Abstract

Introduction: Transplantation of organs in humans is one of the fastest-growing alternative treatments. Theuse of donors from non-family members is one of the considerations. Is a notarized agreement between theorgan giver and the organ recipient necessary so that problems do not occur in the future?Objective: This study’s objective was to analyze the principle precautionary in a notarized deed agreementbetween the donor and recipient transplant.Method Research: This research method uses a normative and empirical juridical approach with descriptiveanalytical and normative research specifications.Conclusion: This study found that the alleged buying and selling of kidneys leaves underhand agreements’ongoing problem. The paradigm that applies in the work of notaries is the principle of prudence in doingnotarial deeds. Prudence comes from the word prudence, which is analogically closely related to thesupervisory function management as it applies to banking. A notary caution is required to draft a transplantnotary agreement between donors and recipients so that disputes do not occur in the future.

Abstract

Tulisan ini bertujuan untuk menganalisis pembaharuan hukum perikatan terhadap pemenuhan perjanjian melalui pembayaran non tunai. Pembayaran  non-tunai dibutuhkan masyarakat  karena lebih praktis dan efisienyaitu dilakukan dengan cara transferlangsung(electronic fundstransfer),menggunakankartupembayaran(paymentcard),menggunakanuang elektronik (electronic money) dan uang digital (digital money). Sedangkan pembayaran secara tunai  harus ada penyerahan nyata uang kartal.  Keuntungan   pembayaran non tunai  dengan mudah dapat melacak riwayat transaksi secara transparan sehingga mengurangi transaksi tunai yang ilegal. Namun pembayaran non tunai belum dikenal masyarakat secara umum karena tidak semua orang memiliki pengetahuan yang cukup dalam melakukan aktifitas pembayaran menggunakan tehnologi digital yang berkembang saat ini, disamping itu juga tidak dikenal dalam pengaturan pemenuhan perjanjian yang terdapat dalam Kitab Undang Undang Hukum Perdata. Oleh karena itu perlu ada  pembaharuan  hukum perikatan berkaitan dengan pemenuhan perjanjian   agar dapat memberikan perlindungan dan kepastian hukum bagi masyarakat.

Abstract

Legal relationship between doctor and patient in health care is often tinged with neglect of the rights of patients, causing a conflict or dispute. Mediation is a form of alternative dispute resolution (ADR) or alternative dispute resolution outside the court. Mediation is considered more profitable the parties since the mediator has no authority to decide, but only as a mediator of the agreement by the parties. The advantages of using mediation path is a simple procedure, effective, inexpensive, decisions are still in control the parties to the dispute, even though mediation is not a panacea to overcome distortions paradigm of litigation and can not be applied to all disputes.

Abstract

Health as one of the basic human needs in addition of food, clothing and shelter. Human life becomes meaningless if sick, because the sick people may not be able to perform daily activities well. Therefore any persons who are ill or patients require definitive treatment and care physicians to be healthy again.The relationship between doctors and patients raise a therapeutic transaction i.e. a transaction or agreement to determine therapy or provide healing services.Through therapeutic transaction then there are rights and obligations for both of them to be protected. As stipulated in ActNo. 8 of 1999 on Consumer Protection, Act No. 36 of 2009 on Health and Act No. 29 of 2004 on the Practice of Medicine.

Abstract

This paper discusses civil liability of medical personnel in radiology services to patient safety. Doctors as medical personnel in carrying out their duties must be accountable for the actions taken when providing health services to patients. The civil responsibility of the doctor is intended to prevent / avoid the things that are not desirable, also aims to obtain compensation for losses suffered by a patient. This civil liability is based on wanprestasi (article 1243 Civil Code) as well as unlawful acts /onrechtmatigedaad (article 1365 Civil Code), using the doctrine "Res Ipsa Loquitur".

Abstract

Globalization and free trade deal to expand the flow of goods and services so that the goods or services offered vary in the production of foreign and domestic. It is useful to consumers because their needs are meeting. Above all, the circumstances but the position of businesses and consumers become unbalanced because business use it to search for maximum profit, consumers in a weak position because of consumer awareness of their rights remains low. Consumer awareness on their rights and obligations necessary to avoid the consumption of goods that is not feasible. A product can be a viable product must meet minimum standards. Consumers will be protected from product that are not worth consume. Therefore, consumers should take an active role. That is why being smart consumers are very essential.

