Abstract

Perkembangan zaman telah menghantarkan dunia pada era globalisasi. Globalisasi identik dengan yang namanya kemudahan, kecepatan, dan berhubungan erat dengan teknologi serta inovasi. Salah satu perkembangan pada era globalisasi adalah sektor transportasi. Jika dulu masyarakat memilih taksi konvensional untuk mendapatkan sarana fasilitas yang aman dan nyaman, maka lain halnya dengan saat ini karena transportasi online khususnya taksi online menjadi sarana transportasi darat yang sedang digemari oleh masyarakat. Hal tersebut sempat menimbulkan pro dan kontra di antara para pengemudi. Guna mengakomodasi layanan taksi online tersebut Pemerintah melalui Menteri Perhubungan membuat Peraturan Menteri Nomor 118 Tahun 2018 tentang Penyelenggaraan Angkutan Sewa Khusus sebagai payung hukum dari taksi online. Dalam Peraturan tersebut ada salah satu Pasal yang mengatur mengenai kuota taksi online. Sebagaimana diketahui bahwa adanya kuota akan menyebabkan pembatasan jumlah kendaraan. Kemudian sejauh apa peraturan mengenai penetapan kuota ini dibutuhkan, bagaimana cara menetapkan kuota dan upaya apa saja yang dilakukan oleh Pemerintah dalam mengimplementasikan penetapan kuota tersebut. Selain itu dampak apa saja yang akan dialami oleh pengemudi dan pengguna dari adanya penerapan kuota.

Abstract

The development of currency trading is not only using the cash as a payment instrument for a transaction. For example is the emergence of non-cash payments such as negotiable instruments. That type of instrument offers a more effective and safer way than using the cash. Along with the development of the technology, a non-cash payment innovation emerged, which characteristics, at a glance, similar to negotiable instruments, such as credit cards, debit cards, and electronic money products which gives a safer and more efficient way than using the cash for a transaction. Based on this, led to the view that non-cash payment instruments such as credit cards, debit cards, and electronic money products can be classified as negotiable instruments. However, that classification must be done by reviewing the relevant regulations, such as Commercial Code and else and also observing the doctrines in the perspective of the science concerned, to state that the development of such instruments can be classified as negotiable instruments or not.Keywords:    Negotiable instruments, Letter of Value, Credit Cards, Debit Cards, Electronic Money Products, Classification.

Abstract

Applying the principle of good faith in the choice of law is one of the most common problems of international business contract, particularly in foreign direct investment contracts. The implementation of the principle of good faith in the choice of law increasingly reduced by the emergence of some problems in the investment contract, which of course, the most aggrieved entities are domestic investors who also host country. The choice of law has an important role in the contract because it concerns the interests of each of the parties, and the principle of good faith as a priority principle of international contract law should be applied as the basis for determining the choice of law for the parties to a contract. This paper examines the principle of good faith in the choice of law to realize justice among the parties with different laws, especially on private and public investment contracts between foreign investors and domestic investors in Indonesia, in the process of formation, implementation, or post-contract. This paper is legal research that is normative, meaning that this research is based on the prevailing laws and regulations in Indonesia. Then, the approach used is statute approach and conceptual approach. So it is expected that between the rules and the concept of existing topics will be aligned. Keywords: Choice of Law, Foreign Direct Investment Contracts, Principles of Good Faith.

Abstract

The specific task of the commercial banks are as follows: the bank must distribute most of the credit for developing the activities of the cooperatives and entrepreneurs economically weak or small entrepreneurs, the public banking that provides credit in foreign currency required to distribute some the foreign currency credit to finance the activities of non-oil exports and required to perform an assessment of the fulfillment the terms of the feasibility of the debtor's business. In carrying out its functions, the bank must still run banking principles contained in the articles contained in the Banking Act. It is often in distribute the credit, the bank requires the third party, such as the insurance companies. The purpose of insurance companies is to minimize the risks that may be experienced by the bank as debtors failed to pay. The bank is very concerned with their insurance company. There are various types of loans that cannot be separated by the insurance, this study focuses on consumer credit in PT. Bank Jatim. In practice, especially consumer credit lending cannot be separated from the role of the insurance companies. But in operating the bussiness, the insurance companies should also continue to apply the principles of general insurance. The application of the insurance principle is intended that no aggrieved parties. Generally speaking, there will be a conflict of interest between the application of the principles of insurance carried by the insurance company as an insurer with the business aspect of the field of insurance and banking.

