Abstract

Transportasi udara mempermudah masyarakat untuk menjalankan kegiatannya dalam hal penggunaan atau pengiriman barang. Segala kemudahan tersebut memunculkan beberapa masalah, termasuk kelalaian dalam maintenance pesawat ataupun kelalaian manusia lainnya sehingga menimbulkan kecelakaan pesawat. Oleh karena itu pengkajian terhadap pertanggungjawaban korporasi produsen pesawat dalam hal ini adalah Boeing.Company sangat diperlukan terhadap kecelakaan pesawat yang terjadi di Indonesia. Metode yang digunakan adalah pendekatan perundang-undangan. Sumber bahan hukum meliputi bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data dilakukan dengan prosedur inventarisasi, klasifikasi serta identifikasi dan sistematisasi. Analisis data dilakukan dengan cara dibahas, diperiksa, dan dikelompokkan. Masalah dalam penelitian ini meliputi (1) proses penentuan ganti rugi/santunan terhadap korban berdasarkan Peraturan Pemerintah Nomor 77 Tahun 2011 (2) pertanggungjawaban korporasi produsen pesawat (Boeing.Co) menurut Undang-undang Nomor 1 Tahun 2009 tentang Penerbangan. Berdasarkan hasil analisis dan investigasi yang dilakukan diketahui bahwa ada kesalahan konstruksi pesawat dan kesalahan pilot dalam menangani accident kecelakaan. Pihak jasa pengangkut maskapai Lion Air mempunyai kewajiban untuk membayar kompensasi kepada masing-masing keluarga korban sesuai dengan Peraturan Menteri Perhubungan Nomor 77 Tahun 2011. Adapun pihak keluarga korban melayangkan gugatan kepada Boeing Company yang diselesaikan secara mediasi. Atas kejadian ini ke depannya maskapai sebagai pengguna barang yang membeli pesawat dari produsen (Boeing Co atau Airbus) harus selalu memperhatikan prosedur dan penggunaan barang atau pesawat yang dibeli, serta penumpang dan masyarakat pada umum agar selalu memperhatikan prosedur-prosedur keselamatan dalam penerbangan sehingga dapat meminimalisir terjadinya risiko kecelakaan.

Abstract

This study aims to determine the extent of legal protection by the Women and Children Service Unit (PPA) of the Gorontalo City Resort Police Criminal Investigation Unit against women as victims of domestic violence and to find out what factors are obstacles to the efforts of the PPA Unit of the Criminal Investigation Unit Gorontalo Resort Police in tackling violence against women victims of Domestic Violence. Data collected through interviews and library research. Analysis of the data used is the data obtained will be analysed descriptively qualitatively describing the data obtained from field research (primary data), tested the truth then linked and analysed qualitatively with data obtained from library research (secondary). The results showed a form of legal protection by the PPA Unit of the Gorontalo Police Resort Criminal Investigation Unit against women as victims of domestic violence, namely preventive efforts by holding legal counselling in collaboration with the local government and further optimizing the performance of the Gorontalo City Resort Police Especially the PPA unit, repressive efforts that are in accordance with the rules of the Domestic Violence Protection Act. What factors hinder the efforts of the PPA Unit of the Gorontalo District Police Resort Criminal Investigation Unit in tackling violence against women victims of Domestic Violence, among others: Legal factors themselves, Law Enforcement Officers Factors, Factors or Facilities That Support Law Enforcement, Factors Society and Culture

Abstract

Courts’ verdicts issued by the judge ideally contain aspects of legal certainty, justice, and utility.  It is not easy though to synergize the three aspects aforementioned. Between aspects of legal certainty and justice, in particular, there are always disagreements. The research results conclude that a judge does not have to stick on one principle whenever examining and deciding a case. In terms of obstacles, the judge is facing a deadlock whenever written stipulations cannot answer the problems arose. The emphasis on justice principle means that the judge should take into consideration the law, which exists in the society, including customs and unwritten laws. The judge in his argument and legal consideration must be able to accommodate any stipulations exist in the society, both customs and unwritten law. The emphasis on utility principle tends to direct to an economic nuance circumstance. It bases its thought on the idea that law is for human beings or public.  Key words: legal certainty, justice, utility, civil justice

Abstract

This study aims to analyze the arrangement of village head elections from the beginning of independence until now. The method used in this study is the normative legal research method regarding primary and secondary legal materials. The legal materials obtained are then analyzed descriptively. The results showed that the arrangement of the selection of village heads has its dynamics in line with the development of the politics of the law of the state that occurs. The existing legal, political conditions influence determining the conditions for the candidates of village heads. Although it has been regulated for a long time, it turns out that all existing laws and regulations have not made arrangements related to the provisions of the supervisory mechanism and the mechanism of resolving disputes for the selection of village heads. Regulation of the Minister of Home Affairs on the Selection of Village Heads attaches supervisory duties to the regional election committee. However, it does not make arrangements for how the surveillance process should be conducted.On the one hand, in the regulation, it is expressly mentioned the existence of supervisors in the implementation of village head elections. Nevertheless, it did not specify who the superintendent was. Similarly, the settlement of disputes for the selection of village heads is left entirely to the Regent /Mayor to do so. Granting authority to the head of the region can undermine the democratic process built by the village through the selection of village heads.

