Abstract

ABSRTAK Hak Terkait (Neighbouring Right) dengan Hak Cipta merupakan hak eksklusif bagi Pelaku yang dapat terdiri dari artis film/telivisi, pemusik, penari, pelawak dan lain sebagainya untuk menyiarkan pertunjukannya. Yang dimaksud dengan menyiarkan termasuk menyewakan, melakukan pertunjukan umum (Public Performance), mengkomunikasikan pertunjukan langsung (Live Performance), dan mengkomunikasikan secara interaktis suatu karya rekaman suara pelaku. Selain pelaku, juga produser rekaman suara dan lembaga penyiaran mempunyai hak-hak terkait. Berdasarkan ketentuan Pasal 1 angka 5 Undang-Undang No. 28 Tahun 2014 Tentang Hak Cipta (UUHC) dapat diketahui bahwa yang dimaksud Hak Terkait adalah hak yang berkaitan dengan Hak Cipta yang merupakan hak eksklusif bagi Pelaku Pertunjukan, Produser Fonogram atau Lembaga Penyiaran. Judul Penelitian ini adalah Determinasi Perlindungan Hukum Pemegang Hak atas Neighbouring Right Dalam Undang-Undang Republik Indonesia Nomor 28 Tahun 2014 Tentang Hak Cipta dengan rumusan masalah. 1. Bagaimana Problematika Pemegang Hak atas Neighbouring Right Dalam Undang-Undang Republik Indonesia Nomor 28 Tahun 2014 Tentang Hak Cipta? 2. Bagaimana Perlindungan Hukum Pemegang Hak atas Neighbouring Right Dalam Undang-Undang Republik Indonesia Nomor 28 Tahun 2014 Tentang Hak Cipta?Dari hasil penelitian menunjukan bahwa perkembangan globalisasi memberikan kontribusi dengan banyaknya karya cipta seperti lagu, film, acara televisi yang sering disalah gunakan oleh orang yang tidak bertanggung jawab seperti memperbanyak, memasarkan dan segala upaya untuk memperoleh keuntungan finansial, sehingga pencipta atau pemilik hak cipta merasa dirugikan baik dari segi Hak Moral maupun Hak Ekonomi. Karena inilah hak terkait dengan hak cipta lahir dengan tujuan untuk melindungi hak performers, produser rekaman dan lembaga penyiaran dari penyalahgunaan karya mereka. Perlindungan hukum untuk hak terkait diberikan melalui peraturan perundang-undangan yaitu Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta juga melalui konvensi konvensi Internasional yaitu Konvensi Roma 1961, Konvensi Jenewa, dan Brussel Convention. Kata Kunci : Hak Terkait (Neighbouring Right), Hak Cipta, Undang-Undang Republik Indonesia Nomor 28 Tahun 2014 Tentang Hak Cipta

Abstract

Korupsi merupakan suatu kejahatan luar biasa dimana telah begitu mengakar kuat di Indonesia. Hal ini dapat di buktian dengan jumlah uang hasil korupsi yang di sita oleh KPK sebesar Rp2 triliun. Gagasan Model Politik Hukum pemberantasan korupsi perlu dilakukan dalam rangka Harmonisasi Kelembagaan Komisi Pemberantasan Korupsi (KPK), Polri dan Kejaksaan. Adapun yang menjadi permasalahan dalam penelitian ini adalah 1) Bagimana Dasar Urgensi Konsep Pemberantasan Korupsi di Indonesia. 2) Bagaimana Model Pemberantasan Korupsi di Indonesia. Metode Penelitian ini mengunakan Penelitian Hukum Normatif menggunakan studi kasus normatif berupa produk perilaku hukum dengan mengunakan pendekatan Perundang-Undangan. Hasil penelitian menunjukkan bahwa Model Politik hukum dalam pemberantasan korupsi di Indonesia merupakan suatu pendekatan yang lebih mengedepankan kepada manfaat hukum dengan cara melakukan penemuan atau pembaharuan hukum sesuai dengan fenomena sosial dimasyarakat dan urgensi kebutuhan hukum dengan melakukan 3 pendekatan yaitu Subtansi Hukum, Struktur Hukum dan Budaya Hukum dimana adanya Harmonisasi Kelembagaan Antara KPK, Polri dan Kejaksaan untuk efektifitas pemberantasan korupsi di Indonesia dengan pendekatan peraturan perundang-undangan.

Abstract

Covid-19 as a pandemic in the 20th century has brought consequences in many aspects, one of which is the force major aspect. The force majeure policy in Indonesia is still incomplete, unlike China, which already has a more complete policy. The purpose of the research is to be able to find out about the Covid-19 policy in Indonesia and to compare the Indonesian and Chinese force major policy settings. The research method uses a normative research type with a statutory approach. The results of the study show that Indonesia's policy in dealing with covid 19 has problems in two policies, namely: the provision of information and the Lockdown policy. Meanwhile, the comparison problem with China is better by providing a mechanism with more legal certainty, namely providing access to the determination of force major against the Supreme Court, while Indonesia does not have a similar mechanism.

