Abstract

The provisions on good corporate governance in Law. 40 of 2007, not yet firmly set in the articles of Limited Liability Company Act is only set implicitly. A more comprehensive arrangement can be found in the Decree of Minister of State. KEP-117/M-MBU/2002 on the Application of Good Practice on Corporate Governance of State Owned Enterprises (SOEs). Responsibilities of directors in implementing good corporate governance is concerned with the provision that the directors are fully responsible for the management company for the benefit of the company in accordance with the company's goals and objectives in terms of the implementation of good corporate governance directors in good faith and responsibly carry out their duties in the interest and effort company and are solely responsible for the accuracy and concordance any data or information provided by the company to the public (society). And if there is a loss due to the negligence and mistakes of directors may be held jointly and severally responsible.

Abstract

Penulisan jurnal ini memiliki tujuan adalah untuk mengeatahui secara jelas kepastian perlindungan hukum bagi konsumen PT. PLN apabila terjadi kesalahan pembacaan kWh meter listrik yang tentunya merugikan konsumen itu sendiri serta untuk mengetahui tanggung jawab PT. PLN terkait kesalahan pencatatan kWh meter listrik. Metode yang digunakan untuk penelitian ini adalah metode yuridis normatif. Adapun hasil dari penelitian ini ialah perlindungan konsumen berasaskan kepastian hukum, keselamatan, dan keamanan konsumen yang dapat kita lihat dalam Undang-Undang Perlindungan Hukum, dan Undang-Undang Ketenagalistrikan dimana sudah dapat menjamin kepastian hukum serta hak-hak bagi konsumen pengguna tenaga listrik. Terkait kesalahan pembacaan kWh meter listrik jelas bahwa PT. PLN tidak memenuhi kewajibannya dengan baik serta konsumen tidak mendapatkan haknya yang tentu saja PT. PLN wajib bertanggung jawab dimana PT. PLN wajib memberikan pengurangan apabila realisasi lama dan/atau jumlah gangguan serta tingkat kesalahan pembacaan kWh meter listrik jumlahnya melebihi di atas tingkat mutu pelayanan yang ditetapkan PT. PLN maka PT. PLN wajib memberikan pemotongan tagihan listrik sebesar 20% sampai 35% dari biaya beban konsumen dan diperhitungkan dibulan berikutnya. Kata Kunci: Kepastian Hukum, Perlindungan Konsumen, Tanggung Jawab ABSTRACT The purpose of writing this journal is to clearly know the certainty of legal protection for consumers of PT. PLN if there is an error in reading the kWh electricity meter which is certainly detrimental to the consumer itself and to find out the responsibility of PT. PLN related to the error in recording the electricity kWh meter. The method used for this research is the normative juridical method. The results of this study are consumer protection based on legal certainty, safety, and consumer security which we can see in the Law on Legal Protection, and the Electricity Law which can guarantee legal certainty and rights for consumers who use electricity. Regarding the error in reading the electricity kWh meter, it is clear that PT. PLN does not fulfill its obligations properly and consumers do not get their rights which of course PT. PLN is obliged to be responsible where PT. PLN is obliged to provide a reduction if the realization of the old and/or the number of disturbances and the error rate of reading the kWh meter of electricity exceeds the level of service quality set by PT. PLN then PT. PLN is required to provide electricity bill cuts of 20% to 35% of the cost of consumer expenses and calculated in the following month. Abstract

The users of electronic service provider often suffered losses caused by internet services did not work properly including losses due to leakage of personal data protection stored in cloud computing.  The study aims to examine electronic service provider liability upon their failure performing internet services properly and security attacks on cloud computing. This study was normative legal research by examining national and international legal materials. The finding shows that the electronic provider shall be responsible based on right and obligation agreed under the agreement.  Related to cloud computing, providing adequate security to avoid security attacks and misuse of private data that caused losses to the users becoming the liability of service provider. Based on the Federal Trade Commission Act, the liability arises on the grounds of deceptive and unfair trade practices.  Under the General Data Protection Regulation of the European Union, the liability arises on the basis as the controller then provider liable for compensation for user’s suffered damage. In Indonesia, based on the Electronic Information and Transaction Law Amendment, the liability to the owner of personal data whose rights are violated and suffered losses arises due to a failure of ISP protect the data security. For better protection in Indonesia, the protection of big data and clear territorial scope of protection become necessary to consider.

