Abstract

This study aims to determine the payment of the curator's fee in the event that the decision of the bankruptcy statement is canceled by the Supreme Court so that it can examine and find out how the payment of the curator's fee in the event that the decision of the bankruptcy statement is annulled by the Supreme Court, as well as to examine and find out the legal consequences of the curator's actions in the event that the decision of the bankruptcy statement is canceled. by the Supreme Court. This research is a type of qualitative research by following the typology of normative legal research. Research data were collected by means of literature and document studies. The data that has been collected will be identified and compiled systematically, both data obtained from primary legal materials, secondary legal materials, and tertiary legal materials. Then all the data obtained from the literature study and document study are relevant to the related theory and written descriptively and analyzed qualitatively. The results of this study show that: first, based on the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia (Permenkumham) Number 18 of 2021 concerning Guidelines for Service Fees for Curators and Management in Article 3 paragraph (1) letter c, payment of the curator fee in the case of a statement decision bankruptcy is canceled by the Supreme Court either at the level of cassation or review, then the amount of service fees is charged to the applicant for the declaration of bankruptcy or the applicant and debtor, the amount of which is determined by the Panel of Judges. Second, the decision to declare bankruptcy was canceled by the Supreme Court either at the level of cassation or review, then the legal consequences that occur are in accordance with the provisions of Article 72 of the Bankruptcy Law and PKPU, namely the curator is responsible for errors or omissions in carrying out management and/or settlement tasks. cause loss to the bankruptcy estate. The legal consequence is the responsibility of the curator after the decision of the Supreme Court that annuls the bankruptcy decision, namely all legal actions that have been carried out by the curator in managing and settling the bankruptcy estate cannot be restored to their original state and are binding forever.

Abstract

This study aims to (1) describe and explain the role and position of children as victims of sexual violence in Buleleng Regency; and (2) describe and explain the rights and obligations of children as victims of sexual violence in Buleleng Regency. The type of research used is empirical legal research which is descriptive. The data and data sources used in this study are primary data and secondary data consisting of primary legal materials and secondary legal materials and. The data collection techniques used in this study are document study techniques, observations, and interviews. The sample determination technique used in this study is non probability sampling with the type of sample, namely purposive sample. Data processing and analysis techniques are carried out qualitatively. Based on the results of the study, it is known that (1) the role of children as victims of sexual violence in Buleleng Regency can be classified as latent or predisposed victims, provocative victims, and unrelated victims. Meanwhile, his position is that children are absolutely victims of sexual violence crimes; (2) the rights obtained by children as victims of sexual violence in Buleleng Regency are to receive treatment, protection, and recovery since the occurrence of the criminal act of sexual violence, while the obligation is to support all efforts and processes of fulfilling the rights obtained so that they can be fulfilled optimally.

Abstract

This study examined a traditional mediation of mahurui hatulang kabalim which is a local wisdom of indigenous Dayak society in Central Katingan, Central Kalimantan who has a traditional mentality and belief in resolving household disputes. Mahurui hatulang kabalim is rooted on conciliation and deliberation culture as society values transforming into the character which is manifested into mechanical solidarity. This study was an empirical legal study or so-called non-doctrinal sociological legal study. The approaches applied in this study were explanatoris approach, conceptual approach and philosophical approach. In the mediation practice of Mahurui hatulang kabalim, the mantir adat as a mediator to resolve disputes was by mangatawan masalah (knowing the problem), nyundau ije-ije (visiting respectively), ngahau ije-ije (calling respectively), Manggau jalan damai (seeking a peaceful way), manukep atei (approaching the heart). Some were successfully reconciled (sarukui haluli) and some were failed to reconcile (separate pinja). The essence of Mahurui hatulang kabalim was a traditional mediation as a repressive effort in restoring family relations as society’s traditional mentality.

Abstract

Over-The-Top (OTT) media-based Electronic System Operators are increasingly being used by the public as a result of media convergences and internet services. Nevertheless, the use of OTT services raises various problems, ranging from problems of threats to users, to regulatory issues for OTT. So far, OTT services are not regulated in a standard manner in one comprehensive law, causing uncertainty for both the consumer and its competitors, which are arranged by some regulatory attestation. This problem then became tangible when one of the broadcast services tried to appeal related to the definition and scope of regulation from the OTT services to the Constitutional Court. Based on these complications, it can be stated that there is a need for legal arrangements followed by institutions from the OTT supervisor. Therefore, the researcher elaborates the status quo with the problems of implementing the OTT services. With the description of the problem, together with further comparisons between countries, the researcher can conclude the arrangements for OTT organizers that can be included in legal regulations. In this study, several policy strategies were formulated for the implementation of institutional arrangements in the OTT services.

