Abstract

In Indonesia, there are two financial institutions, namely conventional financial institutions and Islamic financial institutions. Islamic financial institutions in their operations are based on the fatwa that has been issued by the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) as an authoritative institution in issuing fatwas in the field of Islamic economics. Baiturridha Puska, one of the Islamic financial institutions, issued al-qardh financing products. At the level of practice, which is implemented by BPRS Baituttidha Puska that in the contract it is indicated that there is a clause that is different from the provisions of the DSN-MUI fatwa No. 19 of 2001 concerning al-Qardh. The purpose of this study was to determine the concept of the qardh contract in fiqh and the DSN-MUI fatwa and to analyze the qardh financing contract contract at the Baiturridha Pusaka BPRS. This study uses qualitative research, with a normative juridical approach and data collection techniques by means of literature study. The results of the study show that first, the qardh contract is a form of tabarru contract so it is not intended for profit; secondly, the provisions of Article 2 of the Letter of Acknowledgment of Financing contain a clause that is contrary to sharia principles, namely the DSN-MUI fatwa no. 19 of 2001 concerning al-Qardh.

Abstract

There are various types of prayer times that Muslims refer to on a daily basis. Specifically, there are offline and online prayer times as well as traditional and modern prayer times. Online prayer times that can be accessed from a mobile phone in forms such as android-based applications, online websites, and Google applications. The purpose of this study is to investigate the accuracy of online-based prayer times applications and seek for the possible consistency across these applications. This study employs a qualitative approach and a descriptive data analysis. The data collection is conducted through observations, literature study, and in-depth interviews. This study indicates different degree of deviations among online-based prayer times applications, in which Google applications show the most deviation among the others. This study suggests that Muslims refer to online applications recommended by the Ministry of Religious Affairs of Indonesia.

Abstract

Prayer time is locality in accordance with geographic data. For one geographical data will result one of prayer time. But there are different things with this general rule, namely the phenomenon of maghrib twice during Ramadan 1437 H. / 2016 M. in Bandung. There are two prayer schedule format that developed at that time, which is schedule issued by the Ministry of Religious West Java Regional Office (Kemenag) and schedule sourced by online of the Central of Ministry of Religious Affairs. Bandung has elevated above 600 meters mean sea level, but not located on the beach. Such circumstances make different ijtihad scholars of elevation data in the calculation of the prayer times. According to scholars of the city, Bandung has a elevation above 600 meters mean sea level, in the calculation of the maghrib prayer time must take into calculation the height of the place. This is to get results that match the real conditions. Kemenag and BHRD West Java  using real data in the calculation of prayer times. This schedule is much used as a reference by mosques such as the Great Mosque of al-Ukhuwah Bandung, Mosque PUSDAI, Trans Studio Mosque Bandung, and Masjid Istiqomah Bandung.[]Awal waktu salat bersifat lokalitas sesuai dengan data geografis. Untuk satu data geografis akan menghasilkan satu waktu salat. Namun ada hal yang berbeda dengan kaidah umum ini, yaitu terjadi fenomena adzan maghrib dua kali pada saat Ramadhan 1437 H. / 2016 M. di Kota Bandung. Ada dua format jadwal salat yang berkembang saat itu, yaitu jadwal yang dikeluarkan oleh Kemenag Kanwil Jawa Barat dan jadwal yang bersumber dari sistem online Kementrian Agama Pusat. Diantara jadwal tersebut, ada yang menggunakan data ketinggian tempat dan ada pula yang mengabaikannya. Bandung memiliki ketinggian tempat di atas 600 meter dpl, namun tidak terletak di sisi pantai. Keadaan seperti ini menjadikan ulama ilmu falak berbeda ijtihad dalam penggunaan data ketinggian tempat dalam perhitungan awal waktu salat magrib. Menurut ulama falak, kota Bandung yang memiliki ketinggian tempat di atas 600 meter dpl, dalam perhitungan awal waktu salat Magrib harus memperhitungkan ketinggian tempat. Hal ini untuk mendapatkan hasil yang sesuai dengan kondisi real di lapangan. Kemenag dan BHRD Jawa Barat menggunakan data real dalam perhitungan awal waktu salat. Jadwal ini banyak dijadikan acuan oleh masjid-masjid yang besar seperti Masjid Agung al-Ukhuwah Bandung, Masjid PUSDAI, Masjid Agung Trans Studio Bandung, dan Masjid Istiqomah Bandung.

