Abstract

Pengeluaran dan Pembebasan Warga Binaan Pemasyarakatan melalui Asimilasi dan Integrasi dalam Rangka Pencegahan dan Penanggulangan Penyebaran Covid-19 merupakan Kebijakan yang diambil oleh Kementerian Hukum dan HAM melalui Peraturan Menteri Hukum Dan Hak Asasi Manusia Nomor 10 Tahun 2020 tentang Syarat Pemberian Asimilasi dan Hak Integrasi Dalam Rangka Pencegahan dan Penanggulangan Penyebaran Covid-19 guna melindungi narapidana dari penularan virus tersebut. Dalam praktiknya kebijakan ini menuai pro dan kontra di masyarakat. Dalam penelitian ini digunakan metode penelitian hukum yuridis normatif dengan analisis data yang bersifat kualitatif, yang menganalisa data sekunder melalui bahan hukum yang ada berdasarkan peraturan perundang-undangan yang berlaku. Setidaknya kebijakan pembebasan warga binaan di masa pandemic covid 19 , berkaitan dengan kesehatan dan kemanusiaan. Kata kunci: hak Integrasi, warga binaan, pandemik Covid-19

Abstract

In its efforts to protect the national economy the power of a country is not unlimited. The state, as the holder of sovereignty, must comply with the provisions of international law. As a WTO member who also ratified the GATT, Enabling Clause, Marrakesh Agreement, and Doha Declaration, United States of America should have complied with, and implemented with full commitment, all the provisions governed in these agreements. On the basis of the order issued by President Donald Trump through a memo dated July 26, 2019, on February 10, 2020 USTR announced a new development taxonomy threshold that caused Indonesia and 22 other WTO member countries with Gross National Income per capita less than US $ 12,375.-, the threshold of the World Bank's high-income countries, to involuntarily lose their status as developing countries, which resulted in these countries being deprived access to WTO’s special and differential treatment provisions. The purpose of this paper is to conduct a juridical analysis on the unilateral action taken by USTR to alter the development taxonomy threshold of WTO’s developing country members examined from the concept of "graduation" and the various provisions stipulated in WTO agreements. Seen from the concept of "graduation" development taxonomy designed by USTR contains various weaknesses and was not based on transparent and data-driven methodology, this has caused some WTO developing country members to lose their status prematurely. This unilateral action taken by the USTR also contradicted various provisions stipulated in the GATT, Enabling Clause, Marrakesh Agreement, and Doha Declaration, and was not in accordance with the WTO's noble goal of advancing the economies of developing countries.

Abstract

Problems of industrial relations from time to time, basically arises due to changes in values ​​and internal and external factors. Seeing the large number of industrial disputes arising between companies and workers, it is needed a mediator to bridge these disputes. Termination of employment can not be done at will of the employer, but must be done with a strong reason and grounds, as regulated in Article 158 of Law Number 13 of 2003 concerning Manpower. The research conducted is a descriptive analysis, which describes or illustrates the overall problem in the study associated with the provisions in the literature, legislation, and then analyzed the problems that have to do with the object of the problem. The first discussion about the factors that cause industrial relations disputes between workers and employers is due to violations of the law in general due to differences in understanding in the implementation of labor law, this is reflected in the actions of employers who violate legal provisions. Disputing parties must negotiate the Bipartite at the company level through deliberation; make complaints and record industrial relations disputes to the Social Service, Labor and Transmigration Tangerang if there is a failure in the Bipartite negotiations that have been carried out by bringing letters or documents that can support these complaints, especially the minutes of the Bipartite negotiations, the establishment of mediation as a path for resolving industrial relations disputes. Abstract

Abstrak To date, the FIR over Batam, Tanjungpinang, and Natuna areas are still under Singapore control. The three areas in the Riau Islands Province (Kepri) were entered into the air space of block ABC. The impacts, flight activities at Hang Nadim Airport Batam and the airports included in the ABC block must wait for the notice of take-off clearance other than Air Traffic Control (ATC) Batam, also from ATC Singapore. It means that the flight was carried out on the ABC block by Indonesian aircraft, both civilian and military air planes have to be licensed from Singapore. This led to Indonesia not getting income from ATC, nor sovereign over its air. Various efforts have been made to support the government's plan to take over the management of FIR over Batam, Tanjungpinang, and Natuna of Singapore, even the takeover has been mandated in article 458 of Law No. 1 of 2009 on flights stating that the air area of the Republic of Indonesia, whose flight navigation service is delegated to other countries based on the agreement must be evaluated and served by the service provider of navigation services at the latest 15 (fifteen) years since the Act applies. Based on the law, Indonesia's foreign controlled air space must be in the control of Indonesia at the latest in 2024. Keyword: acquisition of FIR Indonesia from Singapore.

