Abstract

The birth of a child is a gift and the happiness of parents. The birth is an important event in population administration. Each child must get clear and correct self identity. Birth certificate is an identity form of a child that needs to do by parents as a protection form for the child. The parents’ understanding about birth certificate is still lacking especially in partner village. The condition creates an idea to do a law education and accompaniment to make birth certificate with involves the role of village official, provision districts and related agencies. The used method is delivered the material by tutorial lecture to the society by bringing Department of population and civil registration in making birth certificate by involving village official, provision districts and society to find the policy form to protect child with clear and correct self identity. The next stage is accompaniment in making birth certificate and cooperation all materials to the ownership of child as a protection for the children. The result of service shows creating an understanding of partner society in the ownership of birth certificate and the protection form of the child status and the marriage status, and the fulfillment of other requirement in making certificate as the guide book. The result of accompaniment and cooperation in Department of population and civil registration succeed to publish 61 marriage certificate from 67 couples which presents with 2 witnesses when notes in Department of population and civil registration from 123 application marriage certificate submitted. Next form the marriage certificate submitted to publish of birth certificate. The birth certificate which succeeds to be published 107 birth certificate from 162 application birth certificate submitted by society. The failure of submitted certificate because the lack of data, lack of requirement, the discrepancy data, and published the birth certificate.

Abstract

The development of the modus of corruption criminal act in Indonesia today has indicated a wide scale and become more sophisticated so that it is very difficult to prove it. One of the methods to uncover this organized crime of corruption is by using the role of whistleblowers that can help uncover the modus of corruption criminal act more easily. Unfortunately, whistleblowers and justice collaborators in corruption case in Indonesia have not received maximal legal protection; in consequence, people who want to expose the crime and who have the right to gain reward will go to prison instead. In Indonesia, judicial normatively, based on Law No.13/2006, whistleblowers and justice collaborators have not yet received maximal legal protection. The same is true for SEMA No.4/2011; whistleblowers and justice collaborators only received leniency of a sentence. The ideal legal protection is by giving reward, treatment, and protection from all charges as the compensation for what a whistleblower has exposed, whether he is one of the perpetrators or not. Abstract

Recently, corruption has been a serious public attention. Whether or not the criminal act of corruption develops cannot be separated from the element of law enforcer. To anticipate the development of corruption, the law enforcers take the steps, among other things, through the process of investigation. This step is a part of the government efforts to reenforces law under the term of criminal policy or from the aspect of criminal law enforcement policy. In Indonesia, investigating the criminal act of corruption is carried out by three institutions such as Police, Attorney and Corruption Eradication Commission (KPK), Due to the limitation of KPK, the investigation at regional level is focused in the Police and Attorney regional affice. The corruption investigation process cannot be separated from the problems related to technical and non-technical process of criminal justice system. In Medan and its vicinity, the investigation of the criminal act of corruption is focused on Medan Resort Police Departement and Medan Attorney Regional Office. The authority to do the investigation is legal according to the law. Yet, in practice, this authority is less optimally empowered by both institutions, in the scope of its job description in the past three years. To cope with less optimal investigation problem, in the future, Medan Resort Police Department and Medan attorney Regional Office will cooperate with the academicians to provide workshop or seminar, to make staff study, to schedule the investigation of the criminal act of corruption in the scale of priority, to increase the number of investigators, to synchronize the perception of investigators in corruption case investigation. The still rooted culture of corruption will be cahanged through investigating the cases of criminal act of corruption. Community participation in the process of corruption case investigation will be improved and the culture of discipline of government apparatuses will be optimalized.