Abstract

Wakaf memainkan peran ekonomi dan sosial yang sangat penting dalam sejarah Islam. Wakaf berfungsi sebagai sumber pembiayaan bagi sarana ibadah, pendidikan, pelayanan sosial dan pertahanan. Banyak pengembangan sektor ekonomi Islam atau perbankan syariah yang dikaitkan dengan wakaf, tidak terkecuali di tahun 2017 Pemerintah bersama OJK menginisiasi adanya Bank Wakaf Mikro sebagai upaya menjawab permasalahan kemiskinan, yang bekerjasama dengan lembaga berbasis pesantren di Indonesia. Istilah Bank wakaf mikro dipilih karena pihak pemerintah mengharapkan agar inti dari dana yang disebar ke masyarakat tetap terjaga intinya tanpa mengurangi manfaatnya, selain itu dinamai Bank Wakaf Mikro dikarenakan operasi BWM ini berada di lingkungan pesantren. Selama perkembangannya BWM ini, menggunakan istilah bank wakaf mikro dalam penamaan lembaganya akan tetapi dari dasar hukum dan bentuk dari badan hukumnya justru sangat jauh dari penamaannya.Badan hukum dari BWM ini adalah Koperasi, sedangkan izin usaha BWM adalah lembaga keuangan mikro syariah sehingga pengawasannya berada di bawah Otoritas Jasa Keuangan (OJK). Penelitian ini menggunakan metode penelitian yuridis normative dengan menggunakan data sekunder dengan menggunakan analisis deskriptif kualitatif. Kata kunci: Hukum, Bank, Wakaf, Mikro, Indonesia. Abstract Waqf plays a very important economic and social role in Islamic history, waqf serves as a source of funding for religious facilities, education, social services and defense. Many developments in the Islamic economic sector or Islamic banking are associated with waqf, not least in 2017 The Government and OJK initiated the Micro Waqf Bank as an effort to address the problem of poverty, in collaboration with pesantren-based institutions in Indonesia. The term micro waqf bank was chosen because the government expects that the core of the funds distributed to the community is maintained intact without reducing its benefits, besides it is named the Micro Endowment Bank because the BWM operation is in the pesantren environment. During the development of this BWM, the term micro waqf bank was used in naming its institutions, but from the legal basis and form of legal entities it was very far from naming it. under the Financial Services Authority (OJK). This study uses a normative juridical research method using secondary data using qualitative descriptive analysis. Keywords: Law, Bank, Waqf, Micro, Indonesia.

Abstract

The purpose of this research is to find out the implications of Islamic Money Instead based on macroeconomic and social variables value in Indonesia. The used data is secondary data of 2010-2019 time series. The method of this research is using Vector Autoregressive and Vector Error Correction Model (VECM). E-views 9 program is used for processing data. The result of this research indicates that there are implications for a variety of Islamic Money Instead in Indonesia based on macroeconomic and social value variables in Indonesia on 1st model. GDP and inflation as macroeconomic variable have positive implication for Islamic Money Instead, meanwhile the exchange rate variable has negative implication on it. On 2nd model there are implications for Islamic Money Instead based on macroeconomic variable. GDP and inflation have positive implication and greater value than the 1st model. While the exchange rate has negative implication and has not a response for Islamic Money Instead shock. Furthermore, the 3rd model indicates that there is positive implication based on social value variable not only for zakat but also infaq shadaqah