Abstract

Many Indonesian people do not understand and are aware of the infectious diseases caused by bioterrorism. Bioterrorism is an act of terrorism that uses biological weapons in the form of bacteria, viruses, toxins, and fungi. This terrorist act is carried out by utilizing a virus, an infectious germ that is used by terrorist organizations as a means of attack to cause damage and is very dangerous to human health and safety. This study uses a normative juridical approach method, and secondary data as primary data supported by primary data. The secondary data are in the form of primary, secondary and tertiary legal materials that are analyzed qualitatively. Based on the analysis, it was revealed that through Law Number 36 Year 2009 it has regulated the rights and obligations of the community related to the right to health for themselves, however if related to the rights and obligations resulting from threats arising from infectious diseases due to bioterrorism this law has not yet regulated specifically, so that people still stutter associated with the threat of bioterrorism that can threaten their health and safety. Therefore, implementing regulations are still needed related to the threat of bioterrorism to provide protection and legal certainty to the community.

Abstract

Hubungan hukum yang terjadi dalam masyarakat kadang dapat menimbulkan permasalahan satu sama lainnya seperti hubungan antara konsumen dan pelaku usaha. Bila diperhatikan hubungan antara pelaku usaha / penjual dengan konsumen tidak tertutup kemungkinan timbul perselisihan/ sengketa konsumen.   Saat ini sengketa konsumen diselesaikan melalui gugatan dipengadilan namun pada kenyataannya yang tidak dapat dipungkiri bahwa lembaga peradilanpun tidak akomodatif untuk menampung sengketa konsumen karena proses perkara yang terlalu lama dan sangat birokratis. Undang-undang Perlindungan Konsumen yaitu Undang-undang No. 8 Tahun 1999 membuat terobosan dengan memfasilitasi para konsumen yang merasa dirugikan dengan mengajukan gugatan kepada pelaku usaha diluar pengadilan dengan membentuk suatu lembaga dalam hukum perlindungan konsumen, yaitu Badan Penyelesaian Sengketa Konsumen. Permasalahan dalam penelitian ini adalah bagaimana peran Badan Penyelesaian Sengketa Konsumen dalam upaya memberi perlindungan hukum bagi konsumen serta hambatan  yang dihadapi Badan Penyelesaian Sengketa Konsumen dalam upaya memberi perlindungan hukum bagi konsumen dan bagaimana pula upaya penyelesaiannya. Metode penelitian yang digunakan dalam penelitian yaitu tipe penelitian  yuridis normatif, dengan spesifikasi penelitian deskriptif analitis, metode pengumpulan data dengan data sekunder dan data primer , metode penyajian data disajikan dalam bentuk uraian yang disesuaikan dengan permasalahan, metode analisis data secara normative-kualitatif. Hasil penelitian diperoleh bahwa Badan Penyelesaian Sengketa Konsumen (BPSK) adalah badan yang bertugas menangani dan menyelesaikan sengketa antara pelaku usaha dan konsumen. BPSK sebenarnya dibentuk untuk menyelesaikan kasus-kasus sengketa konsumen yang berskala kecil dan bersifat sederhana. Hambatan  yang dihadapi BPSK adalah kelembagaan/institusional, pendanaan, sumberdaya manusia, peraturan,  kurang mengertinya konsumen akan haknya.

Abstract

Health rights are human rights inherent in a person because of his birth as a human being, and not because of the giving of someone or the state therefore it cannot be revoked and violated by anyone. Health rights must be able to become one of the main benchmarks of development and prosperity of a nation. Therefore health must be mid-stream development, which is continuous sustainable development. The implementation of human rights is carried out by creating equality of access to health services, preventing actions that can reduce the health status of the community, preventing actions that can reduce the health status of the community, and making health policies and providing health services and budgets appropriate and adequate for the entire community.
