Abstract

Recently, the public was shocked by the news of a data breach involving 240 million entries from the permanent voter list. This data was leaked from the official website of the General Elections Commission of the Republic of Indonesia by a hacker using the pseudonym “Jimbo”. The data was sold online on BreachForums for USD 74,000. This incident has raised serious concerns among the public due to its broad potential impact on the confidentiality of citizens' personal information and has prompted new questions regarding the accountability of the General Elections Commission of the Republic of Indonesia as the election organizer. In this research, the researcher employs a normative juridical approach by reviewing secondary data collected through library research and using a case and regulatory approach. Based on the research findings, the protection of personal data by the General Elections Commission of the Republic of Indonesia is not yet optimal, as the regulations held by the General Elections Commission of the Republic of Indonesia are only internally applicable and do not have the legal strength equivalent to laws. These the General Elections Commission of the Republic of Indonesia regulations are only applicable to regional head elections and general elections. Furthermore, it is necessary to enhance literacy on the importance of data so that all members of the General Elections Commission of the Republic of Indonesia understand the mechanisms of data processing, inputting, and processing. The General Elections Commission of the Republic of Indonesia members must determine the types of data that can be published and those that should not be exposed to the public, thus enabling the General Elections Commission of the Republic of Indonesia to fulfill its obligations to protect and be accountable for the data obtained from the public.

Abstract

Issues related to employment seem to have become an issue that is always hotly discussed, especially related to the widespread phenomenon of unilateral termination of employment by employers who then invited the author to discuss the decision 76/Pdt.Sus-PHI/2023/PN Jkt Pst, where PKWTT workers did not receive their wages at all from September 2016 to February 2021 and were terminated without official information. This issue is interesting to discuss, especially regarding the form of protection for PKWTT who experience Termination of Employment Relations and reflecting this with the judge's consideration of the a quo decision in terms of the Employment Law which in its development was revised with the Job Creation Law and gave birth to implementing regulations PP Number 35 of 2021 and PP Number 36 of 2021. In this research, the author uses normative juridical research methods using literature studies and a legal approach. The research results show that PKWTT who experience layoffs are entitled to severance pay, UPMK, and separation pay as well as other benefits required by the government such as THR. PKWTT who feel aggrieved also have the right to submit non-litigation legal remedies as a priority for settlement, then if this is not achieved, they can submit litigation legal remedies. In essence, the judge's considerations in handing down the a quo decision were appropriate in referring to the formulation of severance pay calculations in accordance with applicable regulations. The government needs to aggressively continue to carry out outreach regarding labor regulations and routinely open communication spaces with workers and employers to then adjust existing labor regulations.

Abstract

Peneliti dalam melakukan penelitian dengan judul termaksud, bertujuan untuk menganalisa terkait implementasi di masyarakat tentang perlindungan hukum bagi pembeli lelang yang tidak mendapatkan haknya selain itu tujuan dari penelitian ini juga untuk mengkaji perlindungan hukum apa yang dapat diperoleh bagi pembeli lelang yang tidak mendapatkan haknya tersebut karena adanya intervensi yakni keberatan terhadap lelang tersebut dari pihak ketiga, tentunya dikaji sesuai dengan PMK No. 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang serta dikaitkan dengan kasus yang telah diputus melalui Putusan PTUN Jakarta No. 14/P/FP/2018/PTUN.JKT. Metode yang dipakai dalam penelitian ini adalah metode yuridis normatif dimana penelitian ini mengkaji dan menganalisa aturan hukum yang sifatnya formal dengan pendekatan studi kasus yakni menelaah suatu kasus yang berkaitan dengan isu hukum yang telah memiliki kekuatan hukum yang tetap. Selanjutnya hasil pembahasan dalam penelitian ini yang pertama bahwa implementasi di masyarakat terhadap risalah lelang yang mana bersifat otentik dan memiliki kekuatan hukum bagi pembeli lelang nyatanya penjual lelang dapat melanggar hak pemenang lelang yang telah mendapat risalah lelang namun tidak memperoleh objek lelang dan juga penjual lelang tidak mematuhi putusan PTUN majelis hakim dan juga melanggar ketentuan yang telah diatur dalam PMK, oleh sebab itu perlu adanya perlindungan hukum bagi pembeli lelang yang tidak mendapatkan haknya karena menurut yurisprudensi dan dikaitkan oleh bentuk perjanjian jual-beli maka pembeli yang membeli suatu barang melalui pelelangan umum maka pembeli tersebut merupakan pembeli beritikad baik dan wajib mendapatkan perlindungan hukum karena hak-haknya telah dijamin oleh negara. The aim of this research is to analyze the implementation in society regarding legal protection for auction buyers who do not receive their rights. Apart from that, the aim of this research is also to examine what legal protection can be obtained for auction buyers who do not receive their rights due to intervention, namely objections to the auction from third parties. Of course it is reviewed in accordance with the PMK. 27/PMK.06/2016 concerning Instructions for Implementing Auctions and related to cases that have been decided through Jakarta PTUN Decision Number 14/P/FP/2018/PTUN.JKT. The method used in this research is the normative juridical method, namely reviewing and analyzing formal legal rules using a case study approach, by examining a case related to a legal issue that has permanent legal force. Furthermore, the results of the first discussion in this research are the implementation of auction minutes in the community that are authentic and have legal force for auction buyers. It turns out that auction sellers can violate the rights of auction winners who receive the minutes of auction but did not obtain the auction object and also the auction seller did not comply the minutes of auction. The decision of the PTUN panel of judges also violates the provisions regulated in the PMK, therefore there is a need for legal protection for auction buyers who do not get their rights because according to jurisprudence and related to the form of sale and purchase agreement, a buyer who buys an item through a public auction is a buyer who have good intentions and must receive legal protection because their rights are guaranteed by the state.

Abstract

Every five years, Indonesia holds General Elections that are held directly, generally, freely, secretly, honestly, fairly, or commonly known as Luber Jurdil. In the principle of ethics, in politics related to morals, the politics of a country if followed by ethics then a prosperous, just and prosperous nation will be achieved. At this time, campaigns are still widely used to invite commotion by spreading hoaxes. The president has an obligation to maintain neutrality. The president has an obligation to maintain his neutrality during the election campaign. Yesterday's campaign, the President was accused of carrying out a campaign that skewed towards one of the candidate pairs. In this study, juridical normative research was used to see issues related to campaign ethics for the President. When viewed from the context of democracy, the President has the right and freedom as a citizen to participate in the political process, including in election campaigns. As someone who is subject to the rules, the existence of rules regarding the President's right to campaign during the election period, the President must also maintain ethics and moral values outside of the existing legal rules.
