Abstract

Pengabdian ini bertujuan: (i) melakukan sosialisasi pentingnya mengetahui bentuk-bentuk kekerasan dalam rumah tangga (ii) memberikan penjelasan tentang pentingnya mengetahui bentuk-bentuk kekerasan dalam rumah tangga sehingga dapat mencegah terjadinya kekerasan dalam rumah tangga. Tindakan kekerasan dalam suatu hubungan nyatanya bukan hanya melanda pasangan yang sudah menikah saja yang lebih dikenal dengan istilah KDRT (Kekerasan Dalam Rumah Tangga). Kekerasan rumah tangga yang kadang -kadang disebut juga sebagai kekerasan keluarga merupakan kekerasan antar pribadi, termasuk perilaku dan tindakan agresif antara anggota keluarga dan itu mungkin terjadi antara pasangan, anak-anak, orang tua, saudara perempuan atau saudara laki laki. Kekerasan ini biasanya terjadi pada perempuan. Tujuan pengabdian ini ialah (i) untuk memberikan penguatan tentang bentuk-bentuk kekerasan dalam rumah tangga (ii) memberikan pengenalan dan Pemahaman kepada ibu-ibu PKK Desa Bijaepasu. Hasil dari pengabdian ini, ibu-ibu PKK Desa Bijaepasu mengenal bentuk-bentuk kekerasan dalam rumah tangga. Jumlah yang mengikuti kegiatan ini terdiri dari 100 orang. Pentingnya pengabdian ini dilakukan untuk mencegah adanya kekerasan dalam rumah tangga di Desa Bijaepasu.

Abstract

Indeks Perilaku Anti Korupsi (IPAK) Indonesia 2022 sebesar 3,93 pada skala 0 sampai 5, meningkat sebesar 0,09 poin dibanding tahun 2021. Namun kenaikan ini masih belum bisa diapresiasi karena IPK di bawah 50 menunjukan Indonesia masih rawan korupsi. Agar pemberantasan korupsi di Indonesia semakin masif dan intensif, maka seluruh elemen masyarakat di Indonesia harus mengambil peran dalam pemberantasan korupsi, tidak terkecuali siswa sekolah menengah pertama. Siswa sekolah menengah pertama dapat mengambil peran melalui penerapan nilai-nilai anti korupsi sebagai upaya membangun integritas diri. Tujuan kegiatan pengabdian ini adalah menumbuhkan nilai-nilai Anti Korupsi pada siswa sekolah menengah pertama dengan cara sosialisasi nilai-nilai Anti Korupsi. Dalam pelaksanaannya dilakukan dengan melalui pembelajaran dengan media video mapun diagram pohon. Metode ini digunakan agar pemahaman akan nilai-nilai Anti Korupsi sejak dini lebih dipahami dan diterapkan nilai-nilai Anti Korupsi seperti jujur, bertanggung jawab, disiplin dan adil. Hasil pengabdian menunjukan bahwa ada peningkatan pemahaman nilai-nilai anti korupsi pada siswa sekolah menengah pertama.

