Abstract

The purpose of this study was to determine the driving factors behind the smuggling of firearms during the conflict, fire arms smuggling patterns that happened, and the government'sefforts in addressing the issue. In conducting this study, researcher used qualitativeresearch methods in explaining the variables of research to answer the essence ofsmuggling SALW arms during the GAM conflict. This research finds that there are 7factors that encourage the smuggling of weapons by GAM during the conflict in Aceh.Those are, the geographical factor, abuse of authority, a lack of legal mechanisms, lack ofcoordination, a lack of supporting infrastructure, high price of the weapons, and increasingGAM membership.

Abstract

In 2007-2013, European Commission (EC) sent three warning letters to the Italian Government for its failure to fulfill its obligation under the Waste Framework Directives (WFD) 2006 (article 4 and 5). EC was concerned with the ongoing waste problem in Campania Region, Italy that had been happening since 1994. To some extent, the problem caused some environmental issues in Campania Region, which was deemed as the exact opposite of what is regulated in the WFD, particularly regarding the implementation of adequate waste management system and the implementation of waste management without endangering the environment and people’s health. This research aims to explain the waste problem in Campania within the period of 2007-2013, and analyzing the factors that prevent the correct implementation of WFD and its implication on the waste problem. The theoritical framework in this research is, Conceptualizing The Domestic Impact of Europe by Tanja A. Börzel and Thomas Risse is being used to analyze those factors. This research uses the qualitative method. This research finds out that the most significant factor that prevented the correct implementation of WFD in Campania was the lack of role of its formal institution, which was the Committee on Waste Emergency (CWE) during 1994-2009. Eventually, those problems during the 15 years of CWE leadership was not easy to be solved within only four years (2010-2013).

Abstract

Money laundering has targeted pop culture, and one of which is the film industry. The money laundering case by Red Granite Pictures is the first money laundering case in the film industry. Specific methods are needed to prevent money laundering crimes in the film industry for the better future. The main purpose of this thesis is to analyze co-production cooperation as a method of preventing money laundering, by describing the situation and conditions of the United States and European film industry, the development of co-production cooperation, treatment of the Red Granite Pictures case, and of FATF’s recommendations regarding crime of money laundering . This thesis uses qualitative research methods with explanatory research types and is analyzed by collecting data obtained from books, annual evaluation reports along with recommendations from FATF, also mass media. The explanation of the co-production convention as a method of preventing money laundering using public policy theory, while the national film commission will be analyzed using the theory of neoliberal institutionalism using FATF as the bridging institution. The results of this study indicate that the co-production convention is the suitable policy in preventing money laundering crimes in the film industry. This can be seen from the arrangement of co-production conventions by the European Union, which are in line with the FATF recommendations regarding money laundering.

Abstract

In the era of globalization, trade liberalization characterized by problems of counterfeitgoods. Definition of counterfeiting according to the International Trademark Association isa practice of manufacturing goods which are low in quality, and sold under a famous brand,without having a license, and without supervision of a brand and patent owner of the goods.Counterfeit goods activity is not only on the production process, but also on the stage ofdistribution, and import-export process. Counterfeiting is closely related to IPR theft andbecame a global problem. Therefore, the United States as the country with the biggest IPRbasedindustries in the world, it is necessary to eradicate the source of counterfeit goodsfrom China. This study was conducted to measure the effectiveness of the efforts made bythe United States, so it can be a guide to the establishment of policies and strategies forachieve the desired results. In this research, the authors encountered several limitationsrelated to operating results, the result of criminal cases, as well as the lack ofunderstanding of U.S. citizen related to counterfeit goods. This type of research isqualitative descriptive study, in which the analysis is done by collecting data throughlibrary research by using books, journals, government documents, and other writtensources. Comprehension of this research was formed by theory of neo-realism and theoryof effectiveness by William N. Dunn. Thus it is capable to explain the limitations of theresults that have been done by the United States.

Abstract

This research aims to explain the efforts of the Government of India in implementingTRIPS so as to produce generic ARV drugs under the TRIPS regime. The idea ofregulating patent protection on the health aspects of TRIPS has fueled cynical responsesfrom developing countries that view TRIPS as a form of knowledge commodification andfeudalization of information. This research is based on concerns about developingcountries access to Antiretroviral (ARV) due to price increases as a consequence of TRIPS.In response to this problem, India as the world's largest generic ARV producer has becomethe most massive state opposing patent regulation on health aspects. This research seesIndia's efforts in implementing TRIPS in order to achieve its interests through the patternof health diplomacy with the principle that health is the aspect that is interpreted ascommon goods. Periodically, India is advocating the importance of generic ARVaccessibility that is used as an antidote to the HIV / AIDS epidemic in developingcountries. Using the Critical Theory approach, India is able to encourage emancipation andsucceed in protecting the interests of developing countries with serious problems in theHIV / AIDS epidemic.