Abstract

Perkembangan industri asuransi di Indonesia makin berkembang, hal ini dapat dilihat dari makin meningkatnya kesadaran masyarakat untuk ikut berasuransi. Menangkap peluang tersebut, maka saat ini banyak perusahaan asuransi bermunculan dengan menawarkan banyak produk dan jenis asuransi yang kompetitif. Asuransi syariah menjadi salah satu pilihan masyarakat yang dianggap sangat diminati karena dianggap lebih baik daripada asuransi konvensional. Dalam praktiknya perusahaan asuransi tidak semuanya memahami prinsip-prinsip dasar asuransi syariah sehingga pada praktiknya tidak sesuai dengan prinsip-prinsip tersebut. Untuk itu perlu ada kajian yang lebih dalam terkait dengan teknis dan prinsip asuransi syariah yang saat ini dijalankan oleh perusahaan-perusahaan asuransi syariah. Maka perlu diketahui pula oleh para nasabah, calon nasabah dan terutama perusahaan asuransi syariah mengenai prinsip General Takaful System (GTS). Diharapkan perusahaan tersebut benar-benar menjalankan prinsip asuransi syariah sesuai dengan Al-Quran, Hadist dan Peraturan Perundang-undangan yang berlaku di Indonesia agar tercapai kesejahteraan bersama.The development of insurance industry in Indonesia is growing, it can be seen from the increasing awareness of the public to participate in insurance. Capturing these opportunities, then the current many insurance companies have sprung up to offer a lot of products and competitive insurance types. Takaful be one of the people who are considered highly desirable because it is considered better than conventional insurance. In practice, insurance companies do not all understand the basic principles of Islamic insurance so that in practice is not in accordance with these principles. For that there needs to be a deeper study related to the technical principles of Islamic insurance which is currently run by insurance companies’ sharia. Then it needs to be known also by its customers, prospective customers and especially the Islamic insurance company regarding the principle of General Takaful System (GTS). It is expected that the company is actually running the principles of Islamic insurance in accordance with the Al-Qur’an, Hadist and legislations in force in Indonesia in order achieve common prosperity.

Abstract

Kemajuan teknologi mendorong adanya inovasi dalam bidang transportasi, khususnya dalam penyediaan jasa pengangkutan yang efisien dan efektif untuk menenuhi kebutuhan masyarakat. Di Indonesia, ojek yang merupakan jasa transportasi dengan menggunakan sepeda motor dinilai mampu menjadi transportasi publik alternatif yang dapat mengangkut orang dari satu tempat ke tempat lainnya dengan cepat dan dengan biaya yang terjangkau. Dengan perkembangan teknologi dan transportasi di era digital seperti saat ini, ojek konvensional kemudian bertransformasi menjadi ojek online, suatu jasa transportasi yang menggunakan aplikasi online sebagai media pemesanannya. Dari sudut pandang hukum pengangkutan, perjanjian pengangkutan yang terbentuk dalam pelaksanaan ojek online merupakan suatu bentuk baru yang dinamakan kontrak online. Konsensus sebagai syarat pembentukan sekaligus salah satu sifat perjanjian pengangkutan terpenuhi dengan adanya penawaran dari aplikasi penyedia layanan ojek online dan adanya penerimaan oleh pengguna aplikasi sebagai penumpang ojek online. Para pihak dalam pelaksanaan ojek online terikat dalam suatu hubungan kontraktual yang berbeda-beda. Pengemudi dan perusahaan aplikasi terikat dalam hubungan kemitraan yang didasarkan pada perjanjian kemitraan. Hubungan kontraktual antara pengemudi dan penumpang membentuk suatu perjanjian pengangkutan, sedangkan perusahaan aplikasi dan penumpang didasarkan pada perjanjian penggunaan aplikasi.The improvement of technology encourages the innovation of transportation sector, especially for the provision of efficient and effective transportation services to fulfill the community needs. In Indonesia, ojek as a two-wheeled transportation service considered as alternative public transportation which can transport a person from one place to another in a fast way and at affordable costs. With the development of technology and transportation in this digital era, conventional motorcycle taxi (in Indonesia: ojek konvensional) transformed into online motorcycle taxi (known as ojek online), a transportation service using an online application as the ordering media. From the scope of transportation law, the transportation agreement formed by the operation of ojek online is a new form of agreement called online contract. Consensus, as a transportation agreement requirement, is fulfilled by an offer from transportation service application and an acceptance from the users as ojek online’s passenger. The parties in the operation of ojek online bound by a different contractual relation. The driver and the application company bound by a partnership agreement. The contractual relation between the driver and passenger formed a transportation agreement, while the application company and passenger based on application usage agreement.

Abstract

Setiap warga negara Indonesia memiliki hak yang sama dalam hal mendapatkan kesehatan, pedidikan dan pekerjaan yang layak. Hal tersebut merupakan amanah dari Undang-Undang Dasar Republik Indonesia yang harus diwujudkan oleh Pemerintah. Untuk itu perlahan namun pasti, Pemerintah telah mensosialisasikan beberapa program yang pro rakyat, salah satunya adalah dengan menghadirkan program Badan Penyelenggara Jaminan Sosial (BPJS). BPJS memiliki 2 program besar yaitu dalam hal kesehatan dan ketenagakerjaan. Untuk pendampingan ini lebih di fokuskan kepada BPJS Ketenagakerjaan. Hal ini karena di beberapa daerah masih banyak dijumpai ketidak pahaman atau bahkan tidak peduli terhadap program BPJS Ketenagakerjaan ini, terutama bagi pengusaha atau si pemberi kerja. Jika hal ini terus terjadi maka hak-hak para pekerja akan terabaikan dan tentu akan merugikan para pekerja itu sendiri. Sehingga dengan adanya pendampingan ini, diharapkan para pengusaha nantinya akan lebih peduli terhadap kesejahteraan dan keselamatan pekerja. Pada pendampingan ini pula, nantinya akan di berikan tutorial terkait bagaimana cara mendaftarkan para pekerja ke BPJS Ketenagakerjaan. Selain itu akan di beri penjelasan pula terkait hak dan kewajiban sebagai anggota dari BPJS Ketenagakerjaan, serta tidak lupa cara mengajukan klaim apabila ada pekerja yang mengalami kecelakaan saat menjalankan pekerjaannya. Pendampingan ini dilakukan di Kediri, dengan sasaran utamanya adalah pekerja tradisonal.

