Abstract

Penelitian ini ingin menjawab faktor apa saja yang meleatarbelakangi tidak terlaksananya ‘uqubat restitusi, serta upaya yang dapat dilakukan untuk memperoleh hak restitusi terhadap korban perkosaan. Selama tahun 2018, wilayah hukum Mahkamah Syar’iyah Jantho yang menanggani kasus perkosaan tidak pernah menerapkan uqubat restitusi terhadap pelaku perkosaan. Penelitian ini menggunakan pendekatan yuridis empiris, lokasi penelitian di wilayah hukum Mahkamah Syar’iyah Jantho. Hasil penelitian menunjukkan bahwa Qanun Jinayat telah menjamin pemberian hak kepada korban perkosaan. Hak restitusi terhadap korban perkosaan belum terlaksana disebabkan upaya dari korban sendiri tidak membuat laporan, pengaduan, dan pengakuan untuk ditinjaklanjuti oleh penegak hukum. Pada dasarnya upaya yang dapat dilakukan untuk mendapatkan restitusi bagi korban tindak pidana perkosaan adalah adanya pengakuan dari korban, yang menderita dan juga adanya dukungan dari pihak keluarga atau masyarakat yang partisipasi terhadap korban sehingga mengajukan permohonan kepada yang berwajib untuk menjalani proses selanjutnya dengan tujuan agar terpenuhi hak korban. The Implementation of ‘Uqubat Restitution to Rape Victim This research wants to answer what factors are the underlying that have not been implemented the ‘uqubat restitution’, and the efforts to obtain restitution rights for rape victims. During 2018, the Jantho jurisdiction of the Syar'iyah Court never applied the restitutionary sentence to rape perpetrators. This study uses an empirical juridical approach, the location of the study is in the Jantho Jurisdiction of the Syar'iyah Court. The results showed that Qanun Jinayat had guaranteed granting rights to rape victims. The right to restitution of rape victims has not been realized due to the efforts of the victims themselves not to make reports, complaints, and confessions to be followed up by law enforcement. Basically, efforts that can be made to obtain restitution for victims are recognition of the victim and also support from the family or community so that the victim submits an application to the authorities to undergo legal proceedings in order to fulfill the victims' rights.

Abstract

ABSTRAK: Artikel ini ingin menjawab hal yang menjadi pertimbangan yang diberikan Badan Pertimbangan Jabatan dan Kepangkatan kepada Bupati bagi Aparatur Sipil Negara yang akan diangkat dalam jabatan struktural. Selain itu, hal lain adalah keterlibatan badan ini dalam melakukan seleksi Aparatur Sipil Negara yang akan diangkat dalam jabatan struktural. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis-normatif. Hasil penelitian menunjukkan bahwa peran dari Badan Pertimbangan Jabatan dan Kepangkatan dalam mengangkat atau memilih pegawai negeri yang akan diangkat dalam jabatan struktural adalah hanya sebatas wewenang urusan menyeleksi administrasi. Badan ini tidak terlibat dalam pengambil keputusan akhir, akan tetapi hanya melakukan tugas administrasi untuk diajukan kepada kepala daerah terkait pegawai negeri yang akan menduduki jabatan struktural. Artikel ini menyarankan agar kepala daerah mengikutsertakan Badan Pertimbangan Jabatan dan Kepangkatan dalam urusan pengambilan keputusan. Official Consideration Body Authority and Official Ranking in Fulfilling Structural Position ABSTRACT: This article is going to answer the consideration given by the Office of Official Rank Consideration and Duty to the Head of District for civil servants who will be appointed in the official ranks. In addition, it also explores the involvement of this body in the selection of the State Civil Apparatus to be appointed in structural positions. This is juridical-normative research. The findings show that   the role of the Office of Official Position Consideration and Duty in appointing or choosing a civil servant who will be appointed in a structural position is only limited to the authority of administrative process. This body doe not involve as the final decision-maker, it only performs the administrative duty to be submitted to the head of the region related to the civil servant who will occupy the structural positions. It is recommended that the head of the region should include the Office the decision making process.

Abstract

Penelitian ini bertujuan mengkaji akibat hukum terhadap notaris yang tidak membuka kantor, dikaitkan dengan pengawasannya. Setelah pengambilan sumpah dan pelantikan, notaris wajib menjalankan jabatannya secara nyata yaitu salah satunya wajib membuka kantor. Kenyataanya masih ditemukan notaris yang tidak membuka kantor. Metode penelitian ini adalah yuridis empiris, dengan mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataan masyarakat. Hasil penelitian menunjukkan bahwa akibat hukum bagi notaris yang tidak membuka kantor, Majelis Pengawas Daerah bisa merekomendasikan kepada Majelis Pengawas Wilayah dan Majelis Pengawas Pusat untuk menjatuhkan sanksi terhadap notaris yang kantor tidak dibuka. Diharapkan Majelis Pengawas Daerah lebih tegas dalam melakukan pengawasan terhadap notaris yang tidak membuka kantor, melakukan pemeriksaan dan pembinaan secara rutin kepada notaris supaya tidak ada notaris yang tidak membuka kantor, dan notaris bisa melaksanakan tugas dan kewajibannya sesuai dengan perundang-undangan yang berlaku. Supervision of Notary That Does not Open an Office This study aims to examine the legal consequences of notaries who do not open offices, linked to their supervision. After taking an oath and inauguration, the notary is obliged to carry out his position significantly, one of which must open an office. The fact is still found notary who does not open an office. The research method is empirical juridical, by reviewing the applicable legal provisions and what is happening in the reality of society. The results showed that the legal consequences for notaries who did not open offices, the Regional Supervisory Council could recommend to the Regional Supervisory Council and the Central Supervisory Council will impose sanctions. It is hoped that the Regional Supervisory Council will be more assertive in supervising notaries, conduct regular checks and guidance so that there are no notaries who do not open offices, and notaries can carry out their duties and obligations in accordance with applicable laws.

