Abstract

Penelitian ditujukan untuk menganalisis lebih mendalam tentang umur konstruksi secara normatif dengan menjadikan objek analisisnya berupa Surat Perjanjian Kerja (Kontrak) No. 012/SP-Kontrak/PPK/BM-I/DPU-PR/LS/2017, tertanggal 09 Agustus 2017 antara Dinas Pekerjaan Umum dan Penataan Ruang Kabupaten Labuhanbatu Selatan TA. 2017 dengan CV. Karya Jasa Utama. Surat Perjanjian Kerja (Kontrak) tersebut tidak mencantumkan klausula “rencana umur konstruksi” sebagaimana diwajibkan Pasal 65 UU Jasa Konstruksi jo. Pasal 86 Peraturan Pemerintah RI No. 22 Tahun 2020 tentang Peraturan Pelaksanaan UU Jasa Konstruksi. Berbagai masalah hukum yang menjadi perhatian penelitian ini meliputi kewajiban pencantuman rencana umur konstruksi dalam kontrak konstruksi dan konsekwensi hukumnya serta pertanggungjawabannya. Penelitian dilaksanakan dengan menggunakan metode penelitian hukum normatif dan didukung data empiris. Tehnik pengumpulan data menggunakan studi pustaka dan studi lapangan di Dinas PPR Kabupaten Labuhanbatu Selatan. Analisis data dilakukan dengan kualitatif, dengan hasil penelitian menyimpulkan bahwa kontrak kerja konstruksi sebagai perjanjian privat berdimensi publik mewajibkan Penyedia Jasa (Kontraktor) dan Pengguna Jasa untuk mencantumkan klausula rencana umur konstruksi dalam kontrak.

Abstract

Peran OJK yang tampak dari POJK No. 77/POJK.01/2016 Tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi mengatur mengenai pemberian izin kepada penyelenggara layanan peer to peer lending, mengatur jalannya praktik peer to peer lending, mengawasi penyelenggara layanan peer to peer lending, dan memberikan sanksi bagi penyelenggara yang melakukan pelanggaran terhadap aturan POJK No. 77/POJK.01/2016 Tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi. Tanggungjawab penyelenggara layanan peer to peer lending sering kali tersamarkan, sedangkan pihak pemberi pinjaman dan penerima pinjaman bisa mengalami risiko kerugian dalam menjalankan proses pinjam meminjam. Jenis penelitian yang digunakan adalah penelitian hukum yuridis normatif menggunakan pendekatan perundang-undangan (statue approach). Teknik pengumpulan data yang digunakan adalah dengan studi pustaka (library research) yakni pengumpulan data yang dilakukan secara studi kepustakaan dan peraturan-peraturan yang berhubungan dengan tujuan penelitian. Sumber data yang digunakan menitikberatkan pada data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Analisis dilakukan menggunakan metode kualitatif terhadap data primer dan data sekunder. Tanggung jawab dari penyelenggara peer to peer lending diatur dalam Pasal 37 POJK Nomor 77/POJK.01/2016 tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi yaitu : “Penyelenggara wajib bertanggung jawab atas kerugian Pengguna yang timbul akibat kesalahan dan/atau kelalaian, Direksi, dan/atau pegawai Penyelenggara.” Tanggung jawab penyelenggara hanya sebatas pada kesalahan dan/atau kelalaian dalam menjalankan kegiatan usaha Penyelenggara dan/atau pihak ketiga yang bekerja untuk kepentingan Penyelenggara.

Abstract

One of the factors to maintain and increase the level of public trust in a bank is the bank's compliance with the Bank's Secret obligations, namely protection of depositing customers and their deposits from crimes. The obligation to uphold bank secrecy can be exempted, one of which is the exception, namely to the interests of the judiciary in criminal cases, including online gambling crime with the written statement or approval of the Depository Customer. As stipulated in Article 42 of Law Number 10 Year 1998 concerning Banking, by the request of the police during the investigation stage, prosecutors in the prosecution stage, or judges in the stage of examination before the court, can ask permission from the leadership of Bank Indonesia (now at the Otoritas Jasa Keuangan) to obtain an information about the Suspect's deposit. As a form of applying the principle of trust, an obligation arises for banks to protect customer data and funds, where the concrete form of such protection is Bank Confidentiality

Abstract

Tujuan penelitian ini untuk mengetahui dan menganalisis tentang peranan otoritas jasa keuangan dalam pemberantasan tindak pidana pencucian uang yang menggunakan bank sebagai instrumen kejahatan, oleh sebab kejahatan pencucian uang (money laundering) mempunyai kaitan yang erat dengan perbankan, dimana harta hasil tindak pidana (predicate crime) ditempatkan pada institusi perbankan, sehingga proses penyamaran hasil kejahatan dapat menjadi clean money secara cepat. Penelitian ini adalah penelitian yuridis normatif dengan meneliti bahan pustaka atau data sekunder. Hasil penelitian menyatakan bahwa secara garis otoritas jasa keuangan berperan sebagaimana kewenangannya yang diatur berdasarkan undang- undangri nomor 21 tahun 2011 meliputi kewenangan memberikan izin (right to license), kewenangan untuk mengatur (right to regulate), kewenanganuntuk mengawasi (right to control), kewenangan untuk mengenakan sanksi (right to impose sanction) serta kewenangan melakukan penyidikan di sektor jasa keuangan.

