Abstract

A notary is a public official appointed by an authorized official who plays a role in the field of civil law. The authority of the Notary is regulated in Article 15 of Act Number 2 of 2014 concerning Amendment to Law Number 30 Year 2004 concerning Acts of Notary Position. Regarding the authority of the Notary as a public official (openbaar ambtenaar) who has the authority to make authentic deeds can be burdened with responsibility for the authentic deed he made. The need for legal protection for Notaries against these risks, it is necessary to have an insurance / notary position insurance as a way of transferring risk. The legal problems that occur are the absence of an insurance product / Notary position insurance and the form of insurance / notary position insurance. The purpose of this study is to identify the urgency and form of insurance / coverage of the Notary Position. Legal research conducted is normative legal research by conducting research on the legal system. Legal research conducted by the author using a legislative approach, conceptual approach, and comparative approach. The urgency of the use of insurance protection / coverage of the Notary position is an important one as a way of transferring the risks faced by Notaries and as a form of maximum legal protection for Notaries in the execution of positions. The use of insurance / coverage against the risk of implementing a Notary can be in the form of Professional insurance more specifically in the form of Notary insurance which is part of insurance / general coverage which is insurance / loss coverage in the form of new products made by insurance companies / insurance as fulfillment of insurance / insurance needs for Notary in carrying out the position of Notary

Abstract

Dalam proses pembuatan akta peralihan maka dalam waktu selambat  lambatnya 7 (tujuh) hari kerja sejak tanggal ditandatanganinya akta yangbersangkutan, PPAT wajib menyampaikan akta yang dibuatnya berikut dokumendokumen yang bersangkutan kepada Kantor Pertanahan untuk didaftar. Apabila jangka waktu tersebut diabaikan maka akan menimbulkan beberapa akibat hukum terhadap akta peralihan tersebut.Maka untuk lebih terjaganya ketertiban dalam proses pendaftaran peralihan hak atas tanah di Kantor Pertanahan Kota Banjarmasin dan juga agar pihak-pihak yang bersangkutan tidak di rugikan harus adanya sanksi tegas agar PPAT di Kota Banjarmasin tidak melakukan lagi pelanggaran tersebut, karena didalam peraturan itu sendiri sudah mengatakan bahwa hal tersebut adalah “wajib” bagi PPAT. Karena hal di atas menyangkut masalah pelaksanaan dari suatu ketentuan hukum, dikenakan tindakan administrasi berupa teguran tertulis sampai pemberhentian dari jabatannya sebagai PPAT, dengan tidak mengurangi kemungkinan dituntut ganti kerugian oleh pihak-pihak yang menderita kerugian yang diakibatkan oleh diabaikannya ketentuan-ketentuan tersebutAKIBAT HUKUM KETERLAMBATAN PENDAFTARAN PERALIHAN HAK ATAS TANAH TERHADAP AKTA YANG DIBUAT OLEH PEJABAT PEMBUAT AKTA TANAH

Abstract

The Islamic law is the command of God revealed to the Prophet Muhammad. Islamic legal thought can be a discussion about the purpose of Islamic law (al- ahkaammaqaashid). Islam gives comprehensive guidance to human life covering all aspects of life towards the achievement of happiness, physical, spiritual, social, individual and the world hereafter. The philosophy of Islamic law is the rule, principle, Mabda’ rules which are used to control the Islamic community. These rules can be in the forms of the verses the Qur’an, Hadith, or can be the opinions of the Prophet’s friends and tabi’in, and may also be the opinion developed at a time in the life of the community of Muslims or Islam. In the history of Islam, endowments known since the time of the Prophet Muhammad as endowments were prescribed after the Prophet Muhammad was in Medina.

Abstract

A Holder of Right has rights and obligation in using his/her land. One of the obligations of a Holder of Right is providing access right to an area of land depreciated which borders with his/her land. The obligation is one manifestation of social function basis. In the social reality, a legal issue pertaining to access to the area of land depreciated bordering with the land ownership. The emerging law issue is the cancelation of Certificate of Right to Own with the issuance basis by taking for granted access right of area of land depreciated and violation of access to area of depreciated land deemed to be an act contradicting the law. The present study is a normative law research. The law research conducted began with inventorization of laws and regulations, judicial decree, governance or other references concerning right of access to an area of depreciated land to be further applied in the relevant cases. There are some legal vacuums (rechtsvacuum) concerning the obligation of Certificate of Right to Own to provide right of access to the area of land depreciated in accordance with the law perspective of land registry in Indonesia. The governance of right of access to area of land depreciated in the laws and regulations in Indonesia is merely stated in Article 13, 31 and 50 of The Government regulation Number 40 of 1996 concerning Right To Cultivate, Building Rights on Land and Right Over Land. The legal solution that can be applied in the relevant issues concerning the obligation of Certificate of Right to Own Holder to provide right of access to an area of depreciated land in Indonesia in by making a separate governance stated in the Laws of Right to Own. In some cases of area of land depreciated cases which have been decided by court, Judge has different consideration and multi-interpretations on the dispute settlement

