Abstract

Human Traffickingis one of the most common crimes occurs in Indonesia. To eradicate this crime, the government issued the 21/2007 of Human Trafficking Act (UU PTPPO). The statue sanctions persons committing the crime and providing protection to witnesses and victims. The law accomodate a number of penalties for the perpetrators of this crime, ranging from principal punishment, in the form of imprisonment and fine, to additional criminal and ballast. Although Islamic law does not explicitly regulate this crime, it is clearly contrary to Islamic principles of freedom, independence, equality and human dignity.

Abstract

Up to now, the law is still considered discriminatory and gender inequality. Though the law should be equal or sensitive to gender inequality to guarantee women’s rights. By following the principle of equality in all areas of the good men  and women have equal rights or opportunities to participate in every aspect of social life and state. so if there is discrimination against women, it is a violation of women’s rights. women’s rights violations occur due to many things, including the result of the legal system, where women are victims of the system. Reform Order is the most progressive period in the protection of human rights. Various laws and regulations come outin this period, including laws and regulations concerning women’s rights. Seen from the government’s efforts to eliminate discrimination based on sex are included in many  legislations.

Abstract

The decision of the Constitutional Court No.22/PUU-XV/2017, leaves a problem regarding marriage dispensations in the Religious Courts, namely the increasing amount of marriage dispensations.This study discusses the high amount of case for marriage dispensation, the role of the judges on tightening marriage dispensation procedures and the impact of the Constitutional Court Decision No.22/PUU-XV/2017 on the Determination of Marriage Dispensation at the Indramayu Religious Court in 2016-2019. This research uses the empirical juridical method. Collecting data using interviews and documentation. The results show that several aspects have affected the high amount of case for marital dispensation, among others: promiscuity, lack of basic religious education, cultural factors, poverty and low levels of education. The role of the Indramayu Religious Court of Judges on tightening the marriage dispensation procedure, i.e: looking at the truth of the background to the marriage dispensation application and checking the Legality of Birth Certificate and Income Certificate from the Village Head. Constitutional Court Decision No. 22/PUU-XV/2017 which became the basis for the determination of Law no. 16 of 2019 concerning the age limit for marriage of 19 years for men and women, was not effectively implemented toward the Marriage Dispensation at the Indramayu Religious Court in 2016-2019.

Abstract

AbstractImprisonment as the main criminal is the most threatened against offenders. Imprisonment in Indonesia criminal law as a legacy of colonial law enforcement. With the development of the concept of criminal theory form retributive to restorative sentencing, imprisonment and the implementation should be reviewed so that can be in accordance with human rights principles. This research examined the imprisonment in the Indonesian criminal law, customary criminal law, and Islamic Penal law, and also the concept of imprisonment renewal in the concept of Criminal Law Code of Indonesia, and then what is the punishment that is accordance with restorative justice theory that can protect the human rights of the convicted person, victims, and society.Key Word: Imprisonment, human rights, restorative justice.AbstrakPidana penjara sebagai pidana pokok merupakan pidana yang paling banyak diancamkan terhadap pelaku kejahatan. Pemberlakuannya merupakan peninggalan hukum kolonial. Dengan perkembangan pemikiran mengenai konsep pemidanaan dari retributif ke restoratif, pelaksanaan pidana penjara pun harus dikaji ulang sehingga dalam penjatuhan maupun pelaksanaannya dapat sesuai dengan prinsip hak asasi manusia. Penelitian ini mengkaji penerapan pidana penjara dalam hukum pidana Indonesia, hukum pidana adat, dan hukum pidana Islam, serta konsep pembaharuan pidana penjara dalam RKUHP, kemudian bentuk pembaharuan pemidanaan apakah yang sesuai dengan teori restorative justice yang dapat melindungi hak asasi terpidana, korban, dan masyarakat.Kata Kunci: Pidana penjara, hak asasi manusia, keadilan restoratif

