Abstract

A research on Syuẑûẑ and ʽilal of hadith (prophetic tradition) is definitely important to conduct despite it is admitted by Maḥmûd al-Ṭaḥḥân in his Uṣûl al-Takhrîj wa Dirâsat al-Asânîd as a complicated subject for research. He frequently states that the subject is complicated (ṣaʽb) since it deals with the hidden character (ghâmiḍ) which influences how hadis is considered as ḍaʽîf. Syuẑûẑ and ʽilal of hadis can only be detected by those who are granted with deep and thorough knowledge.

Abstract

This article tries to illustrate the geneology of hadith studies in Nusantara. Even though it does not cover such studies in the whole meaning, some basic points therein reveals important informations which are absent in previous studies. Al-Tarmisi, the important figure in the early history of hadith studies in Nusantara, enjoys a great reputation, particularly amongst the muhaddithîn. This is because, among some, he posed connected links (i.e. isnâd) to the transmitters of the first generation.

Abstract

As a paragon who is followed by Muslims, the Prophet Muhammad’s hadiths serve as one of the main sources for Islamic tenets as a universal religion for all mankind. Meanwhile, the prophet was also a man who lived in a society with certain cultures, traditions, and geographical elements which differ, to some extent, from those of Muslims all over the world.Sociological approaches to the life of the Prophet, thus, become necessary in order to realize his guidance by contextual understanding to the gist of hadiths. Sociological approaches can be done by combiningdifferent perspectives of Sociology, such as Sociology of religion, Sociology of Language, Sociology of Culture, and so on, with Sociological theories which are widely well-known in either Islamic world or the West. In order not to be detached from the spirit of Islam, the analysis from the Sociological perspectives should be combined with hadith’s sciences (‘ûlûm al-ḥadîth) covering the isnâd and the matn. The significance of such kind of approach can be seen in its possibilities to reveal –to mention some of them- why the transmitters and collectors of hadith have the similar names and why one hadith seems to contradict the other. Some sub-disciplines of hadith sciences which have been combined with sociological approaches (including names, tittles, country of origins of the transmitters, as well as the contradictive and strange hadith) can prove significance of Sociological approaches to the study of hadith.

Abstract

Living-hadis is the comprehension of hadis under the level of practice. Based on this, the shift of what Fazlur Rahman initiates does not differ all the way around from the study of living-hadis. Such comprehensions reflected in the level of practise, however, in some cases do not correspond with how others understand the hadis in question, but more reflect the contexts of different societies, which is to say, the cotextual comprehension. Any textual and contextual comprehension of hadis which is reflected in the level of practice within any society can be regarded to as living-hadis.

Abstract

Speaking of a scholar can not be detached from his/her contribution(s) to the dicipline he/she deals with. In modern ḥadîth criticism, Ignaz Goldziher is regarded as one of the most prominent scholar with a wide range of influence. Through his provokative writings, he inspires the rise of many responses which lively signs the development of the discipline among Muslims and Orientalists. Goldziher’s interests, however, do not only cover ḥadîth, but also extended to other Arabo-Islamic sciences, more particularly literature criticism with the focus on ancient Arabic poetry. In regard with the ancient Arabic poetry, he too has his great influence by which he deserves to be regarded as a prominent critic of literature.Keen studies on Arabo-Islamic sciences that Goldziher conducted allows him for always being reffered to by scholars. And so his carefull writings are considerred still relevant. On any account, what makes it possible for him to pose such reputations is because of his broad and extensive reading, including the earliest history of the Arabs and Islam from authoritative sources.

Abstract

Discourse on trustee and witness in marriage is one of the seemingly never-ending controversies. Discussions surrounding it, nevertheless, is regarded as the access point to the equality between the role of men and that of women. Even though both sides whose opinion is contradictory all the way around have the same goal in elevating women’s value and dignity, methods and approaches they conduct in comprehending the religious texts are different to each other. For this reason, the re-interpretation of the texts can presumably bridge the gap. The discourse, however complex it is, can be solved in different situation by using methods developed by traditional and contemporary scholars. This article elaborate principle methods in re-interpreting authoritative religious texts relating to, more particularly, trustee and witness in marriage based on Islamic Jurisprudence, as well as arguments proposed by both sides and the re-interpretation to their arguments.

