Abstract

Sharia tourism is one of the tourism concepts applied based on sharia principles. In recent years, Islamic tourism has mushroomed in several regions in Indonesia and even in the world, with different concepts. This concept is not only a media for the promotion of the regions that want to apply it, but more than that the tourism carried out by a person can strengthen his creed and belief, if carried out in accordance with Islamic principles. However, how is the application of sharia tourism in accordance with sharia principles? The concept of Islamic tourism which should be applied?, There are still many unknowns. So it takes an in-depth understanding of the concept of sharia tourism, and the need for a research related to this. Researchers see a relationship between maqoshid sharia with sharia tourism currently being applied. This study aims to determine the application of Islamic tourism in the perspective of Islamic maqoshid, with Lombok as the object of study. This type of research is qualitative research. Data collection method is done by interview and observation. Interviews were conducted on 10 respondents and took 5 tourism objects that became tourist icons in 5 districts in Lombok as research samples. The results of this study indicate that there is a relationship between maqoshid sharia in the application of sharia tourism, namely in the safeguarding of religion, soul, reason, descent and wealth. So the applied sharia tourism must include five safeguards in sharia maqoshid. While the application of Lombok sharia tourism in the maqoshid sharia perspective has not yet reached the five aspects of safeguards.

Abstract

In the modern era, technology has greatly facilitated human activities, especially in online buying and selling activities in a market place. Shopee is a market place that provides buying and selling activities, and in it there are several payment methods, one of the payment methods is shopee pay later. And shopee pay later can be said to be a payment using the installment or credit method made by the user of the relevant shopee account and market place. Some scholars say permissible for several reasons. This study aims to determine the law of shopee pay later as a payment method according to fiqh muamalah. The research method used is descriptive qualitative research with a normative approach, namely by approaching the problem based on Islamic law or Islamic fiqh. The results of this study are that the pay later feature has the concept of buy now pay later. In the pay later method, there are two contracts, namely qardh and ijarah. According to the scholars who allow it, this sale and purchase includes buying and selling istijrar and is permissible because there is a clear contract agreement or as long as the price is certain or known. And there is also an opinion, that shopee pay later is more towards a murabaha contract. And the conclusion of this study is that the payment method using the shopee pay later method is permissible in fiqh muamalah. Abstract

Dominasi Barat selama 300 tahun terakhir, telah membuat kita merasakan empat ideologi utama, yaitu kapitalisme, sosialisme, nasionalisme dan kesejahteraan negara (the welfare state), di mana semua itu telah gagal dalam ilmu ekonomi karena sistem ekonomi tersebut cenderung ke arah sekulerisme. Semua sistem itu berdasar pada premis Barat bahwa agama dan moralitas tidak relevan untuk mengatasi masalah-masalah ekonomi. Pencarian para ilmuwan terhadap sistem ekonomi yang terbaik terus dilakukan, hingga pada akhirnya para ekonom mulai melirik sistem ekonomi Islam yang telah diterapkan sejak zaman Rasulullah. Sistem ekonomi Islam diciptakan oleh para Muslimin bukan hanya diperuntukkan bagi kaum muslim tapi juga bagi seluruh umat manusia. Yang dapat dibuktikan dengan adanya beberapa karakteristik dalam sistem ekonomi Islam yang bersifat universal. Hingga tidak sedikit dari Negara minoritas Muslim yang telah mengadopsi sistem ekonomi Islam ini untuk dijadikan salah satu sistem perekonomian untuk meningkatkan kesejahteraan negaranya. Salah satunya ditandai dengan banyaknya lembaga-lembaga keuangan syariah. Singapura, Filipina, Amerika Serikat, dan Inggris adalah contoh dari Negara-negara minoritas muslim yang mengadopsi sistem ekonomi syariah dalam rangka melepaskan diri dari krisis yang melanda.

