Abstract

In litigating in the court, the Defendant usually made an exception regarding the expiration of the suing rights verjaring, known as Exeptio Temporis. In the inheritance law the Civil Code regulates the passing of verjaring, Article 835 BW That claim (heirs has the right to submit a claim to obtain his inheritance against all people who control all or part of the inheritance on the basis of rights or without basis of rights) becomes past due with the passage of thirty year, counted and the day the inheritance was opened. The emergence of Undang-Undang Nomor 5 Tahun 1960 Tentang Peraturan Dasar Pokok-Pokok Agraria (Law of Basic Rules of Agrarian Principles) eradicates dualism as long as land is enforced with customary law in addition to agrarian law based on the Civil Code, so the Law of Basic Rules of Agrarian Principles revokes the second book of the Civil Code as long as it concerns the earth, water and natural resources that contained therein because the Law of Basic Rules of Agrarian Principles accommodates customary law.

Abstract

There are internal and external barriers to investigating criminal acts through the internet. Internal barriers in the form of a lack of education and knowledge of investigators on the internet itself, while external barriers can be in the form of locus delictinya can be abroad, investigative equipment that often lags behind the sophistication of the tools used by perpetrators of crime, damage to computers and/or mobile phones as goods evidence so that it cannot be used anymore, the difficulty of obtaining witnesses' testimonies who saw the transaction for themselves, as well as expert statements that require large costs.

Abstract

The business world needs certainty in carrying out economic activities that are the backbone of the economy, and business people need legal certainty so that there will be no multiple interpretations in carrying out these business activities. Banking is a business activity in the field of financial services that really needs the law to run its business. If there is no law, public fund raising will be chaotic. These activities require supervision and also require authority so that they can run in an orderly and calm manner. Legal uncertainty will be detrimental to all parties, be it the state, the people and business people. If you want to see further, surely the investment will not go well, which means that money from abroad will not enter Indonesia. Strengthening in law in the field of business is a must and also a lot of attention from developed countries. Evidence is a tool that can be used to strengthen the argument in the procedural law. The procedural law in a bankruptcy case has a difference, it must be proven simply. The normative juridical approach with analytical descriptive is the research method used in this paper. Simple proof of the existence of two or more creditors can be done through B.I Checking. Because the data is managed by the central bank in Indonesia, so the validity of the data can be guaranteed, and the data can be accessed via the internet, so that it can be easily  taken and displayed in court.

Abstract

Law Enforcement is essentially the upholding of ideas or concepts as well as an effort to realize the ideas of people's expectations to become reality. Law enforcement against criminal acts of abuse of residence permit in the immigration environment is carried out by the Civil Servant Investigator. In enforcing the law against perpetrators of misuse of residence permits, Civil Servants of immigration can coordinate with domestic law enforcement agencies, namely the Indonesian National Police, prosecutors and judges. The reality in the field often results in problems in the criminal investigation process carried out by the National Police and Civil Servant Investigators (PPNS) always experiencing ups and downs. The ups and downs can take the form of an incomplete investigation or an incomplete investigation such as the completion of a filing. Many cases of abuse of residence permit only go to the stage of administrative action. Enforcement of criminal law against illegal immigrants entering and entering Indonesian territory without going through immigration checks, namely that in resolving cases or law enforcement criminal acts against illegal immigrants entering and entering Indonesian territory are carried out in two ways namely administrative immigration actions (outside the criminal justice system) and actions projustitia (justice process) included in the criminal justice system (Criminal Justice System).

Abstract

Article 12 a PTPK Law only applies to State Employees and State Administrators. Article 12 a PTPK Law basically regulates the actions of civil servants or state administrators that are contrary to their duties or obligations. The convict Sujendi Tarsono alias Ayen is not a Civil Servant or a State Administrator. The person concerned is as an entrepreneur as Director of PT Ada Mobil / Owner Ada Jadi Mobil. In connection with the description above, the possibility that occurs is the occurrence of errors in persona and Error in Objecto, meaning that the wrong person and the wrong object that was decided to convict Sujendi alias Ayen. In my opinion, the defendant SUJENDI TARSONO alias AYEN can be categorized as Also Participating in this case Telling Doing (Middelijk daders). Forcing to do is someone who wishes to do something criminal, but does not do it himself, but rather tells others to do it. The person who ordered it uses someone else (ie the person who was told) to realize his intention. The main requirement (characteristic) of ordering to do is that the person who is told to be must be a person who cannot be accounted for legally (according to Criminal Law). The reasons are as follows: a. Because of criminal exemptions. b. Because one element of the crime was not fulfilled, for example the element of error (intentional), which is related to the intention (as a subjective element) in the occurrence of the crime. Those who do what is wrong (menrea) while those who do have no mistakes. The liability of the person who ordered it to do is limited to the act carried out by the material maker (the person ordered).

Abstract

The existence of the 1945 Constitution of the State of the Republic of Indonesia has been quite clear that it also encompasses marginal communities, one of which is street vendors, although explicitly it cannot be read. This is already apparent from one of the national goals contained in the 4th paragraph Opening of the Constitution of the Republic of the Republic which states "promoting public welfare". However, it is implicit in the provisions of Article 34 of the 1945 Constitution of the Republic of Indonesia in particular paragraph (2) of the state developing a social security system for all people and empowering people who are weak and unable to comply with human dignity. Promote general welfare (goodness) called bonum commune, including the marginal community, especially the street vendors who are specifically analyzed in this article. Thus, legal politics towards street vendors from the perspective of the 1945 Constitution of the Republic of Indonesia is adequate, and what must be improved is the political will of partiality towards street vendors.

