Abstract

Dalam penerapan Diversi terhadap tindak pidana yang dilakukan oleh anak, polisi khususnya penyidik anak telah memiliki payung hukum baik berdasarkan Undang-undang No 11 tahun 2012 tentang Sistem Peradilan Pidana Anak serta peraturan internal kepolisian yaitu Undang-undang No 2 tahun 2002 tentang Kepolisian RI peraturan perundang-undangan yang memberi wewenang untuk tindakan tersebut.pelaksanaan diversi oleh pihak penyidik selama ini berpedoman pada UU SPPA dimana dalam UU SPPA pasal 7 ayat (1) Undang-undang sistem peradilan pidana anak menyebutkan bahwa “Pada tingkat penyidikat, penuntutan,dan pemeriksaan perkara anak di pengadilan negeri wajib diupayakan diversi.Rumusan masalah 1) Bangaimana kebijakan penyedik polri dalam melakukan prosedur hukum terhadap tindak pidana anak melalui teknik diversi dan non diversi ditingkat penyidikan 2) apakah saksi adminitrasi terhadap penyedik polri yang tidak melakukan diversi terhadap tindak pidana anak Penelitian ini tergolong dalam penelitian Normatif, karena menggunakan pendekatan perundang-undangan yaitu melakukan pengkajian terhadap kebijakan penyidik polri dalam melakukan prosedur hukum terhadap penanganan tindak pidana anak melalui teknik diversi dan non diversi ditingkat penyidikan sebagai upaya mencegah terjadinya pidana anak Pembahasan kebijakan penyidik polri dalam prosedur diversi dan non diversi menurut undang-undang Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak. Menurut konsep diversi dan restorative justice dan non deversi dalam penanganan kasus anak yang berhadapan dengan hukum, yang dikeluarkan oleh Kabareskrim Polri disebutkan, karena sifat avonturir anak, pemberian hukuman terhadap anak bukan semata-mata untuk menghukum tetapi mendidik kembali dan memperbaki kembali. Sanksi adminitrasif terhadap Penyidik yang tidak melakukan diversi terhadap Anak berdasarkan Peraturna Mahkama Agung Nomor 4 Tahun 2014 dalam pasal 33 dengan pidana penjara paling lama 2 (dua) tahun, dan penyididk yang tidak melakukan kewajian sebangaimana dimaksud dalam pasal 7 ayat (1) dipidana dengan pidana penjara paling lama 2 (dua) tahun atau dendan paling banyak 200.000.000,00 (dua ratus rupiah).

Abstract

This study described the implementation of education in TMI Al-Amien Prenduan. It also analyzed its teacher’s role in curriculum development at the multiple intelligences class. This study is a case study. Data was collected through observation, interview and documentation and analyzed using qualitative Model. Data validation was carried out using triangulation of data, method and source. The findings showed that the education process in TMI Al-Amien Prenduan run for 24 hour per day and used Multiple Intelligences approach in dividing the class. Classes at TMI are divided into class groups, enrichment of Islamic religious lessons and enrichment of Arabic class, Indonesian language and literature class, Mathematics and natural science class, and social sciences and English enrichment class. Teachers in this institution play three important roles, namely professional educator, learning guide, and curriculum development. They are involved in the development of Master Plan for Semester Education Program. In addition, they also carry the structural responsibility as managers.

Abstract

Globalization has a positive impact on people's lives, but it also raises some issues, including declining the nation's democratic character. Learning about ethnic and cultural diversity in social studies is shown to be helpful in the development of moral character in children. Based on the above description, this study aims to determine the extent to which students can apply democratic character in their daily lives as a result of the implementation of democratic character education. Interviews, questionnaires, and observation were used to collect data in this study. Descriptive qualitative research using a percentage formula was used. Class V SDN Poja II Sumenep, which included 47 students from various ethnic backgrounds, was used for the study. 3.8 percent more students than last year filled out democratic questionnaires, according to the data. This study concludes that the implementation of democratic character education through social studies learning material on ethnic and cultural diversity in elementary schools is categorized as very good according to the character learning syntax. Students' level of understanding in implementing democratic character in everyday life is categorized as very good. This is because students have carried out all activities by predetermined indicators.