Abstract

ABSTRACTProsecutors acting prosecuting a person suspected of committing crimes is based on Article 8 paragraph (2) of Law No. 16 of 2004 on the Attorney RI. In prosecuting attorney acting for and on behalf of the State. To prosecute a person suspected of committing a crime, the prosecutor is allowed to waive the case in the public interest pursuant to Article 35 letter c. Law No. 16 of 2004 on the Attorney RI. On the other hand the prosecuting attorney must uphold the principle of equality before the law. Authority to waive the case prosecutor apparently misused by the Attorney on specific cases. For example: Case BLBI and Bibit-Chandra case. Setting principles and opportunity in the Code of Criminal Procedure Law. 16 Year 2004 on Indonesian Attorney can not give an explanation although expressly recognized the principle of opportunity. Criminal Procedure Code recognizes the principle of opportunity, however, the Criminal Code does not provide an explanation about this. While in Law. 16 of 2004 on the Attorney RI, the principle of opportunity provided for in Article 35 letter c as the authority of the Attorney General in the case of a waiver in the public interest. Regarding the public interest itself also still can cause a variety of different interpretations due to the Criminal Procedure Code and the Law. 16 Year 2004 on Indonesian Attorney formulate the common definition is too broad and should be returned or refer to the ideals of the law or of the nation as expressed in the preamble of the 1945 Constitution of the Republic of Indonesia. The results showed that: Should termination prosecution done really pay attention to grounds for termination of prosecution; Better regulation principles set opportunity in more detail and specific especially in providing the sense of "the public interest", and should provide limits understanding of the categories included in "the interests of general ".Key Words : Termination of prosecution; Termination of investigation, and the interest of the public.

Abstract

ABSTRACTArrangement complaint about a crime has been arranged expressly in the Book of the Law of Criminal Law Article 72-75 of the Criminal Code. Complaints that have been filed may be withdrawn if still within the grace period of 3 ( three ) months after the complaint is filed ( Article 75 of the Criminal Code). The practice of the law in the Supreme Court decision No. 1600 K/PID/2009. Supreme Court Justice existing legal provisions in the Criminal Code with the advanced legal purpose of restoring the balance that occurs due to a crime and restorative justice teachings that conflict is not simply a crime as a violation of state and public interest but a conflict also represent disrupted and broken relationship between two or more individual in public relations . The panel of judges who handle cases in the decision No.1600 K/PID/2009 has given consideration First Objective of criminal law that is to restore the balance that occurs between the perpetrator and the victim because of the criminal act ; Second : It has been done for peace between the perpetrator and the victim ; Third : To maintain individual relationships within social relationships , especially parties to the conflict are bound family relationship is between the law and the law; Fourth : that the teaching of restorative justice that the judge must be able to facilitate conflict resolution satisfactory to unite the parties to the dispute.

Abstract

ABSTRACTIndonesia as an archipelago has an abundant of fish resources. Geographically, Indonesia is located strategically, for which this condition becomes a challenge, and it is our responsibility to maintain, guard, and conserve these resources. This strategic condition will automatically attract foreign ships to do illegal fishing, particularly in ZEEI (Indonesian Exclusive Economy Zone) in the Area of Fishery Management of the Republic of Indonesia. The result of the research showed that the consequence of the illegal fishing in the area of fishery management of the Republic of Indonesia by foreign fishermen is very big; it amounts to 30 quintillion rupihs each year. It is recommended that, in order to cope with the criminal act of illegal fishing in the Area of Fishery Management of the Republic of Indonesia, particularly in the Indonesia Exclusive Economi Zone, the government should be serious in enlarging the budget for the supervision and furnish equipment and infrastructure which are related to supervision.Keywords: Criminal Act of Illegal Fishing

Abstract

ABSTRACT   In Law No. 15/2001 on brand, the caharacteristics of the criminal act of brand counterfeiting belong to the statement that all criminal act of brand counterfeiting is a violation that it is more to private than public law in nature, the characteristic of criminal law is increasingly less raised, the ordinary offense is changed into a crime on complaint, and the imprisonmentis reduced from 7 years to a maximum of 5 years. The law enforcement resulted in the uncertainty of law and justice. Different court decisions based on different criminal charge and even different imposed articles are given to the matters of the same cases. Therefore, the crime on complaint shall be changed into ordinary offense and the criminal act of brand counterfeiting shall also be considered as a criminal act not as a violation only.   Keywords: Brand, Characteristics, Criminal Act, Brand Counterfeiting, Law Enforcement