Abstract

Abstract— Cryptocurrency as a digital product has grown significantly. Cryptocurrency as a digital currency has been accepted by the world community, with different implementations in each country. Indonesian law regulates cryptocurrency as a commodity product that can be traded on the Futures Exchange. As a commodity, cryptocurrency monitoring is carried out by BAPPEBTI (Commodity Futures Trading Supervisory Agency). The position of cryptocurrency as a commodity is unfortunate by some, who expect cryptocurrencies to be recognized as legal tender as is the case in some countries. Securities law regulates the elements that must be met in order for an object to be recognized as a means of payment. This is also supported by current practices, namely the level of significant fluctuations in cryptocurrencies and the absence of government intervention which makes the government unable to carry out its role as controller. This study aims to determine the position of cryptocurrency in the perspective of Indonesian law. This study uses a type of normative juridical research with a statutory approach and a conceptual approach. The results of the study note that until now cryptocurrency cannot be recognized as a means of payment and is recognized as a commodity. Keywords: cryptocurrencies, securities law, means of payment

Abstract

ABSTRAK Besarnya potensi bisnis perdagangan elektronik (e-commerce) tidak terlepas dari perkembangan pengguna dan pertumbuhan internet di Indonesia. Banyaknya keuntungan yang didapatkan dalam belanja online, mengakibatkan berbagai penyedia belanja online bermunculan, salah satunya adalah Shopee. Bentuk dan interaksi pelaku bisnis e-commerce di Indonesia terbagi dalam berbagai jenis, Shopee merupakan jenis e-commerce Online Marketplace Provider (OMP) dan interaksi para pelaku bisnis Consumer to Consumer (C2C). Selain keuntungan yang didapat dalam belanja online juga terdapat risiko yang mungkin terjadi pada saat pengiriman barang sepertinya rusak atau musnahnya barang saat di terima oleh pembeli. Untuk melihat siapa yang dapat dimintakan pertanggungjawaban atas barang yang musnah atau rusak baik sebagian maupun seluruhnya dapat dilihat melalui hubungan hukum yang telah terjadi sebelumnya. Perlu ditinjau peran Shopee sebagai Online Marketplace Provider (OMP) dalam melindungi kepentingan konsumen, peran dan fungsi pengangkut atau ekspeditur pada saat proses pengiriman barang dan peran dan pertanggungjawaban penjual yang ada pada Shopee. Untuk memberikan jaminan kepastian hukum bagi pembeli atau konsumen, Pemerintah telah mengesahkan peraturan perundang-undangan terkait belanja online antara lain Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 dan Undang-Undang Nomor 8 Tahun 1999 Untuk menganalisis peran dan fungsi dari para pihak, maka metode penelitian yang digunakan statute approach, case study approach, conceptual approach. Kata kunci: e-commerce; online marketplace provider; pengiriman barang; tanggung gugat. ABSTRACT The great potential of the electronic commerce business (e-commerce) is inseparable from the development of internet users and the growth of the internet in Indonesia. The many benefits gained in online shopping, resulting in many various online shopping providers that have sprung up, One of them is Shopee. The forms and interactions of e-commerce businesses in Indonesia are divided into various types, Shopee is a type of e-commerce Online Marketplace Provider (OMP) and the interaction of Consumer to Consumer (C2C) businesses. In addition to the benefits of shopping online there are also risks that may occur when shipping goods. The risk that may occur is damaged or destroyed goods when received by the buyer. Therefore it is necessary to review the role of Shopee as an Online Marketplace Provider (OMP) in protecting the interests of consumers, the role and function of the carrier or expeditor during the process of shipping goods and also the role and responsibility of the seller in Shopee. To provide legal certainty guarantees for buyers or consumers, the Government has passed legislation relating to online shopping including Law Number 19 Year 2016 Regarding Amendments to Law Number 11 Year 2008 and Act Number 8 1999. Pertumbuhan bisnis asuransi di Indonesia mengalami peningkatan yang luar biasa. Namun untuk beberapa golongan masyarakat masih ada yang belum mengerti tentang pentingnya berasuransi. Hal ini dapat disebabkan antara lain karena citra yang kurang baik dari perusahaan asuransi atau penanggung dalam memberikan klaim asuransi kepada tertanggung atau penerima manfaat.