Abstract

PT Timor Tour & Travel is one of the travel agency business actors that provides services for transportation services that are responsible for service passengers if things happen that are detrimental to passengers due to negligence committed by the company. In Indonesia itself, Law Number 22 of 2009 concerning Highway Traffic and Transportation has been in force which regulates the responsibilities of business actors in carrying out their business activities. Responsibilities need to be considered because it raises questions about who should be burdened with guilt and to what extent this accountability burden it. So because of that the authors conducted research with the title Responsibilities of PT Timor Tour & Travel Kupang agents for passengers of travel user services. This study aims to identify and explain the implementation of the responsibilities of PT. Timor Tour & Travel Kupang Agent for users of travel services and obstacles from PT. Timor Tour & Travel Agent Kupang in carrying out duties. The approach used is a statutory and contextual approach. The population in this study are managers of PT. Timor Tour & Travel, drivers and users of travel services. The analysis technique used is descriptive qualitative. The results of the research show that the implementation of PT. Timor Travel loads passengers at their destination comfortably and is also happy to be responsible for compensating passengers for user services according to applicable regulations, namely Law NO. 22 of 2009 concerning Highway Traffic and Transportation and the principle of responsibility based on presumption, but the implementation in the field has not been in accordance with the facts and looks more at evidence of losses suffered by passengers. Obstacles in accountability can be seen from poor communication in resolving problems between the PT and the passenger, with the rules made by the PT that do not pay much attention to the losses suffered by the passengers. The conclusion of this study is the implementation of responsibilities in general and compensating for players who are harmed by the company, but the company sees more written evidence of losses suffered by passengers. can solve existing problems. The advice given by the author is that in carrying out the responsibilities of the company, it must carry out according to the rules contained in the UULLJR and the principle of responsibility based on presumption with the burden of proof being reversed. and The troubled parties as well as PT or passengers should have good communication to be able to resolve existing problems. So that there are no obstacles in the implementation of responsibilities.

Abstract

This writing aims to  find out the precautionary principle in granting credit to the NTT BANK and find out the efforts made by the NTT BANK in legal settlement in the event of default if the debtor has passed away. This research was carried out at NTT BANK Oebobo Branch. The type of research in the preparation of this thesis is empirical. The population studied is the settlement of bad debts due to default for debtors. Data sources in this study consisted of primary data and secondary data. Data collection techniques were carried out using library research and interviews. The data analysis method used is qualitative. The results of this study are The precautionary principle in extending credit to NTT BANK is when credit applications, credit analysis, credit decisions, credit realization and credit development, while the efforts in legal settlement in the event of default if the debtor has passed away are restructuring, attempts to collect by way of a warning letter or subpoena and auction of mortgage rights through the Office of State Property Services and Auctions.               Not all creditors can return credit as promised in the contract. To guarantee the creditor's trust in paying off credit by the debtor, a collateral object is needed. Regarding collateral objects, immovable property is bound with Mortgage Guarantee institutions. But there are often problems in executing collateral objects. Normative legal research that discusses doctrinal law uses the statutory and concept approaches. This study aims to find the most effective way to carry out executions that benefit both parties. Execution of collateral can be done through public auctions or underhanded execution. Execution of Credit Collateral which is burdened with Under Right Handling Rights is one of the alternatives that is considered easier and must take precedence.

Abstract

In the current Indonesian society, examples of parties that provide services to transport or deliver goods are JNE, J&T, TIKI, Ninja Expres, Pos Indonesia and many more parties engaged in this field. In matters of implementation related to the performance of the transport agent (JNE) there are various provisions that regulate how the work procedures of the transport agent, namely JNE in these provisions the service users or consumers are also given various forms of compensation or in the form of liability to service users. The purpose of this research is to find out who or which parties are engaged or provide services in transportation or delivery and to find out how the work procedures of transportation agents. In this study the method used is normative because the object of research is about how the process of shipping goods by JNE agents, how the form of liability of JNE agents to the sender or recipient, and how the form of agreement between the sender and the transport agent. In the shipping process, it cannot be denied that there is damage to the goods sent through the JNE agent. In this case, there is insurance and compensation for the goods. . Based on these activities, there will be a legal relationship between the two that is binding, namely the so-called rights and obligations. The rights and obligations between service users and service providers (JNE) have been explicitly conveyed at the time of the agreement, where one of the main rights of service users or consumers is to get comfort, security, and safety in consuming goods and services while their obligation is to pay shipping money and the right of service providers is to get paid for shipments that have been made while their obligation is to send goods or files safely to their destination or to the recipient. Based on the research that has been done, the researcher knows about how the types of services and stages of delivery of goods from JNE to the recipient, how the transport agent or the sender of the goods is responsible for damage or negligence if things go wrong and the procedures for agreement between the person or party sending the goods with the transport agent. From the results of the discussion above, it can be concluded that it is very important to know related to the provisions that should apply in the transportation / delivery activities.