Abstract

This paper discusses about Ricoeur’s phenomenological hermeneutics. It is a method based on the text interpretation. Author interested in the phenomenon of religiosity in the study of living hadith. It raises the question, what is Ricoeur's phenomenological hermeneutics and how it can be applied? Ricoeur's phenomenological hermeneutics is a synthesis of hermeneutics and phenomenology. In its application, utilizing the text paradigm, the interpretation should be developed through three stages: semantics, reflective and existential. It concludes that the phenomenological hermeneutics can analyze the phenomenon of religiosity that produces eschatology.

Abstract

Kewajiban dan hak suami dan istri diatur dalam Islam, termasuk di antaranya diatur dalam hadis Nabi SAW sebagai bagian daripada dasar hukum Islam. Di antara hal yang diatur dalam hadis terkait hal tersebut adalah tentang puasa istridanpa izin suami. Kualitas sanad dan matan tentang puasa istri tanpa izin suami, baik hadis yang diriwayatkan oleh Abū Hurayrah maupun hadis yang diriwayatkan Abū Sa‟īd al-Khudry merupakan hadis-hadis shahih. Dengan demikian hadis-hadis tersebut yang dapat dijadikan sandaran hukum. Adapun maksud dari tidak dibolehkannya istri melakukan puasa tanpa izin suami adalah bahwa seorang istri tidak diperkenankan berpuasa tanpa izin suaminya dengan syarat-syarat berikut, yaitu: pertama, puasa yang hendak dilakukan adalah puasa Sunnah. Kedua, puasa istri dilakukan ketika suami tidak bepergian.

Abstract

Tidak dapat dipungkiri bahwa pembelajaran hadis di Nusantara mengalami ketertinggalan yang cukup signifikan jika dibandingkan dengan pembelajaran materi keagamaan lainnya, seperti tafsir, fikih dan tasawuf. Hal ini bermula sejak masuknya Islam ke Nusantara. Wajar kalau kemudian minimnya keberadaan tokoh dan kitab hadis, juga pembelajaran hadis di Indonesia, menjadi pertanyaanyang sering dilontarkan banyak orang, termasuk minimnya minat mahasiswa terhadap jurusan Tafsir Hadis. Berbagai ungkapan yang dilontarkan para peneliti terkait dengan kajian hadis masih tercecer, termarjinalkan dan masih tahap permulaan tentunya bukan tanpa alasan dan latar belakang, karena materi yang diajarkan di Nusantara pada masa awalnya masih sangat mengesampingkan hadis, demikian pula dengan keberadaan tokoh dan kitab hadis.

Abstract

الدراسة المجملة عن كتب علوم الحديث تبين لنا أن مناقشة مبحث النسخ في كتب علوم الحديث قليلة و موجزة جدا بالنسبة إلى مناقشته في كتب علوم القرآن و كتب أصول الفقه. قد شهد على ذلك قول ابن كثير في كتابه اختصار علوم الحديث: وهذا الفنّ [ معرفة ناسخ الحديث و منسوخه] ليس من خصائص هذا الكتاب بل هو بأصول الفقه أشبه. وكذا قول يوسف القرضاوي يؤيد هذه الحقيقة "أن دعوى النسخ في الحديث أضيق مساحة من دعوى النسخ في القرآن. مع أن الأمركان يجب أن يكون بالعكس، إذ الأصل في القرأن أن يكون للعموم والخلود، أما السنة فمنها ما يعالج قضايا جزئية أو أحوال مؤقة، بحكم إمامته صلى الله علييه وسلم لألمة، وتدبيره لأمورها اليومية " فقد يكون من الأحاديث ما يراد به العزيمة، ومنها ما يراد به الرخصة. وقد يكون بعض الأحاديث مقيدا بحالة، وبعضها الأخر مقيدا بحالة أخرى حتى تبدو كأن الأحاديث متناقضة بعضها ببعض. وتلك الأحاديث المتناقضة في عرف علوم الحديث تسمى بالأحاديث المختلفة. وقد أفردها العلماء في البحث في علم مختلف الحديث. كان علماء علوم القرآن في مواجهة تعارض النصوص الدينية يقدمون الجمع والتوفيق بين تلك النصوص من النسخ. وأما علماء علوم الحديث يقدمون الجمع ثم الترجيح ثم النسخ ثم التوقف. فنسخ الحديث إذا عملية في معالجة الأحاديث المتعارضة بعد مناظرة عدم الإمكان في التوفيق بين الأحاديث وبعد مناظرة عدم الإمكان في ترجيحها. لذالك عرّف العلماء علم ناسخ الحديث و منسوخه : العلم الذي يبحث عن الأحاديث المتعارضة التي لا يمكن التوفيق بينها من حيث الحكم على بعضها بأنه ناسخ، وعلى بعضها الأخربأنه منسوخ.