Abstract

Abstract. This thesis uses the results of (field research) related to "Analysis of the Sale and Purchase Agreement of Rolled Fabrics in the Use of Khiyar Rights According to Fiqh Muamalah (Case Study at Z Market)".This thesis research aims: (1) To find out the concept of khiyar in buying and selling according to muamalah fiqh (2) To find out the practice of khiyar in buying and selling rolled cloth at the Z market (3) To find out an overview of fiqh muamalah the practice of khiyar in buying and selling rolled cloth at Z Market. The method used in this study is a qualitative research method in the field of normative law, namely examining the arguments of the Qur'an and Hadith as well as the opinions of scholars related to khiyar rights in the contract of buying and selling cloth rolls at the Z Market based on primary and secondary data. secondary data obtained from the field. The results of this study indicate that the use of khiyar rights in the sale and purchase of rolled cloth at the Z Market fulfills the pillars and conditions of sale and purchase. Merchants apply a bargaining system and allow the exchange of goods if the discrepancy meets the conditions agreed upon by the seller and the buyer. However, in buying and selling, the seller should guarantee the buyer to khiyar so as not to feel disadvantaged. The sale and purchase transaction between the parties should do justice by bearing the profits and losses so that the benefit in buying and selling can be achieved. Abstrak. Skripsi ini menggunakan hasil penelitian lapangan (field research) berkaitan dengan “Analisis Akad Jual-beli Kain Gulungan Dalam Penggunaan Hak Khiyar Menurut Fikih Muamalah (Studi Kasus di Pasar Z)”. Penelitian skripsi ini bertujuan: (1) Untuk mengetahui konsep khiyar dalam jual-beli menurut fikih muamalah (2) Untuk mengetahui praktik khiyar dalam jual-beli kain gulungan di pasar Z (3) Untuk mengetahui tinjauan fikih muamalah praktik khiyar dalam jual-beli kain gulungan di Pasar Z. Metode yang digunakan penelitian ini adalah metode penelitian kualitatif dalam bidang ilmu hukum normatif, yaitu mengkaji dalil-dalil al-Qur’an dan Hadits serta pendapat ulama yang terkait hak khiyar dalam akad jual-beli kain gulungan di Pasar Z berdasarkan data primer dan sekunder yang didapatkan dari lapangan. Hasil penelitian ini menunjukkan bahwa penggunaan hak khiyar dalam jual-beli kain gulungan di Pasar Balubr Town Square memenuhi rukun dan syarat jual-beli. Pedagang menerapkan sistem tawar-menawar dan memperbolehkan penukaran barang apabila ketidaksesuaian tersebut memenuhi syarat yang telah disepakati penjual dan pembeli. Namun, dalam melakukan jual-beli hendaknya penjual menjamin pembeli untuk khiyar agar tidak merasa dirugikan. Hendaknya, transaksi jual-beli diantara para pihak melakukan keadilan dengan menangggung keuntungan maupun kerugian agar kemashlahatan dalam jual-beli dapat tercapai.

Abstract

Abstract. Islamic law emphasizes that "marriage is a form of muqayyah worship. Its validity lies in its terms and harmony. Therefore it requires / requires the presence of contracted parties, meanwhile with the development of technology, the marriage contract through the media of video calls is not considered valid if the terms and conditions are not met. The pillars or essential elements are consent and qabul. The problem points formulated in this study are How Marriage via video call media according to Islamic Law, How is the validity of the Marriage Contract through video call according to Islamic Law.The research method used is the normative juridical method. which is the object of Marriage Contract Research through video call media according to Islamic Law. The purpose of this research: To know marriage through video call media according to Islamic law, to know the validity of the marriage contract through video call media according to Islamic law.The results of the study concluded that: Marriage via video call is a consent statement uttered by the female guardian which is then answered by the male, based on technological advances through the internet media. The marriage contract through legal video call media fulfills the requirements and harmonious marriage, does not contradict Islamic law, such as a prospective husband and a female marriage guardian, two witnesses and a consent of Kabul. This is confirmed by the provisions of Article 27 to 29 Compilation of Islamic Law, among others, not intermittent, carried out directly by the guardian of marriage concerned and pronounced directly by the groom through a video call, then fulfilled, among others, harmonious, legal requirements, conditions of marriage. Abstrak. Hukum Islam menegaskan bahwa “perkawinan dinyatakan bentuk ibadah muqayyah keabsahannya terletak pada syarat dan rukunnya. Oleh karena itu mengharuskan/mensyaratkan hadirnya pihak-pihak yang berakad, sementara itu dengan perkembangan teknologi maka akad nikah melalui media video call, tidak dianggap sah jika syarat dan rukunnya ada yang tidak terpenuhi. Rukun-rukun atau unsur-unsur esensialnya adalah ijab dan qabul. Poin masalah yang dirumuskan dalam penelitian ini adalah Bagaimana Pernikahan melalui media video call menurut Hukum Islam, Bagaimana Keabsahan Akad Nikah melalui media video call menurut Hukum Islam. Metode penelitian yang digunakan adalah metode yuridis normatif. yang menjadi Objek Penelitian Akad Nikah melalui media video call menurut Hukum Islam. Tujuan penelitian ini : Untuk mengetahui Pernikahan melalui media Video call menurut Hukum Islam, Untuk mengetahui Keabsahan Akad nikah melalui media Video call menurut Hukum Islam. Hasil penelitian menyimpulkan bahwa: Pernikahan melalui media video call merupakan pernyataan ijab yang diucapkan oleh wali pihak perempuan yang kemudian dijawab oleh pihak laki-laki, berdasarkan kemajuan teknologi melalui media internet. Akad nikah melalui media video call sah memenuhi syarat dan rukun perkawinan, tidak bertentangan dengan hukum islam, seperti adanya calon suami dan, wali nikah pihak perempuan, dua orang saksi dan ijab kabul. Hal ini dikuatkan dengan ketentuan pasal 27sampai dengan 29 Kompilasi Hukum Islam antara lain tidak berselang waktu, dilakukan langsung oleh wali nikah yang bersangkutan dan diucapkan langsung oleh mempelai laki-laki melalui video call, Kemudian terpenuhi antara lain rukun, syarat sah, syarat-syarat perkawinan.