Abstract

ABSTRACTPublic Service Entity „Badan Layanan Umum‟ which is governed in the Governmental Regulation concerning the Financial Management of the Public Service Entity refers to any government institution which gives services to the public in the forms of products and/or services but benefit is not the main objective. It does its activities based on the principles of efficiency and productivity. The objective is to improve the services provided to the public as an attempt to increase the public welfare and to sharpen the nation‟s life. Finance is flexibly managed based on the principles of economy, productivity, and the application of healthy business practice. Abstract

Tujuan studi ini untuk mengetahui pengaturan penggunaan jasa penagih utang oleh bank dalam menagih utang kepada nasabah pengguna kartu kredit serta menganalisis perlindungan hukum terhadap nasabah dalam proses pembayaran melalui jasa penagih utang. Metode yang digunakan yaitu penelitian hukum normatif dengan pendekatan perundang-undangan serta konseptual. Hasil studi menunjukkan pihak bank diperbolehkan menggunakan jasa penagih utang dalam penagihan utang nasabah apabila pada saat kredit nasabah pengguna kartu kredit telah digolongkan kredit macet oleh bank. Hal tersebut telah diatur dalam PBI Nomor: 14/2/PBI/2012 dan SEBI Nomor 14/17/DASP. Pihak bank wajib memberitahu nasabah pengguna kartu kredit apabila menggunakan debt collector dalam penagihan utangnya. Tenaga penagih utang harus mematuhi etika dan syarat-syarat penagihan serta pihak bank wajib melakukan pengawasan terhadap kinerja debt collectornya. Tenaga penagih utang dilarang tegas untuk melakukan kekerasan atau mempermalukan nasabah pengguna kartu kredit pada saat penagihan utang. Apabila terjadi tindakan kekerasan oleh debt collector kepada nasabah maka nasabah dapat melakukan pengaduan ke seluruh kantor bank sebagai bentuk perlindungan hukum. Mengenai pengaduan telah diatur dalam PBI Nomor: 10/10/PBI/2008. Kata Kunci: Perlindungan Hukum, Nasabah Kartu Kredit, Jasa Penagih Utang, Penagihan Utang. ABSTRACT The purpose of this study is to examine the arrangements for the use of debt collection services by banks in collecting debts from credit card users and to analyze the legal protection of credit card customers in the payment process through debt collection services. The method used is normative legal research with a statutory approach and conceptual approach. The results of the study show that banks are allowed to use debt collection services in collecting customer debt if at the time of credit, the credit card user is classified as bad credit by the bank. This has been regulated in PBI Number: 14/2 / PBI / 2012 and SEBI Number 14/17 / DASP.The bank is obliged to notify customers of credit card users if they use debt collectors in collecting their debts. Debt collectors must comply with ethics and collection requirements and banks are required to supervise the performance of their debt collectors. Debt collection personnel are strictly prohibited from committing violence or embarrassing credit card users when collecting debts. If there is an act of violence by a debt collector against a customer, the customer can file a complaint to all bank offices as a form of legal protection. Regarding complaints, it has been regulated in PBI Number: 10/10 / PBI / 2008. Keywords: Legal Protection, Credit Card Customers, Debt Collection Services, Debt Collection.