Abstract

AbstractLegal assistance is a constitutional right of every citizen that is non-derogable rights as an effort to fulfil access to justice and equality before the law, especially for the poor and who doesn’t understand law. The implementation of legal assistance in the Cimahi Religious Court are not optimum due to lack of information, the presence of individuals who seeks personal benefits, and a common sense of high cost advocate services. This study is aimed to determine the implementation of legal assistance for the poor in the Cimahi Religious Court along with its supporting factors. This research is a qualitative research with descriptive analytical method and an empirical juridical approach. The utilized data are primary and secondary data. Data collection is done by interview techniques and literature studies. The implementation of legal assistance in the Cimahi Religious Court is still not effective due to legal factors, law enforcement factors, facilities, community factors and cultural factors. The inhibiting factor in legal assistance is a lack of socialization, difficult access for the community, and a culture in apparatus seeking personal gain. Supporting factors in legal assistance include good relations between legal aid agencies, increased awareness of the Village apparatus and KUA, and the existence of Cimahi Religious Court Website.Keywords:legal assistance, equality before the law, poor society. AbstrakBantuan hukum merupakan hak konstitusional setiap warga negara yang bersifat non derogable rights sebagai upaya mewujudkan Acces to Justice dan Equality Before The Law terutama untuk masyarakat miskin dan buta hukum. Fenomena yang terjadi di Pengadilan Agama Cimahi masih kurangnya informasi bantuan hukum, adanya oknum yang mencari keuntungan pribadi, dan anggapan mahalnya jasa advokat membuat pelaksanaan bantuan hukum belum maksimal. Penelitian ini bertujuan untuk mengetahui pelaksanaan bantuan hukum bagi masyarakat miskin di Pengadilan Agama Cimahi beserta faktor penghambat dan penunjangnya. Penelitian menggunkn penelitian kualitatif dengan metode Deskriptif Analitis dn pendekatan Yuridis Empiris. Data yang digunakan adalah data Primer dan Sekunder. Pengumpulan data dilakukan dengan teknik wawancara dan studi pustaka. Pelaksanaan bantuan hukum di Pengadilan Agama Cimahi masih belum efektif karena faktor hukum, faktor penegak hukum, faktor sarana, faktor masyarakat dan faktor budaya. Faktor penghambat dalam bantuan hukum adalah kurangnya sosialisasi, akses masyarakat yang masih sulit, dan ada budaya di aparat yang mencari keuntungan pribadi. Faktor penunjang dalam bantuan hukum diantaranya adanya hubungan baik antar lembaga pemberi bantuan hukum, meningkatnya kesadaran perangkat Desa, KUA dan ada Website Pengadilan Agama Cimahi.Kata Kunci :Bantuan Hukum, Equality Before The Law, Masyarakat Miskin

Abstract

Dengan adanya kebijakan penghapusan peradilan adat maka secara yuridis yang diakui dalam sistem peradilan di Indonesia yaitu peradilan negara. Namun di Sumatera Barat eksistensi lembaga penyelesaian sengketa adat ini masih berjalan sebagaimana mestinya. Berdasarkan hal tersebut tulisan ini akan mengkaji mengenai praktik penyelesaian sengketa adat di Sumatera Barat. Penulisan artikel ini menggunakan metode pendekatan sosiologis yuridis, mengkaji kaidah, konsep, pandangan masyarakat, doktrin-doktrin hukum. Hasil kajian menunjukkan bahwa tahapan beracara penyelesaian sengketa secara adat dilakukan dengan asas bajanjang naiak batanggo turun yaitu melalui tahap Bakaum (musyawarah antara kaum), Bakampuang (penyelesaian di setiap kampung), kemudian tahap Pasukuan (penyelesaian dibantu oleh suku lain) dan Babalai Bamusajik. Apabila tidak selesai maka diajukan kepada Lembaga Kerapatan Nagari.

Abstract

Abstract: This research reveals that the settlement of criminal cases in Indonesia is at present constructed through criminal justice system organized by the government. The system places abuse of criminal law as an abuse of state concerns, not as a violation to individuals. The formulation and meaning of criminal acts are not viewed as acts of personally and concretely violating the victim’s law concern, but they are seen as the abuse of state norms. Meanwhile, from the model of criminal case settlement in Islamic criminal law, it is found that the arrangement differs from the Indonesian current state of the art. The flow of formal Islamic criminal law provides an opportunity for the victim to prosecute, even to determine the compensation amount. Academically, the formulation of Islamic criminal law possesses a potential of being a reforming model for the setllement of criminal cases in Indonesia.