Abstract

Abstract. Buying and selling is an activity that has long been carried out by humans to fulfill their obligations and fulfill their needs. The sale and purchase of coffee carried out in the District of Kebun Cane uses a mixture of different qualities. This mixing system uses a predetermined dose. Therefore, in every sale and purchase transaction between the seller and the buyer, as well as the buyer and the coffee dealer, there are differences in the quality produced. The purpose of this study is the first to find out the concept of buying and selling according to muamlah fiqh, second to find out the practice of buying and selling mixed coffee carried out in the District of Kebun Tebu, West Lampung, third to find out the fiqh muamalah analysis of the sale and purchase of mixed coffee carried out in the District of Kebun Tebu. The research approach uses case studies, the type of research data is field research, data sources use observation, interviews, and documentation. The results of this study that the sale and purchase carried out in the District of Sugarcane Gardens is not in accordance with the concept of buying and selling fiqh muamalah, because there are buying and selling conditions that are not fulfilled, namely the conditions for the object of the goods being traded must know both the size, scale, dose, and the overall quality of the coffee. to determine the quality of the coffee. Therefore, the sale and purchase is also categorized as fasid buying and selling and contains an element of gharar. Abstrak. Jual beli merupakan suatu kegiatan yang sudah lama dilakukan oleh manusia untuk memenuhi kewajibanya dan memenuhi kebutuhanya. Jual beli kopi yang dilakukan di Kecamatan Kebun Tebu menggunakan percampuran perbedaan kualitas. System percampuran ini menggunakan takaran yang sudah ditentukan. Oleh karena itu dalam setiap transaksi jual beli antara penjual dan pembeli, maupun pembeli dan bandar kopi terdapat perbedaan kualitas yang dihasilkan. Tujuan penelitian ini yang pertama untuk mengetahui konsep jual beli menurutut fiqih muamlah, kedua untuk mengetahui praktek jual beli kopi campuran yang dilakukan di Kecamatan Kebun Tebu Lampung Barat, ketiga untuk mengetahui analisis fiqih muamalah terhadap jual beli kopi campuran yang dilakukan di Kecamatan Kebun Tebu.Pendektan penelitian menggunakan studi kasus, jenis data penelitian yaitu penelitian lapangan, sumber data menggunakan observasi, wawancara, dan dokumentasi. Hasil dari penelitian ini jual beli yang dilakukan di Kecamatan Kebun Tebu Tidak sesuai dengan konsep jual beli fiqih muamalah, karena ada syarat jual beli yang tidak terpenuhi yaitu syarat objek barang yang diperjual belikan harus mengetahui baik ukuran, timbangan, takaran, maupun kualitas keseluruhan kopi tersebut agar diketahui kadar kualitras kopi tersebut. Oleh karena itu, jual belinyapun dikatagorikan kepada jual beli fasid dan mengandung unsur gharar.