Abstract

Akad nikah dalam agama islam sebagai pintu gerbang menuju terwujudnya keluarga sakinah mawaddah warahmah. Tanpa akad nikah, hubungan suami isteri dipandang tidak sah. Dalam kehidupan berumahtangga tidak terlepas dari yang namanya permasalah, percekcokan antara suami dan istri. Banyak masyarakat yang mampu mengatasi permasalah tersebut, tetapi banyak pula permasalah yang muncul dalam kehidupan berumah tangga yang berujung penceraian. Tujuan penelitian ini adalah untuk mengetahui 1) putusnya perkawinan/ talak (perceraian dalam perspektif fiqih dan komplikasi hukum islam; 2) hukum menjatuhkan talak; dan 3) cara menjatuhkan talak menurut fikih. Metode penelitian ini adalah Metode penelitian yang digunakan dalam penelitian ini adalah dengan metode yuridis normatif melalui pendekatan kajian normatif melalui berbagai ketentuan mengenai perceraian dalam perspektif fikih dan kompilasi hukum islam. Hasil penelitian ini adalah Pelaksanaan talak atau cerai dalam perspektif ulama klasik sangat bebas dan tergantung kepada kehendak suami, sebab dialah yang memiliki hak cerai dan tidak perlu dengan meminta pertimbangan isteri. Talak dapat dijatuhkan di mana saja, kapan dan dalam kondisi apapun. Menurut Kompilasi Hukum Islam, talak atau cerai hanya sah jika dilakukan di depan sidang Pengadilan Agama setelah upaya damai tidak dapat dicapai. Hukum mnejatuhkan talak yaitu Wajib, Sunnah, Makruh, Mubah dan Haram

Abstract

The purpose of this research is to see the number of people's interest in cycling. Survey and interview methods were conducted to obtain research data. Respondents taken are people who do cycling at Taman Bunga Sumenep with a total of 25 respondents. The results of the study show data that 75% of respondents think that cycling is very useful and very interested during the Covid-19 pandemic. From the results of this study, it can be concluded that public interest in cycling is very high and based on observations made during the study, cycling is currently the right sport to do during the Covid-19 pandemic.

Abstract

Penelitian ini bertujuan untuk 1) untuk mengetahu pandangan islam terhadap pernikahan dini dan 2) untuk mengetahui dampak-dampak pernikahan dini. Hasil pembahasan makalah ini adalah Substansi hukum Islam adalah menciptakan kemaslahatan sosial bagi manusia pada masa kini dan masa depan. Hukum Islam bersifat humanis dan selalu membawa rahmat bagi semesta alam. Apa yang pernah digaungkan Imam Syatiby dalam magnum opusnya ini harus senantiasa kita perhatikan. Hal ini bertujuan agar hukum Islam tetap selalu up to date, relevan dan mampu merespon dinamika perkembangan zaman. Abstract

Down Syndrome is a condition of underdevelopment of physical and mental development in children caused by chromosomal development abnormalities. At her age which have entered adolescence her mother always serve Subjects in all daily activities. Subjects, in dressing Subject was also still assisted by his mother. After given the handling on the subject, then got satisfactory results. Independence on the subject has begun to develop, the subject at home was not willing to be bathed again, when the bath time the subject will ask for toiletries and then bathed himself, and after bathing, the subject will use his own clothes, but the clothes still need to be prepared before. This research uses research with qualitative of case study. This research data form of interview result, observation result and written sources. The data were collected using interview and observation techniques. The data analysis activity is done by thematic analysis.

Abstract

Religious value inculcation is an awareness and planned to prepare students in terms of knowing, and understanding, and living, practice so that it arises to believe in the religion they profess. Based on the above understanding, the authors are interested in conducting research on the implementation of religious values ​​through school culture. This research focuses on: (1) What forms of religious values ​​in primary schools, (2) How do the implementation of religious values ​​through school culture. With the aim of: (1) To find out the form of religious culture in elementary schools, (2) To find out the implementation of religious values ​​through school culture. In this research the method used is qualitative phenomenology through case studies. Data collection techniques in this study were conducted by (1) semitructured interviews, (2) unstructured observations, (3) documentation, so that the results are arranged systematically, the authors step in analyzing data is to use data reduction, data presentation and data verification (drawing conclusions) . The results of this study indicate (1) the form of religious values ​​in SDN Baban 1 Sumenep include: (a) the value of aqidah / worship consisting of praying in congregation, reading prayer, reading Al Quran short letters, (b) moral values ​​consisting of politeness, 3S (smile, greetings, greetings), silaturrahim values ​​(c) shari'ah values ​​consist of disciplinary values ​​and social values, (2) implementation of religious values ​​through school culture in SDN Baban 1 Sumenep include: (a) routine activities, (b) routine activities, (b) ) spontaneous activities, (c) conditioning, (d) exemplary.
