Abstract

The internet is not only limited to being used as a medium of information that can be accessed into social media, but it also can be used to make valuable trade transactions that have been introduced in Indonesia, which is known as e-commerce. This allows disputes to occur in e-commerce transactions, usually occurring in a conventional relationship. Then if it becomes wider and there are many activities in trade and e-commerce transactions, there will be many disputes about e-commerce that must be resolved. However, by using online media, existing disputes can be resolved properly. If the use of communication and information technology is combined with Alternative Dispute Resolution (ADR). In this study, the researchers discussed how business settlement through Online Dispute Resosulion was implemented in Indonesia. It also provided an understanding of ODR and the law that used as an intermediary in resolving conflicts that occur in the community with internet media which were expected to mix in providing a good conflict resolution. This research was descriptive analytical. It was hoped that this research can be used as a new way of providing facilities to the Indonesian people for those who want to seek legal certainty and resolve disputes using ODR.

Abstract

Procurement of land for the development of public interest and the determination of compensation cannot be separated from the issue of relinquishing land rights. This study aims to study and understand the implementation of compensation for land rights holders who are declared abandoned and legal protection for land rights holders who feel disadvantaged in the process of land acquisition for the public interest. In this study the author uses a normative juridical method, using a statutory approach, namely Law no. 5 of 1960 concerning Agrarian Principles and Law no. 2 of 2012 concerning Land Acquisition. The results of this study indicate that the implementation of compensation for land rights holders who have been declared abandoned for the development of public interest is carried out by identifying, researching, warning, and determining abandoned land. land, deliberation. As well as legal protection for land rights holders who feel aggrieved include; has the right to obtain data and information, the right to demand a file of rights or a claim for the determination of the development area/location, has the right to receive fair and fair compensation payments, and has the right to refuse the type and amount of compensation.

Abstract

Penyalahgunan narkotika tak lagi memandang usia mulai dari anak-anak, orang dewasa hingga orang tua sekalipun. Kurangnya pengetahuan terhadap narkotika, dan ketidakmampuan untuk menolak serta melawan membuat anak di bawah umur menjadi sasaran bandar narkotika oleh karena itu ketika terjadi penyimpangan terhadap anak menjadi pengguna narkoba, negara perlu memberikan perhatian dan perlindungan terhadap anak sangat penting, mengingat anak merupakan generasi penerus bangsa. Dalam penelitian ini penulis menggunakan metode penelitian yuridis normatif, yaitu merupakan pendekatan yang digunakan dengan cara meneliti, mengkaji terhadap permasalahan-permasalahanberpangkal pada kaidah-kaidah hukum atau perundang-undangan yang berlaku terhadap suatu permasalahan perlindungan hukum terhadap anak sebagai pelaku penyalahgunaan narkoba. Hasil penelitian menunjukkan dampak bahaya penayalahgunaan narkoba terhadap anak diantaranya dampak fisik/kesehatan, dampak psikologis, dampak sosial serta dampak terhadap pendidikan dan perlindungan hukum terhadap anak sebagai pelaku penyalahgunaan narkoba di Kabupaten Purwakarta dilakukan berdasarkan Undang-undang Nomor 35 Tahun 2009 tentang Narkotika dan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dan berbagai upaya lainnya.

Abstract

ABSTRAK Tanah ulayat di Minangkabau merupakan identitas masyarakat dan di lindungi keberadaannya oleh Negara yang tertuang dalam Undang-Undang Pokok Agraria. Dalam mempertahankan keberadaannya tidak heran lagi karena sering terjadi peningkatan intensitas konflik di tengah masyarakat bahkan munculnya perkara terbesar di pengadilan adalah permasalahan tanah ulayat, pada saat ini konflik yang terjadi bukan saja melibatkan antar masyarakat tetapi juga masyarakat dengan Negara yang disebabkan oleh faktor kepentingan kedua belah pihak, bukan hanya didalam masyarakat tetapi penggunaan tanah ulayat oleh Perusahaan Swasta juga telah menciptakan perselisihan di Sumatera Barat. Menurut hukum pengadaian tanah di Indonesia untuk mendapatkan tanah ulayat tersebut Perusahaan Swasta harus menghubungi pemilik tanah (masyarakat minangkabau) sebagai subjek tanah komunal untuk membuat kontak langsung, dalam hal ini faktanya mereka sudah mendapatkan tanah dari Pemerintah Daerah tidak dari orang-orang. Korporasi telah melakukan pemukiman perselisihan tetapi tidak effisien untuk memecahkan masalah namun masyarakat juga sudah melakukan segala cara untuk berjuang mendapatkan tanah mereka. Abstract

