Abstract

Ancaman perubahan iklim yang semakin nyata mendorong komunitas global untuk melakukan upaya bersama untuk mencegah dan memeranginya. Penyebab utama terjadinya perubahan iklim adalah emisi gas rumah kaca yang dihasilkan oleh maraknya pembangunan dan industrialisasi di negara-negara maju. Penulisan ini akan membahas mengenai apakah Protokol Kyoto sebagai suatu rezim sudah efektif dalam mencapai tujuannya untuk mengurangi emisi gas rumah kaca dunia. Hasil penulisan ini menunjukkan bahwa meskipun Protokol Kyoto mewakili lambang prestasi diplomatik, namun efektifitasnya rendah, keberhasilannya jauh dari meyakinkan.

Abstract

As one of the international law subjects, international organizations play an important role in the international economy. International economic law does not only discuss the rules of law through international agreements and principles, but also regulates the functions and authorities of international economic organizations that have been recognized as subjects of international law. Among these international organizations are the IMF, World Bank, and the ILO. This article aims to discuss the existence of the IMF, World Bank, and ILO in the field of international economic law. The IMF and World Bank are more engaged in helping countries experience serious economic difficulties, while the ILO is more focused on labor issues.

Abstract

As an international organization, the Association of Southeast Asian Nations (ASEAN) must be responsible for maintaining and maintaining peace and security in Southeast Asia. One exciting development regarding regional security in Southeast Asia today is the issue of the South China Sea dispute. By law, the Philippines has brought the dispute to the Permanent Court of Arbitration (PCA). The verdict from the PCA said that China's claims regarding the nine-dash lines were indisputable and had no legal basis. However, China rejects the ruling and remains aggressive in the South China Sea, potentially creating regional instability. This article aims to look at the role of ASEAN in resolving a dispute that occurs in the South China Sea. This article argues that in dispute in the South China Sea, ASEAN plays a role as an intermediary for countries joined in ASEAN with China in diplomatic dialogue and resolves and ensures the implementation of the Code of Conduct in the South China Sea so that disputes do not extend to military conflict so peace and security in the southern China sea region can be achieved.

Abstract

As the largest archipelagic state in the world, Indonesia has a very wide sea area. Indonesia has a natural resources which are very plentiful. These are certainly advantageous position for Indonesia as the main strength both in the Southeast Asia and Asia Pacific if we capable to exploiting it. Those conditions also can be a boost for the whole layer components of the nation to increase the possessed capability to establish itself as a maritime nation. However the current maritime security in Indonesia still vulnerable due to high levels of violations there. It happens because there are certain parties who enter Indonesia wanting to exploit the national resources illegally. Based on the various problem that often occur, the effort to protect and ensure the security of the country by seas in an absolute must. Authors use juridical normative research method with literature studies. The result of this research shows that Indonesia government’s strong desire to bring Indonesia into a maritime nations which one of the issues is related to the maritime security is by establishing the Indonesia Coast Guard. As for the legal policy formation Indonesia Coast Guard is to synergy the various agencies in securing the Indonesia’s sea because there will not be a sectoral ego either in institutions or governments which is connected so the maritime security will be run effectively.

Abstract

Hak Asasi Manusia (HAM) digunakan dan dimaknai secara berbeda disetiapnegara. Hal ini diawali dari era terjadinya Perang Dingin antara Amerika Serikat dan Uni Soviet. Sebagai dua negara dengan perbedaan ideologi, kedua belah pihak berkompetisi melalui penyebaran ideologi dalam pembentukan hukum HAM internasional. Tulisan ini akan menjelaskan mengenai bagaimana politik hukum ideologi mempengaruhi pembentukan dan penerimaan hukum HAM internasional. Penelitian ini merupakan penelitian yang bersifat yuridis normatif, yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti yang meliputi bahan hukum primer, sekunder, dan tersier yang terkait dengan permasalahan yang diteliti. Hasil penelitian menunjukkan bahwa pertimbangan politik dalam pembentukan hukum HAM internasional sangat dipengaruhi oleh ideology negara-negara, seperti DUHAM yang dapat dikatakan sebagai penyatuan antara konsep liberal (pasal 3 sampai dengan pasal 21) dan konsep sosialis (pasal 22 sampai dengan pasal 27). Perbedaan ideologi ini yang menghadirkan 2 Kovenan terpisah yang ruang lingkupnya berbeda dan proses perancangan kovenan-kovenan tersebut 18 tahun sejak DUHAM diterima.

