Abstract

Cendana sebagai komoditi bernilai ekonomi tinggi yang persebaran alaminya terdapat di Nusa Tenggara Timur (NTT), merupakan kebanggaan masyarakat setempat. Nilai ekonomi tanaman cendana terdapat pada kayu gubal, teras, serbuk dan ampas serta minyak cendana. Kayu cendana digunakan untuk kerajinan dan minyak cendana untuk obat-obatan dan kosmetik. Dampak dari nilai ekonomi yangtinggi adalah sering terjadinya penebangan secara liar (tidak terkontrol), sehingga kehidupannya semakin terancam. Penebangan yang tidak terkendali ini tidak memperdulikan aturan-aturan yang berlaku baik dari segi tertib hukum maupun dari segi konservasi seperti ukuran lingkar batang, umur tanaman dan intensitas penebangan. Dilihat dari umur cendana yang berkualitas bagus dapat ditebang pada umur berkisar 40-50 tahun. Walaupun cendana cukup berpotensi karena harga jual yang cukup menjanjikan tetapi tidak membuat kesejahteraan hidup masyarakat meningkat. Hal ini karena monopoli pemerintah terus berlanjut bagi tanaman cendana yang tumbuh di pekarangan maupun lahan lainnya milik masyarakat; sehingga terjadi masalah yang cukup serius mengenai cendana ini bila dilihat dari segi ekonomi,ekologi serta perilaku masyarakat. Selanjutnya bagaimana hukum pengelolaan cendana dan bagaimana perilaku masyarakatnya dengan berlakunya ketentuan hukum tentang cendana di NTT. Dibutuhkan tertib hukum yang menyangkut aspek yuridis seperti hak dan kewajiban, kedudukan hukum, peran serta masyarakat serta kepatuhan masyarakat. Dapat disimpulkan bahwa pemerintah sebagai penanggungjawab penyelenggaraan pengelolaan cendana di NTT belum mengadopsi azas-azas hukum umum pengelolaan sumber daya alam hayati (SDAH) yang berlaku di Indonesia. Adanya pengaturan hukum yang memberikan hak mengelola cendana kepada Pemerintah Daerah mengakibatkan penyimpangan yang lebih merugikan cendana dan habitatnya di NTT. Sosialisasi hukum lingkungan dan peraturan lingkungan lainnya perlu segera disosialisasikan kepada seluruh masyarakat NTT.

Abstract

Adultery, according to Sabu Society is relations between a man who is bound a custom matrimony or religious marriage with a woman who is bound a matrimony or one of them has bound in a matrimony. Adultery, based on the positive law is ruled in chapter 284 book of Undang-Undang Hukum Pidana (KUHP). Chapter 284 KUHP has the point that a man or woman who has been married and doing adultery (overspel). The point in chapter 284 KUHP has similarity with the point in customary law of Sabunese, namely adultery is conducted with someone (man or woman) who has been joined in matrimony. Based on the research has been done, it found that the people of Sabu is prefer to completing adultery customarily because of some factors, that is: sanction and serious fine, it is normally using the completion customarily with the people of Sabu,the justice law based on the people of Sabu, the effect of completion and completion pattern. Two patterns of completion which appears in completion process of adultery based on the customary law of Sabu is the completion pattern in kinship way which are preventing and protecting.

Abstract

One of the important aspects in environmental development is the use of green open space that serves its objectives and functions. Therefore, the Kupang City Regulation Number 7 of 2000 as a legal guarantee in the use of green open space was issued. The legal issue being studied is whether the implementation the Kupang City regional regulation Number 7 of 2000 is in line with the purpose and function. The research is an empirical research. The results of the study found that implementation of Kupang City Regulation Number 7 of 2000  has not served its purpose and function. It was caused by various factors, as law enforcement officials factor and inadequate supporting facilities and infrastructure. Therefore, it was recommended that there should be seriousness in preparing both supporting facilities and infrastructure for the implementation of these local regulations. Keywords: The Implementation Of There Is A Regional Regulation; The Construction Of The Environment; Green Open Space

