Abstract

Cryptocurrency is a new investment commodity that is growing fast in Indonesia. Crypto assets have different taxonomies from one another. For this reason, this research aims to identify the taxonomy of crypto assets as digital assets and analyze the framework of regulation for crypto assets as an investment commodity in Indonesia using normative juridical methods. This research uses statute and an analytical approach. The research data is taken from secondary data sources. The results study show that to create proper regulation of crypto assets in Indonesia is crucial to classify the types of crypto assets appropriately. Although the Indonesian government has issued several specific rules related to crypto assets, such as Bappebti Regulation No. 8 of 2021, these regulations have not provided sufficient legal certainty and protection for crypto asset users who have a broad dimension and scope as digital assets that can be used as a means of payment and investment and involve cross-sectoral. Therefore, stronger regulations in the form of laws are needed to provide legal protection for cryptooassettusers in Indonesia.

Abstract

The implementation of outer space exploring and using activities by a state builds on the Space Treaty 1967. This provision governs two basic principles in using outer space: non-appropriation and freedom exploration. The principle of giving the states a freedom to do their activities in outer space leads so many space objects to be launched. Some problems then result from the activities done by the states in outer space: outer space debris problem, falling space object, and misuse.  If a state does an activity and then results in damage or loss against other stages in the outer space, it will be imposed with a liability as governed in the Liability Convention 1972. This research focuses on a study on the concept of state’s liability if its activities in outer space results in damage/loss against other states. This research used a normative legal research method, aiming to analyze the concept of fault from the state’s action resulting in damage/loss against other states in outer space. This analysis is important because the term of the fault of state action is not defined in Liability Convention 1972.

Abstract

After general election, fair and competitive elections in 2019 with the election of Kais Saied as president, Tunisia's democracy has been a success. However, political turmoil arose after President Saied's political actions by issuing emergency decrees; dissolving parliament, removing the prime minister and controlling executive institutions were considered to hinder democratic development in Tunisia. This research looks at the elements of democratization development using Robert Dahl's theory of democracy on the one hand and on the other hand will look at President Saied's autocratic actions using Levitsky and Ziblatt's theory of otritarianism. The method used in this research is a microscopic research method, which looks at parts of President Saied's political actions in the democratization process in Tunisia. The results of this study indicate that the democratization process in Tunisia is considered to have been successful as seen from the implementation of elections, public participation and freedom of the press. However, the development of democracy has stagnated due to actions that occurred after President Saied issued decrees such as rejection of the democratic system, control of the media and repressive actions showing the decline of democratic values in Tunisia towards authoritarianism. This shows the decline of democratization principles in Tunisia after the achievements obtained after the Arab Spring.

Lifting, observation, interviews, and documentation are used as data collection approaches. Quantitative data analysis approaches utilise questionnaire verification, data tabulation, and percentage data questionnaires, whereas qualitative data analysis techniques use data reduction, display, and verification procedures. While quantitative data is validated using dependability (accuracy) and validity tests, qualitative data is validated using source triangulation and triangulation procedures. (benar). The study's findings demonstrated that habitus transmission, habitus reception, and collective habitus are used to strengthen the movement's character among students at Muhammadiyah University Makassar so that they participate in community and Muhammadiyah activities there.
