Abstract

The presence of the Sharia Court in Aceh Province has further strengthened the authority to implement Islamic law in this province. However, there are several things that must be considered so that the rule of law can be realized namely: structural, substantial and cultural aspects. Law enforcement will work if these three aspects are carried out continuously. Nevertheless, there are still a number of legal experts and legal practitioners who have not been able to accept the delegation of authority for criminal cases (jinayat) to the Sharia Court. In fact, the presence of the sharia court as a component of the legal integration mechanism in Aceh. This study will address this issue by examining many regions in Southwest Aceh, including the Syar'iyah Courts of Tapak Tuan, Meulaboh, and Calang, as well as the Province, which serves as the delegation of appeal cases. After all, this research encourages the Sharia Courts to work closely with government stakeholders to provide information and disseminate authority

Abstract

The phenomenon of radicalism and terrorism in the name of religion in Indonesia is still showing its stretching in various existing cases. Responding to this problem requires the objectification of character education values for the Indonesian people in the context of forming a moderate mindset and attitude in their social and religious life. This research intends to identify the dimensions of Pancasila educational values in the four indicators of religious moderation formulated by the Ministry of Religion of the Republic of Indonesia. This qualitative research is in the form of a literature review with a normative-philosophical approach. The results of the study conclude that there are dimensions of Pancasila educational values contained in the four indicators of religious moderation in Indonesia. First, the educational value of the first precepts in the indicator of tolerance in the form of educational values in shaping the mindset and attitude of respecting and respecting various distinctive aspects of religious pluralism. Second, the educational value of the second precept in the indicator of anti-radicalism attitudes in the form of educational values in forming awareness of attitudes to uphold the values of the benefit of human life. Third, the educational value of the third precept in the indicator of national commitment in the form of awareness of the attitude of upholding the values of unity and unity in the frame of state life in Indonesia. Fourth, the educational value of the fourth and fifth precepts in adaptive indicators to local culture in the form of being democratic and making the value of social justice in responding to diversity related to local wisdom. The theoretical implication of the findings of this study shows that the construction of ideas in the formulation of the four indicators of religious moderation in Indonesia has a normative-universal value base that becomes the ideology of the Indonesian nation, not the ideology of a particular religion or group.

Abstract

The Covid-19 pandemic which has been afflicting Indonesians since the beginning of 2020 has a tremendous influence on their lives in variety of ways. The Indonesian government has taken steps to ensure that citizens are protected and that the number of positives is reduced. Keeping the rights of people seeking justice to continue litigating during the Covid-19 pandemic while simultaneously guaranteeing the safety of those infected with the virus is problematic in the field of law enforcement and justice during the Covid-19 epidemic. As a result, the government through the Supreme Court of Indonesia used the Salus Populi Suprema Lex Esto principle which means that people's safety is the highest law by passively using technology in litigation and increasing the supporting facilities for strict health protocols throughout the judiciary, including the Sungguminasa Religious Court. In the context of Maqashid Syariah, the goal of this study was to show and explain the harmony of the use of the Salus Populu Suprema Lex Esto Principle during the Covid-19 Pandemic. This study took a qualitative and empirical approach. The study of primary data source was interviews conducted by judges and court personnel. Collecting, decreasing, presenting, and describing results were all part of the data analysis process. The findings of the investigation revealed that during the Covid-19 epidemic, the government's efforts to uphold justice while preserving the safety of the human soul, such as Maqashid Syariah's of the hifz an-nafs, which is at the primary level was dharuriyyah

Abstract

The function and role of the mosque which was carried out by the Prophet Muhammad when he first founded the mosque, that is, apart from being a place of worship, it is also a place of education. Based on the researcher's observations from the preliminary study conducted, the mosque at SMPN 17 Bandung is highly optimized and used as a laboratory for Islamic religious education in the midst of other junior high schools that already have a special laboratory for Islamic religious education. The problem is, how is the effectiveness of the management of the mosque as a laboratory for Islamic religious education at SMPN 17 Bandung, which encourages the author to conduct research on this matter. This study aims to (1) describe the profile of the mosque, (2) describe the effectiveness of planning, organizational effectiveness, implementation effectiveness, and effectiveness of supervision of mosque management as a laboratory for Islamic religious education. This research starts from the idea that achievement in managing mosques as Islamic Education laboratories can be measured through 4 aspects, namely planning, organizing, implementing and monitoring which will be used as a measure of the effectiveness of mosque management. This research uses a qualitative approach, the research method is descriptive, with the type of research being field research. Which is located at SMPN 17 Bandung. Data collection techniques using observation, in-depth interviews and documentation. The result of the research is that the effectiveness of mosque management as an Islamic religious education laboratory can be said to be quite effective with the running of each planned program, although there are still some that are less than optimal in technical implementation, such as in organizing in terms of the person in charge still lacking human resources but does not hinder the activities. In terms of implementing the activities, everything went well, only because of the large number of students, the activities carried out in the mosque were only certain programs, and the researchers focused on activities that went well in the mosque. For supervision, teachers and related parties in the ongoing activities take attendance before starting and directly monitor the course of activities by paying attention to students who do not participate in activities