Abstract

Banking credit is one of the conventional bank businesses that has been widely used by members of the public who need funds. Law Number 10 of 1998 concerning Banking states that the main function of Indonesian Banking is as a collection and distribution of public funds aimed at supporting the implementation of national development towards improving the welfare of many people. We know two types of credit guarantee rights in practice in the community, namely individual credit guarantee rights (personal guarantee), which is a guarantee of a third party who acts to guarantee the fulfillment of debtor obligations. The research method that the author uses is an empirical juridical research method. 'This research uses a problem approach, a statutory approach (Statute-Approach) and a concept approach (conceptual approach). The data source that the author uses is primary data by means of field research (Field Research) located at Bank NTT.

Abstract

Indonesia is a Maritime Country, where Indonesia's seas are wider than its land. Therefore, it is certain that there will be modes of transportation as facilities and infrastructure to support the movement of people. Therefore, the problem in this journal is how to organize the transportation of passengers in sea transportation, forms of protection and also make the existing regulations effective, namely Law No. 17 of 2008 concerning shipping for the safety of sea transportation passengers in this case conducting research on PT. ASDP Kupang Bolok Ferry Branch.The research method used in this study is normative juridical research, because this research originates from positive law by looking at its relevance in its application in society, then the data obtained is analyzed qualitatively. Normative qualitative, namely the data obtained after being systematically arranged to be analyzed qualitatively normatively in the form of descriptions, so that conclusions can be drawn to achieve clarity regarding the issues to be studied. The results of the literature will be used to analyze the data, then the data will be analyzed qualitatively normatively to answer the problems in this journal.The main conclusion that can be drawn from the writing of this journal is that with the promulgation of Law No. 17 of 2008, it has also regulated how legal protection for users of sea transportation services, which expressly prohibits carriers from being responsible at all or limited to losses incurred caused by the means of transportation, proof of the existence of a transportation agreement is a passenger ticket. As for the suggestion in writing this journal is to increase its ability to support its obligations as the executor of transportation, the carrier together with the community and the government must work together to realize this.

Abstract

Perkembangan teknologi dan perdagangan yang telah membawa suatu perubahan, adalah kebutuhan masyarakat atas suatu alat pembayaran yang dapat memenuhi kecepatan, ketepatan, dan keamanan dalam setiap transaksi elektronik. Untuk menyesuaikan perkembangan transaksi dengan kebutuhan masyarakat terhadapnya, maka akhir-akhir ini sistem pembayaran cashless atau e-money semakin digalakan di berbagai daerah di Indonesia. Metode yang digunakan dalam penulisan makalah ini adalah yuridis-empiris. Dalam UU Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen Pasal 4 huruf (d) menjelaskan bahwa, “hak untuk didengar pendapat dan keluhannya atas barang dan/atau jasa yang digunakan.” Pada kenyataannya keluhan, pendapat, dan saran para konsumen dalam hal ini para calon penumpang tidak ditanggapi dengan baik oleh pihak ASDP. Selanjutnya, UU Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen Pasal 4 huruf (g), menjelaskan bahwa “hak untuk diperlakukan atau dilayani secara benar dan jujur serta tidak diskriminatif.” Sebelum diterapkannya metode E-Money pada sistem jual beli tiket kapal pada ASDP Kupang, masalah seperti penumpukan antrian, penumpang gelap, penumpang prioritas dan pungutan liar (pungli) memang sudah menjadi masalah lumrah, sehingga cobalah metode E-Money ini diterapkan. Penerapan prosedur pelayanan yang baik dimana para calon penumpang diharuskan membeli e-tiket sebagai syarat untuk dapat menggunakan jasa penyeberangan oleh jasa ASDP, hal ini penting untuk memudahkan proses administrasi terkait keselamatan penumpang itu sendiri, memudahkan proses pencarian data penumpang dan untuk keperluan lainnya. Waktu yang diperlukan untuk melakukan penyeberangan sudah cukup maksimal, kecuali jika faktor alam seperti musim penghujan, atau angin kencang maka PT ASDP tidak dapat berbuat banyak dalam menanggulangi permasalahan cuaca yang buruk. Harga tiket yang dikeluarkan oleh PT ASDP juga sudah sangat relevan, oleh karena itu wajib bagi PT ASDP menjaga kualitas pelayanan yang diberikan salah satunya ialah dengan mengadakan perawatan rutin yang sudah dilakukan sejak dulu.

