Abstract

Konsep omnibus law yang dianggap dapat menjadi solusi pada permasalahan yang timbul akibat adanya pengaturan yang tumpang tindih, juga akan diterapkan pada tata kelola laut khususnya di bidang penegakan hukum di laut. Artikel ini akan menganalisis apakah penerapan konsep omnibus law tepat bila dilakukan pada aspek penegakan hukum di laut. Metode yang digunakan dalam artikel ini adalah yuridis normatif dengan pendekatan perundang-undangan. Meskipun terdapat tumpang tindih pengaturan dalam penegakan hukum di laut, penerapan konsep omnibus law dalam hal penegakan hukum tidaklah tepat. Hal ini dikarenakan adanya pengaturan UNCLOS 1982 tentang zona maritim yang mengakui hak-hak negara lain di wilayah laut, baik wilayah laut yang merupakan kedaulatan negara pantai maupun wilayah yurisdiksi negara pantai. Diperlukan harmonisasi dan revisi peraturan perundang-undangan terkait penegakan hukum di laut.

Abstract

One important thing that must be considered in the use of nuclear and other radioactive materials is the process of transporting radioactive substances through the sea. This paper will analyze the optimization of the supervisory authority of BAPETEN in the transportation of radioactive substances, especially in the process of transporting radioactive substances by sea. Option to choose the sea because most of Indonesia's territory is the sea. If it has the authority, Bapeten's supervisory authority will then be analyzed in the process of transporting radioactive substances via the sea lane. Recommendations from this article are a form of juridical liability if an error occurs, which causes a loss in the process of transporting radioactive substances by sea. Because the process of transporting radioactive substances is essential in preventing the occurrence of radiation, the regulatory authority in the transportation process must be regulated in detail based on the precautionary principle, as well as the form of juridical accountability.

Abstract

In Indonesia, here is no exact politic and legal system regarding the application of International Treaty within national legal system. Article 11 of Indonesian Constitution 1945 merely envisages the division of authority between President and Parliament in ratifying international treaty, however, such article does not state clearly Indonesia’s legal politics concerning the application of international treaty within national legal system. The lack of clarification on Indonesia’s legal and political system in such area raises problems in the application of international treaty domestically. This research is aimed to:  (1) analyses Indonesia’s legal politic concerning the application of international treaty towards Indonesian Constitution 1945 as well as other legal instruments; (2) analyses legal implications of international treaty upon Indonesia’s national interests and; (3) propose concept on legal politic regarding the application of international treaty in Indonesia. Since legal politic is crucial in supporting which law should be implemented towards state’s national goal, it is important to clarify Indonesia’s legal politic concerning the implementation of international treaty. As stated by Hans Kelsen, that as the application of the rule of law, a state should eliminate existing inconsistency and overlaps of its laws.

Abstract

Located between two continents and two oceans, Indonesia is vulnerable to various transnational crimes. Hence, the concept of maritime security emerged. This paper focuses on three crucial matters, maritime delimitation, IUU Fishing as well as piracy and armed robbery at sea. This research aims to analyze the urgency of national maritime security legal framework in Indonesia. This research uses normative method with statute approach and comparative approach. It is submitted that although regional dan international cooperation is important to address maritime threats, national legal instrument is also necessary. Unfortunately, Indonesia still does not have comprehensive national legal instrument in place. Thus, it is argued that Indonesia should formulate specific policy and national legal frameworks in addressing maritime threats completed with certain measures for each threats as well as point out which institutions competent in handling each threats.

Abstract

Penelitian ini bertujuan untuk menganalisa implikasi hukum atas implementasi ISM dan ISPS Code di Indonesia. Menggunakan metode penelitian hukum normatif, dengan pendekatan statuta. Hasil dari penelitian ini menunjukan bahwa Implikasi yuridis dari pengakuan Indonesia terhadap kedua koda tersebut adalah tindakan implementasi atau penerapan atas ketentuan-ketentuan ISM dan ISPS Code baik oleh stakeholder pelayaran, dalam hal ini terutama pemilik kapal (shipowner) dan operator serta dari pemerintah dalam hal ini berkenaan dengan masalah kepelabuhanan dan Port State Control. penerapan ISM dan ISPS Code maka penyelenggaraan transportasi laut khususnya pengengkutan barang lewat laut akan dapat dilaksanakan dengan baik

Abstract

This study focuses on discussing the validity of information technology-based loan contracts and the use of third party personal data for company activities in the event of default. This study uses a normative juridical method with a legislative approach and a case approach. Loan contracts use legitimate electronic transactions if there is a contract of the parties that bind themselves. An information technology-based loan contracts to borrow money using third party personal data without permission will not cancel the contract. A third party can apply to the court to cancel himself as a party involved in the agreement.

Abstract

The research objectives were to analyze the legal protection of participants of the old age guarantee program as well as the threat of sanctions for companies that delinquent payment of Social Security Agency for Employe (BPJS Employment) dues. The research used a juridical-sociological approach with a type of sociolegal research. Data sources in the form of primary, secondary, and tertiary data were analyzed qualitatively. Legal protection of participants of the old age guarantee program consisted of preventive legal protection, namely through Government Regulation Number 60 of 2015, and repressive legal protection based on internal Standard Operating Procedure (SOP) from BPJS Employment provided if the company in question delinquent dues payment. The threat of sanctions for companies that delinquent payment of BPJS Employment dues was in the form of administrative sanctions, although in practice the sanctions were considered ineffective to be applied.