Abstract

Pancasila and the 1945 Constitution describe Indonesia as a welfare state. In order to cause this happen, many regulations have been formed, which to this date have not been able to bring comfort and splendor in implementing the welfare of the Indonesian people. The number of regulations has actually brought Indonesia to the brink of regulatory obesity and resulted in ineffective regulations in the welfare sector. This study aims to provide an overview of solutions to various welfare problems in Indonesia through regulatory arrangement using the omnibus law method. It represents a normative study using a legal approach and conceptual approach. The results indicate that the application of the omnibus law method can be an innovative alternative without violating the Indonesian legal system. It is because the application of the omnibus law method begins with a legal transplant, which comprises several provisions: The omnibus law approach pattern is limited per sector/theme; (2) simplification of law using the omnibus law method is carried out by measuring the relevance of a regulation with basic criteria; (3) the formation of regulations using the omnibus law method using comprehensive, multidisciplinary and multi-sector approach; (4) the application of the omnibus law method as a whole must be oriented to Pancasila, the 1945 Constitution and Law Number 12 of 2011. Regulatory arrangement with the omnibus law method can not only provide effectiveness but also overcome regulatory obesity for more satisfactory legal system and administration of welfare.

Abstract

Jalan Panjang konstitusional untuk menemukan format pemerintahan telah mengantarkan pada titik pilihan terhadap sistem presidensil dengan sistem multi partai yang diperhadapkan pada realitas politik tentang koalisi dalam mengusung sekaligus memenangkan calon presiden. Keberhasilan dari presiden terpilih dalam menjalankan tugas konstitusionalnya kedepan salah satunya akan ditentukan dari keberhasilan presiden dalam memilih Menteri-menterinya, presiden yang tidak kuat dan berani, akan sangat rentan dikendalikan oleh partai pengusung dalam bingkai koalisi, termasuk dalam hal pengangkatan menteri, sehingga akan mereduksi hak prerogatif presiden. Tujuan tulisan ini hendak mengurai konsep pengisian kabinet yang ideal guna mewujudkan pemerintahan yang berkualitas konstitusi. Pendekatan yang digunakan dalam penulisan artikel ini adalah pendekatan sejarah dan statute dengan Teknik analisis preskriptif. Hasilnya, secara yuridis ketentuan tentang persyaratan pengangkatan menteri oleh presiden masih memiliki “ruang kosong” terkait persyaratan kualifikasi, kompetensi atau pun keahlian seseorang dalam pengangkatan sebagai menteri. Kondisi ini tak jarang menyebabkan pengangkatan menteri lebih berdasar pada bagi-bagi “voucer hadiah” oleh presiden terhadap partai politik sebagai balas budi atas “keringat” partai yang bercucuran saat pemenangannya menjadi presiden. Pilihan untuk menapaki jalan konstitutional menuju zaken kabinet merupakan pilihan yang tepat, dengan mekanisme pengangkatan yang menciptakan kultur kompetisi, selektif dan objektif, dimana semua dapat mengusulkan orang-orang yang dianggap baik dan kompoten, dan tim kecil bentukan presiden yang akan menelusuri rekam jejak keahlian serta integritas calon menteri, dan hasilnya berbuah pada rekomendasi kepada presiden yang akan menentukan siapa-siapa saja menteri yang akan membantunya mewujudkan pemerintah yang berkualitas konstitusi, pemerintah yang mampu menunaikan janji konstitusi pada Pembukaan UUD NRI Tahun 1945, sekaligus juga melakukan pemenuhan hak konstitusional warga negaranya. Abstract

The obstacles faced by a judge in realizing the principles of legal certainty, justice, and utility can be categorized into internal and external obstacles. Internal obstacles, which come from within the judgeconsist of: the appointment of the judge, his education, his understanding of science and knowledge, hismorality, and his welfare. On the other hand, external obstacles, which comes from outside the judge,consist of: the independence of judicial power, the formulation of legislations, the prevailing judicialsystem, community participation, and judge supervision. Kendala yang dihadapi hakim dalam mewujudkan kepastian hukum, keadilan dan kemanfaatan  dapat dibedakan menjadi kendala internal dan kendala eksternal. Kendala internal yang datangnya daridalam diri sendiri. Kendala internal terdiri dari: pengangkatan hakim, pendidikan hakim, penguasaanterhadap ilmu pengetahuan, moral hakim, kesejahteraan hakim. Sementara kendala eksternal datangnyadari luar diri hakim itu sendiri. Kendala eksternal hakim terdiri sebagai berikut, kemandirian kekuasaankehakiman, pembentukan undang-undang, sistem peradilan yang berlaku, partisipasi masyarakat,pengawasan hakim.

Abstract

The investigation process is an integral part of the investigation. Put merely, and the research is an essential part of the study. The emphasis of investigations is on finding and gathering evidence so that the criminal act found becomes apparent and can find the culprit. In principle, the analysis of a criminal case is a continuation of the research carried out previously. For an event that has been declared a criminal act by the investigator, the next step is to investigate who the perpetrator of the crime is. This research was conducted by examining field data. This writing is to provide an ideal concept of supervision in the process of suspected criminal acts and then goes to the supervision of the investigation process. The investigation is carried out by officials appointed by Law as referred to in applicable laws and regulations. Still, management needs to be carried out by all parties, including the community. This management is a fundamental affirmation that all stakeholders play a significant role in eradicating corruption that threatens society's stability and security and weakens the institutions and values of democracy and justice, endangers sustainable development and law enforcement.
