Abstract

Criminal sanctions that regulate narcotics crimes have emphasized the sanctions that will be given to anyone who violates them, ranging from rehabilitation to the death penalty. However, there are still many who commit these violations, until now, there are various forms of modus operandi for committing a criminal act in distributing narcotics. Perpetrators do not run out of wits to do all kinds of ways to achieve their goals. This mode is developed because law enforcement officers are intensively carrying out prevention efforts to eradicate narcotics crimes. One form of the mode that is carried out is through drug intermediaries or couriers, by neatly wrapping and inserting into plastic capsules, stored in boxes or cans, tucked in candy or food, to places that have been specially designed so as not to be penetrated by detection equipment. The perpetrators of these drug couriers are not only carried out by Indonesian nationals, but have also been carried out between foreign countries through foreign nationals. Narcotics distribution is carried out in various ways through land, sea and air transportation. From the various modes carried out by the perpetrators of drug couriers, it is not uncommon for them to be unsuspected so that they can escape various forms of examination by the authorized law enforcement officers.

Abstract

Cigarettes without excise duty or cigarettes with a hammer excise stamp on them can also be said to be illegal cigarettes with the characteristics of the original excise stamps including that the original excise stamps can be detected by naked eye, the hologram paper is usually green with the Indonesian symbol but the color can change every year, and Original excise tape paper has worm-like fibers and watermarks. Cigarettes that are mandatory for distribution in Indonesia can be achieved with business legality, production legality, and promotion legality as the bureaucracy of cigarette distribution in Indonesia. And as explained above, that smoking is a product of processed tobacco, in accordance with Law Number 39 of 2007 concerning Excise, cigarette packages must be affixed with and attached with excise tape as proof of excise payment so that cigarettes can be said to be legal to offer, hand over, provided for sale. Law Number 39 of 2007 concerning Excise also regulates that cigarettes that circulate without excise bands and do not comply with the applicable laws are said to be illegal cigarettes, anyone who distributes them can be said to be against the law and can be subject to imprisonment and fines.

Abstract

Narcotics are substances that primarily have anesthetic effects, or can reduce consciousness, and can also cause other physical and mental symptoms if used continuously and wildly with the result, among other things, of becoming dependent on these substances. Narcotics abuse is the use without rights and against the law which is carried out not for the purpose of treatment, therapy because you want to enjoy its effects, in excessive amounts, irregularly, and lasts long enough to cause physical, mental and social health problems, this is in line with increasing activity. distribution of illegal narcotics by a network of international groups to developing countries. Types of class I drugs are heroin/putaw, cocaine, marijuana, methamphetamine, etc., a narcotics crime is an act that violates the provisions of the narcotics law, in this case Law Number 35 of 2009 concerning narcotics and other provisions including and/or does not conflict with the Law. The problem in this research is how the pretrial decision of the BNN East Kalimantan Province (Tenggarong) regarding narcotics abuse is based on decision number 1/Pid.Pra/2023/PN.Trg, the legal basis in the pretrial decision of the BNN East Kalimantan Province based on decision number 1/Pid .Pra/2023/PN.Trg. The research method uses a normative juridical approach, the types of data used are primary data and secondary data. Data collection through decision research and field research and analyzed qualitatively, data processing through editing, data classification, and data systemization.