Abstract

Abstract. Ijarah contract is a form of exchange whose object is in the form of benefits accompanied by certain rewards. In the practice of renting kebaya clothes online on the @Scaia.co Instagram account by entering into a rental contract between the business owner and the tenant, for the sake of mutual safety and comfort, but in practice the @Scaia.co account has been quite disappointing to the consumers, where the owner of this account does not notify of additional costs outside the contract. The purpose of this study is to find out the @Scaia.co rental system, and to find out the review of the ijarah contract in fiqh muamalah on the rental of kebaya clothes on the @Scaia.co account. The approach in this study uses a qualitative research approach with descriptive analysis and uses field research data. Data collection techniques used by interview, observation, documentation, and literature. The data analysis used is data reduction, data presentation, and data conclusion. The result of this research is that the owner of the @Scaia.co account has violated the pre-approved contract, namely violating the transaction in buying and selling. It should have certain properties and have useful values, and in the provisions of the ijarah contract there should be no fraud from either mu'ajir or mustajir, then the object of the ijarah transaction must be something that is permissible, not something that is illegitimate. Abstrak. Akad ijarah adalah bentuk pertukaran yang objeknya berupa manfaat dengan disertai imbalan tertentu. Dalam praktik sewa menyewa pakaian kebaya online di akun Instagram @Scaia.co dengan melakukan kontrak sewa antara pemilik usaha dengan pihak penyewa, demi keamanan dan kenyamanan bersama, namun pada praktiknya yang dilakukan oleh akun @Scaia.co ini telah cukup mengecewakan para konsumennya, dimana pemilik akun ini tidak memberitahu akan adanya tambahan biaya-biaya di luar akad. Dalam tujuan penelitian ini untuk mengetahui system sewa-menyewa @Scaia.co, dan mengetahui tinjauan akad ijarah dalam fikih muamalah terhadap penyewaan pakaian kebaya di akun @Scaia.co. Pendekatan dalam penelitian ini menggunakan pendekatan penelitian kualitatif dengan deskriptif analisis dan menggunakan jenis data penelitian lapangan (field research). Teknik pengumpulan data digunakan dengan cara wawancara, observasi, dokumentasi, dan kepustakaan. Analisis data yang digunakan yaitu reduksi data, penyajian data, menyimpulkan data. Hasil dari penelitian ini bahwa pemilik akun @Scaia.co telah melanggar akad yang telah disetujui sebelumnya, yaitu melanggar transaksi dalam jual beli. Seharusnya memiliki sifat tertentu dan mempunyai nilai yang bersifat manfaat, serta di dalam ketentuan akad ijarah tidak boleh adanya penipuan baik dari mu‟ajir atau mustajir, maka obyek transaksi ijarah haruslah berupa sesuatu yang mubah, bukan sesuatu yang haram.

The research method used is the normative juridical method. Which is the object of Marriage Contract Research through video call media according to Islamic Law. The purpose of this research: To know marriage through video call media according to Islamic law, to know the validity of the marriage contract through video call media according to Islamic law. The results of the study concluded that: Marriage via video call is a consent statement uttered by the female guardian which is then answered by the male, based on technological advances through the internet media. The marriage contract through legal video call media fulfills the requirements and harmonious marriage, does not contradict Islamic law, such as a prospective husband and a female marriage guardian, two witnesses and a consent of Kabul. This is confirmed by the provisions of Article 27 to 29 Compilation of Islamic Law, among others, not intermittent, carried out directly by the guardian of marriage concerned and pronounced directly by the groom through a video call, then fulfilled, among others, harmonious, legal requirements, conditions of marriage. Abstrak. Hukum Islam menegaskan bahwa “perkawinan dinyatakan bentuk ibadah muqayyah keabsahannya terletak pada syarat dan rukunnya. Oleh karena itu mengharuskan/mensyaratkan hadirnya pihak-pihak yang berakad, sementara itu dengan perkembangan teknologi maka akad nikah melalui media video call, tidak dianggap sah jika syarat dan rukunnya ada yang tidak terpenuhi. Rukun-rukun atau unsur-unsur esensialnya adalah ijab dan qabul. Poin masalah yang dirumuskan dalam penelitian ini adalah bagaimana pernikahan melalui media video call menurut Hukum Islam, Bagaimana Keabsahan Akad Nikah melalui media video call menurut Hukum Islam. Metode penelitian yang digunakan adalah metode yuridis normatif. yang menjadi Objek Penelitian Akad Nikah melalui media video call menurut Hukum Islam. Tujuan penelitian ini: Untuk mengetahui Pernikahan melalui media Video call menurut Hukum Islam, Untuk mengetahui Keabsahan Akad nikah melalui media Video call menurut Hukum Islam. Hasil penelitian menyimpulkan bahwa: Pernikahan melalui media video call merupakan pernyataan ijab yang diucapkan oleh wali pihak perempuan yang kemudian dijawab oleh pihak laki-laki, berdasarkan kemajuan teknologi melalui media internet. Akad nikah melalui media video call sah memenuhi syarat dan rukun perkawinan, tidak bertentangan dengan hukum islam, seperti adanya calon suami dan, wali nikah pihak perempuan, dua orang saksi dan ijab kabul. Hal ini dikuatkan dengan ketentuan pasal 27 sampai dengan 29 Kompilasi Hukum Islam antara lain tidak berselang waktu, dilakukan langsung oleh wali nikah yang bersangkutan dan diucapkan langsung oleh mempelai laki-laki melalui video call. Kemudian, terpenuhi antara lain rukun, syarat sah, syarat-syarat perkawinan.
