Abstract

Execution of Pengadilan Tata Usaha Negara (PTUN) judges verdict in some nation administrative dispute resolution practice in Indonesia have not been properly implemented due to the absence of an executorial Instution as well as a strong legal basis lead to weak force power for  verdict of  the PTUN. Undang-undang Peradilan Tata Usaha Negara also do not explicitly and clearly regulate the issue of force of verdict PTUN and  the execution of the verdict really depends on the goodwill of the Tata Usaha Negara Entity or Officials in obeying the law. How was the execution of the PTUN judges verdict? What was the reason for the unexecuted  judges verdict? So that we can find out how the judges verdict was executed and the reasons why the judges verdict was not executed. We use sociological research method to search what happened. Executor of a decision required to overcome and minimize the PTUN judges verdict  that was not executed as well as improvements to the basis of the Law which is more concrete and forces the execution of PTUN  judges verdict so that no party were harmed. Pelaksanaan putusan hakim Pengadilan Tata Usaha Negara dalam praktek penyelesaian sengketa Administrasi negara di Indonesia sebahagiannya belum terlaksana sebagaimana semestinya yang disebabkan ketiadaan lembaga eksekutorial, maupun landasan hukum yang kuat mengakibatkan putusan Pengadilan Tata Usaha Negara tidak mempunyai daya paksa. Undang-undang Peradilan Tata Usaha Negara pun tidak mengatur dengan tegas dan jelas mengenai masalah daya paksa putusan Pengadilan Tata Usaha Negara, sehingga dalam pelaksanaan Putusan benar-benar tergantung pada iktikad baik Badan atau Pejabat Tata Usaha Negara dalam mentaati hukum. Bagaimana pelaksanaan putusan hakim PTUN.? Apa sebab tidak terlaksananya eksekusi putusan hakim tersebut? Sehingga dapat mengetahui bagaimana pelaksanaan putusan hakim  dan sebab mengapa tidak terlaksananya putusan hakim tersebut. Dalam meneliti sengekta ini penulis menggunakan metode (Sosiologis research) lebih kepada penelitian lapangan apa yang terjadi, untuk mengatasi dan meminimalisir putusan hakim PTUN yang tidak terlaksana diperlukan adanya eksekutor putusan, serta perbaikan pada landasan Undang-Undang yang bersifat lebih konkrit dan memaksa Pelaksanaan putusan hakim PTUN sehingga tidak ada pihak yang dirugikan.

Abstract

Dropshipping is a form of online buying and selling in which business actors act as intermediaries between genuine sellers (suppliers) and consumers. Shoe dropshippers in Syiah Kuala District do not stock goods and do not take care of shipments so they do not know the actual condition of the goods. Sometimes in online buying and selling like this there is a risk in the form of defects/damage to goods, shipping errors, etc. so a warranty system is needed to protect both parties from loss or disputes at a later date. The problem in this research is what is the form of return guarantee in the sale and purchase agreement of shoes in Syiah Kuala District by dropship and how is the khiyār review of the terms of the return guarantee form of dropship shoe purchase. In this study the authors used a sociolegal approach with descriptive analysis research methods based on data obtained from interviews. The result of this research is the guarantee provided by the dropshipper in the Syiah Kuala District in the form of exchanging goods (returns) and a refund (refund) for 3x24 hours with certain terms and conditions. In the concept of fiqh muamalah, the return guarantee has relevance to the khiyār requirement, because the dropshipper provides an option for returns within a certain time in order to guarantee the willingness of the parties. The provision of 3 days is in accordance with the terms of the khiyār time according to the terms of the fuqaha. The difference lies in the form of guarantee provided, in khiyār the terms of sale and purchase can be canceled if there is consumer defect or dissatisfaction, while the return guarantee by most dropshippers only provides exchange of goods, which shows that the sale and purchase cannot be canceled.

Abstract

There are 3 things that want to be explained further in this research, namely: how are traffic practices regulated in traffic fiqh in Aceh, and how are ideas and implementation of human security values through traffic fiqh in Aceh? Apart from that, this research also reviews the background to the birth of traffic fiqh for the Acehnese public. This research is qualitative with a descriptive analysis approach. The results found that driving practices regulated in traffic fiqh also strengthen what is regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation, but by using a religious approach to touch the public's awareness of the importance of protecting a sense of security for themselves and others.