Abstract

Every child certainly has the same rights in terms of inheritance and others, mistakes made by both parents should not have an impact on children who are victims of immoral acts or adultery of both parents. Every human being has the same rights in the eyes of the law, whether Islamic law or positive law and it is regulated in the law so that in determining the inheritance status of a child born as a result of adultery, if born at the age of marriage of at least 6 (six) months, the child can follow the lineage of the father and the rights to inherit the property. It is also explained in articles 100 and 186 of the Compilation of Islamic Law which means that children from the consequences of adultery have the rights to inherit if they are born in a marital relationship

Abstract

This article provides an overview of the condition of  the  competitiveness of Islamic banking performance in Indonesia and Pakistan using the porter's diamond theory descriptive analysis method, namely (i) resource variables with indicators of Institutional Performance and Financial Performance, (ii) Demand Variables with Market share and financing indicators (iii) Industry variables related to indicators of the number of sharia business units, (iv) Strategy variables with the roadmap for the development of sharia banking. The conclusions in this study are: 1) The competitive advantages of Islamic banking in Indonesia in 2016-2020 namely Institutional Performance of Islamic commercial banks, average profit growth and average growth of third party funds, compared with the same indicators on Islamic banking  in  Pakistan.  2)  Competitiveness  of  Islamic banking in Pakistan in 2016-2020, namely the Financial Ratio of NPF, FDR and BOPO which ranked first in terms of bank health level, and the average market share growth andfinancing growth compared to the same indicators in Islamic banking in Indonesia.Keywords: Islamic Banking Performance, Competitiveness, Diamond Porter theory.

Abstract

The falak science is a discipline of practical astronomy which is more inclined to the relationship between the movement of celestial bodies and the practice of muslim worship. The movement of celestial bodies is often used as an indicator in the implementation of certain worship rituals. The five daily prayers are concerned with the rotation of the earth which causes day and night. The earth and moon revolutions led to the Syamsiah and Qomariah calendars to find out the schedule for the Hajj. The shape of the earth that is round and the sun's light at a certain time can be an indication of the Qibla direction. The definition of falak as the movement of celestial bodies as described above is interesting to study in the Qur’an. This study used a content analysis method of the Qur’an with interpretation media of Tafsir Al-Misbah. There were three concluding phases of this study; First, textual identification of falak verses were found in three words, namely al-falak, al-falaq, and al-fulk. Al-falak means the path of the earth, al-falaq means a cleaver, and al-fulk means ark (sailing ship). Al-Falaq which means the movement of celestial bodies has significance with the theory of nature's qadim. Scientifically, astronomy can prove scientifically that nature predates time

Abstract

The Quick Response Code Indonesian standard  is one part of the digital-based payment instrument issued by Bank Indonesia which was adopted by Bank Syariah Mandiri  to facilitate customers in transacting. Currently all applications that have a QR code are required to use QRIS as a national standard. This study raises the issue of concepts, systems and mechanisms as well as the views of Islamic law regarding QRIS. The research method used  a field research with qualitative method with observations, interviews and documentation techniques. The results showed that QRIS is a halal product that has gone through the supervision process of the Dewan Pengawas Syari’ah  and has a DSN fatwa as the legality law for Bank Syariah Mandiri. QRIS mechanism by scanning the code available in the BSM Mobile Banking application. In addition to having practical and efficient benefits, QRIS is very safe so that customers are protected from criminal practices such as skimming and other types of theft. In addition, by using QRIS, customers can break the chain of the spread of Covid 19 because they do not make physical contact. The results of this study are very important for customers who use Bank Syariah Mandiri products so that they know that QRIS is a halal product, safe from all cyber crimes, flexible and reduces physical interaction in the pandemic era.

Abstract

The purpose of the study to describe three things, namely the partial influence of discipline on work commitments, the partial influence of achievement on work commitments, and the simultaneous influence of work commitments of teacher madrasah Ibtidaiyah Negeri 4 Aceh Timur. The research method used is quantitative survey. Collecting data using questionnaires. Data analysis is performed with regression test, t test, F test, and determination coeffesient. The findings showed that there was a partial influence of disciplinary variables on work commitments of 0.319 (31%), there was a partial influence of achievement on work commitments of 0.594 (59%) and there is a simultaneous influence of discipline and achievement together on teacher work commitments of 0.940 (94%) only 6% were affected by other variables outside of this study

Abstract

Divorce is a phenomenon of family division involving husband and wife with an increasing percentage in Indonesia. The increase in divorce cases in court is due to the insistence on divorce by litigation and divorce by talaq as the main initiative of husband and wife at the Parepare Religious Court. In order to discuss these issues, the data was collected using a field research (qualitative descriptive) system, so that the results showed that divorce cases from 2019-2020 showed that divorce by litigation was more dominant than divorce by talaq at the Parepare Religious Courts Class 1B. The presentation of the increasing number of divorces by litigation indicated that the wives were dissatisfied with the duties and obligations of their husbands in their marital life. Meanwhile, the factors that influenced divorce by litigation at the Parepare Religious Court consisted of 13 factors, namely third parties, drunkenness, mandates, gambling, leaving one party, imprisoned, polygamy, Domestic Violence (DV), disability, disputes or quarrels continuously, forced marriage, apostasy, and economics. In reality, economic problems, leaving one party and disputes or quarrels continuously were the highest causes in the 2019-2020 timeframe. As a result, divorce cases affected the children's psychology and the disharmony of each party