Abstract

Tujuan penelitian adalah untuk mengkaji prosedur dan mekanisme perolehantanah untuk kepentingan badan hukum swasta dalam rangka penanaman modaldan untuk mengkaji status kepemilikan tanah badan hukum swasta dalam rangkapenanaman modal. Kegunaan penelitian dapat memberikan sumbangan pemikirandalam pengembangan ilmu hukum khususnya di bidang hukum agraria dandapat memberikan sumbangan pemikiran dalam memecahkan masalah yang timbulmengenai perolehan tanah untuk kepentingan badan hukum swasta. Penelitian inimerupakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan yang dilakukan dengan menelaah semua undang-undang yang bersangkutpaut dengan isu hukum yang ditangani dan pendekatan konseptual yangmerujuk pada prinsip-prinsip hukum yang ditemukan dalam perundang-undangan.Sifat penelitian ini adalah Preskriptif Analitis yang bertujuan untuk menjelaskansecara tepat dari sifat-sifat suatu individu, kondisi/gejala keleompok tertentu/untukmenentukan penyebaran dari suatu gejala untuk menentukan ada dan tidaknyahubungan antara satu gejala dengan gejala lain di dalam masyarakat kita. HasilPenelitian: Pertama Prosedur dan mekanisme perolehan tanah untuk kepentinganbadan hukum swasta dalam rangka penanaman modal adalah mengatur mengenaitatacara yang sesuai dengan aturan dalam hal badan usaha memperoleh hak atastanah, maka akan meningkatkan produktivitas kegiatan perekonomian khususnyayang dilakukan oleh badan hukum swasta. Ini tentu saja akan membawa pengaruhyang sangat besar bagi perekonomian nasional kita. Status kepemilikan tanaholeh badan usaha swasta dalam rangka penanaman modal adalah memberikankepastian hukum dan perlindungan hukum kepada pemegang hak atas suatu bidangtanah khususnya badan usaha swasta yang bergerak menjalankan perekonomiannegara, ketika sudah memiliki status kepemilikan yang jelas maka tanah tersebutterdaftar sehingga akan mudah bagi badan hukum swasta untuk dapat membuktikandirinya sebagai pemegang hak yang bersangkutan.

Abstract

Penelitian ini bertujuan untuk mengidentiikasi dan menilai bagaimana pemerintah menjamin dan memberikan perlindungan hukum terhadap hak-hak tanah adat di Provinsi Kalimantan Tengah berdasarkan Pasal 3 UU Pokok Agraria (UUPA) dan Peraturan Gubernur Kalimantan Tengah Nomor 13 2009. Jenis penelitian adalah penelitian hukum normatif dengan menggunakan tiga sumber hukum yang terdiri dari sumber hukum primer, sekunder dan tersier yang berasal dari literatur penelitian. Jenis penelitian adalah sinkronisasi hukum, yaitu penelitian tentang sinkronisasi dan korelasi antara penerapan UUPA dan Peraturan Gubernur Kalimantan Tengah Nomor 13 tahun 2009, dan pendekatan undang-undang. Penelitian ini ingin mengetahui apakah Pemerintah melalui ketentuan Pasal 3 dari UUPA dan Peraturan Gubernur Nomor 13 Tahun 2009 telah memberikan kepastian hukum dan perlindungan hukum bagi hak atas tanah adat di Provinsi Kalimantan Selatan