Abstract

This paper aims to review the Court Decision Number: 15 / Pdt.G / 2014 / PN.JMB dated October 14, 2014, relating to the validity of the transfer of land rights by buying and selling through payment using Bilyet Giro, and analyzing the settlement of the transfer of land rights using Bilyet Giro according to customary law. The method used in this paper is normative research to find a solution to the problem of transferring land rights through buying and selling using Bilyet Giro to produce a new opinion, theory or concept as a prescription related to the problem. The results of the analysis in this paper show that the payment in full with the Bilyet Giro against the price agreed in the sale of land rights must be declared valid and valuable, both in terms of the Civil Code and the concept of customary law, and according to the provisions of customary law, cash payment with Bilyet Giro is sufficient for the transfer of land rights due to buying and selling.

Abstract

ABSTRAKPerkembangan kelautan di Indonesia semakin berkembang dari tahun ke tahun hingga dicetuskannya konsep ‘poros maritim’ oleh Presiden Joko Widodo. Konsep ‘poros maritim’ menekankan pada terwujudnya konektifitas antar pulau melalui pengembangan industri pelayaran serta transportasi laut. Dengan demikian dibutuhkan akselerasi pembangunan pelabuhan di wilayah-wilayah kepulauan seperti maluku dan Riau. Sayangnya alokasi dana dari pusat untuk daerah masih didasarkan pada luas wilayah daratan. Hal ini menjadikan daerah dengan wilayah perairan yang lebih banyak tidak mendapatkan alokasi dana sebagaimana daerah yang mempunyai wilayah daratan yang luas. Padahal percepatan pembangunan di wilayah kepulauan sangat dibutuhkan dalam mewujudkan Indonesia sebagai ‘poros maritim’ dunia. Tulisan ini akan menganalisa tantangan dan peluang pembangunan wilayah kepulauan yang berlandaskan poros maritim dalam perspektif negara kepulauan. Pembangunan Wilayah Kepulauan sangat diperlukan untuk mewujudkan konsep Poros Maritim. Akan tetapi perlu diperhatikan mengenai perimbangan keuangan daerah dalam mewujudkan akselerasi pembangunan tersebut. Dibutuhkan pengembalian mindset masyarakat Indonesia ke kelautan serta harmonisasi aturan dan kelembagaan dalam mewujudkan ‘poros maritim’ dalam perspektif negara kepulauan yang berimplikasi pada perimbangan keuangan daerah antara daerah biasa dengan daerah yang terdiri dari kepulauan. Kata kunci: peluang; poros maritim; tantangan; wilayah kepulauanABSTRACTThe development of maritime affairs in Indonesia is growing rapidly until the inception of ‘maritime fulcrum’ by President Joko Widodo. Such concept emphasizes the establishment of inter-island connectivity through the development of shipping and sea transportation industries. Thus, the acceleration of port and facilities development in islands region such as Maluku and Riau is needed. Unfortunately, fund allocation from the central government to region areas is still based on how large the land areas of certain region. This makes island regions have less fund allocation than those of regions with large areas of land. While, on the other hand, the establishment of ‘maritime fulcrum’ concept is largely depends on the acceleration of national development in island regions. This paper aims to analyze challenges and opportunities in developing island regions based on ‘maritime fulcrum’ concept within the perspectives of archipelagic state principles. National development in island regions of Indonesia is important to support the establishment of ‘maritime fulcrum’, however, the usage of the term ‘archipelagic’ should also carefully consider legal implication of the term ‘archipelago’ according to International Law. Restoration of Indonesian people’s orientation to the ocean is crucial. In addition to this, the harmonization of related legal instruments as well as institutional arrengement, especially focusing on balancing reginal funding is also urgent.Keywords: challenges; island regions; maritime fulcrum; opportunities

Abstract

Indonesia is the first and only archipelagic state which has designated Archipelagic Sea Lanes (ASLs). However, such ASLs was only considered as a ‘Partial ASLs’ by the International Maritime Organization (IMO). This is due to the lack of the inclusion of all normal passage routes used for international navigation as required by Article 53 (4) of Law of the Sea Convention (LOSC). On the other hand, Indonesian national law stated that the rights of ASLP can only be exercised over the designated routes and this leave the undesignated routes under the innocent passage regimes, which is inconsistent with Article 53 (12) of LOSC. This article seeks to analyse Indonesia’s rights in designating ASLs and the implementation of Indonesia’s ‘Partial ASLs’. It is questionable whether Indonesia’s rights in designating ASLs has become an obligation by the ‘partial’ recognition of Indonesia’s ASLs by IMO. While none reported incident of navigational rights over Indonesia’s north-south ASLs, however some incidents did occur over the undesignated east/west ASLs. This paper begins with the analyses of the provisions of LOSC concerning archipelagic sea lines passage by looking at its travoux-preparatoir and then follows by the discussion of Indonesia’s implementation on its designated ASLPs. Reported incident occurred over the undesignated ASLs will also be discussed to gain clear understanding on the matter. It is argued that Indonesia should either designated the east/west ASLs or if not, adjusting its national law to be in conformity with LOSC.
