Abstract

Indonesian criminal law adheres to various principles that form the basis for solving problems, especially in problems related to two or more countries. One of the principles recognized and in line with the research, in this case, is the territorial principle, which is a useful principle in determining the limits of validity of criminal law provisions based on place or location. This study aims to analyze the application of the territorial principle to perpetrators of pedophilia crimes committed by foreign nationals. The method used in this study is a normative type of research that uses the law approach and case studies. The results of this study indicate that should be based on the principle of criminal law, namely the territorial principle, Indonesian law will be applied to anyone who commits a crime in Indonesia, including in this case foreign citizens who commit pedophilia crimes, especially a sovereign state has exclusive jurisdiction in the environment. the territory itself is called territorial sovereignty so that the state has full jurisdiction to punish people who commit crimes against the law in the territory of the country. In reality, this territorial principle cannot be applied to this case because the suspect is still in the process of waiting for the results of approval or rejection of extradition by the Ministry of Law and Human Rights of the Republic of Indonesia, considering that the suspect is a foreign citizen and is also a fugitive in his home country, namely the United States of America. so that the country of origin sends a letter of request for extradition and this extradition request is still in the process of being followed up.

Abstract

This research examines the Implementation of the Law of Evidence: Comparative of the State of Indonesia and the United States of America. This study aims to analyze the application of evidence in Indonesia and the United States. This study uses normative research methods. The results of this study explain that there is a comparison between the application of evidence before and during the process in trials between the two countries, but over time and Indonesian law has implemented several processes in evidence that were previously used by the United States. It is hoped that lawmakers in Indonesia will be able to quickly find a new law that will not hinder the process of proof, and will not complicate the judiciary.

Abstract

Through Article 2 paragraph (1) of Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code (National Criminal Code), customary law opportunities are open to existing through the prerequisites contained in the Explanation to Article 2 paragraph (1). For this reason, this study aims to determine the opportunities for the existence of Gorontalo customary law through the prerequisites contained in the Explanation of Article 2 paragraph (1) of the National Criminal Code. This research uses normative legal research methods with a statutory approach and conceptual approach and uses primary, secondary and tertiary legal materials. The legal material is then analyzed qualitatively using grammatical, systematic, and historical interpretations. The results showed that Gorontalo customary law exists through the presence of several regional regulations, including (1) Gorontalo Provincial Regulation Number 2 of 2016 concerning the Implementation of Customary Institutions; (2) Gorontalo Mayor Regulation Number 10 of 2020 concerning the Implementation of the Dulohupa Customary Institution of Gorontalo City; and (3) Regional Regulation of Bone Bolango Regency Number 8 of 2020 concerning the Implementation of Customary Institutions. Furthermore, through regulations at the regional level, Gorontalo customary law is also present through concrete events such as the management of customary institutions carried out periodically. Based on this, the regulation of concrete norms related to acts prohibited under living law in regional regulations as required by the Explanation to Article 2 paragraph (1) of the National Criminal Code will have a very large opportunity.

Abstract

Abstract: This study aims to analyze law enforcement for people who refuse vaccination from the perspective of human rights, as well as to examine the obstacles faced by law enforcement in enforcing the law for people who refuse vaccination. This type of research is juridical empirical. The approach used in this research is the statute approach and the case approach. The analysis used in this study is descriptive data analysis using a qualitative approach to secondary data and primary data. The results show that the Government and the Covid-19 task force tend to provide education and rewards to people who want to be vaccinated and provide administrative sanctions for those who refuse, especially the space for movement and regulation of vaccine card requirements in receiving public services by the government and the police. The thing that hinders the process of vaccination to the public is the doubts that arise in the community about the safety and halalness of vaccines caused by hoax news from sources that are not credible.

Abstract

This study aims to determinelegal protection for children as victims of the crime of sexual intercourse.The method used in this research is empirical research methodology. This study uses a qualitative approach and sampling using purposive sampling and using descriptive qualitative analysis techniques. The results of this study indicate thatLegal protection for child victims of the crime of sexual intercourse is given with the aim of protecting victims, especially victims of sexual intercourse in order to get their rights as victims by way of children getting health services as an effort to restore the condition of children as victims of sexual intercourse, children also get legal protection in terms of legal aid, rehabilitation, and prevention. The need for a fair criminal law settlement for victims of sexual intercourse, which adds or considers the rights of victims of sexual intercourse and parents should participate in efforts to provide protection for children by fulfilling children's rights, protecting the best interests of children, and increasing supervision over children. environment and children's play area.