Abstract

Issues with regional rules on Koranic education in Gorontalo Province are discussed. This is because the draft regional law on Koranic education is merged with preexisting regional regulations for the provision of education, as stated by the Ministry of Home Affairs. As a methodology, normative legal study will provide solutions to these issues. The author employs this legal research method because it allows for a comprehensive assessment of relevant literature, statutes, and judicial decisions. This article draws the conclusion, supported by the study's findings, that a regional regulation on Qur'anic education in the province of Gorontalo may contradict with the principles of forming legislation. This is because the establishment of regional regulations should never lead to discrimination of any kind, and this is based on the content of regional regulations that mandate protection for all groups and religions. A legal policy for the Gorontalo Provincial government is required to accommodate Qur'anic education in regional regulations regarding the implementation of education in the region so that, in the long run, the values of the Koran are not only accepted in the sociol Later, the values of the Koran are not only accepted in the sociol. Therefore, it is essential to update regional regulations on the implementation of education to include a chapter on religious education that regulates not just Koranic education but also education in other religions. As a follow-up to the revision of regional regulations on the implementation of education, the governor's regulation on Koranic education is required.

Abstract

Indonesia specifically addresses the refugee issues in Presidential Regulation No. 125 of 2016 on the Handling of Foreign Refugees. The handling of refugee status in Indonesia is handed over to UNHCR considering that Indonesia is not a party to the 1951 Refugee Convention or the 1967 Protocol. Besides Indonesia, Australia and Thailand are also not parties to the convention. Therefore it is important to see a comparative study of policies between countries. This study also aims to find out whether Presidential Decree No. 125 of 2016 can resolve the problem of refugees in Indonesia and what is the policy comparison between Indonesia, Australia and Thailand. The research method used is normative legal research with a statutory approach. The results of the study concluded that Presidential Decree No. 125 of 2016 has adequately accommodated arrangements for overseas refugees, but there are still several provisions that have multiple interpretations, such as arrangements regarding "foreigners", Rudenim arrangements, and the principle of "local integration" that has not been regulated. The implementation in Australia is firmer compared to Thailand and Indonesia. Australia itself emphasizes forced repatriation if it is detected as threatening the country's sovereignty. Meanwhile, Thailand provides access to foreign refugees to submit applications so they can live and settle.Key Words: Presidential decree 125 Year 2016, Refugees, 1951 Convention, 1967 Protocol AbstrakIndonesia secara khusus mengatur masalah pengungsi dalam Peraturan Presiden No. 125 Tahun 2016 tentang Penanganan Pengungsi Luar Negeri. Penanganan status pengungsi di Indonesia diserahkan kepada UNHCR mengingat Indonesia bukan negara pihak Konvensi Pengungsi 1951 atau Protokol 1967. Selain Indonesia, Australia dan Thailand juga bukan negara pihak konvensi. Oleh karena itu penting untuk melihat studi perbandingan kebijakan antar negara. Penelitian ini juga bertujuan untuk mengetahui apakah Perpres No. 125 Tahun 2016 dapat menyelesaikan masalah pengungsi di Indonesia dan bagaimana perbandingan kebijakan antara Indonesia, Australia dan Thailand. Adapun metode penelitian yang digunakan, yaitu penelian hukum normatif dengan pendekatan perundang-undangan. Hasil penelitian menyimpulkan bahwa Perpres No. 125 Tahun 2016, telah cukup mengakomodasi pengaturan pengungsi luar negeri, akan tetapi masih terdapat beberapa ketentuan yang multitafsir, seperti pengaturan tentang “orang asing”, pengaturan Rundenim, dan belum diaturnya mengenai prinsip “integrasi lokal”. Adapun implementasi di negara Australia lebih tegas dibandingkan dengan Thailand dan Indonesia. Asutralia sendiri menegaskan pemulangan paksa jika terdeteksi mengancam kedaulatan negara. Sedangkan Thailand memberikan akses kepada pengungsi luar negeri untuk mengajukan permohonan agar dapat tinggal dan menetap.Kata-kata Kunci: Perpres 125 Tahun 2016; Pengungsi; Konvensi 1951; Protokol 1967

