Abstract

Hak Asasi Manusia merupakan hak dasar yang melekat di dalam sanubari manusia itu sendiri, yang tidak dapat dikurangi baik oleh masyarakat, pemerintah maupun dirinya. Salah satunya adalah hak kebebasan beragama. Hak kebebasan beragama merupakan suatu hak yang bebas dipilih oleh seseorang. Komisi Nasional Hak Asasi Manusia merupakan lembaga mandiri yang kedudukannya setingkat dengan lembaga negara lainnya, yang berfungsi melaksanakan pengkajian, penelitian, penyuluhan, pemantauan, dan mediasi HAM. Dari penelitian yang telah dilakukan, terlihat bahwa tidak ada sinkronisasi peranan antara Komnas HAMdengan pemerintah. Komnas HAM sebagai lembaga mandiri yang berfungsi menegakkan hak kebebasan beragama, tidak memiliki sikap tegas dalam mengimplementasikan peranannya. Dalam penelitian ini juga dikemukakan kasus penyelesaian konflik antar umat beragama, yaitu Peraturan Gubernur Sumatera Barat Nomor 17 Tahun 2011 tentang Larangan Kegiatan Jemaat Ahmadyah Indonesia di Provinsi Sumatera Barat dan Surat Keputusan Bersama Dua Menteri terkait dengan rumah ibadah, dimana Komnas HAMkurang memiliki sikap terhadap hal ini. Seharusnya, Komnas HAM sebagai lembaga mandiri memiliki sikap tegas dalam pelaksanaan fungsinya tersebut dan memilikiperaturan perundang-undangantersendiri tentang peranan Komnas HAM.  Inter-Religious Conflict ResolutionAbstractHuman Rights is a human or fundamental rights inherent in the human heart itself, which can not be reduced either by the public, government and himself. One of them is the right to religious freedom. Right to religious freedom is a right that is freely chosen by the individual. The National Commission on Human Rights, an independent institution whose position is equal to other state agencies, which function to carry out an assessment, research, extension, monitoring, and mediation of human rights. From research conducted, it appears that there is no synchronization between Komnas HAM and the role of government. Komnas HAM, as an independent institution whose function is to uphold the right of religious freedom, does not have a firm stance in implementing its role. This study also found cases of inter-religious conflict resolution, namely West Sumatra Governor Regulation No. 17 of 2011 on the Prohibition of the Activity of Ahmadyah Indonesia in West Sumatra province and two ministerial decree related to houses of worship, the Commission lacks the attitude towards it. Abstract

AbstrakPengelolaan hasil laut dan perikanan di Indonesia rentan memunculkan sengketa karena laut bersifat open access. Dalam lingkup lokal, Provinsi Aceh memiliki lembaga alternatif penyelesaian sengketa (APS) adat laut yakni Panglima Laôt. Penyelesaian sengketa di luar pengadilan sebelumnya telah diatur dalam Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan APS (UU APS). Namun, sistem pendukung dari UU APS ini belum terbentuk sehingga penyelesaian sengketa melalui jalur alternatif seperti lembaga APS adat laut Panglima Laôt tidak berjalan secara optimal sekalipun putusannya bersifat mengikat bagi para pihak.Kata Kunci: lembaga penyelesaian sengketa adat laut, Panglima Laôt, alternatif penyelesaian sengketa, sistem hukum Indonesia, sistem pendukung. “Panglima Laôt” as Traditonal (Adat) Dispute Resolution in Aceh as an Alternative Dispute Resolution in Indonesian Legal SystemAbstractThe nature of the sea as an open access area potentially created a dispute especially concerning the management of marine and fisheries products. Locally, Aceh Province has established a traditional law of the sea Alternative Dispute Resolution (ADR) body or so-called “Panglima Laôt”. Formerly, ADR has been regulated by the Law number 30 year 1999 concerning Arbitration and ADR. However, the supporting system of this regulation has not been created yet. Abstract

