Abstract

Era otonomi daerah dalam dinamika demokrasi sekarang ini menuntut adanya partisipasi masyarakat, tidak terkecuali masyarakat desa dalam rangka mewujudkan pembangunan nasional. Oleh karena itu diperlukan regulasi di tingkat daerah termasuk regulasi di desa. Desa merupakan cikal bakal terbentuknya masyarakat politik dan pemerintahan di Indonesia jauh sebelum Negara bangsa ini terbentuk, desa merupakan daerah dengan karakter yang unik, yang dapat menyelengarakan fungsi pemerintahan dan memiliki tradisi yang berbeda antara satu dengan yang lain. Akan tetapi dalam konteks kekinian telah terjadi pergeseran otonomi di desa, dimana sekarang desa tidak lagi memiliki hak otonomi. Dalam pemerintahan desa, terdapat regulasi untuk menjalankan pemerintahan desa berdasarkan wewenang yang dimiliki desa yaitu peraturan desa. Namun karena telah terjadi pergeseran otonomi desa, peraturan desa dalam perkembangannya hanya merupakan penjabaran lebih lanjut peraturan yang lebih tinggi bukan untuk menjalankan otonomi.Kata Kunci: Peraturan Desa, Pemerintahan Desa, Otonomi.

Abstract

Nowadays, The Institutional of environmental in regional experinced many changes, its cause of stipulated of Law No. 23 of 2014 on Local Government and Government Act No. 18 of 2016 on Local Government Organization. Rule about central government authority and local government authority on environment aspect that ruled by Act No. 32 of 2009 on Protection and Management of Environment must be adjusted with Act No. 23 of 2014 on Local Government and Government Act No. 18 of 2016 on Local Government Organization. This research analyze about institutional harmonization on statute approaches. It is expected that this research give a knowledge of affairs which central government authority, province government authority, and district/regency government authority clearly especially on environment aspect. The minister of environment and forestry in order to implementing coordinative function, should be obliged to synchronize working program of environment institution between local and central government for making integrated environment management (policy) approaches.

Abstract

The enactment of Law Number 30 of 2014 on Government Administration had given the changes to the authority of the State Administrative Court. There are two mechanism of the case investigation in the State Administrative Court in providing legal protection against a lawsuit or petition filed by the public. The first mechanism is to file a lawsuit directly to the State Administrative Court. The second mechanism is to resolve internal disputes within the government before filing a lawsuit to the Administrative Courts. There are two mechanisms of the case investigation prove that the existence of discrimination for people who seek justice in the case investigation system in the State Administrative Court. This research focus on an issues first the nature of public legal action by the government in government administration and second Ratio legis non-judicial legal protection against public legal acts  by the government. The results which have to be achieved are to provide the prescription of essential truth. There are several problems approach used in this study, such as statute approach, conceptual approach, and case approach.
