Abstract

Taxpayer data and information from banking and finance institution could be guidance on any development. Therefore, it could be a corrective act to do the law enforcement on increasing Inland Revenue. Financial information exchange regarded to tax interests, besides by demanding way also could automatically way done (Automatic Exchange of Financial Account Information/AEol). Indonesia commitment was manifested by Multilateral Competent Authority Agreement signed after AEOI on 3rd June 2015. Indonesia agreed to start the financial information exchange automatically on September 2018. The followed-up Indonesia government commitment was on 8th May 2017. It had approved the financial information access no.1 2017 legislations as to tax interests. Abstract

Abstract

An insured who bind themselves to the insurer to protect his life by taking life insurance, of course, will conduct the closing of the contract of insurance agreements. To close this insurance contract the insured is deemed very essential to peruse the terms and conditions and the rights and obligations that will he get. In many cases it is turned to be extremely detrimental to the insured party when related to the contract of insurance. This is due to a lack of good faith on the part of the insurer to pay insurance claim filed by the insured or beneficiary. Instead, the insured is required to execute an agreement in good faith even at the beginning of the insurance contract the insured has been burdened insurance for acting in good faith.Keywords: contract, good faith, life insurance.

Abstract

Sea transportation is a commercial shipping business that is regulated in the provision of sea freight services where its business activities are very broad in its field and plays an important role in advancing trade both domestically or abroad including in its efforts to expedite the flow of goods from production areas to consumer areas. In the Port, there are tools to facilitate and facilitate the demolition and loading of goods from or to ships, or equipment to take fuel, water supplies and so on. In ports, of course, there are loading and unloading companies that are always connected with Indonesian ports (Pelindo). This is certainly related to the entry and exit of ships. The loading and unloading company is an Indonesian legal entity established to carry out and carry out business activities for loading and unloading goods from and to ships. In loading and unloading services, there are loading and unloading service providers, namely companies that carry out loading and unloading activities (stevedoring, receiving and receiving/delivery using loading and unloading labor) and loading and unloading equipment. obstacles or obstacles that might occur, these obstacles must be studied more deeply so that the impacts or losses that might be suffered by the parties in the vessel loading and unloading agreement can be minimized. The legal method used in answering the legal issues raised is through statute approach, conceptual approach, and case approach.

Abstract

Every religious adherent is guaranteed to choose and practice his religion, so the state is obliged to provide protection and guarantee regarding the halalness of the products used and used by the community. Whereas in society there are still many conclusions about various products that have not been guaranteed their halalness and regulations have not provided legal certainty and guarantees for Muslim communities. So to provide legal certainty the promulgation of Law number 33 of 2014 concerning Halal Product Guarantee. The guarantee for the implementation of Halal Products is aimed at providing comfort, safety, and certainty of information on Halal Products for the public in consuming and using Products, as well as increasing added value for Business Actors to produce and sell Halal Products. The halal certificate must be submitted by the business actor in writing to BPJPH while the determination of the halalness of the product is still carried out by MUI through the Halal Fatwa Session. This research is a normative legal research that uses a statute approach and a conceptual approach.

Abstract

Legal protection of consumer rights in essence is the role of the government to protect the interests of consumers in the framework of trade. Violation of consumer protection norms can only be enforced if business actors are willing to voluntarily fulfill consumer demands for the fulfillment of consumer rights that have been violated by business actors. However, if the business actor is not willing to carry it out voluntarily, while the consumer assumes that the business actor concerned has violated the consumer protection norms stipulated by the UUPK and is detrimental to the consumer, then the enforcement of the consumer protection norms can only be prosecuted through a dispute specified resolution process in the UUPK. The purpose of establishing the Consumer Dispute Settlement Agency (BPSK) is to protect consumers and business actors by creating a consumer protection system that contains elements of legal certainty and information disclosure. This study is to analyze the implementation of consumer rights enforcement through the Consumer Dispute Resolution Board in order to increase the consumer satisfaction index, as well as to analyze the obstacles and barriers to consumer rights enforcement through the Consumer Dispute Resolution Board.

Abstract

Manusia hanya akan menerima, menghindari, maupun mencegah risiko yang kemungkinan akan terjadi. Hal ini menghasilkan sebuah pengalihan risiko yang dilakukan dengan cara menggunakan asuransi laut. General average merupakan sebuah kerugian yang disepakati oleh para pihak untuk ditanggung bersama dan pertanggungjawaban tersebut akan dipikul bersama antara para pihak. Average Adjuster merupakan penilai kerugian asuransi yang ditunjuk oleh perusahaan asuransi dalam menangani klaim peristiwa general average. Hasil laporan dari Average Adjuster menjadi dasar perusahaan asuransi dalam melakukan klaim yang diajukan oleh tertanggung sehingga mereka memiliki tanggung jawab atas hasil report yang diberikan. Penelitian hukum normatif dengan metode pendekatan perundang-undangan, bahwa jika Average Adjuster melakukan kesalahan dalam hasil report tersebut maka salah satu pihak dapat mengajukan survei ulang pada perusahaan asuransi ataupun mengajukan pengembalian atau penambahan nilai klaim asuransi sehingga dikeluarkan sebuah LoD sebagai parameter uji batas atas instrumen yang diberikan. Oleh sebab itu, penelitian ini menyarankan perlunya lembaga baru yang berfungsi mengawasi atau mengaudit dengan tujuan pengecekan ulang validitas hasil report Average Adjuster sehingga memperkuat fungsi pengecekan ganda sebelum perusahaan asuransi memberikan keputusan final terhadap klaim tertanggung.Humans will only accept, avoid, or prevent risks that are likely to occur. This results in a transfer of risk that is carried out by using marine insurance. The general average is a loss agreed by the parties to be shared and the responsibility will be shared between the parties. The Average Adjuster is an insurance loss assessor appointed by the insurance company to handle claims for general average events. Report results from the Average Adjuster become the basis for insurance companies in making claims submitted by the insured so that they have responsibility for the results of the report provided. Normative legal research using the statutory approach method, that if the Average Adjuster makes a mistake in the results of the report, one party can submit a re-survey to the insurance company or submit a return or increase in the value of the insurance claim so that an LoD is issued as a parameter of the upper limit test of the instrument used. given. Therefore, this study suggests the need for a new institution whose function is to supervise or audit with the aim of re-checking the validity of the results of the Average Adjuster hassle so as to strengthen the double checking function before the insurance company makes a final decision on the insured’s claim.