Abstract

Pelarangan dalam penguasaan senjata penikam telah menjadi masalah klasik yang sudah sangat lama diterapkan mengingat bahaya yang dapat ditimbulkan dari senjata penikam atau sejenisnya yang dapat mendorong niat atau keinginan seseorang untuk melakukan tindak pidana. Penelitian ini berfokus pada pertanggungjawaban anak di bawah umur telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana membawa senjata tajam berdasarkan Putusan Nomor 48/Pid.Sus-Anak/2023/Pn Tjk. Permasalah penelitian yang akan dibahas dalam penulisan ini adalah apa faktor penyebab pelaku melakukan tindak pidana dan bagaimana pertanggungjawaban anak dibawah umur berdasarkan Putusan Nomor 48/Pid.Sus-Anak/2023/Pn Tjk. Metode penelitian dilaksanakan secara yuridis normatif dan empiris. Jenis data yang dipergunakan dalam penelitian ini berupa data sekunder dan primer, yang diperoleh dari studi kepustakaan dan studi lapangan. Teknik analisis data dalam penelitian ini menggunakan analisis yuridis normatif. Berdasarkan hasil penelitian dan pembahasan diketahui faktor penyebab yaitu (1) Motivasi Intrinsik, (2) Motivasi Ekstrinsik yang terdiri dari, Faktor keluarga, Faktor pendidikan dan sekolah, Faktor pergaulan anak, serta Faktor media sosial. Pertanggungjawaban pelaku yaitu Pidana Pelayanan Masyarakat sebagai Marbot di Masjid Miftahul Iman, Jln. Wartawan Gg. Hi. Ahmad, Kelurahan Gunung Sulah, Kecamatan Way Halim, Kota Bandar Lampung selama 40 (empat puluh) jam dengan ketentuan 1 (satu) jam untuk setiap harinya. Abstract

The development of science and technology has triggered the use of genetic engineering. Genetic engineering is the transplantation of genes into other genes, both between genes and across genes, to produce valuable products for living creatures. Genetically engineered food products, due to the development of modern biotechnology in the field of genetic engineering technology, have given rise to new legal problems because of the possibility of posing a risk to human health. This research uses a normative juridical approach with an emphasis on secondary data. This research uses doctrinal research methods. The research specifications used are analytical descriptive. The research results show that there is no special legal protection for consumers of genetically engineered food products, because it still refers to consumer protection contained in the UUPK. It should be noted that genetic effects resulting from human genetic engineering need legal protection. Protection and intellectual property rights, where everyone, individually or collectively, must be a consumer of goods and services, so the parties need equal legal protection. Therefore, the responsibility of producers of genetically engineered food products for consumer losses must be able to fulfill the principle of justice because the economic position of producers is higher than that of consumers. By implementing the principle of absolute responsibility, the producer responsibility law will foster an attitude of caution for producers of genetically engineered food products to maintain the quality of their products.

Abstract

The embodiment of West Lampung Traditional Cultural Expressions has not been optimal both in terms of intellectual property protection and in terms of its usefulness for the local community of West Lampung. In this article, we will discuss how intellectual property legal protection is implemented if it is implemented in the protection of traditional cultural expressions and how far has the West Lampung Regency Government tried to protect and utilize the potential of traditional cultural expressions. This article aims to identify a model of protection against traditional cultural expressions in West Lampung by using normative and empirical legal research methodologies. The results of the discussion show that the Protection of Traditional Cultural Expressions is carried out based on Law Number 28 of 2014 concerning Copyright, Law Number 5 of 2017 concerning the Advancement of Culture, Law Number 11 of 2010 concerning Cultural Conservation and Government Regulation Number 6 of 2017. 2015 concerning Museums, and Regulation of the Minister of Culture Number 106 concerning Indonesian Intangible Cultural Heritage in addition to the autonomy of the Regional Government of West Lampung Regency has also made efforts to preserve istiadar custom through the Regional Regulation of West Lampung Regency Number 14 of 2000 concerning the Guidance, Preservation, and Development of Indigenous Peoples. and Customary Institutions. The West Lampung Regency Government also seeks to protect and preserve traditional cultural expressions by participating in activities such as traditional festivals organized by the Lampung Provincial Government so that the existence of traditional cultural expressions in West Lampung Regency is known to the public. However, overall the protection of the majority of traditional cultural expressions has not been inventoried and utilized optimally, including the traditional cultural expressions of West Lampung. There should be immediate efforts to regulate the protection of traditional cultural expressions in a sui generis manner apart from the Copyright Law.