Abstract

Abstrak Pelaku kekerasan dalam lingkup pasangan yang telah hidup bersama dalam satu rumah yang namanya belum dicatat dalam akta perkawinan. Rumusan masalah penelitian ini yaitu Apakah kekerasan yang terjadi terhadap pasangan telah hidup bersama dalam satu rumah yang namanya belum dicatat dalam akta perkawinan, merupakan bentuk tindak pidana kekerasan dalam rumah tangga atau tindak pidana penganiayaan? Penelitian menggunakan Penelitian hukum yuridis normatif dengan Data sekunder. Hasil penelitian menunjukan bahwa pasangan kekerasan dalam pasangan telah hidup bersama yang namanya belum dicatat dalam akta perkawinan masuk dalam bentuk tindak pidana penganiayaan (Pasal 351 KUHP). Abstract

All forms of regulatory constraints must be simplified, especially overlapping regulations that require reform and harmonization so that they do not hamper investment. For this reason, the Government will make laws with the concept of Omnibus Law, which is an umbrella act. However, the umbrella law is not known in Law No. 12 of 2011 which regulates the formation of legislation. so to be enacted, the Omnibus Law must obtain legitimacy from Law No. 12 of 2011. This study uses a normative type of research with analytical descriptive research nature using document study data collection tools sourced from primary, secondary and tertiary legal materials, where the data are analyzed qualitatively. Abstract

Facing the liberalization of trade and services in international trade, further in the development of the 21stMaritime Silk Road concept that aims to improve connectivity and open the widest trade routes, making tariff rates as one of the factors to win the competition. Meanwhile, the existence of the cabotage principle which prevents foreign sea transportation from carrying out transportation activities in Indonesian waters is not in line with the concept of the 21st Maritime Silk Road. The purpose of this study was made to determine the role of Cabotage Principle in the midst of Indonesia’s commitment in facing the MSR’s concept. Based on the results of the study, the consistency in implementing Cabotage Principle in Indonesia will eventually supports Indonesia’s commitment in the concept of 21stMaritime Silk Road. keyword: Cabotage Policy, 21stMaritime Silk Road

Copyright is very important part of Intelectual Property Right. That is particularly in the field creation of Copyright about song and music, its offence extremely concerned and serious in Indonesia. Copyright is the exclusive right or special right which has meaning that other people cannot take all advantages on the right as from creator economy for its creatures without any license creator or copyright holders legitimate. The Consequences are in every utilization of music for Commercial Business activities and or for purpose relates with business/aims commercial such as Café, Hotel, restaurant and others, must request permission first to the creator and or copyright holder over the use of creation in regards about the song and music. Abstract

The debate regarding the imposition of criminal penalties for narcotics abusers from a human rights perspective has generated various opinions, both among academics and from legal experts. There are those who agree to the imposition of imprisonment and others who do not agree to imprisonment but provide rehabilitation for narcotics abusers. The punishment of imprisonment for narcotics abusers is a severe punishment and often differs from other decisions, but the evidence presented in court is smaller, but the verdict is considered inadequate due to personal use for oneself and does not victimize others by traded to the crowd. Rehabilitation given to narcotics abusers in Indonesia is still relevant given evidence that can be defended in court and this research can be applied that in the future the formulation, application and implementation of rehabilitation will be given to narcotics abusers who have strong evidence and are given a balance to them. other communities are not selective. Abstract

Menjadi penting untuk dibahas tentang simpang siur dari proses pembuktian oleh Hakim yang memutus permohonan PKPU dan Kepailitan di Pengadilan Niaga. Sebagian Hakim memilih bukti yang bersumber dari perangkat digital telah cukup meyakinkan Hakim untuk memutus, namun sebagian Hakim memilih bahwa bukti tersebut tidak cukup kuat untuk dipergunakan sebagai pertimbangan untuk memutuskan sebuah permohonan. Dalam proses permohonan PKPU dan Kepailitan diperlukan adanya pembuktian tentang apakah pemohon telah mampu membuktikan dalil tentang telah terdapat dua kreditor dan salah satu sudah jatuh tempo dan dapat ditagih (vide Pasal 2 ayat (1) UU No. 37 Tahun 2004 Tentang PKPU dan Kepailitan). Pembuktian ini menurut hukum dilakukan secara sederhana (Pasal 8 ayat (4) UU No. 37 Tahun 2004 Tentang PKPU dan Kepailitan). Kerancuan terjadi terus menerus dan berimplikasi kepada perkembangan PKPU dan Kepailitan itu sendiri, sehingga memerlukan penyesuaian lebih lanjut.