Abstract

Penulisan ini berjudul “Kebijakan Dalam Penjatuhan Sanksi Pidana Terhadap Tindak Pidana Pelacuran Sesuai Dengan Perda Kota Denpasar No. 2 Tahun 2000”. Di Bali masalah pelacuran diatur dengan Perda No. 2 tahun 2000 tentang Pemberantasan Pelacuran di Kota Denpasar, kebijakan hukum pidana ini dibuat dengan tujuan untuk menegakkan norma dalam masyarakat, namun minimnya penjatuhan sanksi pidana yang diberikan tidak membuat efek jera bagi pelaku tindak pidana pelacuran. Metode penelitian yang digunakan adalah metode penelitian hukum normatif, melalui pendekatan undang-undang. Permasalahan yang diangkat yaitu bagaimana penjatuhan sanksi pidana terhadap pelaku tindak pidana pelacuran sesuai dengan Perda Kota Denpasar No. 2 Tahun 2000, dan apakah kebijakan hukum pidana dalam menangani tindak pidana pelacuran telah berjalan dengan efektif. Kesimpulan yang diperoleh adalah Penjatuhan sanksi pidana terhadap pelaku tindak pidana pelacuran melihat ketentuan Pasal 6 Perda Kota Denpasar No 2 Tahun 2000 yakni pidana kurungan paling lama 3 bulan atau denda paling banyak Rp. 5.000.000,-, dan Kebijakan formulasi dalam menangani tindak pidana pelacuran dirasa sudah tidak efektif lagi, hal ini dikarenakan Perda Kota Denpasar No. 2 Tahun 2000 memiliki kekosongan norma sehingga perlu diperbaharui dan ditinjau kembali.

Abstract

The role of banks in society today is very important and strategic, given the bank as a financialinstitution and is the measure of a country's financial system. Strategic role is a primary function ofbanks as institutions that can raise and channel public funds effectively and efficiently with ° Basedon economic democracy, to support the implementation of development nasional. Bank is afinancial institution which is where people save their money solely based on the belief that moneywill be recouped in time and with benefits such as interest. With the increasing number of bankstoday resulted in increased competition among banks. Of competition there are indications that leadto the banks less competitive behavior affects the health of the banks concerned eventuallyexperienced bankruptcy because of bad credit. The presence of large amounts of bad loans willcertainly bring banks to the struggling bank liquidation so that there was a problem.Based on the description of the background of the above it can be stated the following researchquestion: How does the role of the team in the process of liquidation of the bank's liquidation inaccordance with applicable law and the position of directors How bank after bank liquidation teamsetting?Problem solving is a very important role in the Liquidation Team bank liquidation process.Liquidation Team has the authority to perform maintenance tasks on the liquidated banks settle therights and obligations of the bank. Of arrangements made Liquidation Team is expected to providemaximum protection against the interests of bank creditors, while the bank's board of directorsposition after setting the Liquidation Team is to assist the team in completing the task managementliquidation of banks in liquidation and can be held responsible, together with shareholders terms ofthe elements found errors and omissions of the Board of Directors resulting bank license has beenrevoked and liquidated.

Abstract

Perkembangan teknologi terutama perkembangan internet yang pesat di Indonesia menjadikan setiap orang memanfaatkannya dalam kegiatan bisnis serta transaksi menggunakan internet. Tetapi kehadiran jual beli online ini seringkali justru menyebabkan satu atau dua belah pihak baik penjual ataupun pembeli mengalami kerugian. Tujuan penulisan artikel ilmiah ini guna mencari tahu urgensi dilakukannya pengaturan pengawasan mengenai perlindungan hukum atas konsumen saat bertransaksi jual-beli online serta memberi kejelasan pihak yang berwenang untuk pelakukan pengawasan terhadap transaksi jual-beli dengan cara online. Penelitian ini termasuk penelitian hukum normatif. Adapun metode dalam pengumpulan data mempergunakan studi kepustakaan. Kesimpulan yang ditarik dalam penelitian ini, yaitu Proses transaksi bisnis elektronik (online) dapat berjalan selaras dan seimbangan melalui pengawasan yang tegas dalam penerapannya. Transaksi daring yang dilakukan antara pengusaha dan konsumennya harus memiliki maksud yang baik sejak awal. Untuk mencegah sesuatu yang tidak diinginkan produk harus memenuhi SNI. Pengawasan perlindungan konsumen dilaksanakan bersama-sama oleh masyarakat, pemerintah, juga Lembaga Perlindungan Konsumen Swadaya Masyarakat (LPKSM) melihat semakin beragamnya produk yang ditawarkan di pasar. Kata Kunci: Transaksi online, Pengawasan, Perlindungan konsumen ABSTRACT The development of technology, especially the rapid development of the internet in Indonesia, makes everyone use it in business activities and transactions using the internet. But the presence of buying and selling online often actually causes one or two parties, both the seller and the buyer, to suffer losses. The purpose of writing this scientific article is to find the urgency of conducting supervisory arrangements regarding legal protection for consumers when online selling and buying and to provide clarity to the authorities to carry out supervision of selling and buying transactions online. This research includes normative legal research. The method of data collection using literature study. The conclusion drawn in this study is that the electronic (online) business transaction process can run in harmony and balance through strict supervision in its implementation. Online transactions between entrepreneurs and their consumers must have good intentions from the start. To prevent something unwanted, the product must meet SNI. Supervision of consumer protection is carried out jointly by the community, the government, as well as the Non-Governmental Consumer Protection Agency (LPKSM) seeing the increasing variety of products offered in the market. Abstract