AbstrakDalam kajian ilmu hukum, bidang hukum dibagi menjadi dua kelompok besar, yaitu kelompok hukum publik dan privat. secara teoretis kedua kelompok hukum ini dapat dibedakan secara jelas, tetapi pada praktiknya kedua kelompok hukum ini seringkali tumpang tindih, sehingga perbedaan di antara keduanya menjadi samar. Konstitusionalisasi hukum privat merupakan konsep di mana konstitusi mengatur ketentuan-ketentuan yang sebelumnya masuk dalam ranah hukum privat. Konsep ini berkembang seiring dengan berkembangnya pemikiran tentang hak asasi manusia dan konsep fundamental rights. Konsekuensinya, terjadi pencampuran antara hukum privat dengan hukum publik yang aktualisasinya semakin nyata terutama pasca lahirnya peradilan konstitusional yang bertugas untuk menjaga hak-hak fundamental yang dijamin dalam konstitusi.Kata Kunci: konstitusionalisasi, hukum privat, hukum publik, hak-hak fundamental, hak asasi manusia. Constitutionalization of Privat Law: Some Emerging Thoughts in Legal StudiesAbstractThere are distinction between private and public law in the study of law. Theoretically the differentiation is strict and clear, but in practice they often interrelate or even overlap, which leads to vagueness in their distinction. Constitutionalization of private law is when the provision of the constitution interfere the clause in private law. The thoughts of constitutionalization of private law develop as concurrently with human rights and fundamental rights thoughts and concept. Constitutionalization of private law creates the incorporation of private and public laws. Abstract

Indonesia, as a democratic state of law, performs state management based on the principle of rule of law and the principle of democratic state. One aspect of the implementation of the rule of law and democracy is the provision of legal protection for the public and their parcipation in the public administration, including supervision on the government. In order to achieve this, an Ombudsman institution was established by Indonesian Government in 2000. This institution is intended as a public supervision agency to improve the protection of the rights of the public in obtaining public services, justice, and prosperity. There are currently over one hundred countries in the world with Ombudsman institutions as their government supervision. Every ombudsman institutions have their own unique traits, which is also the case with the Ombudsman institution in Indonesia. This paper discusses the characteristics of the Ombudsman institution in Indonesia and its comparison with some of the Ombudsman institutions of other countries such as Sweden where the Ombudsman originated, the Netherlands, the United Kingdom, and France. Untuk mencapai hal tersebut Pemerintah Indonesia sejak tahun 2000 telah membentuk lembaga Ombudsman. Lembaga ini dimaksudkan sebagai lembaga pengawasan publik untuk meningkatkan perlindungan hak-hak masyarakat guna mendapatkan keadilan dan kesejahteraan yang lebih baik. Saat ini ada lebih dari seratus negara di dunia telah memiliki lembaga ombudsman sebagai lembaga pengawasan pemerintahan dengan karakteristik atau ciri-ciri tersendiri. Makalah ini membahas karakteristik lembaga Ombudsman di Indonesia dibandingan dengan beberapa lembaga Ombudsman di negara-negara lain yaitu dengan Swedia sebagai negara asal dari Ombudsman, Inggris, dan Perancis. Abstract

