Abstract

AbstrakEra reformasi ditandai dengan adanya pemberian hak, wewenang, dan kewajiban bagi daerah otonom untuk mengatur dan mengurus sendiri urusan pemerintahan serta kepentingan masyarakat setempat sesuai dengan peraturan perundang-undangan. Penyelenggaraan pemerintahan daerah diarahkan untuk mempercepat terwujudnya kesejahteraan masyarakat melalui peningkatan pelayanan, pemberdayaan, dan peran serta masyarakat, serta peningkatan daya saing daerah dengan memperhatikan prinsip demokrasi, pemerataan, keadilan, dan kekhasan suatu daerah dalam sistem Negara Kesatuan Republik Indonesia. Dalam Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah, hubungan kewenangan antara pemerintah pusat dengan pemerintah daerah berimplikasi pada praktik pengawasan, khususnya pengawasan preventif yang cenderung terlalu ketat. Abstract

The floating TI problem will also have an impact on policies on environmental conservation, fisheries and cultural change. Subjectivity of policy issues.  This research approach is socio-legal. Research with such an approach, views the law in its complex face, not only stops at the norm, but also targets how the process of formation is up to its implementation. TI floating problems must be identified related to issues of authority, economic and environmental issues. With this concept, this research was carried out by conducting a step review of norms for the first stage. In the next stage, a search for certain norms related to floating TI is carried out the act of number 4 ‘ 2009 on Minerals and Coal. It was only analyzed by offering how floating law enforcement related to IT in the Bangka Regency area. Policy problems are only possible when humans make judgments about the desire to change some problem situations. The policy problem is the result / product of human subjective assessment, the policy problem can also be accepted as legitimate definitions of objective social conditions and hence policy problems are understood, maintained and changed socially; and there are many solutions to a problem as there are many definitions of the problem. Problems and solutions are in constant changes.

Abstract

Perkembangan teori hukum tidak bisa dilepaskan dari lingkungan zamannya. Upaya memahami hukum harus dimulai dengan mamahami tatanan sosial lingkungannya. Tatanan sosial tersebut pada dasarnya mewakili cara berfikir manusia terhadap lingkungan sosialnya, yang selalu terikat dengan ruang dan waktu. Artikel ini ingin menjawab masalah utama yakni: apa saja pemikiran hukum Satjipto Rahardjo dalam kerangka ilmu hukum? Bagaimana kerangka pemikiran berbasis teori hukum dari Satjipto Rahardjo terkait dengan pembangunan hukum dalam konsep hukum progresif? Pemikiran hukum progresif dari Satjipto Rahardjo, lahir karena keadaan Indonesia pada masa lalu, berkaitan dengan usaha dari pemikir hukum untuk menawarkan gagasannya agar persoalan hukum di negeri ini tidak menemui ?jalan buntu?. Namun demikian konsep pembangunan hukum, konsep hukum progresif berperan penting di dalamnya.

Abstract

Dinamika politik hukum pengaturan mengenai kewenangan perizinan mineral dan batu bara mengalami perubahan yang cukup signifikan. Semula kewenangan diberikan oleh undang-undang kepada pemerintah daerah, saat ini kewenangan tersebut diambil alih oleh pemerintah pusat. Tujuan dari penelitian ini ingin mengetahui arah dan dasar filosofis politik hukum yang melatarbelakangi perubahan Undang-Undang Minerba serta implikasinya terhadap kewenangan perizinan pertambangan. Manfaat yang diperoleh dari penelitian agar dapat diketahuinya beberapa perubahan yang signifikan kewenangan perizinan pertambangan berikut pula syarat dan tahapannya. Metode penelitian menggunakan penelitian hukum normatif. Hasil kajian penelitian menyajikan kesimpulan bahwa paradigma sentralistik pemberian izin secara terpadu menandai pula bergesernya kewenangan daerah yang semula secara atribusi menjadi kewenangan delegasi. Penegasan arah politik hukum pertambangan merupakan prioritas kewenangan pemerintah pusat ketika beberapa pasal-pasal strategis telah dilakukan perubahan bahkan dihapuskan. Perubahan formulasi dalam Pasal 4 (hak penguasaan mineral dan batu bara) dan Pasal 6 (kewenangan pengelolaan pertambangan) UU Minerba Tahun 2020 menunjukkan tidak adanya lagi keberpihakan terhadap pemerintah daerah untuk memberikan alokasi kewenangan perizinan pertambangan.The dynamics of the legal politics of regulating mineral and coal licensing authorities have undergone significant changes. Initially, the authority was given by law to local governments, now this authority is taken over by the central government. The purpose of this research is to find out the direction and philosophical basis of the legal politics behind the amendments to the Minerba Law and its implications for the mining licensing authority. The benefits obtained from research are so that some significant changes in mining licensing authority can be identified as well as the terms and stages. The research method uses normative legal research. The results of the research study present the conclusion that the centralistic paradigm of granting permits in an integrated manner also marks the shift of regional authority from attribution to delegation authority. Affirming the political direction of mining law is a priority for the authority of the central government when several strategic articles have been amended and even eliminated. Amendments to the formulation in Article 4 (mineral and coal control rights) and Article 6 (mining management authority) of the 2020 Minerba Law show that there is no longer any partiality for local governments to allocate mining licensing authority.