Abstract

The agricultural biotechnology laws and regulations are sectoral and are spread out in various separate laws and regulations. This pattern has implications for overlapping content and difficulties in law enforcement. Another weakness is that agricultural biotechnology laws and rules do not comprehensively contain international legal principles that have been agreed globally to protect public health and the environment from the risks of using agricultural biotechnology. This study sets out three formulations of the problem: (1) why the renewal of legislation on agricultural biotechnology must be based on international law?; (2) what are the principles of international law as a source of renewal of legislation on agricultural biotechnology?; and (3) how is the implementation of international legal principles in agricultural biotechnology legislation? In this research using the type of normative legal research with a statute legal approach and a conceptual approach, three answers were obtained. First, international law is material for updating agricultural biotechnology legislation because of its strong influence on developing national law both now and in the future. Second, the principle of international law as a source of renewal of agricultural biotechnology legislation includes the principle of state sovereignty, the principle of prevention, the principle of prudence, the principle of polluters paying, the principle of cooperation, the principle of equal responsibility with different obligations, the principle of sustainable development, and the principle of participation public. Third, the implementation of the principles of international law is not carried out comprehensively but sporadically and is placed in the chapter on the principles, objectives, and scope of the law in question, not formulated in the form of a norm that has the legal force to be implemented.

Abstract

Every development activity must always adhere to the principles of sustainable development in the context of implementing environmental protection. Therefore, it is necessary to have a form of study on every business activity that has an important impact on the environment, through an Environmental Impact Assessment (EIA) mechanism as an instrument of preventive environmental administration. Seeing the important impact on the environment, of course it will be a concerns and responsibility of all parties (the public) to be involved in the EIA process until making decisions of environmental feasibility as an embodiment of the participatory principle. However, after the Job Creation Act, the involvement of public participation in the EIA process is considered to have been reduced. Based on this problem, this study aims to determine the concept of public participation in environmental permit and the implications of Job Creation Act on the role of public participation in the EIA process. This study uses a normative juridical method in the form of an analysis of the principles, rules, and provisions of laws and regulations, also accompanied by a relevant approach. The result of the study shows that there are 3 (three) forms of restrictions on public participation in the EIA process after the Job Creation Act. First, restrictions on the preparation stage that only involve directly affected communities. Second, restrictions on community elements in the Environmental Feasibility Test Team, and the third is restrictions due to the objection provision that have been removed. Finally, these three forms of restrictions by and by affect the reduction of environmental protection. Keywords: Environmental Impact Assessment, Public Participation, Job Creation Act Setiap aktivitas pembangunan harus senantiasa berpegang pada prinsip-prinsip pembangunan yang berkelanjutan dalam rangka pelaksanaan perlindungan lingkungan hidup. Karena itu, perlu adanya suatu bentuk kajian terhadap setiap usaha kegiatan yang memiliki dampak penting pada lingkungan hidup melalui sebuah mekanisme Amdal sebagai instrumen administrasi lingkungan yang bersifat preventif. Melihat adanya dampak penting pada lingkungan, tentunya akan menjadi kepentingan dan tanggung jawab semua pihak (publik) untuk dapat terlibat di dalam proses Amdal hingga pengambilan keputusan kelayakan lingkungan sebagai perwujudan dari asas partisipasif. Namun pasca UU Cipta Kerja, keterlibatan partisipasi publik dalam proses Amdal dinilai telah direduksi. Berdasakan permasalahan tersebut, penelitian ini bertujuan untuk mengetahui konsep partisipasi publik dalam perizinan lingkungan dan implikasi UU Cipta terhadap peranan partisipasi publik dalam proses Amdal. Penelitian ini menggunakan metode yuridis normatif berupa analisis terhadap asas, kaidah, dan ketentuan peraturan perundang-undangan, juga disertai dengan pendekatan yang relevan. Hasil penelitian menunjukkan bahwa terdapat 3 (tiga) bentuk pembatasan partisipasi publik dalam proses Amdal pasca UU Cipta Kerja. Pertama, pembatasan pada tahap penyusunan yang hanya melibatkan masyarakat terdampak langsung. Kedua, pembatasan unsur masyarakat di dalam Tim Uji Kelayakan Lingkungan. Ketiga, pembatasan akibat dihapusnya ketentuan upaya keberatan. Dimana ketiga bentuk pembatasan ini yang pada akhirnya berpengaruh terhadap tereduksinya aspek perlindungan lingkungan hidup. Abstract

The Radio Frequency Spectrum is a limited Natural Resource, which in terms of its management has a strategic and economic impact on the community. These limitations require the government to make quite strict regulations in the utilization of these resources. Indonesia is one of the countries that uses frequency as the consumption of daily life. This is illustrated using communication tools for the telephone network. To avoid using license frequencies, Indonesia must adjust without national and international frequency rules, considering that Indonesia is already a member of the ITU. This situation has been realized through Law no. 24 of 2015 concerning the Table of Allocation of the Indonesian Radio Frequency Spectrum, which states that the frequency allocation in Indonesia refers to the ITU-Radio Regulations. Indonesia is currently in a state of urgency for cyber security or cyber security because of the level of cybercrime or cybercrime in Indonesia. Policy handling cybercrime is different from other crime prevention. However, unlike other crime prevention, cybersecurity requires a comprehensive thought to deal with it. Therefore, the study found two problems: (1) What are the provisions for the use of frequencies in Indonesia, (2) What are the provisions regarding the existence of cyberwarfare, and (3) How are the impacts of cyberwarfare on the frequencies of Indonesian cellular operators based on international information technology law?.