Abstract

The rise of Islamic economic has established the development of Islamic banking. This indicates that Islamic banking could be competitive with conventional banking. One difference between both banking systems is in lending operation. In conventional bank known as credit, while in Islamic bank known as financing. For certain, financing procedures in Islamic banking refer to Qur’an and Sunnah. Indeed, there are also defaults in its process, because the problems occured after the process. This research aims for knowing the factors which cause the default financing and its mechanism as performed by Bank Muamalat Indonesia (BMI) branch Sragen to solve it. To reach thus aims, the researcher uses field research with deductive explorative methods. The result from this research indicates that there are two factors which cause the default financing, internal factor and external factor. Internal factor is the factor from the customers, while the external factor is the factor from other than customers, ot because of universe. But the most imminent factor at BMI is internal factor, such as the late payment because of neglect. The mechanism runs by BMI branch Sragen is monthly data collection, monitoring and controlling, so that the financing at BMI branch Sragen chategorized as stable.

Abstract

Penelitian ini bertujuan untuk mengetahui penerapan prinsip kehati hatian (prudential banking principle) yang terdapat di dalam hukum perbankan di Indonesia yang ditinjau dalam sadd dzari’ah. Di dalam Undang Undang Nomor 10 tahun 1998 tentang perbankan mewajibkan seluruh lembaga perbankan untuk menerapkan prinsip kehati-hatian dalam seluruh fasilitasnya baik dalam pemberian pembiayaan dan dalam aspek internal perbankan. Dalam perbankan syariah pemberian akad pembiayaan sangat diminati oleh masyarakat, namun, sejatinya akad pembiayaan sangat rentan akan risiko yang terjadi baik akan risiko eksternal maupun internal. Penelitian ini merupakan penelitian kualitatif dengan menggunakan studi kepustakaan ( library research) dengan menghasilkan suatu kesimpulan bahwasanya penerapan prinsip kehati- hatian pada sektor perbankan bertujuan untuk menjaga tingkat kesehatan bank, dengan begitu maka kondisi bank akan selalu sehat, liquid dan solvent. Karna menjaga kepercayaan masyarakat merupakan suatu keharusan yang wajib dilaksanakan oleh perbankan. Dikarenakan Sektor perbankan merupakan suatu bisnis yang menjanjikan suatu keuntungan yang besar dan penuh resiko, dibutuhkan suatu model pengelolaan yang baik dan prudent dalam setiap aktivitasnya khususnya dalam pembiayaan yang membutuhkan dana yang besar yang berasal dari tabungan maupun deposito, yang rawan akan perilaku menyimpang ( moral hazard) dan adverse selection. Oleh karena itu penerapan prinsip prudential banking principle dengan dimaksudkan untuk mencegah segala sesuatu jalan menuju kerusakan adalah sesuai dengan hukum islam dan dalam kajian ushul fiqh yaitu sadd dzari’ah.

Abstract

Limited information, experience, and very low economic conditions are the background of business dispute cases, especially in Islamic mortgages. Business dispute cases, including Islamic mortgage, have so far been resolved using non-litigation settlements using Alternative Dispute Resolution (ADR), it is considered easier, does not incur expensive costs, is familial, and achieves the goal of dispute resolution, namely win-win solutions. Settlement of disputes using this method has been regulated in Law Number 30 of 1999 concerning arbitration and alternative dispute resolution. In this case, the Yogyakarta Ombudsman as one of the non-litigation institutions also takes part in resolving disputes non-litigation. This study aims to analyze the method used, namely alternative dispute resolution in resolving disputes over sharia mortgage loans. Finally, this research finds that in the process of resolving disputes over sharia mortgages with alternative dispute resolution, the method of consultation, negotiation, mediation, and expert judgment is used. The alternative dispute resolution method prioritizes peace and a win-win solution or conditions that are favorable to the parties, but in this case, the non-litigation dispute resolution method does not succeed in bringing about peace or a win-win solution.

Abstract

The excellent potential of benefit waqf has not been fully realized since nāẓir or the community failed to develop a strategy and did not innovate enough on the advantages of waqf and its administration. One of the successful principals in administering benefits waqf is the Tazakka Modern Boarding School with its innovation and programs on endowment benefits. This study intends to identify the benefit waqf development approach for Tazakka Modern Boarding School for economic independence. With a descriptive strategy, this study employs a qualitative methodology. The results of this study demonstrate that the development of benefit waqf in Tazakka is advantageous for economic independence with three distinct benefit waqf categories. So, for future researchers to be able to discuss professional nāẓir with good management and strategy, to maximize the potential and role of beneficial waqf in improving the economy and people's welfare.