Abstract

The statement that human life in society is governed by law. The law referred to here is the law known in the Regulations of State product legislation, established by the authorities, socialized through books, books and writings, not understood as the law that lives in society as a social construction even those that are thus only classified as social norms. The presence of law in the community agrees to integrate and coordinate interests that can conflict with each other that are integrated in order to be able to strengthen as little as possible. Organizing those interests is carried out with those interests and interests. The law that discusses this is a community-made law that contains the daily knowledge of each individual member of the community as a starting point for the birth of a social order.

Abstract

Consideration of the importance of environmental preservation based on local wisdom is an embodiment of the law that lives in the community. The law works and is embedded in a socio-cultural matrix to answer the problem of inventory of local wisdom in the Bangka Belitung Islands Province. Research carried out with a non-doctrinal approach (socio-legal research) is an approach in legal research in which law is conceptualized as an empirical phenomenon observed in the realm of experience. Local wisdom in the Bangka Belitung Islands Province includes those in Bangka Regency (ampak tin), West Bangka Regency (customary sanctions of the jungle bulin), and Belitung Regency (macara taun) as explained above, as a representation of environmental preservation in the Bangka Belitung Islands Province. Keywords: Lokal Wisdom, Environmental Conservation, Bangka Belitung Islands Province.

Abstract

Secara umum sektor pertambangan selama ini memberikan kontribusi yang sangat besar bagi perekonomian Indonesia serta daerah-daerah yang menjadi lokasi pertambangan. Situasi khusus terjadi pada pertambangan rakyat di wilayah Provinsi Kepulauan Bangka Belitung yang justru menyisakan sejumlah kasus yang belum terselesaikan. Hanya saja, pemerintah daerah setempat nampaknya belum mangakomodir kearifan lokal untuk menyelesaikan kasus pertambangan rakyat dalam bentuk kebijakan daerah (baik peraturan ataupun penetapan). Penelitian ini bertujuan untuk menganalisis kearifan lokal terkait pertambangan rakyat tertransformasi ke dalam kebijakan daerah agar tetap lestari, berkembang, dan ditaati oleh masyarakat dengan penuh kesadaran. Artikel inimerupakan penelitian hukum normatif dengan mengidentifikasi peraturan perundang-undangan terkait adakah peluang mentransformasi kearifan lokal ke dalam kebijakan daerah.Bahan hukum primer diperoleh dari peraturan perundang-undangan terkait danbahan hukum sekunder berupa sumber kepustakaan danartikel-artikel ilmiah. Hasil penelitian menjelaskan bahwa kearifan lokal pada aktivitas pertambangan rakyat tidak terakomodir dalam kebijakan daerah sehubungan dengan keterbatasan kewenangan daerah dalam sektortersebut. Pintu masuk untuk mentransformasikan kearifan lokal ke dalam produk hukum daerah justru terdapat pada kewenangan pemerintah daerah baik provinsi maupun kabupaten/kota di bidang pengelolaan lingkungan hidup.

Penelitian dengan menggunakan metode sosio-legal research ini menemukan penyebab penambang timah inkonvensional (ti) tidak melaksanakan mekanisme izin sebagaimana dimaksud dalam perda provinsi Kepulauan bangka belitung tentang pengelolaan pertambangan umum karena mekanisme yang mensyaratkan harus berbentuk perusahaan (cv) dan bermitra, menyebabkan biaya dan waktu dan ketidaktahuan mereka. Budaya hukum penambang timah inkonvensional (ti) terhadap mekanisme berdasar perda pengelolaan pertambangan umum di provinsi Kepulauan Bangka Belitung karena pengetahuan dan persepsi penambang terhadap mekamisme tersebut, karena dari segi ekonomi, pendidikan dan pengetahuan tentang mekanisme perizinan , yang sebagian besar tidak menyadari birokrasi dan prosedur perizinan karena pendidikan mereka yang relatif rendah, pengurusan yang memakan waktu, sedangkan mereka menambang suatu lokasi hanya untuk sementara kalau sudah habis mereka pindah, perilaku “dak kawa nyusah” karena belum tentu lokasi yang akan ditambang itu menghasilkan. Legal science coupled with the values   of Pancasila , gave birth to legal experts who will make the rule of law in our country can not be separated from the Pancasila as the state . Containsbasic values   of local wisdom keindonesiaan that principles are translated into the fifth principle. Ultimately creating a socially just economy called Pancasila economy .Ilmu pengetahuan termasuk ilmu hukum yang tidak dibarengi dengan ilmu Ketuhanan (dalam Pancasila) adalah tidak lengkap. Ilmu hukum yang dibarengi dengan nilai Pancasila, melahirkan para pakar hukum yang akan membuat aturan hukum di Negara kita tidak terlepas dari Pancasilasebagai dasar negara. Mengandung nilai-nilai dasar dari kearifan lokal keIndonesiaan yang dijabarkan ke dalam kelima silanya. Pada akhirnya menciptakan perekonomian berkeadilan sosial yang disebut dengan ekonomi Pancasila.
