Abstract

This study aims to determine how the bank's responsibility for credit card customers who experience losses in online transactions at the Consumer Loan Center of PT Bank Negara Indonesia (Persero) Tbk Denpasar Branch and efforts to resolve credit card customer losses in online transactions at the Consumer Loan Center of PT Bank Negara Indonesia (Persero) Tbk Denpasar Branch. This research uses empirical research methods that examine data through primary and secondary data analysis. The results of this study indicate that the responsibility of the Consumer Loan Center of PT Bank Negara Indonesia (Persero) Tbk Denpasar Branch is to provide compensation if the results of the investigation prove that the loss was caused by the fault of Bank Negara Indonesia. Efforts to resolve credit card customer losses in online transactions at the Consumer Loan Center PT. Bank Negara Indonesia (Persero) Tbk Denpasar Branch were resolved through internal settlement by Bank Negara Indonesia, namely by submitting an apology statement and providing compensation to credit card customers.

Abstract

Health is the right of all citizens as mandated in the 1945 Constitution, so health services should not discriminate against patients based on certain groups. In fact, in Indonesia there is still a phenomenon where patients are compartmentalized based on their economic and social groups. This has led to several cases of patient rejection and delayed treatment due to administrative constraints. In the light of this phenomenon, this study seeks to examine the form of legal protection that indigent patients must obtain in health services, especially for BPJS or KIS patients. The Mengwi I Health Center as a community health service center should provide maximum service, but there are still some obstacles in service related to underprivileged patients due to administration. This research is a type of empirical legal research with a statutory regulation approach, data collection is done by interviews. The results of this study indicate that the implementation of health rights services for underprivileged patients at Wangaya I Health Center has been carried out based on Law Number 36 of 2009 and Law Number 44 of 2009, Law Number 8 of 1999 concerning Consumer Protection, Law Number 36 of 2009 concerning Health and Law Number 44 of 2009 concerning Hospitals. Legal remedies that are usually taken by incapacitated patients if they do not receive health services from the hospital are to question the management of the Wangaya I Health Center and report this to members of the local DPRD. In addition, patients can also file a civil lawsuit in accordance with the Civil Code.

Abstract

Artikel ini menganalisa dan mengkaji atas kedudukan pihak ketiga pemegang hak tanggungan atas vonis Mahkamah Konstitusi terkait perjanjian pernikahan yang awalnya perjanjian prenuptial menjadi perjanjian postnuptial, khususnya pada pasangan kawin campur. Bank sebagai pemegang hak tanggungan terhadap suatu perjanjian kredit jaminan, selain memiliki dasar prinsip kehati-hatian dalam pemberian kreditnya, diharapkan pula dapat memiliki kepastian hukum dan keadilan dalam kaitannya terhadap perjanjian kredit hak tanggungan yang dibuat sebelum perjanjian perkawinan dibuat oleh pasangan kawin campur. Bank selaku pemberi kredit dalam pembuatan persyaratan kreditnya harus berdasarkan Undang Undang Perbankan dan Peraturan dari Lembaga Pengawas Otoritas Jasa Keuangan (OJK). Bank dalam memberikan kreditnya, juga melihat kredibiltas si calon kreditur. Sehingga pemberian kredit dengan jaminan hak tanggungan dapat diberikan kepada beberapa pasangan perkawinan campur. Berdasarkan penelitian ini perjanjian kredit dengan hak tanggungan maupun perjanjian perkawinan memiliki prinsip dasar dari perjanjian kontraktual, yang berlaku bagi para pihak sehingga memiliki kepastian hukum dan keadilan bagi para pihak. Itikad baik melahirkan keadilan dan kepastian hukum. Tata cara pembuatan dan pendaftaran kedua jenis perjanjian ini selama dilakukan sesuai dengan peraturan perundang-undangan dapat pula melahirkan prestasi dari tiap perjanjian tersebut, akan tetapi dalam prakteknya posisi bank selaku pemberi kredit tidak didukung oleh perundang-undangan yang mengaturnya

Abstract

The purpose of this research report is to establish legal protection rules for the use of personal data to ensure legal certainty for the community and the role of law enforcement in preventing future crimes related to misuse of personal data. on personal criminal law the right to reform. Abstract