Abstract

The purpose of the research entitled Settlement of Commercial Business Disputes through Online Non-Litigation Dispute Resolution in Indonesia is to analyze the mechanism for resolving commercial business disputes through non-litigation in the form of ODR in Indonesia and its legal consequences. The research method is in the form of normative legal research, which is a method that uses statutory regulations, which are then analyzed and drawn conclusions from general matters into a specific conclusion. The results of the research obtained are, First: that the legal basis that contains and states implicitly regarding matters relating to ODR is contained in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, namely, the contents of the legal regulations also do not provide much clarity. Details on how the conditions for ODR are carried out, the ODR mechanism, and other explanations. Second, the Inconsistency Norm that occurs in regulations relating to dispute resolution through non-litigation ODR, namely between several articles in the AAPS Law, there is a discrepancy or contradiction between the rules or articles that apply, so that the legal rules become vague and unclear. Where according to several articles of the AAPS Law it is stated that the Arbitration dispute resolution process must be written, while according to other articles of the AAPS Law it can be online. There is a legal ambiguity in the non-litigation dispute resolution mechanism through ODR, so that the parties feel that there are no clear directions or instructions in resolving cases, this makes the process of non-litigation dispute resolution mechanisms through ODR not well directed, due to disharmony or inconsistency the rule of law, so that the rule of law becomes vague, vague and unclear. The solution to these legal issues is that the government should make legal regulations that specifically regulate ODR or revise Law Number 30 of 1999 and add articles related to ODR. To the Government to provide websites and institutions that can specifically handle non-litigation dispute resolution through ODR to handle commercial business dispute resolution.

Abstract

Tujuan dari Penelitian ini adalah untuk mengkaji kepmilikan hak-hak tanah bagi warga Negara Asing di Indonesia dan juga bagaimana akibat hukum yang timbul dari Nominee di Indonesia. Penelitian yang digunakan melalui penelitian hukum normatif dengan melakukan beberapa pendekatan berbagai peraturan Perundang-Undangan dengan mengkaji kaidah-kaidah hukum positif yang berkaitan dengan perkembangan kegiatan bisnis khususnya yang terkait dengan larangan kepemilikan tanah oleh Warga Negara Asing. Hasil Penelitiannya dalam Warga Negara Asing sama sekali tidak terbuka untuk mendapatkan hak atas tanah berupa hak milik dalam sistem pertanahan oleh Warga Negara Asing di Indonesia namun cukup dengan mennggunakan Hak Pakai intuk investasi di Indonesia. Notaris sebagai Sebagai Pejabat Umum dalam membuat akta otentik harus menolak dengan tegas apabila para pihak melakukan perjanjian pinjam nama atau nominee khususnya apabila tujuan dari Warga Negara Asing yang ingin menguasai tanah dengan status untuk menjalankan aktvitas di Indonesia. Sehingga Seorang Notaris harus memberikan arahan kepada Warga Negara Asing apabila ingin menguasai tanah dengan status hak milik di Indonesia, Notaris seharusnya menjaga kehormatan jabatannya serta menjunjung tinggi Kode Etik Profesi, sebagai pelaksanaan dari sumpah jabatannya

Abstract

This type of research is juridical-empirical, character of an explanatory study, using non probality sampling technique, with sampling purposive or judgment sampling, with its own considerations for selecting members of the sample. Respondents farmers, farmer groups, informants: National Land Agency, Agency for Agricultural Extension and the National Bureau of Statistics.A redistribution subject of Agricultural Land in South Kalimantan province, not all poor farmers and sharecroppers, but there are also traders, private employees and civil servants. Due to ignorance of the farming community will Land Redistribution program. Object of agricultural land redistribution in South Kalimantan, only on state land or land uncultivated state-controlled, whereas the maximum limit for the excess land, absentee land and abandoned land is not part of the object of reform because it could not be implemented due to the constraints of data and information not enough about it. Because the object redistribution of agricultural land that is not up to two (2) acres, has not been able to fulfill the lives of farmers, because it is too small farms and agricultural produce is not maximized.

Abstract

Barito Kuala District has developedpalm oil plantation sector in wetlands areawhich gradually changed the pattern of its community life. Previously, most of the peoplewere sharecroppers with the land as their main commodities, then they become the laborbecause the companies employ people especially from the local community.This researchis an empirical legal study to obtain primary data and literature study to obtain secondarydata. Its population is the palm oil plantations in Barito Kuala District and the sample ispalm oil plantations in wetlands, which employ workers. In relation to the employment, thereare sometimes disagreements among the parties which can be caused by a variety of factors.The settlement of the industrial disputes is through stages of the bipartite; the mediation(tripartite); conciliation; arbitration; and the Industrial Relations Court.