Abstract

Enforcement of criminal law against tourists who damage the environment in tourist attractions. The purpose of this research is to make the reader aware that acts damaging the environment, one of which is a tourist spot, can be subject to criminal sanctions in accordance with Law no. 10 of 2009 in the field of tourism. Using empirical research methods, this research study was carried out at the Botu Motoli'ouwa tourist spot, precisely in the province of Gorontalo. The results of this study explain the supervision of threats to pollution and environmental destruction of Botu Motoli'ouwo tourism objects, law enforcement and criminal liability for tourists who damage the sustainability of the tourism environment.

Abstract

This study aims to find out how the application of narcotics criminal recidivism sanctions is seen from the perspective of penitesnier law and the factors that cause recidivism of narcotics crimes. This study uses empirical legal research methods which are carried out by collecting data through observation and interviews. The results of the research on the Application of Sanctions Against Recidivist Perpetrators of Narcotics Crime Seen from a Penitensier Legal Perspective are not optimal. The application of sanctions against recidivists of narcotics crimes in the perspective of penitential law must include aspects of prevention, rehabilitation, fair treatment and strict supervision. This aims to reduce the level of recidivism, improve the behavior of perpetrators, and prepare for reintegration into society. law enforcement and government. The Application of Sanctions Against Recidivist Perpetrators of Narcotics Crime From the Perspective of Penitensier Law is not optimal. The application of sanctions against recidivists of narcotics crimes in the perspective of penitential law must include aspects of prevention, rehabilitation, fair treatment and strict supervision. This aims to reduce the rate of recidivism, improve the behavior of offenders, and prepare for reintegration into society. Causes of Recidivists Committing Narcotics Crimes are influenced by internal and external factors including: personality, mental health, religion, social and economic skills, environment, social, law enforcement officials and government.

Abstract

Penanganan bagi anak yang bermasalah dengan hukum sudah diatur dalam hukum positif. Sifat dasar anak sebagai pribadi labil, masa depannya sebagai aset bangsa, dan kedudukannya di masyarakat yang membutuhkan perlindungan menjadi dasar alternatif menghindarkan anak dari pidana formal, penjara, dan stigma anak sebagai narapidana. Proses penyelesaian yang dilakukan penegak hukum harusnya diselesaikan dengan cara efektif melalui diversi pendekatan restorative justice. Tujuan dari penelitian ini memberikan pandangan terhadap efektifnya Sistem Peradilan Anak yang berorientasi pada Restorative Justice yang berangkat dari permasalahan bagaimana upaya penanganan anak berhadapan hukum dalam restorative jurtice. penelitian ini menggunakan penedekatan konseptual dan perundang-undangan. Adapun hasil yang didapatkan yakni, Restorative justice melalui diversi yang diyakini dapat menjaga hak-hak yang harus didapatkannya sekaligus dapat menghukumnya ketika berbuat kesalahan. Pemerintah meyakini anak adalah masa depan bangsa yang harus dijaga. ketika anak tersebut menjadi korban, maka proses keadilan yang dilalui anak di pengadilan hanya akan menambah beban fisik dan psikisnya. Sistem restorative justice melalui diversi melibatkan banyak pihak didalamnya, hal ini untuk mencapai keadilan hasil diversi berupa keputusan akhir dari musyawarah yang dilakukan beberapa pihak termasuk pihak masyarakat, korban, keluarga korban, hingga pelaku. Pengadaan seluruh aspek yang terlibat didalamnya guna menyelesaikan perkara tanpa melalui proses pengadilan

Abstract

Tulisan ini membahas tentang Apa saja dampak dari pencemaran lingkungan akibat sampah elektronik dalam prespektif hukum lingkungan dan membahas tentang pengaturan hukum pidana lingkungan terhadap pencemaran dan pengelolaan sampah elektronik (E-Waste) Di Indonesia. Dalam Undang-Undang Nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup dan peraturan pemerintah nomor 101 tahun 2014 tentang pengelolaan limbah Bahan Berbaha Dan Beracun mengatur tentang bagaimana melakukan pengelolaan limbah elektronik. Namun sampai dengan saat ini setiap tahun Indonesia mengalami peningkatan terkait dengan sampah elektronik hal ini di sebabkan oleh perkembangan industri teknologi elektronik yang sangat cepat mengeluarkan dan menawarkan alat elektronik yang terbaru dan lebih canggih, hal tersebut menjadi salah satu pendorong meningkatnya jumlah sampah elektronik tiap tahunnya. Penelitian ini menggunakan penelitian Normatif yang menggunakan metode pengumupulan data dengan cara studi literatur mengenai judul penelitian tersebut. Hasil dari penelitian ini yaitu bahwa pengelolaan sampah elektronik Di Indonesia masih jauh dari kata sempurna selain itu juga untuk pengaturan sampah elelktronik sendiri belum diatur secara spesifik dalam satu peraturan.
