Abstract

Hukum haruslah dinamis, yang mana dengan kata lain dapat dikatakan pula bahwa hukum tersebut dapat berubah dan berkembang sebagai akibat dari faktor-faktor luar hukum yang mempengaruhi hukum tersebut. Dalam hal ini salah satu mengenai perubahan hukum sebagai bentuk dari kedinamisan hukum ini adalah mengenai kewenangan pemerintah yang terdapat pada hukum administrasi.Maka dari itu sebagai upaya dalam bidang administrasi yang bertujuan untuk menyelesaikan permasalahan tersebut maka pemerintah yang dalam hal ini adalah Presiden Republik Indonesia mengeluarkan Peraturan Presiden Nomor 14 tahun 2007 Tentang Badan Penanggulangan Lumpur di Sidoarjo, yang mana dengan adanya Peraturan Presiden ini maka diharapkan dapat mampu menanggulangi atau setidaknya mengatasi maupun mengurangi dampak dari semburan lumpur panas terhadap masyarakat, negara maupun dari pihak swasta.Keyword: Hukum, Pemerintah, Peraturan Presiden

Abstract

Mengenai ekspor dan impor sendiri pada zaman sekarang ini tampaknya tidak akan tidak terlaksana dengan baik apabila hanya mengandalkan pada dua belah pihak yaitu eskportir dan importir, tanpa adanya pengawasan dari lembaga multilateral yang dalam hal ini adalah WTO. sekalipun pada hakikatnya kegiatan ekspor impor tersebut merupakan sebuah perikatan yaitu perjanjian jual –beli antara eksportir dan importir. karena baik dari lingkungan eksportir maupun dari lingkungan importir pasti terdapat perbedaan-perbedaan, baik dalam hal regulasi maupun nilai kurs mata uang yang digunakan, sehingga dalam kegiatan ekspor impor tersebut diperlukan adanya suatu pihak atau lembaga yang menjamin terlaksananya pembayaran bagi kedua belah pihak. Abstract

Barriers on international trade is one of the complicated problems, therefore the efforts to eliminate it still have been doing by the countries around the world. Meanwhile the discrimination factor in international trade is one of the most important issue that can hamper trade and economic progress of a country, because discrimination can cause uneven distribution of goods and services which are aimed to prosper the people of a country. Therefore, the equal treatment among countries in international trade or as known as Most Favoured Nation Priciple, is crucial. This principle emphasizes equal treatment in every country so trading activity will be expected the same in any country. This Principle can automatically remove the obstacles that might occur in the international trade, by maximizing the role of the World Trade Organization in the International Trading arena.Key words: Most Favoured Nation, Discrimination, Trade.

Abstract

Insider trading is one of a crime that has a systemic impact and it’s difficult to prove. An abstractness of its action makes it hard to prove. Also, the impact has tremendous effect to the stock exchange in the stock market, an unhealthy condition of the stock exchange is very dangerous because it can make disbelief from the stakeholders which automatically will effect on investment in some countries. Abstract

Qawaid fiqhiyyah is a very important element in the contemporary application of Islamic law for the reason that values contained in the fiqiyyah qowaid is a pulse in any fiqh in-the-istinbath of contemporary Islamic jurists. Not only that qowaid fiqiyyah is a parameter benefit whether law is needed or not, but also its main role to ensure that any fiqh in istinbathkan does not contradict the texts, namely the Quran and Sunnah. By applying qowaid fiqiyyah into every attempt of making or interpreting a law, it can be ascertained that law meets the standards to be applied in contemporary society, so it is not feared that the law would lead to new problems or a conflict of norms to apply. Islamic law and qowaid fiqhiyyah have interrelationship with one another, this is because the dynamism of Islamic law embodied in fiqh is very dependent on qowaid fiqhiyyah, in this case the characteristic of the generality or generality of the rules that make the Islamic law can be applied to all Conditions at all times and times.

Abstract

Agreement in Arabic termed Mu'ahadah Ittfa, or Contract. In the language of Indonesia known by contract, agreement or approval meaning is an act where one or more bind itself against someone else or more. Equivalent of the word Agreement in Arabic is aqad. In terms of jurisprudence in general contract means something into someone's determination to carry out, both emerging from one party such as endowments, divorce, and the oath, as well as emerging from the two parties such as sale and purchase, rent, wakalah and pawn. On the basis of Islamic banking environment there are ikhiyati where this principle should be applied on the mudharabah financing contract. Basic Ikhtiyati/prudence had the meaning that each contract is done with careful consideration and implemented appropriately and carefully. The implementation of the principle of mudharabah financing contract on ikhtiyati requires the analysis of pembiyaan before the financing approved by the syariah bank, if the customer (mudharib) violate these restrictions, then the mudharib should be responsible in case of loss.

Abstract

Islamic law has a value of adaptability and flexibility, but also as a revelation that comes from God Almighty, Islamic law also are rigid, immortal and cannot be personalised way. The hallmark of the dynamics and flexibility combined with purity that can’t be fickle that is what makes the uniqueness of the Islamic law as revelation that can answer the entire question of the contemporary that appeared at this time. To understand the Islamic law need to instil an understanding between sharia and fiqh. Of which in respect of Islamic law as revelation from God Almighty, then that’s called Sharia, i.e. a set of international rules from God that its nature remains unchanged and immortal, but when looked at Islamic law is dynamic and flexible that it can adapt to the conditions of time and age then that is called fiqh. Which of course is part of the Islamic fiqh and must not be contrary to the Shariah, this article will lead to an understanding of the concept of Sharia and fiqh in General, to find the characteristics of the eternal, timeless until the day of resurrection, as well as dynamic and versatile development of the times.

Abstract

The Financial Services Authority only regulates information technology-based money lending and borrowing services that have not yet regulated sharia-based information technology financing services (fintech Syariah). This is evidenced by the provision of loan interest rates in the Financial Services Authority Regulation. This is contrary to sharia principles. The existence of Fintech Syariah is only based on DSN-MUI Fatwa Number 117/DSN-MUI/II/2018 which expressly states that information technology-based financing services are permitted with conditions that must be by sharia principles so that they cannot promise usury, gharar, maysir, tadlis, and dharar. Abstract

Article 171 section c the Compilation of Islamic Law which was ratified through the Presidential Instruction of the Republic of Indonesia Number 1 of 1991 stressed that one of the conditions for heirs in Islamic inheritance law is Mulsim. In its development, the requirement of the Islamic religious obligation is deemed not to provide justice, this can be seen from the many complaints filed by the community to the court. Based on this background, the formulation of the problem in this study is Firstly position of Non-Muslim Inheritance of Islamic Inheritance Inheritance according to positive law in Indonesia Secondly, to find out the position of Non-Muslim Inheritance Against Islamic Inheritance Inheritance from various court decisions in Indonesia. This research is a juridical research, with a statutory, conceptual, and case approach. The results of this study indicate, that First, according to positive law in Indonesia, Non-Muslim Heirs are not entitled to Islamic Inheritance. Secondly, in its development, to fulfill the sense of justice in the community, the judge in Indonesia, decided that the Non-Muslim heirs, although not entitled to become heirs, were still entitled to the inheritance of the Islamic heirs through the obligatory wills. This can be seen from the various court decisions that exist, such as Supreme Court Decision Number 368 K/AG/1995, Supreme Court Decision Number 51 K/AG/1999, Supreme Court Decision Number 16 K/AG/2010, and Supreme Court Decision No. 331 K/Ag/2018
