Abstract

Dalam perspektif ketenagakerjaan, iklim berusaha yang kondusif adalah suatu kondisi hubungan kerja yang harmonis di perusahaan dimana pengusaha dan serikat pekerja/buruh bekerja sama atas dasar saling menghormati dan saling memahami kepentingan masing-masing, secara optimal mengedepankan dialog dan musyawarah untuk mencapai mufakat dalam mengatasi perbedaan pendapat dan kepentingan, tidak memaksakan kehendak dengan cara-cara yang melanggar peraturan perundang-undangan untuk mencapai tujuan yang dikehendaki, tidak berprasangka negatif atau buruk terhadap mitra kerjanya. Untuk dapat menciptakan iklim berusaha yang kondusif sebagaimana diuraikan, diperlukan beberapa hal yang pengusaha dan serikat pekerja/serikat buruh sebagai para pihak pelaku hubungan kerja dalam proses produksi barang dan jasa di tempat kerja harus bersedia dan mampu melaksanakan hal-hal yang Menunjukkan dan melaksanakan sikap kemitraan dalam kegiatan hubungan kerja. Oleh karena itu untuk mencapai keharmonisan dalam menjalin Hubungan kerja sebagaimana yang diuraikan tersebut, tentunya Para pihak ( Pekerja dan Pengusaha ) harus memiliki pemahaman tentang peranan dan tanggung jawab masing-masing dalam menyelenggarakan hubungan kerja.

Abstract

This study aims to determine the legal considerations used by the judge in Determination Number 135/Pdt.P/2021/PA.Sub in granting the petition for wali adhal (the guardian who refuses to marry off his daughter), and the legal consequences of the guardian adhal determination. This research uses the normative method. The data analysis technique used in this research is qualitative data analysis. The results of this study showed that one of the judges' basic considerations in determining wali adhal was the refusal of the wali nasab (the guardian who has blood relation) to marry off the applicant with his prospective husband not based on law. The legal consequences arising from the wali adhal determination were the transfer of guardianship from the wali nasab to the guardian judge, namely the District Religious Affairs Office official as marriage registrar in their area.

Abstract

This research aims are to know how is the form of legal protection for Indonesian migrant workers in the pre-placement time according to the government regulation Number 59 of 2021, and also to know tasks and responsibilities of central and local government in the protection Indonesian migrant worker. This work was normative legal research in which the data were analyzed qualitatively. Result of this study shows that Indonesian government has been conducting all efforts to protect the migrant worker, one of them are protecting them in the pre-placement time, also it is tasks and duties of central and local government.

Abstract

Efforts to provide legal protection for workers/labourers in an employment relationship are a follow-up to the enforcement of human rights. The acknowledgment of equality before the law between employers and workers/labourers is a juridical consequence of the meaning contained in Article 27 of the 1945 Constitution, so Iman Soepomo (1985: 7) wrote, "that juridically the relationship between workers and employers in carrying out work relations have the same position, in the sense that they can exercise freely. This unequal position between workers/ laborers and employers often creates conflicts, employers provide/issue policies or regulations which according to their considerations are good and accepted by workers/laborers. However, sometimes workers/laborers have different views from employers, so the result is predictable, it will lead to conflicts or disputes; which is in the Act. No. 13 of 2003 concerning Manpower is called the Industrial Relations Dispute. With this, research will be conducted on what are the factors that underlie the disputing parties in choosing the pattern of compulsory dispute resolution as an option in resolving industrial relations disputes. So to find out the factors that underlie the disputing parties in determining the pattern or method of compulsory settlement as a way of resolving their industrial relations disputes.

Abstract

Perdagangan orang merupakan kejahatan kemanusiaan tumbuh kembang sejalan dengan pertumbuhan kebudayaan manusia.Praktek-praktek perdaganagn orang khususnya perempuan dan anak kian marak dalam berbagai bentuk baik berupa penempatan TKI/TKW di Luar Negeri, eksploitasi seks komersial, kerja paksa, pengatin pesanan, pelacuran yang terorganisir, penjualan bayi dan penjualan organ tubuh. Persoalan perdagangan orang saat ini sangat penting mengingat korban perdagangan orang semakin meningkat dan korban seringkali tidak bisa mengakses hak-haknya baik secara sosial maupun secara hukum karena kasus perdagangan orang di daerah khususnya Propinsi Nusa Tenggara Barat dalam proses hukum pelaku ( trficker) dibebaskan walaupun telah terbukti pelaku melakukan TPPO. Hal ini menimbulkan dampak yang sangat signifikan dalam masyarakat yaitu korban akan terus bertambah karena seolah-olah tidak mudah menjerat pelaku perdagangan orang .