The Financial Services Authority (OJK) is an independent institution that is free from interference from other parties or institutions. This institution has the functions, duties, and authorities of regulation, supervision, examination, and investigation. OJK was established under Law No. 21 of 2011 with the function of implementing an integrated regulatory and supervisory system for the entire financial services sector. The establishment of OJK with the need to restructure the institutions that carry out regulatory and supervisory functions in the financial services sector. The supervisory system carried out by the OJK is an integrated supervision system, meaning that all financial service activities carried out by various financial institutions are subject to the OJK regulatory and supervisory system. Alternative Dispute Resolution Institutions (LAPS) in the Financial Services Sector number 1/POJK.07/2014 which regulates Alternative Dispute Resolution Institutions in the Financial Services Sector. Dispute resolution must be carried out at the LJK in the OJK Regulation concerning Consumer Protection in the Financial Services Sector, which stipulates that each LJK must have a work unit and/or function as well as a service mechanism and settlement of complaints for consumers. If the dispute resolution at the LJK does not reach an agreement, the consumer can settle the dispute out of court or through the court. Out of court dispute resolution is carried out through the Alternative Dispute Resolution Institution (LAPS).

Abstract

The outbreak of covid-19 causes a variety of problems in the community, where this outbreak also has a bad impact on the economic sector both central and regional where this affects the payment of taxes for taxpayers in Indonesia. Because of the many sectors affected by this outbreak that affect the sources of income of businesses are no exception for businesses nightlife venues, because of this outbreak and the enforcement of restrictions on hours and also the policy of psbb the night entertainment businesses get a pretty bad impact where they have to pay the salaries of their employees they are also harmed because they have to accept that their turnover decreased during the outbreak this hit Indonesia so that because the application of taxes from the huburan is quite high, so they will be quite burdened with the dependents they have by having to pay taxes. Thus things such as delayed payment of taxes are inevitable. With the explanation of these things, this study will explain how responsibility for businesses as a result of the delayed payment of entertainment tax.

Abstract

Settlement of Land Disputes through Mediation (Studies on Karawang Regency Land). The Karawang Regency Land Office can resolve several cases of land disputes through mediation, but cases are rarely resolved. In this thesis, several issues are raised, namely the role of the Karawang Regency Land Office in resolving land disputes through mediation, the procedure for resolving land disputes through mediation at the Karawang Regency Land Office and what is the success rate of mediation and obstacles in the mediation process at the Karawang Regency Land Office. The research method used in this research is a combination of a normative juridical approach with an empirical juridical approach. The normative juridical approach is to collect the necessary literature in the form of books, research journals, internet sites and laws and regulations on mediation, the National Land Agency, then an empirical juridical approach, namely by collecting data which is then taken from the results of interviews with the Head of Dispute Handling Subsection. , Conflicts and Land Cases. Settlement of land disputes at the Karawang Regency Land Office through mediation, which acts as a mediator. Settlement of land disputes through several procedures that have been implemented at the Karawang Regency Land Office. The success rate of resolving land disputes through mediation is rarely resolved, this is influenced by several obstacles. After conducting the research, it was concluded that the role of the Karawang Regency Land Office in resolving land disputes through mediation as a mediator was not optimal. Dispute resolution carried out at the Karawang Regency Land Office is carried out in accordance with Technical Guidelines No..05 / Juknis / D.V / 2007 concerning Mediation Implementation Mechanisms and Regulation of the Minister of Agrarian Affairs Number 11 of 2016 concerning Settlement of Land Cases. The success rate of mediation at the Karawang Regency Land Office is very low. This level of success is influenced by obstacles in the mediation process from the disputing parties which brings more emotional feelings, if the disputing parties use the services of a legal attorney, then there are some attorneys who prefer to win cases in court, and the absence of one of the parties in the mediation process.