Abstract

The purpose of this study is to analyze the responsibility of taxpayers who manipulate transaction values in order to reduce Fees for Acquisition of Land and Building Rights (BPHTB). This research is inspired by the results of previous research that many BPHTB taxpayers manipulate transaction values to reduce BPHTB, but they are missed from legal responsibility, so that their actions seem normal in society and are not perceived as despicable and violating of the law. This research is a normative legal research using a statutory approach, so that it can be seen how the responsibility of taxpayers who are not honest in paying BPHTB. The results showed that in statutory regulations cannot be found administrative sanctions imposed on taxpayers who manipulated transaction values to reduce BPHTB. In fact taxpayer's actions are really detrimental regional finance, because their taxes are paid to the Regional Treasury as the original financial resources. Sanctions contained in statutory regulations are only criminal sanctions, as regulated in Article 174 of Law Number 28 of 2009 with the threat of imprisonment for a maximum of one year if due to negligence and a maximum of two years if done intentionally.

Abstract

Penelitian ini untuk mengetahui alasan pemerintah kabupaten tidak melibatkan perancang peraturan perundang-undangan dari Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia dalam pembentukan qanun. Sebagaimana ditentukan dalam Undang-Undang Pembentukan Peraturan Perundang-undangan, setiap tahapan pemben-tukan peraturan perundang-undangan melibatkan perancang peraturan perundangan-undangan. Hal ini berdampak pada beberapa qanun yang dibatalkan oleh pemerintah. Metode pendekatan yang digunakan penelitian ini adalah yuridis empiris, yakni dengan memadukan data primer dan sekunder. Hasil penelitian menyatakan bahwa pemerintah kabupaten tidak memiliki anggaran untuk melibatkan perancang peraturan perundang-undangan, selain subtansi pengaturan dalam qanun belum perlu melibatkan perancang serta belum adanya kententuan yang mewajibkan melibatkan perancang dalam setiap pembentukan qanun. Penelitian ini menyarankan kepada pemerintah kabupaten untuk melibatkan perancang peraturan perundang-undangan demi menghasilkan sebuah produk hukum yang berkualitas dan dapat berdaya laku dalam masyarakat. The Involvement of Legal Drafter from Kemenkumham Aceh In Formstion of District Qanun This study aims to find out the reason for the district government not involving the drafting of laws and regulations from the Regional Office of the Ministry of Law and Human Rights in the formation of qanun. As determined in the Laws Formation of Laws and Regulations, each stage in the formation of laws and regulations involves the drafters of laws and regulations. This resulted in several qanuns being canceled by the government. This research uses an empirical juridical approach, which is by combining primary and secondary data. The results showed that the district government did not have a budget to involve the drafter of laws and regulations, in addition to the substance of the regulation in the qanun, it was not necessary to involve the designer and the absence of provisions requiring the involvement of the designer in each formation of the qanun. This research recommends that the district government involve the drafting of legislation in order to produce a qualityof legal product that can be empowered in society.

Abstract

ABSTRACT: This is the research explaining the legal status of and the existence of the Islamic Law Court in national judicial system, the authority of Aceh Government in enacting the local law derived from Islamic rules as a regulation for the court in acting in national judicial system. The rules would be a guidance for the court in fulfilling the justice for Moslems in Aceh thus the court would be more effective in holding its functions and the constraints faced by the Aceh Government and the court in implementing Islamic Law as a concrete action to fulfil the needed justice in society. The data are gathered by conducting library research and interview with the Islamic Law experts and the experts of criminal justice procedure and civil procedure law which then the data are discussed through.  In order to complete the data gathered from library research, field research is also conducted. The gathered data both from library and field research is analysed by qualitative normative approach then described descriptively.  The findings shows that the Act Number 11, 2006 regarding Aceh Governance has strengthened the legal status and the existence of the court as an Islamic Judicial Court inAceh Province that is apart of the national judicial system. Unlike, the Act Number 18, 2001, the authority that has been conferred to enact substantive and procedural law of the court has not been applied seriously even this is not priority. Therefore, it has not been able to give law certainty and protect the society from undue law process.  The main obstacles faced the practitioners are an unavailable of process law, especially criminal Islamic process law. The Authority of Aceh Government Towards the Conduct of Mahkamah Syar’iyah  in National Judicial System  (A Study on a Judicial Authority in the Context of Special Autonomy)
