Abstract

Kelemahan regulasi pertanggungjawaban pidana korporasi akan mempengaruhi proses penegakan hukum kepada korporasi sebagai subjek hukum pelaku tindak pidana. Oleh karena itu, pilihan kebijakan hukum pidana untuk formulasi pertanggungjawaban pidana korporasi sangat penting.

Abstract

Legal protection, especially against the alleged criminalization policies, which apply to policy makers and implementers, should be explicitly included in the legislation, as an excuse criminal eraser, ie eliminate unlawful nature (justification). However, its implementation should be done with reference also to some general principles of state governance, namely: the principle of legal certainty, is a principle in law that gave priority to state the basis of legislation, decency and fairness in every policy of state officials, the principle of Orderly Operation of the State, is a principle that to order, harmony, and balance in the control of the state organization, the principle of public interest, is the principle of priority to public welfare by aspirational, accommodative and selective, the principle of openness, is the principle of opening up to the right of people to obtain correct, honest and not discriminatory on the administration of the state with due regard to protection of personal rights, class and state secrets, the principle of proportionality, is a principle that prioritizes a balance betweenrights and obligations of the state, the principle of professionalism, expertise is a principle that prioritizes based code of ethics and rules of law and regulations, and principles akuntabililas, is a principle which determines that each activity and the end result of the activities of stateadministration must be accountable to the community or the people as the supreme sovereign state in accordance with the provisions of the legislation in force, also refers to the principles unwritten law which is the propriety of living in society. Abstract

Satjipto Rahardjo (lahir di Banyumas, 15 Februari 1930, meninggal di Semarang, 9 Januari 2010 pada umur 79 tahun) adalah seorang tokoh hukum Indonesia. Buku karya Satjipto Rahardjo yang berjudul Ilmu Hukum (Bandung: PT. Citra Aditya Bakti, 2014), telah dicetak tidak kurang dari 8 (delapan) kali. Pertama kali diterbitkan pada tahun 1982, selanjutnya di tahun 1986, 1991, 1996, 2000, 2006, 2012 dan 2014. Dalam kata pengantar cetakan kedelapan disebutkan rupa-rupanya buku ini cukup banyak dikonsumsi oleh berbagai Fakultas Hukum di Indonesia. terbukti dengan terbitan 1.500 eksemplar pada tahun 2012, ternyata pada tahun 2014 awal buku ini harus dicetak lagi.Sedikit catatan tentang Satjipto yaitu menamatkan pendidikan pada Fakultas Hukum Universitas Indonesia, Jakarta, pada tahun 1960 dan kemudian meraih gelar Doktor Ilmu Hukum di Universitas Diponegoro, Semarang, pada tahun 1979, dengan judul disertasi “Hukum dan Perubahan Sosial”. Guru Besar dalam Sosiologi Hukum pada Fakultas Hukum, Universitas Diponegoro, Semarang. Selanjutnya ada sebutan Tjip, (kata Tjip lahir sejak tahun 2008. Yaitu dilatarbelakangi berdirinya kelompok diskusi hukum progresif bersama “Kaum Tjipian”, berasal dari kata panggilan Satjipto, mengutip tradisi Hegelian, Marxian, Aristotelian, dst. Pada tahun 2011 telah dideklarasikan sebuah lembaga nonprofit bernama “Satjipto Rahardjo Institute”).Buku ini muncul ini dilatar-belakangi kekosongan buku pegangan mata kuliah yang disebut “Pengantar Ilmu Hukum” untuk mahasiswa yang ditulis dalam bahasa Indonesia, selain itu kebanyakan fakultas-fakultas hukum di Indonesia pada waktu yang lalu secara “tradisional” memakai buku Apeldoorn, yang menurut Satjipto banyak fakultas hukum yang sudah tidak lagi meng-gunakan buku tersebut. Buku tersebut, yang notabene adalah buku pengantar untuk mempelajari hukum Belanda, kurang memberikan informasi yang sesuai dengan tingkat perkembangan pengetahuan tentang hukum dewasa ini.