Abstract

Pada era ini diperkirakan persaingan di Indonesia akan semakin tajam dalam memperebutkan pasar karena Indonesia merupakan pasar potensial bagi produksi luar negeri. Penelitian ini bertujuan untuk mengetahui bentuk-bentuk perlindungan hukum kepada konsumen terhadap pencantuman komposisi produk pada penandaan kemasan suplemen makanan. penelitian ini menjelaskan Perlindungan Konsumen Terhadap Pencantuman Komposisi Produk Pada Penandaan Kemasan Suplemen Makanan Ditinjau Dari Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, maka tipe penelitian yang digunakan yakni Penelitian Yuridis Normatif. Memproduksi suplemen makanan yang tidak memenuhi standar dan/atau persyaratan dengan menggunakan bahan baku sapi yang tercemar DNA babi. Memproduksi suplemen makanan yang tidak sesuai dengan produk yang didaftarkan di BPOM.

Abstract

Bhanda Ghara Reksa bertanggung jawab atas keselamatan penerima dan penyerahan barang, kebenaran laporan yang disampaikan dan mengatur penggunaan jasa tenaga kerja bongkar muat. Kelancaran arus barang dapat tercapai apabila dalam pelaksanaannya didukung oleh sumber daya manusia yang terampil dan penggunaan peralatan bongkar muat yang memadai. Rumusan masalah dalam penelitian ini yaitu bagaimana tanggung jawab perusahaan bongkar muat terhadap keselamatan barang dalam pelaksanaan perjanjian antara PT. Adhiguna Putera sebagai Costumer dengan PT. Bhanda Ghara Reksa Logistics (Persero) Divre Kupang sebagai Vendor nya, Apa Faktor yang menjadi penghambat dalam pelaksanaan tanggung jawab perusahaan bongkar muat dan Bagaimana cara penanggulangan dalam pelaksanaan bongkar muat. Penelitian ini merupakan penelitian yuridis empiris dengan menggunakan dua metodologi yaitu, pertama metode Interview (Wawancara) yaitu dengan melakukan wawancara langsung kepada pimpinan perusahaan dan karyawan. Kedua metode observasi atau pengamatan dilapangan guna untuk mengumpulkan data dari tempat kegiatan pelaksanaan bongkar muat berlangsung. Hasil Penelitian ini menunjukan bahwa, batas tanggung jawab perusahaan bongkar muat yaitu tercapainya kelancaran dan kegiatan keselamatan bongkar muat barang angkutan, tersedianya peralatan dan perlengkapan untuk kegiatan bongkar muat. Kekurangan dan kerugian yang disebabkan oleh perusahaan akibat kelalaian dari pihak perusahaan maka pihak perusahaan harus menganti kerugian tersebut sesuai kesepakatan yang dilakukan. Hambatan yang muncul pada saat pelaksanaan bongkar muat sangat bervariasi sehigga diperlukan koordinasi para pihak dalam menyelesaikan hambatan yang timbul dan apabila terjadi sengketa dapat diselesaikan dengan cara musyawah dan mufakat. Hambatan yang dihadapi dalam proses bongkar muat diantaranya berupa Faktor Cuaca, Faktor Alat, Faktor Keterlambatan Angkutan Darat (waiting truck), Faktor Kondisi Muatan dan Faktor Keamanan. Perusahaan dapat mempertahankan bahkan meningkatkan kinerja dalam menangani pelaksanaan tanggung jawabnya tentang kerusakan/kekurangan muatan dalam proses bongkar muat.