Abstract

This study aims to determine the rights of workers who experience termination of employment based on Government Regulation No. 35 of 2021 concerning certain time work agreements, outsourcing, work and rest periods, and termination of employment. This research uses normative legal research by using approach methods, namely; Legislation approach method, conceptual approach and Historical approach. The analysis of legal materials obtained is in accordance with the above data collection techniques, then the collected data is then processed and analyzed qualitatively. The results of the research and discussion conclude that the regulation regarding the process of termination of employment as regulated in Articles 37,38 and 39 as well as the rights of workers obtained in the event of termination of employment are contained in Articles 40 to 59 of Government Regulation Number 35 of 2021 concerning work agreement for a certain time, outsourcing, working time and rest time, and termination of employment.

Abstract

This study aims is to know and to analyze debt agreement legal concept in the view of KUHPerdata and Islamic Law, and how is the concept of debt agreement by using Shopeepaylater in Shoppe app according to KUHPerdata and Islamic Law. This research applied normative legal research and statute and comparative approaches. result of this study shows that, according to KUHPerdata, credit agreement on the using shopeepaylater has been comply with all legal requirements in the KUHPedata and related law sources such as implementing regulations from Shopee paylater, thus in the perspective of KUHPerdata shopee paylater agreement is legit. However, in the perspective of Islamic Law shopeepay later is not valid because it is violates the sharia principle, which is it has usury element with 2,95% of interest and every added value which agreed in the agreement conclusion or contract, then it is usury or “riba”, thus shopee pay later in the perspective of Islamic Law is invalid.

Abstract

This research has the purpose to find out the legal relations between the parties like guarantor (bank) and insured (customer) through telemarketing offering bank insurance to the customers. This bank insurance is an agreement to give rights and duties to the parties. The type of this research is normative-empirical legal research which uses the statute approach, the conceptual approach, and the sociological approach. Based on the result of this field study, the study showed that there are problems like the bank not clearly explaining the insurance products when they offered to the customers. The legal protection for the bank customers regulated in Act Number 8 of 1999 concerning Consumer Protection and Financial Services Authority Regulation Number 23/POJK.05/2015 concerning Insurance Product and Insurance Product Marketing.

Abstract

Undang Undang Dasar 1945, Pasal 27 ayat (2) menetapkan bahwa, “tiap-tiap warganegara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan”. Guna mewujudkan ketentuan pasal tersebut maka Pemerintah mengeluarkan UU. Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI). Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI), pada intinya mengatur tentang bagaimana cara bekerja di Luar Negeri yang baik atau sesuai dengan ketentuan peraturan perundang-undangan. Dalam rangka memasyarakatkan tentang bagaimana prosedur bekerja yang baik di luar Negeri sebagaimana diatur dalam Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (PPMI) di atas Tim Penyuluh Fakultas Hukum Universitas Mataram dengan Surat Tugas No. 3340/UN18.F3/PP/2021 tanggal 5 Juli 2021 melakukan penyuluhan di Desa Kekeri, Kecamatan Gunungsari, Kabupaten Lombok Barat, tanggal 9 September 2021. Penyuluhan dilakukan dengan tatap muka secara langsung dengan para audience yang terdiri dari para pemuda, tokoh masyarakat dan aparat Kampung dan desa.

Abstract

This study aims to determine the employer's responsibility for the safety of the home wi-fi installation workforce and the factors that affect the safety of the home wi-fi installation workforce. The type of research used is normative-empirical law with the approach method used by legislation (statute approach), conceptual approach (conceptual approach) and Sociological Approach (Social Approach). The results showed The responsibility of the entrepreneur PT. Netzen Media Access, PT. Icomnets Plus, and PT. Media Facilities Data on labor safety, namely, First Aid and BPJS Employment. Factors that affect workers can be internal factors, caused by human error and external factors caused by the work environment and weather.
