ABSTRAKDalam mengungkap tindak pidana narkotika, pihak Kepolisian tidak hanya memanfaatkan personil yang ada padanya saja, melainkan juga melibatkan potensi masyarakat, baik anggota masyarakat umum yang ingin ikut serta membantu tugas polisi (dalam arti anggota masyarakat yang melihat secara langsung terjadinya tindak pidana narkotika dan melaporkan kepada pihak Kepolisian) maupun anggota masyarakat yang memang sengaja diminta atau ditunjuk oleh Kepolisian untuk memberikan informasi atau sering disebut dengan istilah Informan Polisi. Dalam konteks penelitian ini, penulis memfokuskan pada anggota masyarakat yang memang sengaja diminta atau ditunjuk oleh Kepolisian untuk memberikan informasi atau sering disebut dengan istilah Informan Polisi. Peran serta dari Informan Polisi ini dalam rangka memberikan informasi terhadap penyalahgunaan dan peredaran gelap narkotika sangatlah penting dalam mengungkap kasus-kasus tindak pidana narkotika ini.Berdasarkan data dari Direktorat Reserse Narkoba Polda Kalimantan Barat bahwa jumlah kasus tindak pidana narkotika yang berhasil diungkap oleh pihak Kepolisian selama kurun waktu dari tahun 2016 sampai dengan tahun 2018 sebanyak 293 kasus, dimana pengungkapan kasus tersebut seluruhnya menggunakan jasa Informan Polisi. Namun, keberadaan dari Informan Polisi ini tidak sejalan dengan kepastian dari status hukumnya, karena Informan Polisi bukanlah Aparatur Sipil Negara. Informan Polisi ini tidak termasuk dalam struktur organisasi Kepolisian dan kedudukannya tidak bersifat tetap, tergantung dari kebutuhan pihak Kepolisian untuk menggunakan jasa mereka.Atas adanya fakta tersebut, maka yang menjadi permasalahan dalam penelitian ini adalah bagaimana peran Informan Polisi dan mekanisme penggunaan Informan Polisi dalam pengungkapan tindak pidana narkotika di wilayah hukum Polda Kalbar, bagaimana perlindungan hukum terhadap Informan Polisi dalam pengungkapan tindak pidana narkotika di wilayah hukum Polda Kalbar pada saat ini, dan bagaimana seharusnya upaya perlindungan hukum terhadap Informan Polisi dalam pengungkapan tindak pidana narkotika di wilayah hukum Polda Kalbar pada masa yang akan datang.Dalam penelitian ini, penulis menggunakan metode penelitian hukum empiris dan bersifat deskriptif analitis. Berdasarkan hasil penelitian, maka diperoleh kesimpulan bahwa perlindungan hukum yang diberikan oleh pihak Kepolisian terhadap informan polisi yang membantu dalam pengungkapan tindak pidana narkotika pada saat ini hanya bersifat lisan saja tanpa adanya surat perintah dari pihak Kepolisian. Selain itu, apabila informan polisi melakukan penyamaran untuk melakukan pembelian terselubung (under cover buy), maka pihak Kepolisian yang menggunakan informan tersebutlah yang melindunginya agar tidak diproses secara hukum.Upaya perlindungan hukum terhadap informan polisi dalam pengungkapan tindak pidana narkotika di wilayah hukum Polda2Kalbar pada masa yang akan datang dapat dilakukan melalui: dibuatnya Peraturan Kapolri yang khusus mengatur masalah jaminan perlindungan hukum bagi informan polisi beserta keluarganya, agar informan polisi ini merasa aman dan dapat bekerja secara maksimal dalam membantu tugas Kepolisian untuk mengungkap tindak pidana narkotika dan dibuatnya surat perintah dari Direktorat Reserse Narkoba Kepolisian Daerah yang diperuntukkan bagi informan polisi dalam mengungkap tindak pidana narkotika, agar pada saat terjadi penangkapan/penggerebekan di tempat transaksi narkotika, informan ini bebas dari jerat hukum dan tidak dapat dipertanggungjawabkan secara pidana.Kata Kunci: Perlindungan Hukum, Informan Polisi, Pengungkapan, Tindak Pidana, Narkotika.ABSTRACTIn disclosing narcotics crimes, the Police not only use the personnel available to them, but also involve the potential of the community, both members of the general public who want to help the police (in the sense that community members directly see narcotics crime and report to the police) and community members who were deliberately requested or appointed by the police to provide information or often referred to as police informants. Based on data from the Narcotics Investigation Directorate of the West Kalimantan Regional Police that the number of narcotics criminal cases that were revealed by the Police during the period from 2016 to 2018 were 293 cases, where the disclosure of the case entirely used the services of the Police Informant. However, the existence of this Police Informant is not in line with the certainty of his legal status, because the Police Informant is not a State Civil Apparatus. These police informants are not included in the police organizational structure and their position is not permanent, depending on the needs of the police to use their services. Based on these facts, the problem in this research is how the role of Police Informants and the mechanism of the use of Police Informants in disclosing narcotics crimes in the West Kalimantan Regional Police jurisdiction, how to protect the police from disclosing criminal acts of narcotics in the West Kalimantan Regional Police at this time, and how should the legal safeguards against Police Informants disclose narcotics crimes in the West Kalimantan Regional Police jurisdiction in the future. In this study, the authors used empirical legal research methods and were descriptive analytical. Based on the results of the study, it was concluded that the legal protection provided by the police to police informants who assisted in the disclosure of narcotics crimes at this time was only verbal without a warrant from the police. In addition, if the police informant disguises under cover buy, the police who use the informant protect it so that it is not legally processed.