AbstrakLaporan Delri yang disampaikan oleh Pemerintah Indonesia kepada Komite Hak Asasi Manusia PBB menyatakan bahwa ICCPR telah menjadi bagian dari hukum nasional Indonesia sehingga substansi ICCPR dapat diterapkan secara langsung di pengadilan nasional tanpa memerlukan peraturan pelaksana. Selain itu, dikatakan pula bahwa Mahkamah Konstitusi telah merujuk secara langsung pada Pasal 2 ICCPR dalam beberapa putusannya seperti putusan untuk kasus Nomor 101/PUU-VII/2009 tentang Pengujian terhadap UU Advokat Nomor 18/2003 dan putusan untuk kasus Nomor 73/PUU-IX/2011 tentang Pengujian terhadap UU Pemda Nomor 32/2004 sebagaimana yang telah diamandemen oleh UU Nomor 12/2008. Sayangnya, Pasal 2 ICCPR tersebut pada kenyataannya tidak dapat diterapkan sebagai rujukan langsung dalam putusan-putusan pengadilan karena substansi pasal ini tidak mengatur hak dan kewajiban individu, tetapi negara. Pasal 2 ICCPR sebenarnya hanya ingin menjelaskan status hukum dari ICCPR bagi negara-negara pihak. Secara filosofis, Pasal 2 ICCPR menyatakan bahwa ICCPR bukanlah perjanjian internasional yang dapat diterapkan secara langsung di pengadilan nasional negara-negara pihak karena keberlakuannya memerlukan peraturan pelaksana, yaitu berupa undang-undang. Dalam praktiknya, Indonesia menganut model dualisme dengan pendekatan transformasi dalam penerapan perjanjian internasional di level nasional. Semua perjanjian internasional yang telah diratifikasi harus ditransformasikan ke dalam undang-undang agar dapat digunakan oleh hakim karena hakim hanya terikat oleh peraturan hukum yang dibuat oleh DPR dan perjanjian internasional hanya dapat diterapkan melalui metode interpretasi hukum.Kata Kunci: International Covenant on Civil and Political Rights, Komite Hak Asasi Manusia, penerapan, pengadilan nasional, perjanjian self-executing dan non-self-executing. The Implementation of International Treaties in Municipal Courts: A Critic to the Initial Report of the Indonesian Delegations to the United Nations Human Rights Commitee regarding the Implementation of International Covenant on Civil and Political Rights in IndonesiaAbstractThe initial report, submitted by the Government of the Republic of Indonesia to the UN Human Rights Commitee in 2013, stated that the ICCPR—which Indonesia has ratified, is part of the domestic law of Indonesia. It, therefore, can be directly applied in municipal courts without previous establishment of an implementing legislation. It has also been stated that the Constitutional Court of Indonesia has made a direct reference to the Article 2 of the ICCPR; for instance in the case Number 101/PUU-VII/2009 regarding judicial review on the Advocate Act Number 18/2003, and the case Number 73/PUU-IX/2011 regarding judicial review on the Regional Government Act Number 32/2004 as amended by the Act Number 12/2008. The writer argues that the Article 2 of the ICCPR cannot be used as a direct reference as the article is intended only to govern the rights and duties of states, not individuals. In other words, the ICCPR governs the rights and duties of the State Parties. Specifically, this article stipulates that the ICCPR is a non-self-executing treaty because it needs an implementing legislation for its implementation at the municipal level. Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis mengapa praktik trademark squatting dapat terjadi dalam proses pendaftaran merek beserta cara mengatasinya. Selanjutnya, penelitian ini juga membahas mengenai konsepsi ideal terkait proses pendaftaran merek di Indonesia guna menghindari dan meminimalisasi praktik trademark squatting. Penelitian ini merupakan penelitian kualitatif yang bersifat yuridis empiris dan data yang terkumpul dianalisa dengan metode deskriptif kualitatif. Hasil penelitian menunjukkan bahwa praktik trademark squatting merupakan suatu tindakan mendaftarkan merek milik orang lain yang belum terdaftar, sehingga membuat pemilik merek yang sebenarnya tidak dapat lagi mendaftarkan mereknya. Setelah itu, pelaku menjual sertifikat hak atas merek tersebut kepada pemilik aslinya dengan harga melebihi biaya permohonan pendaftaran merek pada umumnya. Kendala yang ditemui dalam proses pendaftaran merek di Indonesia adalah kurangnya sumber daya manusia dalam menangani jumlah permohonan pendaftaran merek yang mencapai ribuan setiap harinya. Hal ini berdampak pada tidak optimalnya proses pendaftaran merek di Indonesia yaitu dengan menggagas suatu sistem yang bernama first to file based on use guna mengoptimalisasikan perlindungan pemilik merek, pertimbangan untuk meratifikasi Madrid System juga merupakan salah satu opsi lain untuk mencegah praktik trademark squatting.Trademark Squatting Practice in Trademark Registration Process in IndonesiaAbstractThe purpose of this research is to identify and analyze why the practice of trademark squatting could occur in Indonesias trademark registration process along with the constraints found in the trademark registration process in Indonesia and how to overcome them. Furthermore, it will also discuss the ideal conception related to trademark registration process to avoid and minimize the practice of trademark squatting. This research is an empirical legal research and all data were analyzed with qualitative methods. The results showed that trademark squatting is an act performed by actors (trademark squatters) to file trademarks application owned by others, so that when application registered by the real owner is rejected, the trademark squatters will offer the real trademark owners to buy the certificate with unreasonable price. Obstacle encountered in the process of trademark registration in Indonesia is the lack of human resources who handle the application which caused the inspection process to become ineffective. The ideal concept of the trademark registration process can be achieved by initiating first to file based on use system to strengthen protections for trademark owner. Abstract

