Abstract

Law No. 18 of 2003 concerning Advocates emphasizes the status of Advocates as one of the law enforcers who have roles and functions that are equal to the Police, Prosecutor's Office and Judicial Power as law enforcement officers, but there is specialness given by the law to lawyers, namely the independence of advocates in carrying out their duties and profession. The independence of advocates aims to support the implementation of a justice system that is free from power and political intervention in law enforcement, and with that independence the Advocate Profession is said to be a very noble profession (offiicium nobile). As a noble profession, of course, advocates are bound by ethical values ​​that become the guidelines in the implementation of their duties and authorities, where those values ​​are posited as a Professional Code of Ethics. Talking about advocates, of course it cannot be separated from law enforcement, talking about law certainly cannot be separated from the state system or the political colors of certain countries and so on. This article wants to explain how the code of ethics of the advocate profession in upholding the law is how the role of advocates in providing justice to society based on applicable law. In conclusion, this article wants to explain that the code of ethics can compensate for the negative aspects of the profession and with the existence of a code of ethics, community trust in a profession can be strengthened, because every client has the assurance that his interests will be guaranteed, and the implementation of legal aid must be in line with the breath that becomes the goal is protection human rights and ideals of justice.

Abstract

Hukum acara perdata merupakan hukum perdata formil, yang pada dasarnya berfungsi mempertahankan atau menegakkan hukum perdata materiil melalui pengadilan apabila terjadi pelanggaran terhadap hukum perdata materiil atau terjadi sengketa. Bahkan hukum acara perdata juga mengatur bagaimana tata cara memperoleh hak dan kepastian hukum manakala tidak terjadi sengketa melalui pengajuan “permohonan” ke pengadilan. Artikel ini ingin menjelaskan bagaimana mekanisme beracara di pengadilan perdata terhadap hukum acara perdata, dengan menggunakan metode penulisan secara normatif. Sebagai kesimpulan, artikel ini menjelaskan bahwa didalam beracara hukum acara perdata dapat ditinjau dalam dua aspek yakni dalam arti luas dan dalam arti sempit, dalam arti luas beracara meliputi segala tindakan hukum yang dilakukan, baik di luar maupun di dalam persidangan di pengadilan guna menyelesaikan suatu perkara menurut ketentuan hukum acara perdata. Sedangkan dalam arti sempit, beracara meliputi tindakan beracara di dalam persidang di pengadilan dari sidang pertama sampai dengan hakim menjatuhkan putusannya. Sedangkan untuk prosedur dalam pengajuan Gugatan di Pengadilan merujuk pada Pasal 118 ayat (1) Herizen Indlandsch Reglement (“HIR”)/Pasal 142 RBg. Abstract. Civil procedural law is formal civil law which basically is to defend or enforce material civil law through the court if there is a violation of the law toward material civil law or a dispute. Even the civil procedural law also regulates how to obtain legal rights and certainty, if there is no dispute through filing an "application" to the court. This article aims to explain how the procedure of mechanisms in civil courts toward civil procedural law by using the normative writing method. In conclusion, this article explains that civil procedural law proceedings can be viewed in two aspects, which are broad sense and narrow sense. In the broad sense, it includes all legal actions that are taken both outside and inside the court to resolve the case according to the provisions of civil procedural law. Whereas in a narrow sense, it includes proceeding at trial in court from the first trial until the judge makes his decision. whereas, the procedure for filing a lawsuit in court is referring to Article 118 paragraph (1) Herizen Indlandsch Reglement (“HIR”) / Article 142 RBg.