Abstract

Abstrak Pelaku kekerasan dalam lingkup pasangan yang telah hidup bersama dalam satu rumah yang namanya belum dicatat dalam akta perkawinan. Rumusan masalah penelitian ini yaitu Apakah kekerasan yang terjadi terhadap pasangan telah hidup bersama dalam satu rumah yang namanya belum dicatat dalam akta perkawinan, merupakan bentuk tindak pidana kekerasan dalam rumah tangga atau tindak pidana penganiayaan? Penelitian menggunakan Penelitian hukum yuridis normatif dengan Data sekunder. Hasil penelitian menunjukan bahwa pasangan kekerasan dalam pasangan telah hidup bersama yang namanya belum dicatat dalam akta perkawinan masuk dalam bentuk tindak pidana penganiayaan (Pasal 351 KUHP). Kata Kunci : Tindak pidana kekerasan, pasangan yang belum dicatat dalam Akta perkawinan

Abstract

Coastal zone is a crucial zone because it has a wealth of natural resources of high economic value while at the same time is prone to adverse affects due to interference of development activities. This research is an empirical legal research which examines that there have been various local regulations with which management of the zone must comply but within those regulations themselves there exist contradictory articles. Furthermore,  this research discovered that this was caused by the drafting of local regulations do not consider to environmental aspects in coastal  zone, inaccuracy in the process of local regulations drafting and the strong ego sector so that the Government issued building license by law enforcement officials that deviate much from the existing regulations. The incompliance of which was done for the sake of economic gain without the least consideration about the environmental aspects and proper land use whereas the development in coastal zone should have a strong regulatory foundation and not based on interests of public authority and sheer power. Keywords: Development Activities, Land Use, Coastal zone

Abstract

The kuanheun coastal communities have a customary law that help maintain coastal environmental sustainability resourceS called as lilifuk customary law(lilifuk atolan instrument). This research applied empirical method by formulating three problems: what are the values embedded in lilifuk customary law; how is the of lilifuk customary law contribution to prevent coastal environmental degradation; and how is the correlation between lilifuk customary law values and the law provision on coastal areas and small islands management.The result of the research identified the following; the first, Lilifuk customary law contains religious value, ecological value, communal value, social relations value, solidarity and responsibility value, social leadership value, and educational value. Second, the settlement of law violation by lilifuk customary law is conduted by the following steps: reporting; discussion; verdict; and  execution. Third, there is a correlation between the lilifuk customary lilifuk values and  WP3K Law values.Keywords: lilifuk customary law, environmental degradation, kupang bay

Abstract

Law enforcement for fisheries management violations in East Flores, East Nusa Tenggara province has not been effectively implemented. It is proven in recent years, violation’s cases of fisheries management is significantly high. This study examines how local wisdom values of indigenous society overcome the ineffective law enforcement for fisheries management violations. This paper employs normative juridical approach and was carried out by identifying and collecting customary law principles which govern fishermen’s attitude. The results show that law enforcement has not been effectively implemented to solve fisheries management violations in terms of the structure, substance and culture of law. To overcome this, it requires functionalization of local wisdom values that have been proven to alleviate marine resources damage by fishermen. Functionalization of local wisdom values is conducted by establishing a partnership between law enforcement and traditional authorities to institutionalize and integrate values system, cultural traditions, and customary penalty to have formal mechanisms of law enforcement.Keywords: local wisdom, law enforcement, fisheries

Abstract

Manggarai communities has been in and around the area of Ruteng Recreation Parksince before the establishment. The determination of the area for conservation cause tenure conflictsfor the closure region for access to agricultural and the timber. The conflict resolution involves three elements, namely the government, customs and religion are called the three pillars. This study aims to understand the stages of the conflict tenure in Manggarai, relevant stakeholders and the role of the three pillars in conflict resolution. The study was conducted in four villages with village conflicting criteria and do not conflict in April to May 2016. Acquisition of data using observation, in-depth interviews with a purposive and snowball and secondary data. Analysis of data using analysis of tree conflicts, stakeholders and conflict mapping. The results showed that the cause of the conflict which is the difference value systems which have implications for the disagreement land status and boundaries as well as the uncertainty of access due to rights issues and access. Ruteng Recreation Park area assignment is not determined by the collective perception that lack of support of the parties. Ruteng Recreation Parksetting legislation and its implementation does not guarantee the security of rights and indigenous peoples' access due to constraints of knowledge and understanding of the laws and regulations, resource constraints, regulatory and administrative development issues. The concept of the three pillars was not optimal because it has not reduced the rate of destruction of Ruteng Recreation Park and there were still conflict of encroachment and illegal logging.
