Abstract

Artikel ini  menjelaskan  bagaimana pelaksanaan Itbat Nikah di Inkuisisi Garut serta  kendala dan upaya penyelesaian masalah Itbat Nikah di Inkuisisi Garut. Dan penelitian ini terkait dengan Pasal 1(1)(1) Undang-Undang Perkawinan 1974  yang menyatakan bahwa perkawinan adalah sah jika dilakukan menurut hukum masing-masing agama dan kepercayaan. Dan  ayat (2) menyatakan bahwa semua perkawinan harus dicatat sesuai dengan peraturan perundang-undangan yang berlaku. Tujuan dari penelitian ini adalah untuk menjelaskan bagaimana perkawinan kelelawar di Inkuisisi Garut dilakukan, dan untuk mendorong upaya penyelesaian isu dan isu yang berkaitan dengan perkawinan kelelawar di Inkuisisi Garut untuk mengetahuinya. Metode penelitian yang digunakan adalah jenis penelitian kualitatif, dan dalam penelitian ini teknik pengumpulan data dilakukan dengan  mewawancarai informan seperti hakim pengadilan agama Garut, wakil panitera pengadilan agama Garut, dan pemohon. untuk pernikahan kelelawarnya. Berdasarkan hasil penelitian ini dapat disimpulkan bahwa Akta Nikah Inkuisisi Garut sudah sesuai dengan peraturan perundang-undangan yang ada, namun menghadapi kendala dalam pelaksanaannya. Edukasi tentang pentingnya pencatatan nikah, dan pemahaman  yang kuat dari mereka yang meyakini bahwa nikah beda agama itu sah sepanjang tidak melanggar syariat.This article describes how to carry out Itbat Nikah in the Garut Inquisition as well as the obstacles and efforts to resolve the issue of Marriage Inquisition in the Garut Inquisition. And this research is related to Article 1(1)(1) of the 1974 Marriage Law which states that marriage is legal if it is carried out according to the laws of each religion and belief. And paragraph (2) states that all marriages must be recorded in accordance with the applicable laws and regulations. The purpose of this study is to explain how the marriage of bats in the Garut Inquisition was carried out, and to encourage efforts to resolve issues and issues related to bat marriage in the Garut Inquisition to find out. The research method used is a qualitative research type, and in this study the data collection technique was carried out by interviewing informants such as the judges of the Garut religious court, the deputy clerk of the Garut religious court, and the applicant. for his bat wedding. Based on the results of this study, it can be concluded that the Garut Inquisition Marriage Certificate is in accordance with the existing laws and regulations, but faces obstacles in its implementation. Education about the importance of registering marriages, and a strong understanding of those who believe that interfaith marriages are legal as long as they do not violate the Shari'a.

Abstract

This article tries to discuss divorce from a gender perspective, this research arises from the understanding of a handful of Islamic societies regarding the use of divorce rights to break marriage ties. The belief that divorce is the authoritative right of men causes husbands to treat their wives as they please. So this is very contrary to gender equality and protection of women. This article aims to create an understanding of Divorce from a gender perspective. The method used in this article is library research with a qualitative form. Data was collected from articles in journals, books and other library materials which were then narrated. The results of the study found that divorce from a gender perspective is interpreted as equal rights between a husband and wife in filing for divorce, such as khuluk and fasahk.