Abstract

Menurunnya kunjungan wisatawan akibat pandemik covid-19 menjadikan promosi wisata menjadi langkah konkrit dalam memulihkan kembali sektor kepariwisataan. Promosi tersebut dapat dilakukan melalui media sosial yang dapat menjangkau seluruh pihak. Akan tetapi, penggunaaan media sosial justru dapat beribas pada hal-hal negatif ketika promosi yang dilakukan tidak sesuai dengan etika dan tanggungjawab dalam menggunakan media sosial. Persoalan minimnya pengetahun masyarakat di desa Patoameme terhadap etika penggunaan media sosial untuk promosi destinasi wisata harus diijawab dengan berbagai langkah, salah satunya adalah melakukan pengabdian masyarakat sebagai tanggungjawab dari perguruan tinggi sekaligus mengamalkan tridarma perguruan tinggi. Hasil pengabdian menunjukan bahwa promosi destinasi wisata merupakan hal yang sangat penting dilakukan dalam pengembangan suatu destinasi wisata. Melalui promosi tersebut maka kunjungan wisatawan akan meningkat dan akan berimbas pada peningkatan pendapatan dari aktifitas wisatawan yang dilakukan pada destinasi wisata. Salah satu bentuk promosi destinasi wisata ialah melalui media sosial. Akan tetapi, perkembangan media sosial yang begitu pesat harus diimbangi dengan etika hukum dalam penggunaan media sosial. Hal ini dimaksudkan agar promosi destinasi wisata yang dilakukan tidak bertentangan dengan kaedah hukum yang berlaku.

Abstract

   This article discusses the problems of regulating Koranic education in regional regulations in Gorontalo Province. This is based on the consideration of the Ministry of Home Affairs which states that the draft regional regulation on Koranic education cannot be regulated separately but is integrated with existing regional regulations for the provision of education. These problems will be answered methodologically by using normative legal research. The author uses this legal research because the focus is on reviewing literature studies, laws and regulations and court decisions related to the object of research.   Based on the results of the study, this article concludes that the establishment of a regional regulation in the Gorontalo province regarding Qur'anic Education has the potential to cause conflict with the principles of establishing legislation. This is based on the material content of regional regulations that require protection for all groups and religions to prevent discriminatory actions on the formation of a regional regulation.The basis for regulating Qur'anic education should be used as part of local wisdom where the province of Gorontalo is known as the Serambi Medina area with a majority Muslim population supported by a strong culture so that a legal policy for the Gorontalo Provincial government is needed to accommodate Qur'anic education in regional regulations regarding the implementation of education in the region so that later the values of the Koran are not only accepted in the sociological scope but are recognized juridically.   Therefore, it is necessary to revise regional regulations on the implementation of education by including a chapter on religious education which does not only regulate Koranic education, but other religions can also be included in the chapter. If the regional regulations have been revised, the next effort is to strengthen Koranic education, it is necessary to make an implementing regulation, namely the governor's regulation on Koranic education as a follow-up to regional regulations on the implementation of education..

Abstract

Food Reserves and food security are two concepts that cannot be separated because good and strong food security will have implications for both national and regional food reserves. This study aims to discuss (1) the function and role of regional apparatus organizations in the era of regional autonomy? and (2) What are the problems faced in implementing Regional Food Reserves? The research method is carried out with a normative juridical type through a statute approach. The study results show that (1) The duties and functions of regional organizations in terms of food security and reserves must be integrated with local and village governments. (2) Problems in the Implementation of Regional Food Reserves, namely the Management of food security or food availability at the national and regional levels and the conversion of agricultural land, which has a tremendous impact on food reserves.

Abstract

Buying and selling is an activity that takes place and is inherent in every society in the State of Indonesia. Therefore, there are many rules that regulate the matter of buying and selling in Indonesia. Agreements made by the community in terms of buying and selling must be clear and have a legal basis because every agreement born of an agreement is bound by law, as stated in article 1338 of the Civil Code (KUHPerdt). Buying and selling also has its own way, including buying and selling in the ijon or ngijon system, namely selling fruit that has not been seen. This research is categorized into the type of empirical normative legal research, it is based on the issues and or themes raised as research topics. Empirical normative legal research uses case studies in the form of products of legal behavior, for example reviewing laws and their application in society.

Abstract

Inter-regional cooperation is a system of working relationships carried out by two or more regions that are in a level and balanced position to achieve a common aim of enhancing people's welfare. South Bolaang Mongondow Regency's government is highly concerned about the significance of collaboration, both with neighboring regions, In this paper there 2 (two) research questions, namely; 1). What is the urgency of inter-regional cooperation in regional development?; 2). What are the philosophical, sociological and juridicial considerations for the information of a draft regional regulation on the implementation of Regional Coopertaion in South Bolaang Mongondow Regency?. The urgency of inter-regional cooperation found by the author is as follows; 1). Public Service Improvement; 2). Border Area; 3). Spatial Order 4).Disaster Management and Handling Potential Conflicts; 5). Poverty Reduction and Regional Disparities; 6). Increasing Role of Provinces; 7). Regional Expansion. And the Implementation of Regional Cooperation in South Bolaang Mongondow Regency required much deliberations and considerations in philosophical foundation, sociological foundation, and juridicial foundation. These considerations are as follows; a). Philosophical Foundation, The philosophical basis is a consideration or reason that demonstrates that the regulations formed base on Pancasila and 1945 Constitution; b). Sociological Foundation, Cooperation based on the needs and considerations of efficiency, effectiveness of public services and carried out in a mutually beneficial manner; c). Juridicial Foundation, The juridical or normative basis of a rule or rule, if the rule is part of a certain legal rule which in the legal rules points one to another.