Relasi dan interaksi antara hukum internasional dan nasional merupakan salah satu isu penting sekaligus kontroversial dalam hukum internasional. Mengomentari hal ini Lambertus Erades mengatakan sebagai berikut: “The relation between international and municipal law is a subject with which many generations of lawyers have wrestled, are westling and will continue to wrestle”(Lambertus Erades: 1980: 376). Meskipun kedua sistem hukum ini memiliki sejumlah perbedaan yang dapat ditelusuri baik dalam praktik maupun teori, namun keduanya memiliki sejumlah titik persamaan, salah satu diantaranya adalah kedua sistem hukum tersebut menjadikan negara sebagai subjek sekaligus objek kajiannya. Persoalan pokoknya adalah, apakah kedua sistem hukum itu merupakan satu kesatuan (Monisme) atau merupakan dua sistem hukum yang terpisah (Dualisme) dan bagaimana pola interaksi diantara kedua sistem hukum tersebut. Para pakar hukum internasional berbeda pendapat dalam mendudukkan masalah ini. This book compiles his research and advocacy in Asias privacy development since 1970, as well as his writings on Asian Privacy Development in Privacy Laws & Business International Report. This book is the result of his long collaboration with many privacy law experts from many States in Asia and has been published in numerous books and journals. The book is written because the author believes that privacy in its many forms is worth protecting as one of the rights protected under human rights laws. Abstract

AbstrakPenelitian tentang kebijakan netralitas politik Pegawai Negeri Sipil (PNS) dalam pemilukada ini dimaksudkan untuk mengevaluasi kebijakan dalam rangka mengantisipasi keterlibatan PNS dalam aktivitas politik praktis maupun menunjang aktivitas politik praktis, khususnya dalam pelaksanaan pemilukada di wilayah Jawa Tengah. Pendekatan yang digunakan dalam penelitian ini bukan hanya pendekatan doctrinal, tetapi juga penelitian terhadap hukum sebagai law in action yang non-doktrinal. Subyek penelitiannya adalah KPU Provinsi Jawa Tengah, Bawaslu Provinsi Jawa Tengah, Panwalsu, KPUD, dan BKD di Kabupaten Banyumas, Purbalingga, Semarang, Solo, dan Karanganyar. Berdasarkan hasil penelitian, diketahui bahwa sumber masalah dalam penerapan netralitas PNS adalah lemahnya fungsi koordinasi dan penerapan sanksi. Hal ini didasarkan pada permasalahan substansi yang bias dalam menempatkan netralitas PNS sebagai objek hukum. Hasilnya, terciptalah kebijakan yang sifatnya sektoral yang tidak dapat menuntaskan permasalahan, baik dari unsur kelembagaan, ketatalaksanaan, maupun penegakan hukumnya.Kata kunci: netralitas politik, Pegawai Negeri Sipil (PNS), pemilukada, partai politik, politik praktis.  Policy on Political Neutrality of Civil Servants in Regional ElectionAbstractThis research on the political neutrality policy for civil servants in the regional election has the intention to evaluate the policy in order to anticipate the involvement of civil servants in political activities, especially in the Regional Election of Central Java. In this regard, the approach used by this study is not only doctrinal, but also the study of law in action as non-doctrinal. The subjects of this research are KPU of Central Java Province, Bawaslu of Central Java Province, Election Supervisory Committee, the Election Commission and BKD in Banyumas, Purbalingga, Semarang, Solo, and Karanganyar. The research found that the identified source of problem is the weak function of coordination and implementation of sanctions. The problem is due to the biased legal substance which confines the neutrality of civil servants as an object of law. It creates sectoral policies those are unable to resolve the problems from institutional, managerial, and law enforcement aspects.Keywords: political neutrality, civil servants, regional head election, political party, low politics.DOI: https://doi.org/10.22304/pjih.v1n3.a7