The law consequence of joint agreement beetwen Koperasi and Bank at Denpasar in order to give KPR. Problem shown up in related matter on placement of Koperasi on the joint agreement on KPR from Bank? And what is the law consequence related to the jammed KPR in given KPR from Bank? Writing method using empiris yuridis method which is descriptive. Based on the research the result of the placement of Koperasi in joint agreement to facilitate KPR are as a facilitator and guarantor the member of Koperasi. If the credit jammed in order to return the KPR from the member of koperasi then as the joint agreement regulation as a result Koperasi have to buyback the house which is funded by the KPR itself. Then the conclusion in joint agreement between Koperasi and Bank in order to give the KPR plecement between Koperasi and Bank is not balance because as a facilitator and guarantor Koperasi should not having responsibility to buy back the house which has been sold and on the credit agreement of money loaning is only happen between the Bank and the member of Koperasi as the regulation article 1340 point (1) KUHPerdata, the agreement is just valid between both sides that make the agreement.

Abstract

Tujuan penelitian ini untuk mengetahui dan memahami hak opsi dalam perjanjian sewa menyewa tanah dan akibat hukum bila hak opsi dalam perjanjian sewa menyewa tanah dilanggar oleh yang menyewakan. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan Perundang-undangan. Adapun hasil yang diperoleh dalam penelitian ini yaitu bahwa hak opsi dalam suatu perjanjian sewa menyewa tanah harus diatur secara jelas dalam suatu akta perjanjian sewa menyewa baik yang dibuat secara dibawah tangan maupun secara otentik, sehingga tidak menimbulkan penafsiran terhadap maksud serta persyaratan terhadap hak opsi itu sendiri. Hak opsi dalam perjanjian sewa menyewa tanah merupakan hak yang diutamakan bagi penyewa dalam perjanjian sewa menyewa tanah, hak mana diberikan oleh yang menyewakan, khususnya untuk kepentingan penyewa dan juga kepentingan yang menyewakan. Agar terjaminnya kepastian hukum atas perpanjangan sewa menyewa dimaksud. Apabila hak opsi dalam perjanjian sewa menyewa tanah dilanggar oleh pihak yang menyewakan maka akibat hukumnya penyewa dapat menuntut untuk pemenuhan pemberian hak opsi tersebut oleh yang menyewakan. Tuntutan sebagaimana dimaksud dapat di awali dengan suatu proses mediasi (musyarawwah untuk mencapai kesepakatan) atau bahkan dapat dilakukan melalui suatu gugatan pengadilan. Kata kunci : Hak Opsi, Perjanjian, Sewa Tanah ABSTRACT The purposes of this research are to know and understand option right in land leasing agreement and the legal consequences if the option right in land leasing agreement is being violated by the lessor. This research is using normative method with legal and juridical approach. As for the result obtained in this research is that option right in the land lease agreement must be regulated clearly in a certificate of lease whether it’s created under hand or under seal, so that there won’t be multi-interpretations about the meaning and the requirements regarding the option right itself. Option right in the land lease agreement is a prioritized right in the land lease agreement, which is given by the lessor, especially for the interest of the lessee and also the lessor for the legal certainty’s assurance of the extension of the leasing mentioned before. If the option right in the land lease agreement is being violated by the lessor, then the legal consequences are the lessee could demand for the fulfilment of the giving of the option right by the lessor. The demand mentioned could be initiated by the mediation process (deliberation to reach consensus) or even could be done through court lawsuit. Keywords: Option Right, Agreement, Land Leasing
