Abstract

This writing aims to  find out the precautionary principle in granting credit to the NTT BANK and find out the efforts made by the NTT BANK in legal settlement in the event of default if the debtor has passed away. This research was carried out at NTT BANK Oebobo Branch. The type of research in the preparation of this thesis is empirical. The population studied is the settlement of bad debts due to default for debtors. Data sources in this study consisted of primary data and secondary data. Data collection techniques were carried out using library research and interviews. The data analysis method used is qualitative. The results of this study are The precautionary principle in extending credit to NTT BANK is when credit applications, credit analysis, credit decisions, credit realization and credit development, while the efforts in legal settlement in the event of default if the debtor has passed away are restructuring, attempts to collect by way of a warning letter or subpoena and auction of mortgage rights through the Office of State Property Services and Auctions.               Not all creditors can return credit as promised in the contract. To guarantee the creditor's trust in paying off credit by the debtor, a collateral object is needed. Regarding collateral objects, immovable property is bound with Mortgage Guarantee institutions. But there are often problems in executing collateral objects. Normative legal research that discusses doctrinal law uses the statutory and concept approaches. This study aims to find the most effective way to carry out executions that benefit both parties. Execution of collateral can be done through public auctions or underhanded execution. Execution of Credit Collateral which is burdened with Under Right Handling Rights is one of the alternatives that is considered easier and must take precedence.

Abstract

The practice of investing using stock instruments often occurs the practice of frying stocks, which means manipulating the price of a stock that is actually illiquid so that it jumps above normal. This practice of frying stocks is carried out by market participants with the aim of certain interests. Market manipulation itself is a practice carried out by one and/or several parties to create a false stock market price, with the aim of making a profit. This research uses normative juridical research, namely by examining statutory products related to what the researcher wants to examine. Preventive protection is legal protection that is carried out with the aim of preventing fraudulent practices in the Capital Market that can lead to losses for investors, while repressive legal protection is when there are problems between financial service providers and their consumers, Bapenam-LK or OJK has the authority to provide defense or legal protection for the public as consumers, in this case investors. The preventive action also carried out by Bapenam-LK is to regulate that the securities prospectus is prohibited from containing misleading content or untrue information about material facts or presenting information about the advantages or disadvantages of the securities offered. The practice of stock frying is illegal and violates market regulations.

Abstract

This study aims to study the operational security standards of bank services that can result in losses for customers and bank responsibilities related to customer losses for loss of customer money stored in bank accounts. The method used is a type of normative research using a statutory approach, especially banking regulations. Studies show that a standard bank security system that is less than optimal allows for skimming, phishing, system errors, or human errors that can be detrimental to depositors. Regulatory protection for savers with regard to using their savings in bank accounts can refer to the Consumer Protection Act, BI Regulation No. 16/1/PBI/2014 concerning protection of Consumers of Payment System Services and OJK Regulation number 1/POJK.07/2013 concerning protection of Consumers of the Financial Services Sector, and Article 1365 of the Civil Code. The Bank must be responsible for the deposit customer in the event that the customer's losses are incurred by the Bank. Settlement of customer loss disputes can be reached through two processes, namely the trial mechanism (litigation) and procedures outside the court (non-litigation). Legal protection for bank customers in terms of Law No. 8 of 1999 concerning consumer protection is a guarantee of legal certainty provided by banks to customers because basically this law protects consumers, including customers in general. In accordance with the consumer protection law, banks as business actors are obliged to serve customers correctly and honestly and provide true, clear and honest information regarding the conditions and guarantees of the services provided.

Abstract

Penelitian ini bertujuan untuk tinjauan yuridis terhadap transaksi perbankan melalui internet banking di Indonesia. Jenis penelitian yang dilakukan adalah penelitian yuridis normatif. Sifat penelitian dalam penelitian ini adalah bersifat deskriptif analitis. Jenis data yang digunakan dalam penelitian ini adalah penelitian kepustakaan (library research). Berdasarkan hasil penelitian ditemukan bahwa penyelesaian sengketa perlindungan hukum terhadap transaksi bank (nasabah) pengguna layanan internet banking yang diberikan oleh pihak bank dari segi keamanan teknologi sudah maksimal dan juga memenuhi aspek-aspek confidentially, integrity, authentication, availability, access control, dan nonrepudiation. Sedangkan perlindungan dari segi hukum yang paling efektif yaitu yang terdapat pada "syarat dan ketentuan internet banking", karena di dalam syarat dan ketentuan tersebut mengandung unsur hak dan kewajiban para pihak, khususnya pihak bank dan pihak nasabah. Penyelesaian sengketa terhadap permasalahan hukum yang timbul dapat ditempuh melalui pengadilan atau diluar Pengadilan, berdasarkan pilihan sukarela para pihak yang bersengketa. Dijelaskan dalam Pasal 45 ayat (1) Undang-Undang Perlindungan Konsumen, bahwa penyelesaian sengketa melalui Pengadilan dikatakan menjadi wewenang dari Peradilan Umum, sedangkan untuk penyelesaian sengketa diluar peradilan menjadi wewenang Lembaga yang bertugas menyelesaikan sengketa Konsumen. Pengaturan hukum transaksi perbankan melalui internet banking diatur dalam beberapa peraturan perundang- undangkan, seperti dalam Undang-Undang Nomor 10 thaun 1998 tentang perbankan menetapkan dan memberikan perlindungan hukum atas data pribadi nasabah dalam penyelenggaraan layanan internet banking.