Abstract

AbstractThis article examines the characteristics of the medical profession liability insurance agreement, which is a method to transfer the risk of medical liability (the insured) to the insurance company (the insurer). To discuss this, normative research methods are used. This study found that medical profession liability insurance is a long tail (injury or injury) which takes a few moments to find after a procedure or medical action is carried out, the dispute resolution process is quite long, and the assistance of the medicolegal team is needed in the claim investigation process). the amount of compensation paid is rather difficult to predict, the risk exposure and the amount of the premium varies in each specialization of medical practice, and there are difficulties in identifying and classifying specialties into classes (classes) accurately. The purpose of this insurance is to protect and maintain the reputation of doctors as a profession based on the trust given by patients and to restore the victim’s (patient’s) health condition. AbstrakArtikel ini mengkaji karakteristik perjanjian asuransi tanggung gugat profesi dokter, yaitu sebuah metode untuk mengalihkan risiko tanggung gugat dokter (Tertanggung) kepada perusahaan asuransi (Penanggung). Untuk membahas hal itu, digunakan metode penelitian normatif. Penelitian ini menemukan bahwa asuransi tanggung gugat profesi dokter bersifat long tail (luka atau cedera) yang dialami memerlukan waktu beberapa saat untuk ditemukan setelah suatu prosedur atau tindakan medis dilakukan, proses penyelesaian sengketa cukup lama, dan diperlukan bantuan tim medikolegal dalam proses investigasi klaim), jumlah pembayaran ganti kerugian yang agak sukar diprediksi, paparan risiko dan besaran premi yang bervariasi pada setiap spesialisasi praktik kedokteran, serta adanya kesulitan dalam mengenali dan mengelompokkan spesialisasi-spesialisasi dalam golongan (kelas) secara akurat. Tujuan asuransi ini adalah melindungi dan mempertahankan reputasi dokter sebagai profesi berlandaskan kepercayaan yang diberikan oleh pasien serta memulihkan kondisi kesehatan korban (pasien).

Abstract

E-Commerce atau Elektronik Commerce adalah aktivitas perdagangan yang berkaitan dengan penjualan, pembelian, pemasaran barang dan atau jasa dengan memanfaatkan sistem internet. Salah satu E-Commerce yang banyak digunakan oleh masyarakat pada saat ini adalah TikTok Shop. Namun dalam pelaksanaan TikTok Shop masih ditemukan beberapa masalah, salah satunya terkait dengan kerusakan barang dalam proses pengangkutan sehingga ketika barang sampai di pembeli tidak dalam kondisi yang baik. Tentunya hal tersebut merugikan pembeli dari segi waktu maupun biaya yang telah dikeluarkan, disatu sisi terkadang pihak penjual dan pihak layanan pengiriman saling melempar tanggung jawab mereka atas masalah tersebut. Hal inilah yang memunculkan permasalahan yang akan dianalisis yakni terkait bagaimana perlindungan hukum konsumen akibat terjadinya kerusakan barang dalam pengiriman yang dibeli melalui TikTok Shop. Tulisan ini akan menggunakan pendekatan perundang-undangan dan pendekatan konseptual untuk dapat menemukan jawaban-jawaban yang berkaitan dengan rumusan masalah. Akhirnya diharapkan tulisan ini dapat bermanfaat dalam rangka memberikan pengetahuan khususnya mengenai pertanggungjawaban hukum terhadap kerusakan barang dalam proses pengangkutan yang dibeli melalui TikTok Shop serta menambah edukasi atau solusi jika terjadi masalah tersebut.

Abstract

This study critically analyses the entrenched concept of the privity of contract doctrine within the context of goods delivery agreements and its impact on the final consumer, specifically focusing on issues of delayed delivery and consequential losses. Adopting normative legal research methodologies, it employs statutory, conceptual, and case-based approaches to dissect this complex consumer protection issue. The research reveals that while the privity of contract paradigm posits rights and obligations as exclusive to the contracting parties, the final consumer, as the recipient of goods, possesses legal standing in cases of delivery negligence or incurred losses. The study also highlights the consumer's right to delivery in accordance with the agreed terms, even when not a primary party in the agreement, as long as the goods are not for resale. The paper concludes by emphasizing the critical role of judges in assessing immaterial losses based on the principle of ex aequo et bono, thus underscoring a shift towards a caveat vendor approach in consumer law, with significant implications for both business actors and global consumer protection frameworks. Highlights: The concept of privity of contract is not absolute in goods delivery agreements, and the final consumer can possess legal standing in cases of delivery negligence or incurred losses. The recipient of goods, even when not a primary party in the agreement, maintains the right to delivery in accordance with the agreed terms, provided the goods are not intended for resale. Judges play a pivotal role in quantifying immaterial losses, underlining the shift towards a caveat vendor approach in consumer law.