Abstract

In 2009 PT. Sarwo Indah sold one of the housing units in Merapi Regency with Lie Anita (hereinafter referred to as LA). In the process of settling the bankruptcy assets of PT. Sarwo Indah experienced legal problems which later became the focus of this research. As in the Determination of the Supervisory Judge in case Number: 02/Pailit/2011/PN. Commerce. Smg, dated 13 June 2014, one of the contents was the determination of the Curator appointed by PT. Sarwo Indah (in bankruptcy) on behalf of Nasrullah Nawawi. The type of research in this research is normative juridical. This type of research was used because the researcher wanted to examine something related to the curator's legal actions in selling land and houses on the basis of PPJB and becoming the object of bankruptcy. As long as the house certificate that is the object of the PPJB agreement is still in the name of the bankruptcy debtor, the house becomes a bankruptcy debtor. This is based on Article 21 of the K-PKPU Law which explains that bankruptcy covers all of the debtor's assets at the time the decision to declare bankruptcy is pronounced. Application of the Law of the Panel of Judges in Supreme Court Decision No. 436 K/Pdt.Sus-Pailit/2019 is appropriate considering the juridical aspect, namely referring to the applicable law, namely assessing the relationship between the function of the curator and the settlement of the bankruptcy estate's assets so that there is no obligation for the Curator to continue the agreement between the Buyer and Seller (in bankruptcy)

Abstract

Water Treatment Plant (WTP)companies experience dilemma between the obligation to provide healthy drinking water and the company's limitations in providing water infrastructure. This encourages state water companies to collaborate with the private sector to procure infrastructure. This study raises issues related to the concept of state control over water and its implications for cooperation schemes for drinking water supply, as well as the legal aspects of cooperation in the management of drinking water treatment plants. This study uses normative research method with statute and conceptual approach. The result shows that considering the status of state water companies are subject to public finance accountability, that parties must design and implement the cooperation with due care, that is the principles of good corporate governance. This principle remains difficult to implement as many challenges facing. Hence the more efforts and cooperation with associated stakeholders should be taken into account.

Abstract

Financial literacy is an important part of financial sector consumer protection. With financial literacy, the community will be able to choose financial products and services that are appropriate to their needs and have the ability to do better financial planning. Data shows that housewives have low financial literacy and, hence, are vulnerable to fraud and scams. Fraud and suspicious fundraising activities are still prevalent in many cities all over Indonesia, including Medan. Training of financial literacy and the legal protection in investment for housewives were designed and implemented to help overcome this issue. The training took place in Medan Selayang and Medan Maimun Districts and aimed to improve housewives’ financial literacy, including on how to manage household money properly and safely so as not to get trapped in bad investment, as well as to educate them about the legal measures that can be taken if they become victims of fraud. The training was conducted using lecture method followed by discussion and consultation. The participants were provided pocket books that were designed to be easily read and understood. Questionnaires were also prepared to measure the knowledge of the participants before and after training. The result of the test shows that the participants’ financial literacy improved after the training.

Abstract

Indonesia currently has Law Number 11 of 2012 concerning the Criminal Justice System for Children (UU-SPPA) to provide protection for children who need special protection such as child offenders, victims and witnesses. In fact, the implementation of the UU-SPPA actually only focuses on children as perpetrators. This not only shows that justice for children is still not upright especially for children who are victims of sexual violence. This is evident from the findings of a study conducted in 2019 entitled "The Effectiveness of the Convention on the Rights of the Child Victims of Sexual Violence". This study found that although Indonesia already has 2 government regulations governing the fulfillment of victims of sexual violence in the form of compensation and or restitution, none of the decisions of the Medan District Court and Lubuk Pakam contain the rights of victims. The decisions of the Medan District Court and Lubuk Pakam throughout 2018 were oriented towards providing penalties for the perpetrators. The two Government Regulations which are guidelines for implementing the Law are (a) Government Regulation of the Republic of Indonesia Number 7 of 2018 concerning Provision of Compensation, Restitution and Assistance to Witnesses and Victims; and (b) Government Regulation of the Republic of Indonesia Number 43 Year 2017 Concerning Implementation of Restitution for Children Who Are Victims of Criminal Acts. These two Government Regulations are the basic ingredients for the implementation of the 2019 Mandatory Servant Lecturer service dedication. This situation is the basis of community service in two districts namely Medan Baru and Medan Sunggal. Law Enforcement Officials (APH) in this case the police and the community not only obtain new information about victims' rights but also increase their awareness to guarantee the rights of children victims of sexual violence are requested in legal proceedings for perpetrators. Furthermore, the Police and the community hope that the information on these two Government Regulations can be continued both by the Regional Government Organization (OPD) and other institutions such as the Civil Society Organization (CSO) in Medan.