Community service has been carried out in Tiga Village, Susut District, Bangli Regency, Bali Province. This community service activity was carried out for 27 days, starting from January 16 to February 11, 2023. Desa Tiga traditionally has one unit and is summarized in Gebong Satak Tiga Buungan which consists of 9 Pakraman villages. In Tiga Village, there are several potentials to be used as work programs, namely the agricultural sector, the livestock sector, tourism objects, teaching and education. This potential can help the main objective of implementing community service, namely to improve the quality of human resources in improving and developing the quality of the village. This community service begins with an assessment process to find out the village's potential as a means of implementing community service. The implementation of the community service program is carried out in a balanced manner starting with planning, maturation and implementation of the work program, the potential that researchers choose here is how to sort waste in the 3R way through education with wall magazine media. Abstrak Pengabdian kepada masyarakat telah dilaksanakan di desa Tiga, kecamatan susut, kabupaten Bangli, provinsi Bali. Kegiatan pengabdian masyarakat ini Dilaksanakan selana 27 hari, yang dimulai pada tanggal 16 januari sampai 11 februari 2023. Desa tiga secara adat istiadat memiliki satu kesatuan dan terangkum didalam gebong satak tiga buungan yang terdiri dari 9 desa pakraman. Di Desa Tiga ini terdapat beberapa potensi untuk dijadikan program kerja yaitu diantaranya sektor pertanian, sektor perternakan, objek wisata, mengajar dan edukasi. Potensi tersebut dapat membantu tujuan utama pelaksanaan pengabdian masyarakat yaitu untuk meningkatkan kualitas sumber daya manusia dalam meningkatkan dan mengembangkan kualitas desa tersebut. Pengabdian masyarakat ini diawali dengan proses penjajakan untuk mengetahui potensi desa yang menjadi sarana dalam pelaksanaan pengabdian masyarakat. Abstract

Kesehatan merupakan salah satu aspek terpenting dalam kehidupan manusia. Seseorang yang sehat berarti memiliki keadaan yang tidak sakit dan baik dalam tubuhnya. Pandemi covid-19 merupakan contohnya perubahan yang terjadi sehingga masyarakat harus berdaptasi dalam era tatanan baru pasca keberlangsungan pandemi, salah satu bentuk adaptasi yang dapat dilakukan adalah membudayakan Perilaku Hidup Bersih dan Sehat (PHBS). Kegiatan sosialiasi dilakukan dengan pemberian materi terkait PHBS dan penerapannya dalam kehidupan sehari-hari. Adapun tujuan dalam pelaksanaan program ini adalah meningkatkan pengetahuan anak usia sekolah dasar di SD Negeri 4 Desa Tiga terkait PHBS dan mampu untuk menerapkannya dalam kehidupan sehari-hari. Sasaran yang disasar dalam kegiatan ini adalah siswa kelas 2-6 di SD Negeri 4 Desa Tiga. Metode pelaksanaan program dilakukan secara langsung melalui penyuluhan menggunakan media poster publik. Penyelenggaraan program diharapkan dapat memberikan dampak yang positif dengan peningkatan pengetahuan siswa serta ke depannya mampu untuk meningkatkan derajat kesehatannya. Hasil pelaksanaan kegiatan diketahui bahwa terjadi peningkatan pengetahuan pada peserta. Dengan demikian, program ini memberikan manfaat positif terhadap pengetahuan peserta. Luaran program yang dihasilkan adalah media poster publik dan artikel yang dipublikasikan di jurnal pengabdian masyarakat. Keberlanjutan program akan dilaksanakan dengan melakukan kerja sama dengan stakeholder terkait.