Abstract

AbstrakSejak tahun 2016, negara-negara yang tergabung dalam ASEAN telah memasuki era baru dengan mulai berlakunya ASEAN Economic Community (AEC). Dalam rangka mewujudkan pasar bersama dan integrasi ekonomi dibuatlah suatu cetak biru yang berfungsi sebagai rencana induk yang koheren. Salah satu elemen yang tercantum dalam cetak biru tersebut adalah aliran bebas investasi. Tulisan ini akan memfokuskan mengenai bagaimana pengaturan hukum di Indonesia terkait kebebasan berinvestasi dalam rangka menghadapi AEC serta terkait juga dengan isu pengharmonisasian hukum mengenai investasi di wilayah ASEAN. Hasil tulisan ini menunjukkan bahwa hadirnya payung hukum dibidang investasi ASEAN yakni ASEAN Comprehensive Investment Agreement (ACIA) memberikan keuntungan bagi lingkungan investasi dan sektor bisnis. Terkait hal investasi, Indonesia sudah mempunyai UU No. 25 Tahun 2007 tentang Penanaman Modal yang telah menggambarkan bahwa Indonesia menerima kegiatan investasi dalam bentuk penanaman modal asing maupun dalam negeri.Kata kunci: Investasi, ASEAN, Harmonisasi hukum AbstractSince 2016, ASEAN countries have entered a new era with the entry into force of the ASEAN Economic Community (AEC). In order to realize a shared market and economic integration, a blueprint has been made. One of the elements listed in the blueprint is the free flow of investment. This paper will focus on how the legal arrangements in Indonesia related to freedom of investment in the context of facing the AEC and also related to the issue of legal harmonizing regarding investment in the ASEAN region. The results of this paper indicate that the presence of a legal framework in the ASEAN investment sector namely the ASEAN Comprehensive Investment Agreement (ACIA) provides benefits for the investment environment and the business sector. Related to investment, Indonesia already has Act No. 25 of 2007 concerning Investment which has illustrated that Indonesia receives investment activities in the form of foreign and domestic investment.Keyword: Investment, ASEAN, legal harmonization

Abstract

Maritime security in Indonesia is still vulnerable because of the high level of violations at sea such as illegal fishing, as well as various threats and other problems. The practice of illegal fishing, which remains a common issue in Indonesian territorial waters has made it difficult for Indonesia to realize itself as a maritime nation. Therefore, the author intends to discuss how are the appropriate efforts to eradicate illegal fishing practices in order to create a sovereign Indonesian state. The type of research used is normative juridical. In addition, this research has an analytical descriptive nature. This research concludes that to maximize the eradication of illegal fishing practices in Indonesia is to strengthen its maritime security system. There are two indicators, namely the optimization of maritime security institutions and strengthening legal products in the form of the Maritime Security Law to be able to realize Indonesia as a maritime country.Keywords: maritime security; illegal fishing; sovereignty AbstrakKeamanan laut di Indonesia masih rawan karena tingginya tingkat pelanggaran di laut seperti penangkapan ikan secara ilegal, serta berbagai ancaman dan permasalahan lain. Praktik penangkapan ikan secara ilegal, yang saat ini masih sering terjadi di wilayah perairan Indonesia membuat keinginan Indonesia untuk mewujudkan diri sebagai negara maritim akan sulit dicapai. Oleh karena itu, penulis bermaksud untuk membahas terkait bagaimana upaya pemberantasan yang tepat terhadap praktik penangkapan ikan secara ilegal guna mewujudkan negara Indonesia yang berdaulat. Jenis penelitian yang digunakan adalah yuridis normatif. Selain itu, penelitian ini memiliki sifat deskriptif analitis. Penelitian ini menyimpulkan bahwa untuk memaksimalkan pemberantasan praktik penangkapan ikan secara ilegal di Indonesia adalah dengan memperkuat sistem keamanan maritimnya. Terdapat dua indikator yakni optimalnya lembaga keamanan maritim dan memperkuat produk hukum dalam bentuk Undang Undang Keamanan Maritim untuk dapat mewujudkan Indonesia sebagai negara maritim.Kata-kata Kunci: Keamanan maritim; penangkapan ikan secara ilegal; kedaulatan