Abstract

The Criminal Code (KUHP) which currently applies does not recognize corporations as the subject of criminal acts. Therefore, the formulation/legislation policy concerning corporate criminal liability system in Indonesia is only regulated in various specific criminal laws (lex specialis). This research discusses the formulation/legislation policy regarding the corporate criminal liability system in 124 special criminal legislations outside the Criminal Code (KUHP) from 1950-2017. This research used a normative juridical research method as well as interpretation method with a policy-oriented approach. Types and sources of data used were secondary data in the form of primary, secondary, and tertiary legal materials. The collected data were then analyzed based on qualitative analysis method. The results of the research showed that the corporate criminal liability system in legal politics in Indonesia (especially in the formulation/legislation policy) still experiences disorientation and disharmonious. Besides, the national law development should follow every development and/or change of society that is developing in the direction of modernization and globalization and should be able to accommodate all society’s needs in various fields. This legal development should be continuously carried out (as a dynamic and an endless process) by "improving (making things better)" and "changing the law to be better and modern".Kitab Undang-Undang Hukum Pidana (KUHP) yang saat ini berlaku tidak mengakui korporasi sebagai subjek tindak pidana.Oleh karenanya, kebijakan formulasi/legislasi mengenai sistem pertanggungjawaban pidana korporasi di Indonesia hanya diatur dalam berbagai peraturan perundang-undangan pidana yang bersifat khusus (lex specialis). Penelitian ini akan membahas mengenai kebijakan formulasi/legislasi mengenai sistem pertanggungjawaban pidana korporasi dalam 124 (seratus dua puluh empat) peraturan perundang-undangan pidana khusus di luar Kitab Undang-Undang Hukum Pidana (KUHP) dari tahun 1950-2017. Penelitian ini menggunakan metode penelitian yuridis normatif dan metode interpretasi dengan pendekatan yang berorientasi pada kebijakan (policy oriented approach). Jenis dan sumber data yang dipergunakan adalah data sekunder yang berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Data yang telah terkumpul akan dianalisis berdasarkan metode analisis secara kualitatif. Hasil penelitian menunjukan bahwa sistem pertanggungjawaban pidana korporasi dalam politik hukum di Indonesia (khususnya pada kebijakan formulasi/legislasi) masih mengalami disorientasi dan disharmoni. Selain itu, pembangunan hukum nasional harus mengikuti setiap perkembangan dan/atau perubahan masyarakat yang sedang berkembang ke arah modernisasi dan globalisasi serta mampu menampung semua kebutuhan masyarakat di berbagai bidang. Pembangunan hukum seperti ini harus terus-menerus dilakukan (sebagai proses yang dinamis dan proses yang tidak pernah berakhir) dengan cara “menyempurnakan (membuat sesuatu yang lebih baik)” dan “mengubah agar hukum menjadi lebih baik dan modern”.

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis penerapan business judgment rule dalam perkara tindak pidana korupsi Karen Agustiawan. Penelitian ini bersifat deskriptif dengan jenis yuridis normatif. Pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan (statute approach) dan pendekatan kasus (case approach) dengan menggunakan data sekunder yang dianalisis secara kualitatif. Hasil penelitian ini menunjukkan penerapan doktrin business judgment rule dalam perkara tindak pidana korupsi Karen Agustiawan terjadi pada tingkat pemeriksaan di Mahkamah Agung (judex juris). Dalam pertimbangannya, apa yang dilakukan oleh Karen Agustiawan tidak keluar dari ranah business judgment rule, ditandai dengan tidak adanya kecurangan (fraud), benturan kepentingan (conflict of interest), perbuatan melawan hukum, dan kesalahan yang disengaja.  This study aims to examine and analyze the application of the business judgment rule in the corruption case of Karen Agustiawan. This research is descriptive with normative juridical type. The approach used is the approach laws and regulations (statute approach) and case approach using secondary data which was analyzed qualitatively. The results of this study show the application of the business judgment rule doctrine in the corruption case of Karen Agustiawan occurred at the examination level at the Supreme Court (judex juris). In her judgment, what Karen Agustiawan did was not outside the realm of the business judgment rule, marked by the absence of fraud, conflict of interest, unlawful acts, and intentional mistakes.

Abstract

Biological needs are primary needs for everyone. Likewise, he is an ordinary human being who has the right to biological needs, which requires more attention from the government in terms of regulations or policies that regulate the needs of a biologist.The first problem is regarding government policies related to prisoners’ sexual needs. The second one is the fulfilment of sexual needs in the perspective of the aim of punishment. This research method uses a normative juridical method, namely by analyzing the data qualitatively, meaning that the data obtained which leads to a theoretical study in the form of principles, legal doctrines and the contents of legal rules are first described systematically. This policy regarding imprisonment is still the alternative that is most often applied by law enforcers, which results in correctional institutions becoming over-capacity/overcrowded so that the sentencing process is not optimal, one of which is regarding the fulfillment of biological rights and creates a sense of lack of justice in it, in order to achieve a social policies, criminal policies, and law enforcement policies that are optimal and just, must be oriented to the aspired values. So the policy needs synergy between law enforcement officials and the community, for the sake of realizing justice.