Abstract

Prinsip dari sebuah negara demokrasi adalah dengan menjunjung tinggi Konstitusi dan ideologi dalam sebuah negara. Kebebasan dalam hak sosial dan politik menjadi sebuah jaminan yang sangat diperlukan untuk dapat mencapai sebuah negara yang menjunjung tinggi demokrasi sehingga aspirasi yang ada dapat tersalurkan dengan baik. Permasalahan yang muncul yaitu Bagaimana Prinsip Dan Jaminan Hak Warga Negara Menurut UUD 1945 dan Bagaimana Dinamika Sosial Politik Dalam Sistem Demokrasi di Indonesia. Metode penelitian yang digunakan berupa penelitian hukum yuridis normatif yang merupakan penelitian kepustakaan, yaitu penelitian terhadap bahan hukum primer dan bahan hukum sekunder yang terdiri dari peraturan perundang-undangan dan literatur-literatur terkait untuk memecahkan persoalan hukum atau permasalahan yang akan dibahas. Kemerdekaan menyampaikan pendapat dimuka umum harus dilaksanakan dengan bertanggung jawab, sejalan dengan ketentuan peraturan perundang-undangan yang berlaku. Oleh karena itu negara wajib dapat mengelola dan mengendalikan dominasi iklim kapitalis agar tetap berjalan pada koridor yang tidak merugikan warga. Negara juga harus membuka dan memberdayakan ruang publik secara optimal sebagai instrumen warga dalam menyalurkan aspirasinya, serta menutup keran tumbuh suburnya praktek politik uang baik di kalangan elit politik maupun di kalangan masyarakat, karena dengan membiarkan politik uang berlangsung, maka tidak hanya berimpilkasi melahirkan politisi yang korup dan mengekang hati nurani masyarakat dalam memberikan partisipasi politiknya, namun juga berakibat tercederainya suatu pemilu yang demokratis.

Abstract

Nowadays, Indonesia as a developing country has been developed in various sectors. Globalization is a process of organizational change from the function of capitalism which is marked by the emergence of the integration of markets and transnational companies and the lagging of supranational institutions. With this, it is possible for it to affect the work patterns of Indonesian society. For this reason, a further legal remedy will be needed if the party that feels disadvantage is not satisfied with the outcome of the dispute resolution that arises due to the development of globalization. The intended legal remedies are administrative efforts as referred to in Article 48 of Law Number 51 of 2009 concerning Amendments to Law Number 9 of 2004 concerning Amendments to Law Number 5 of 1986 concerning State Administrative Court (PTUN). The aim of this article is to find out the authority for dispute resolution of State Administrative Court (PTUN) toward dismissal with no reverence verdict and dispute resolution efforts for State Administrative Court (PTUN) toward dismissal with no reverence verdict. Juridical normative is applied as research method. This research concludes that dispute resolution on personnel is done through the State Administrative Court except it is caused by violations of the disciplinary rules of the State Civil Apparatus which will be resolved through administrative appeals to the Court of Civil Service.

Abstract

There are legal issues in the society which resolved through a non-litigation mediation process, especially in civil disputes, where there are several factors that influence people prefer to settle legal issues through non-litigation aspects rather than resolving cases by litigation or through the court. This article aims at explaining how the principles and stages of civil dispute resolution through non-litigation mediation and the essence or value that can be used for the society in dispute. So it can be concluded that this article wants to explain that non-litigation mediation in principle has a consensual as well as collaborative nature, so the result will have win-win solution for each sides, so that the problematic side is cannot be harmed. Then there is a very large value which can be taken, if several problems that arise in society, especially in civil cases which resolved through non-litigation mediation aspects.

Abstract

The purpose of this research is to describe and analyze the process of updating voter list in the final voter list (DPT) in General Election 2019 in KPU Gorontalo Regency. This research is motivated by the findings of Election Supervisory Body (BAWASLU) regarding the existence of 1,013,366 double DPTs in 76 districts and cities. Another claim is also made by a special team formed by Prabowo-Sandiaga Uno regarding the findings of 8,145,713 double DPTs (kompas.com, September 12th, 2018). The Permanent Voters List (DPT) becomes the basis for citizens’ political participation in general election (Pemilu). Community political participation has a very important role for the development of democratic politics in every country. In the context of elections, voters change from citizen participations to supports for illegitimate power through election competition among election participants. As a result of the problem of DPT, at the time of recapitulation of the revised DPT (DPTHP), the problem of double DPT cannot be separated from the absence of a policy for protecting personal data. The contents of DPT related to the personal identity of population have not become an absolute priority for the state to provide protection. It is also the duty of each stakeholder for their protection policy, in addition accessing for the public to the voter list up to the polling station (TPS) level. The result of the study shows that the stages of updating voter data that occurred in Election 2019 are indeed a long stage. This happens with the recommendation from BAWASLU and the input and response to the Election Permanent Voters List 2019 from the stages so that an extension is carried out by Indonesian KPU in order to create accurate and accountable voter data. This research uses qualitative research method namely descriptive research which tends to use analysis. Process and meaning (subject perspective) are more prominent in qualitative research. To improve the quality of the voter list, it is necessary to have a more adequate system and competent human resources in processing the permanent voter list.