Abstract

ABSTRAK Masalah penyalahgunaan narkotika telah menjadi masalah nasional maupun internasional yang tidak pernah henti-hentinya dibicarakan. Permasalahan penyalahgunaan narkotika telah menghiasi pemberitaan hampir setiap harinya. Penyalahgunaan narkotika dapat menimbulkan kerusakan fisik, mental, emosi dan sikap dalam masyarakat. Masalah penyalahgunaan narkotika telah mengancam bangsa dan masyarakat tertentu sehingga menjadi suatu kejahatan teorganisasi nasional ataupun transnasional. Berdasarkan latar belakang tersebut, penulis mengangkat jurnal ilmiah berjudul KEBIJAKAN HUKUM PIDANA TERHADAP PENGATURAN TINDAK PIDANA NARKOTIKA DI INDONESIA. Dalam jurnal ilmiah ini, penulis mengemukakan permasalahan bagaimana konsep kebijakan hukum pidana dalam penanggulangan kejahatan dan bagaimana kebijakan hukum pidana terhadap pengaturan tindak pidana narkotika di Indonesia. Metode penelitian dalam jurnal ilmiah ini dilakukan dengan pendekatan yuridis normatif yaitu dengan melakukan analisis terhadap permasalahan melalui pendekatan asas-asas hukum serta mengacu pada norma-norma hukum yang terdapat dalam peraturan perundang-undangan. Data yang digunakan dalam jurnal ilmiah ini adalah data sekunder. Adapun hasil penulisan ini adalah dalam penerapan Undang-Undang  No. 35 Tahun 2009 tentang Narkotika agar dapat lebih efektif maka perlu adanya tindakan yang terkoordinasi antara para pihak atau instansi seperti antara kepolisian dengan pihak Badan Narkotika Nasional, Kementerian Perhubungan, Kementerian Pendidikan dan Kebudayaan, Kementerian Agama, lembaga-lembaga pendidikan, organisasi kemasyarakatan dan lain-lain. Generasi muda adalah calon penerus bangsa, oleh karenanya agar jangan sampai terjebak penyalahgunaan narkotika maka yang diperlukan dengan memberikan pemahaman agama dan pembinaan moral pada generasi muda yang dimulai dari keluarga, karena agama dan moral adalah benteng yang kokoh dalam melindungi keluarga dari kerusakan dan kehancuran termasuk dari bahaya narkotika

Abstract

ABSTRAKSI Rozhi Ananda Sitepu   Korupsi merupakan perbuatan yang sangat merugikan keuangan negara dan masyarakat sehingga dapat menghambat jalannya pembangunan nasional, oleh karena itu segala macam perbuatan yang sifatnya merugikan keuangan negara perlu dikikis habis diantaranya adalah dengan cara memaksimalkan daya kerja dan daya paksa dari peraturan perundang-undangan yang ada baik melalui penegakan hukum pidana maupun melalui penegakan hukum perdata. Permasalahan dari skripsi ini adalah bagaimana Peranan kejaksaan dalam pelaksanaan pembayaran uang pengganti dalam segi umum. Dan bagaimana pelaksanaan dan hambatan-hambatan yang dihadapi pihak kejaksaan dalam pelaksanaan pembayaran uang pengganti pada perkara tindak Pidana Korupsi didaerah Kabupaten Fak-Fak Papua Barat. Dalam penelitian ini penulis menggunakan metode penelitian dengan cara pendekatan yuridis normatif dan yuridis empiris. Pengembalian uang pengganti tersebut dapat dilihat dari UU No.20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi dan UU. No. 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi. Berdasarkan hasil penelitian maka di kejaksaan Negeri Kabupaten Fak-Fak dalam pelaksanaannya menggunakan sistem yang sama dengan yang tertulis dalam UU No.20 Tahun 2001 Tentang Pemberantasan Tindak Pidana Korupsi dan UU No.30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi. Mengenai hambatan yang dihadapi pihak kejaksaan Negeri Kabupaten Fak-Fak yaitu terdakwa pernah melarikan diri sewaktu pihak penyidik akan melakukan penyidikan dan terpidana tidak dapat membayarkan uang pengganti sehingga terpidana hanya dikenakan hukuman pengganti berupa hukuman penjara tambahan selama 6 (enam) bulan, sehingga uang pengganti tidak dapat dikembalikan ke negara.

