Abstract

Introduction to The Problem: The advancement of Artificial Intelligence (AI) has marked the beginning of an age in digital technology, social economics, human needs, and professional conduct. A previous study shows a significant difference in the level of accuracy between Artificial Intelligence (AI) machines and human advocates in which AI machines turned out to be more accurate than advocates. However, the challenges are related to the inadequacy of laws in responding to the development of AI. Furthermore, Indonesian law enforcement officers lack awareness of the advantages of using AI to support their profession.Purpose/Objective Study: Hence, this study aims to analyze the urgency of implementing AI for law enforcement in providing legal services and the law enforcement process.Design/Methodology/Approach: The method used in this research is normative, empirical research with Statute and Conceptual Approach. Furthermore, the data uses primary and secondary data sources. Primary data was obtained through interviews with law enforcement officials. Meanwhile, secondary data sources are primary and secondary legal materials. Furthermore, it will be analyzed qualitatively and presented descriptively.Findings: Artificial Intelligence (AI) is crucial in assisting in developing services and law enforcement, especially for Indonesian law enforcement, which still relies on manual or conventional means to carry out its duties. Artificial Intelligence (AI) can bring benefits in terms of time efficiency and accuracy in assessing cases urgently needed by law enforcement. In terms of law enforcement's perception of the use of AI, they are placed as assistants who cannot entirely replace the law enforcement profession since Artificial Intelligence (AI) lacks human traits that law enforcement officers must possess.Paper Type: Research Article

Abstract

After the peaceful agreement signed by the Indonesian government with the government of Aceh, special autonomy was granted for Aceh and provided additional space for the two governments to improve the relations. Islamic law was fully effected after the assignment of Law No. 22 of 1999 concerning Regional Autonomy and amended by Law No. 11 of 2006 concerning the Law of the Government of Aceh, which provides a legal basis for the Privileges and Application of Islamic Law in Aceh. This research aims at analyzing the history and current existence of Islamic law in Indonesia and its contradiction with human rights. As an effort to enforce Sharia law, the regional government, besides pouring it into regional regulations or what is called Qanun, also forms institutions tasked with ensuring the proper implementation of Islamic Sharia law in Aceh. The research used normative legal research with a statute approach. The data are taken from secondary data. The results found that there were no human rights violations in applying Islamic law in Aceh.

Abstract

Promosi produk-produk yang dijual di kafe biasanya disertai dengan pemutaran lagu dan/atau musik. Hal tersebut tidak bisa lepas dari hak pencipta maupun pihak terkait atas karya yang digunakan sebagai pemenuhan hak ekonomi. Dimana terdapat sebuah kewajiban dalam membayar royalti yang dicantumkan dalam Peraturan Pemerintah Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Hak Cipta Lagu dan/atau Musik. Terdapat indikasi pelanggaran dalam pelaksanaan pengelolaan royalti yang seharusnya dilakukan Lembaga Manajemen Kolektif Nasional (LMKN) yang merugikan pencipta. Tujuan penelitian ini untuk menganalisis kepatuhan hukum musisi dan penyedia layanan berbasis komersial dalam membayar royalti berdasarkan prinsip doktrin labour. Metode dalam penelitian ini menggunakan yuridis empiris dengan pendekatan undang-undang dan konseptual. Dalam penelitian ini, data yang digunakan adalah hasil wawancara dengan beberapa responden, buku, artikel, dan bahan hukum lain yang relevan dengan penelitian ini. Hasil dari penelitian ini menunjukkan bahwa tingkat kepatuhan musisi dan penyedia layanan berbasis komersial yang masih rendah dalam melakukan kewajiban membayar royalti, berdasarkan prinsip doktrin labour sebagai sebagai apresiasi terhadap karya ciptaannya yang ditujukan untuk pemenuhan hak ekonomi pencipta atau pemilik hak terkait atas karyanya bertentangan dengan prinsip keadilan, hal ini dilatarbelakangi oleh lemahnya penegakan dari Peraturan Pemerintah Nomor 56 Tahun 2021.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum marketplace dalam pengawasan produk kecantikan yang tidak memiliki izin edar dan untuk mengetahui efektivitas pengawsan produk kecantikan tanpa izin edar di marketplace. Metode penelitian yang digunakan yaitu yuridis normatif dengan pendekatan Undang-Undang. Sumber data diperoleh dari hasil wawancara dengan Shopee Yogyakarta dan BPOM Yogyakarta, dan juga studi pustaka. Hasil penelitian ini menunjukan bahwa kedudukan hukum marketplace Shopee hanya sebagai perantara dimana hanya menghimpun penjual dan pembeli. Sedangkan tugas pokok pengawasan tetaplah di BPOM sementara Shopee hanya membantu BPOM dalam pengawasan. Meskipun BPOM telah menggandeng IDEA dalam pengawasan produk kecantikan tanpa izin edar di marketplace sampai sekarang masih banyak produk kecantikan tanpa izin edar yang di iklankan di marketplace dan itu menunujkan belum efektifnya pengawasan yang dilakukan.

Abstract

The principle of good faith is one of the efforts to provide legal protection to consumers inonlinetransactions. This research aims to review andauthorize theapplication of theprinciple of goodfaith, and its legal protectionif consumers are harmed in onlinetransactions. This research is expected to provide additional thought for all partiesinvolved in transactions through online. The method used in this study is normativejuridical, with data collection through literature studies and interviews. The resultsshowed that the application of the principle of good faith by business actors in transactionsthrough online is a very important thing, and must be implemented by the partiesconcerned, so that no party is lost. This is because good faith is the basis of business actorsin making agreements to minimize losses for consumers. But in practice there are stillmany consumers who are harmed by business actors. Legal protection of consumers isbased on Law No. 8 of 1999 on Consumer Protection and Law No. 19 of 2016 on changesto Law No. 11 of 2008 on Information and Electronic Transactions (ITE Law), namely whatare the rights and obligations of business actors and comments, and how the provisions ononline transactions to protect the interests of the parties. Legal efforts that can be done byconsumers are settlements on a non-litigation basis or litigation.

Abstract

The profess on the development of Artificial Intelligence (AI) has widely transformed a new era in the digital technology, social economic, human need and professional behavior. Eventually, artificial intelligence automates even more aspects of legal profession. Furthermore, AI allows the legal profession to automate lower-level tasks, freeing time to focus on complex analysis and client interaction. The research aims to know the literacy of legal professional on the use of AI. The methods used in this study are normative-empirical legal research. Furthermore, research uses primary data which obtained from questionary survey, secondary data i.e., law, books, journals and other related legal sources for research. Meanwhile, the research will analyze through descriptive qualitatively. The research shows that the literacy level of law enforcers in the use of AI is in the medium category. Data shows that 75% of legal professional shows their positive respond about the implementation of AI in their profession. While other shows, 8% of high percentage and 17% of low percentage.