Abstract

This study is aimed at analyzing the difference in political participation of inland communities and coastal communities in addressing local elections as an embodiment of synergy in combating Covid-19 and money politics. In this qualitative research, the data were analyzed using an interactive model comprising three analysis components: (1) data reduction, (2) data display, and (3) data verification and conclusion drawing. According to the results, the way the coastal communities respond to the local election differs from that of the inland communities regarding sociological perspective. The coastal communities are not so keen on the election as they concentrate more on their fishing activities. On top of that, people in coastal areas spend most of their time at sea; thus, issues regarding the election are not that impactful for them. The inland communities, on the other hand, has different views thanks to their gregarious characteristic. All their activities and work-life are centralized in a workgroup, enabling the people to have ample time to find out their local leader candidates. This aspect underlines the reason for pluralism among inland communities’ political views, confirming the characteristic of individualism among people in coastal areas.

Abstract

The research aimed to investigate the effectiveness of Regulation Number 25 in 2009 concerning public service on the organization of the local forces and investigate the hindrance factors of the implementation of Regulation Number 25 in 2009 concerning public service on the regional organizations. It was empirical juridical research employing the interview method. The technique of data analysis applied descriptive analysis. Findings revealed that the public services of Gorontalo District's regional organizations had been implemented based on the procedure operational standard and the provision of Legislation, although it was not effective. It can be seen from community satisfaction with administrative services that still need to be addressed and improved. The hindrance factors of implementing public service regulation were human resources and the availability of facilities and infrastructures. In creating public services appropriately with the Legislation, the government should be entirely done to improve employees' awareness. Society or paying attention to the organization management and adequate human resources and facilities and infrastructures can support the role of government in improving the public services, particularly the regional organizations of Gorontalo District.

Abstract

Penelitian ini dilakukan untuk mengetahui proses bagaimana perencanaan partisipatif pemerintah desa dan masyarakat dalam mengelola APBDes di Desa Bukit Hijau Kecamatan Bulawa Kabupaten Bone Bolango serta faktor pendukung dan penghambat perencanaan partisipatif. Pemerintah Desa Bukit Hijau Kecamatan Bulawa Kabupaten Bone Bolango menjadi bagian dari desa yang menerima anggaran dana desa sebagai salah satu sumber Anggaran Pendapatan dan Belanja Desa (APBDes), tetapi sampai saat ini kemajuan pembangunan, pendapatan desa dan masyarakatnya masih belum maksimal. Penelitian ini menggunakan metode deskriptif kualitatif dengan metode analitis yaitu penelitian yang menghasilkan data deskriptif berupa kata-kata tertulis atau lisan dari orang-orang dan prilaku yang dapat diamati. Hasil penelitian ini menunjukkan bahwa perencanaan partisipatif pemerintah desa dan masyarakat dalam mengelola APBDes secara umum dijalankan dengan baik, akan tetapi belum sepenuhnya mengakomodir kebutuhan masyarakat. Sedangkan, faktor pendukung dan penghambat perencanaan partisipatif pemerintah desa dan masyarakat dalam mengelola APBDes yaitu: (1) Pengetahuan, (2). Pekerjaan Masyarakat, (3). Tingkat Pendidikan, dan (4). Tingkat Kepercayaan Terhadap Pemerintah DesaRekomendasi penelitian ini adalah diharapkan agar dalam mengelola keuangan desa melalui APBDes, seharusnya pemerintah Desa Bukit Hijau mengarahkan kegiatannya terhadap pembangunan desa dan meningkatkan kesejahteraan masyarakat, serta memperhatikan segala kebutuhan masyarakat yang dapat mempengaruhi perencanaan APBDes yang akan dilaksanakan di desa.