Abstract

ABSTRAKSI Konsep hukuman pidana mati seringkali digambarkan sebagai sesuatu yang kejam, tidak manusiawi, dan sadis. Hal ini semata-mata hanya dilihat dari satu aspek, yaitu kemanusiaan menurut standar dunia modern, tanpa melihat alasan, maksud, tujuan, dan keefektifannya, penelitian ini didasarkan pada penelitian hukum normatif yang dilakukan dalam upaya menganalisis data dengan mengacu pada norma-norma hukum yang terdapat dalam peraturan perundang-undangan dan penerapannya di dalam masyarakat. Dalam penelitian ini juga menunjukkan bahwa bukan hanya persoalan pidana matinya, namun “raison de etre” dari pidana mati, ialah tenggang waktu yang acap kali begitu lama dan seperti tidak jelas apakah akan dilaksanakan pidana mati dalam jangka waktu bertahun-tahun, apalagi sampai melebihi sepuluh atau dua puluh tahun, jelas merupakan pertanggungjawaban dari pihak yang berkuasa. Apapun alasan dan motivasi dari pertanggungjawaban itu, tidak dapat dibenarkan secara moral dan etis. Dalam Pasal 340 KUHP, mengatur tentang barangsiapa dengan sengaja direncanakan dahulu menghilangkan jiwa orang lain, dihukum, karena pembunuhan direncanakan (moord), dengan hukuman mati atau penjara seumur hidup atau penjara sementara selama-lamanya dua puluh tahun. Pidana mati yang tercantum dalam pasal 10 KUHP yang berlaku sekarang adalah warisan dari pemerintahan kolonial belanda, dimana hukum pidana peninggalan kaum penjajah tersebut aslinya masih dalam bahasa belanda yaitu “Wetboek van Strafrechit” (WvS) yang dinyatakan berlaku di Indonesia oleh pemerintah hindia belanda pada tanggal 1 januari 1918 berdasarkan Staadblad 1915 No.735 dan setelah Indonesia merdeka dengan kekuatan aturan peralihan Undang-undang dasar 1945 dinyatakan masih tetap berlaku.. kemudian dengan kekuatan Undang-undang no.1 tahun 1946 jo, undang-undang No.73 tahun 1958 istilah WvS disebut dengan kitab undang-undang hukum pidana dan dinyatakan berlaku untuk seluruh wilayah republik Indonesia sampai sekarang ini meskipun dengan beberapa perubahan. namun beberapa perubahan tersebut memiliki permasalahan-permasalahan yaitu perkembangan hokum eksekusi pidana mati di indonesia  dan ada penundaan ekeskusi hukumam pidana mati yang tidak jelas arah tujuan untuk menjalankan hukuman tersenut tanpa memandang sudut padang HAM . Mengenai pidana mati jika dikaitkan dengan hak asasi manusia (HAM) memang menjadi masalah yang besar bagi masyarakat Indonesia khususnya bagi para penegak hukum. Di satu pihak mereka harus menegakkan keadilan dan dipihak lain dianggap merupakan pelanggaran hak asasi manusia sehingga menghambat penegakkan HAM di Indonesia. Dianggap menghambat penegakkan HAM dan merupakan pelanggaran HAM harus dilihat dahulu sejauh mana konteks kejahatan-kejahatan tersebut telah dilakukan, apakah dapat ditolerir atau tidak. Faktor-faktor dalam penundaan eksekusi pidana mati di Indonesia dari sudut pandang Hak Asasi Manusia (HAM) yaitu terdapat dalam upaya hukum biasa (pemeriksaan tingkat banding dan upaya hukum kasasi), upaya hukum luar biasa (pemeriksaan tingkat kasasi demi kepentingan hukum dan peninjauan kembali putusan pengadilan yang telah memperoleh kekuatan hukum tetap), dan permohonan grasi.