Abstract

Marketing unique and artistic cups and kettles made of coconut shells has not been effective. The problem is that marketing activities still need to be more conventional and have limited marketing reach. One alternative marketing method for promotional media, information dissemination, and communication of handicraft products is digital marketing through online media such as Instagram, Facebook, and YouTube. This community outreach program aims to assist partners in developing digital marketing strategies using online media for the handicraft products they produce. The implementation of this community outreach program uses four methods, namely, observation, interviews, documentation studies, and assistance in making branding videos and online posts. The program is successful in introducing the use of online media to develop partners’ marketing strategies.  ---  Pemasaran produk kerajinan tangan berupa cangkir dan cerek dari tempurung kelapa dengan tampilan yang unik dan bentuk yang artistik belum berjalan secara efektif. Permasalahannya adalah kegiatan pemasaran masih bersifat konvensional sehingga memiliki keterbatasan jangkauan pemasaran. Salah satu alternatif metode pemasaran sebagai media promosi, penyebaran informasi serta komunikasi produk kerajinan tangan adalah berupa pemasaran digital melalui pemanfaatan media daring seperti, Instagram, Facebook, dan YouTube. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk membantu mitra mengembangkan metode pemasaran digital menggunakan media daring atas produk kerajinan tangan yang dihasilkannya. Pelaksanaan kegiatan pengabdian kepada masyarakat ini menggunakan empat metode yaitu, observasi, wawancara, studi dokumentasi, dan pendam-pingan pembuatan video branding dan postingan daring. Capaian dari kegiatan ini adalah mitra mampu memanfaatkan media daring untuk mengembangkan strategi pemasarannya.

Abstract

Presidential Regulation No. 12 of 2021 on the Amendment to Presidential Regulation No. 16 of 2018 on Government Procurement (PR 12/2021) expands the authority for the Proxy of Budget User (PBU) to become Commitment Making Officer. Consequently, the process of procuring government goods/services is controlled by a single person; such a condition can facilitate various forms of criminal acts, especially corruption. This study aims to analyze the dual position of PBU as a Commitment Making Officer, the tendency of corruption due to the expansion of PBU’s authority, and the reformulation of PBU’s authority in the future. It is normative juridical research that examines PR 12/2021 with a qualitative analysis approach. Amendment to the Presidential Regulation on Government Procurement includes the legitimacy of PBU as a Commitment Making Officer without any requirements as stated in the previous regulation. Among others, this study underlines that centralized authority will have implications for a more robust culture of corruption due to the absence of control from other parties. In future provisions, PBU may not hold a concurrent position as Commitment Making Officer in accordance with the principles of transparency and accountability. The culture of professionalism in the procurement of government goods/services needs to be improved to reduce the culture of corruption, collusion, and nepotism.

Abstract

In the current era of globalization and modernization, trademarks play a crucial role in distinguishing products or services in the market. Valid and protected trademark rights are valuable assets for their owners. However, the phenomenon of unregistered trademarks often poses a challenge in trademark protection. This research aims to analyze the legal construction of unregistered trademarks and the conflicts that arise from the perspective of inclusive law. The focus of this research is on the analysis of legal aspects, rights of trademark owners, consumer rights, public policies, and socio-economic aspects. The research method used is normative legal research with a dogmatic legal approach. Data sources include laws, regulations, court decisions, and legal literature related to trademarks. Data analysis techniques use a deductive approach with the application of relevant theoretical frameworks. The results of the research indicate that the inclusive legal construction in the Trademark Law provides broader protection for unregistered trademarks. Owners of unregistered trademarks can obtain protection if consistent use of the trademark in trade can be demonstrated. The inclusive approach in trademark supervision also encompasses unregistered trademarks that have potential rights to protection. Conflicts between protection of unregistered trademarks, consumer rights, and indigenous communities can be resolved through consultation and participation of relevant parties. Specific regulations that acknowledge the traditional knowledge of indigenous communities and the responsibilities of producers can also help resolve these conflicts. Mediation and arbitration mechanisms can also be used as alternative dispute resolution methods.

Abstract

Sejak itu, pemerintah telah mengambil serangkaian langkah untuk mengurangi dampak epidemi Covid-19 pada berbagai industri. Pembatasan kegiatan masyarakat berdampak pada kegiatan usaha yang pada gilirannya berdampak pada perekonomian sektor ketenagakerjaan. Dalam rangka mengatasi dampak pandemi Covid-19, bantuan diberikan kepada desa adat Gelgel untuk membantu ekonomi masyarakat dan memenuhi kebutuhan hidup keluarganya. Bantuan yang diberikan dalam acara ini adalah untuk mendapatkan bantuan kredit murah dari Lembaga Perkreditan Desa (LPD) di desa adat Gelgel di Kabupaten Klungkung dan kabupaten dengan memberikan dana pinjaman untuk pekerja yang di-PHK karena penutupan perusahaan mereka. Bekerja. Metode yang digunakan adalah metode analisis situasi di masyarakat. Acara ini bertujuan untuk membantu kelangsungan ekonomi masyarakat desa adat Gegel.