Abstract

The 2019 general elections in Indonesia have been held differently from the previous period. The 2019 general elections held simultaneously five boxes. This article discusses how the implementation of the 2019 general election and how the rather election should be carried out in the future. The author concludes that the implementation of simultaneous general elections in 2019 caused tremendous complexity for participants, voters, and organizers. The complexity and constraints that occur make the selection process not run well and less efficient and effective time spent. Then for the coming period, the elections should be carried out using the design of simultaneous national elections and simultaneous regional elections. In the simultaneous national election, it held to elect the President and Vice President, members of the House of People’s Representative, and members of the Regional Representative Board. Then in the simultaneous regional election, it held to elect the Governor, Regent/ Mayor, Provincial Legislative Council, and Regency/ City Legislative Council.

Abstract

After years of being formed, the Indonesian Constitutional Court is considered to have carried out its duties and functions well. However, if we look further, there are still shortcomings and several things that the Indonesian Constitutional Court has not accommodated in carrying out its duties and functions compared to the German Constitutional Court which is known to the world as one of the Constitutional Courts which is often used as a reference by other countries in the establishment of the Constitutional Court. This article will discuss the differences between Indonesian Constitutional Court and German Constitutional Court which aims to sort out the positive things that can be an improvement material for the Indonesian Constitutional Court to strengthen the Indonesian Constitutional Court. This writing uses a normative writing method with a comparative approach and a historical approach. The results of this study show that there are several arrangements from the German Constitutional Court that can actully be applied by the Indonesian Constitutional Court such as the authority of constitutional complaints and constitutional questions, arrangements regarding the expansion of the applicant party in the application for dissolution of a political party to the Constitutional Court, and regarding the elimination of re-election for a constitutional judge and also about the addition of their term of office.

Abstract

Policy on the Prohibition of the Export of CPO Oil by the Government with the issuance of a moratorium through Minister of Trade Regulation No. 22 of 2022 on April 28, 2022. This moratorium is a form of government protection that prioritizes the interests of the people over the fulfillment of cooking oil needs for domestic purposes. After almost a month of implementing the policy, the government finally reopened the export of CPO and its derivatives starting May 23, 2022. This policy certainly caused problems, especially in the purchase of fresh fruit bunches (FFB) of palm oil. The purpose of this study is to discuss the impact of the policy of banning the export of CPO and its derivative products to oil palm farmers in the Border. The company's unilateral FFB price fixing, the shift of border oil palm farmers selling their FFB and the shifting of CPO demand to competitors from other countries are the inevitable impacts of the CPO export ban. The research method uses descriptive qualitative. Data was collected by observation and in-depth interviews. Withdrawal of informants is done purposely. The data was analyzed using the Miles and Huberman interactive model, which started with data collection, data reduction, data presentation and drawing conclusions. The results show that the impact of the export ban policy is very large on oil palm farmers and requires oil palm farmers to take steps to sell their palm products to Malaysia
