that the involvement of the Customary Village in maintaining the balance of Tri Hita Karana values implementing tourism investment was not optimal, which can be seen from the effect of this activity in the form of environmental pollution within the tourism area, the shifting values of the local wisdom to be more commercialism, liberalism, and individualism.

Abstract

Pulau Bali merupakan salah satu destinasi yang memiliki potensi paling banyak untuk dikunjungi oleh masyarakat domestik atau asing. Di Bali juga terdapat aturan yang disebut dengan awig-awig yang diterapkan oleh berbagai desa maupun suku contohnya seperti Desa Adat Kerobokan,Kabupaten Badung. Tujuan penelitian ini yaitu untuk mengetahui ketentuan awig-awig desa adat kerobokan dalam pengelolaan tanah adat terkait kegiatan investasi pariwisata dan efektivitas peraturan hukum adat dalam pengelolaan tanah adat untuk investasi pariwisata.Jenis Penelitian yang digunakan yaitu, metode yuridis empiris, Berdasarkan hasil penelitian di lapangan tersebut dapat dinyatakan bahwa awig-awig yang diterapkan di desa tersebut masih belum efektif untuk di implementasikan.

Abstract

The COVID-19 pandemic has had a very broad impact on people's lives, especially with regard to traditional ceremonies in Bali. One of these activities is the Ngaben Ceremony (Pitra Yadnya). On the other hand, PPKM has been a policy of the Indonesian Government to combat the Covid-19 pandemic since early 2020. PPKM has a great influence in the Ngaben ceremony. Ngaben is a ceremony to purify spirits and smelting corpses by burning the bodies of people who have died. The formulation of the problem in this research; What is the role of law in carrying out the Ngaben ceremony in Bali? and how to use sanctions against people who violate PPKM during the Ngaben ceremony in Bali? This research approach, with legislation, the type of research used is normative legal research. The technique of collecting legal materials used in this paper is through literature study. The conclusions from the formulation of the problem are the role of law and sanctions against PPKM violators in relation to the Ngaben ceremony, namely in accordance with applicable regulations, such as; Minister of Home Affairs Instruction Number 35 of 2021 and Governor's Circular Letter Number 12 of 2021.

Abstract

This article provides an assessment of the state of digital freedom in Indonesia, with a focus on online censorship, privacy, and free expression. The research methodology used in this study was a combination of normative legal approach and literature review, which provided a comprehensive analysis of the legal framework that governs digital rights in Indonesia. The discussion highlights the importance of human rights in the digital realm, and how the legal framework in Indonesia aligns with international human rights standards. The study found that the current state of digital freedom in Indonesia is mixed, with laws and regulations in place to protect privacy and freedom of expression, but concerns about online censorship and restrictions on these rights in practice. The implementation of laws such as the ITE Law has led to the prosecution of individuals for online speech, raising concerns about the impact on freedom of expression. To improve the state of digital freedom in Indonesia, several suggestions are made. Firstly, the implementation of laws and regulations related to digital rights must be consistent with international human rights standards. Secondly, efforts should be made to address the gaps between the legal framework and the reality of digital rights on the ground. This may involve greater transparency and accountability in the enforcement of laws and regulations related to digital rights. Additionally, there is a need for greater public awareness and education about digital rights, both among citizens and among policymakers and law enforcement officials.

Abstract

Implementation of compliance with environmental documents according to the UUPPLH for business actors and/or activities, with supervision efforts from the Badung Regency Environment and Sanitation Service on the level of compliance of those in charge of businesses and/or activities with the provisions of laws. The type of research used in the research used in this research is empirical legal research. In implementing environmental documents, there are still many business actors who have not fulfilled their obligations in accordance with laws and regulations, due to a lack of understanding, commitment, and concern for environmental documents owned by business actors and/or activities to carry out obligations, fulfill requirements, and avoid prohibitions. . The target for the implementation of monitoring of pollution and environmental destruction is set forth in the Budget Execution List (DPA) every year and the realization of its implementation is regulated in accordance with the cash flow which has been determined every month. Business actors and/or activities proven to have violated environmental management are given administrative sanctions in accordance with the violations committed and business actors and/or activities that have complied with environmental management are given appreciation.

Abstract

The Covid-19 pandemic has had a significant impact on the economy in Bali. Efforts to formulate a strategic and integrative policy in the tourism sector to accelerate the post-Covid-19 economic recovery can be done by implementing the Pentahelix Strategy in the development of the tourism industry. This strategy collaborates with Academia-Business-Community-Government and Media, which are oriented towards meeting the needs of the tourism industry based on local wisdom. The general objective of this study is to determine how the implementation of tourism policy in Denpasar City post-Covid-19 pandemic is conducted, as well as to identify the synergies of the Pentahelix Strategy in formulating tourism policies as an effort to support economic recovery in Denpasar City. This research reflects a descriptive-analytical study, a type of research that is not only limited to description but also to efforts to study the characteristics of problem-solving cases in tourism investment. The research method used is qualitative research, often referred to as a naturalistic research method because the research is conducted in natural settings. It is also known as an ethnographic method because it was originally used more in cultural anthropology research. This method is called qualitative because the collected data and analysis are more qualitative in nature.

Abstract

This study aims to find and examine the implementation of land management in the Kerobokan Traditional Village for tourism industry activities. The issues raised in this study are about mechanisms and procedures for land management and the implementation of land management in traditional villages for the tourism industry. This research is an empirical research with an emphasis on field data as primary data. This study found that the implementation of land management in the Kerobokan Traditional Village for tourism industry activities was carried out by leasing a contract based on an agreement through the relevant Paruman Desa Adat/Banjar Adat. The Kerobokan Traditional Village also has a Perarem Pangele which regulates administrative provisions that must be met by krama tamiu (in this case including investors). The authority to manage this land is strengthened by the Regional Regulation of the Province of Bali Number 4 of 2019 concerning Traditional Villages in Article 1 number 8 which provides autonomy for Traditional Villages to manage their own households. Penelitian ini bertujuan untuk menemukan dan mengkaji terkait implementasi pengelolaan tanah di Desa Adat Kerobokan untuk kegiatan industri pariwisata. Permasalahan yang diangkat dalam penelitian ini adalah tentang mekanisme dan prosedur pengelolaan tanah serta implementasi pengelolaan tanah di Desa Adat untuk industri pariwisata. Penelitian ini merupakan penelitian empirik dengan menekankan pada data lapangan sebagai data primer. Penelitian ini menemukan bahwa implementasi pengelolaan tanah di Desa Adat Kerobokan untuk kegiatan industri pariwisata dilakukan dengan sewa kontrak berdasarkan kesepakatan melalui Paruman Desa Adat/Banjar Adat yang bersangkutan. Desa Adat Kerobokan juga memiliki Perarem Pangele yang mengatur tentang ketentuan administrasi yang harus dipenuhi oleh para krama tamiu (dalam hal ini termasuk investor). Kewenangan pengelolaan tanah tersebut diperkuat dengan Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 tentang Desa Adat pada Pasal 1 angka 8 yang memberikan otonomi bagi Desa Adat untuk mengurus rumah tangganya sendiri.