Abstract

Thailand, Laos, Myanmar, China, Vietnam, and Cambodia createdCOMMIT and COMMIT SPA. During COMMIT SPAimplementation period 2011-2013, the number of human traffickingincreased in Thailand. Most of human trafficking victims in Thailandare exploited into sexual exploitation and forced labor. The studyaims to analyze causes of human trafficking increased duringCOMMIT SPA implementation. The study result is the increase ofhuman trafficking is caused by Thailand’s interests by using sextrafficking victims in prostitution and sex tourism activities as a drawfor foreign tourists to Thailand and labor trafficking victims inproducing prawns for supermarkets in US and European countries toget economic benefits.

Abstract

It is almost undeniable that the existence of interests has basically become the basis of every states in taking policies both domestically and abroad, including Japan and China. In the contemporary era, the scope of state power is no longer limited to the issue of security and defense (military) but also its economic strength. The increasing of  economic power now  has included in the top of the country's interests. In an effort to increase the economic strength of state, Japan and China realize it by overcoming their domestic problems which potentially obstruct the economic growth as well as damage the country's economic stability. The problem in question is the crime of corruption and money laundering and categorized as complex crimes. It takes the role of other actors besides the state who are believed that it is able to help accelerate the handling of these crimes, in this context is the role of the international regime. This argument at the same time also become the main reason of why Japan China comply to the international regime towards corruption and money laundering handling. This research aims to explain that Japan and China comply to the regime is caused by the national interest that the two countries want to achieve, in this case is the interest of increasing the economic strength of Japan and China.

Abstract

Woman trafficking in Vietnam was a transnational crime in which the victim experienced sexual exploitation, either for porstitution or forced marriage. This study aimed to explain the case of woman traffickingin Vietnam to China 2005-2009. This study employed socialist feminism theory along with qualitative methods through interviews, and literature research. This study also found that women trafficking in Vietnam caused by the culture of patriarchy in both Vietnam and China. In both countries women were considered as a second class that made them, underwent social and economic discrimination. Consequently, the vunerability of women trafficking abroad was significantly increased.

Abstract

Conflict is an intrinsic aspect that can not be avoided in social conditions. UNPeacekeeping Operations (UN PKO) became a form of UN to help conflict nations becomepeaceful by building military, police and civil forces. Indonesia is one of the most activeand sustainable countries within the United Nations PKO since 1957. In the era of SusiloBambang Yudhoyono's administration, Indonesia's participation and commitment to UNPKO has received international attention for having achieved more than once. This studythen has a purpose to know the results of changes in Indonesia's commitment in the UnitedNations PKO in the era of SBY. This research uses constructivism paradigm. The methodused in this research is explanative type research. The result of the change in Indonesia'scommitment to PKO of the United Nations is because SBY interpreted Indonesia's identityas 'one million zero friend enemies' and as a member state of the UN. The identity thenspawned a set of interests that motivated Indonesia to increase participation in the PKO ofthe United Nations.

Abstract

The Merida Initiative 2008 showed the anomalous relationship between UnitedStates and Mexico that have a history of disharmonious relationship overhundreds of years ago. In addition, this study also aims to determine the effortsthat have been made between United States and Mexico in implementing thepoints of agreement on the Merida Initiative 2008. Using constructivismparadigm of collective identity, the research method used in this research isdescriptive explanatory method with the variable dependent lies on thecollective identity of the United States and Mexico under the Merida Initiative,and the independent variables lies on three determinants of collective identity,which are structural, systemic and strategic factors. Merida Initiative can beregarded as an effective cooperation, since the two countries haveimplemented the points of agreement in this cooperation positively. It ischaracterized by the high number of drug seizures, arrested officials of drugcartels, and the continuation of this cooperation. United States and Mexicoalso described Merida Initiative as a new paradigm in their securitycooperation. Merida Initiative has successfully renew the relationship betweenthe two countries, especially in diplomatic relations on security cooperation.