Abstract

Community advisors are correctional officers at the Correctional Center who provide guidance to residents assisted by correctional facilities outside the authority of prisons. In the juvenile justice process, community supervisors in making reports on the results of community research (LITMAS). This social research serves to take a closer look at the background of children's social life in terms of economy, education, interactions and social interactions. The function of criminalization is no longer just a deterrent but also a process of social rehabilitation and reintegration of the Assisted People in prisons. In this investigation, it shows that the task of Community Guidance in making social research and assisting children in conflict with the law as suspects / defendants in juvenile criminal justice processes, and for adult suspects in certain criminal acts and LITMAS for the benefit of treating prisoners and coaching prisoners shows Community Guidance since the beginning Pelaksanaan Tugas Pembimbing Kemasyarakatan Dalam Proses Diversi Anak Yang Berkonflik Dengan Hukum di Balai Pemasyarakatan Kelas 1  of the legal process until the return of a prisoner and correctional protege to the community. Abstract

In carrying out its professional duties, the National Police has the authority of discretion that can be carried out in certain circumstances. Discretion is an authority given by law to law enforcement officers, especially the police to act in special situations in accordance with the judgment and conscience of the agency or the officer himself. This research formula is: 1). How to implement police discretion at the investigation stage; and 2). How far the effectiveness of the implementation of police discretion at the investigation stage. This research is a normative legal research, which uses secondary legal material as the main data. From the results of this study concluded that 1) The use of police discretion in stopping investigations, it appears that there is authority in certain cases or circumstances to make a decision whether to take action or not if a crime occurs and there are factors that influence the discretion of the police in stopping investigations between Other legal factors; law enforcement factors; community factors; infrastructure factors; and legal cultural factors; 2. The effective implementation of discretion must be carried out with caution by improving the quality of human resources in the field of law enforcement as well as the power or authority that is carried out based on law based on considerations and beliefs and emphasizes more on moral considerations rather than legal considerations and provides real justice by paying attention the risk and benefit side of an action taken

Abstract

Gender adalah konstruksi sosial maupun kultural yang dilekatkan oleh masyarakat pada laki-laki dan perempuan. Misalnya perempuan lemah lembut, penyayang, sabar dan tekun. Sedangkan laki-laki tegas, berwibawa, tidak cengeng dan sebagainya. Pembedaan gender ini kemudian diperkuat pula dengan mitos dan pembagian kerja seksual yang berlaku bagi masing-masing jenis kelamin. Misalnya perempuan lebih sesuai untuk memilih jurusan sastra, sosial atau ekonomi sedangkan laki-laki lebih cocok masuk jurusan teknik. Perempuan lebih cocok menjadi sekretaris, laki-laki lebih cocok bekerja di lapangan (hutan, lepas pantai, dan lain-lain). Bila sebuah keluarga memiliki dana terbatas untuk menyekolahkan anak-anaknya, prioritas akan diberikan kepada anak laki-laki untuk melanjutkan sekolah. Anak perempuan diharapkan dapat menerima ini karena ”setinggi-tingginya perempuan sekolah, nantinya akan ke dapur juga.” Perbedaan-perbedaan gender dikarenakan banyak hal, di antaranya dibentuk, disosialisasikan, diperkuat, bahkan dikonstruksi secara sosio kultural, melalui ajaran keagamaan maupun negara. Meniadakan diskriminasi tersebut di atas, kita membutuhkan kesetaraan gender (gender equality) atau pandangan bahwa perempuan dan laki-laki memiliki akses dan kesempatan yang sama di segala bidang. Kesetaraan gender bukan berarti perempuan harus menjadi sama dengan laki-laki, karena secara kodrati perempuan memang berbeda dengan laki-laki. Kesetaraan gender lebih berarti negara melakukan tindakan untuk memberikan kesempatan dan hak yang sama bagi laki laki dan perempuan.

Abstract

Tujuan penelitian ini adalah untuk menemukan sistem penyelesaian sengketa konsumen yang ideal dalam rangka memberi perlindungan kepada konsumen, dengan mengkaji ketentuan ketentuan penyelesaian  sengketa konsumen dan ketentuan-ketentuan tentang organisasi dan tata kerja Badan Penyelesaian Sengketa Konsumen (BPSK), yang terdapat di dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK), dihubungkan dengan ketentuan perundang-undangan lain tentang penyelesaian sengketa, pendapat para ahli, serta sejumlah putusan-putusan BPSK. Kajian dimaksudkan untuk menemukan kekurangan atau kelemahan dalam pengaturannya, yang dipandang memengaruhi penyelesaian sengeketa yang ideal: efektif, cepat, murah, dan adil. Hasil penelitian menunjukkan bahwa terdapat sejumah kelemahan di dalam ketentuan tentang penyelesaian sengketa sebagaimana terdapat pada UUPK, demikian juga dengan ketentuan yang menyangkut BPSK. Sikap dan pandangan lembaga peradilan konvensional dalam memandang putusan BPSK pun  turut memengaruhi efektivitas BPSK sebagai alternatif penyelesaian sengketa konsumen. Disarankan beberapa ketentuan tentang penyelesaian sengketa konsumen dan BPSK yang terdapat di dalam UUPK perlu direvisi.