Abstract

A civil dispute in an agreement is a case that arises from an agreement that has been previously agreed upon by the parties. An agreement that starts from negotiation to produce an agreement that is written on a trading contract. The current condition shows that dispute resolution in court is no longer the main choice because it is considered not effective and efficient enough. The choice of dispute resolution through an arbitration institution is considered to provide its own advantages over going through a national court. And the neglect of consumer rights can invite losses that lead to consumer disputes. So the purpose of this main discussion is how the process of resolving consumer disputes based on UUPK and the process of resolving disputes through mediation channels. The research method is normative law, and obtains data by using secondary data based on legal provisions and periodic legal developments. The choice of dispute resolution through the UUPK can be resolved through court (litigation) and out-of-court (non-litigation) channels. And it has been explained in Article 48 of the UUPK that "the litigation path can be taken through filing a lawsuit through the court, looking at the provisions regarding the applicable general court". "Arbitration and Alternative Dispute Resolution" is "a civil dispute resolution institution that can be resolved through a procedure agreed upon by the parties, namely an out-of-court settlement through consultation, negotiation, mediation, conciliation or expert judgment". Then arbitration is a dispute resolution out of court based on an arbitration agreement as well. Mediation is a method of resolving disputes that has a main scope such as a private/civil law area. Mediation is "a settlement through the assistance of a third party, but the role of the mediator is only to bridge the parties without giving an opinion on dispute resolution".

Abstract

Pasal 49 ayat (1) juga menyatakan bahwa Pemerintah membentuk organisasi penyelesaian debat pelanggan di Daerah Tingkat II untuk penyelesaian pertanyaan pembelanja di luar pengadilan. Badan Penyelesaian Sengketa Konsumen (BPSK) adalah lembaga yang dipercaya untuk mengurus dan menyelesaikan pertanyaan antara pelaku bisnis dan pembeli. Kantor tersebut adalah Badan Penyelesaian Sengketa Konsumen yang menunjukkan kompleksitas proses pengadilan yang umumnya akan panjang, formal dan berbelit-belit dengan pendekatan elektif untuk menyelesaikan perdebatan di luar pengadilan dengan mempertimbangkan standar biaya yang cepat, lugas dan minimal. Penjelajahan ini diarahkan pada Badan Penyelesaian Sengketa Konsumen yang berkedudukan di Kabupaten Karawang dengan menggunakan pendekatan dan pendekatan yuridis yang mengatur. Tugas BPSK dilihat dari UU no. 8 Tahun 1999 tentang Perlindungan Konsumen dapat ditempuh dengan 3 (tiga) strategi, yaitu strategi peredaan, intervensi dan mediasi berdasarkan keputusan dan pemahaman dari pertemuan-pertemuan interogasi. Jenis pilihannya adalah konklusif dan membatasi untuk memanfaatkan strategi peredaan dan intervensi.

Abstract

Tidak dapat dipungkiri bahwa pada saat ini persaingan usaha atau kegiatan bisnis yang semakin hari semakin pesat sangat menunjukkan bahwa dalam hal kegiatan usaha yang mencapai ratusan atau bahkan pula ribuan dalam setiap harinya, tidak menutup kemungkinan bahwa dapat terjadi suatu sengketa ( dispute, diferrence )  diantara para pihak yang terlibat dalam dunia bisnis tersebut, yang disebabkan dari semakin banyaknya kegiatan perdagangan yang semakin luas. Dalam sengketa tersebut pasti pula ada salah satu pihak menuntut dan berharap penyelesaian dan pemecahannya dapat diselesaikan melalui sebuah  alternatif penyelesaian sengketa yang salah satunya mediasi tentu diharapkan dalam upaya yang dilakukan oleh para pihak untuk dapat menyelesaikan suatu sengketa dengan hasil kesepakatan bersama dengan bantuan seorang mediator yang bersikap netral dan tidak memihak, penyelesaian sengketa melalui alternatif penyelesaian sengketa mampu diharapkan pula selalu berperan dalam membantu para pihak. Sehingga mediasi pula tidak hanya dimanfaatkan dinegara Indonesia saja tetapi dimanfaatkan oleh negara-negara lain, yang pastinya memiliki perbandingan negara satu dengan yang lainnya dalam penerapan mediasi sebagai alternatif penyelesaian sengketa.
