ABSTRAKTercapainya kepastian hukum hak atas tanah merupakan sasaran tujuan yang ingin dicapai oleh setiap pemegang hak, dan untuk mewujudkan kepastian hukum tersebut telah ditetapkan lembaga rechtsverwerking di dalam PP No.24 Tahun 1997 yang memberi batas waktu hingga 5 tahun Sertifikat masih dapat digugat oleh pihak lain. Namun dalam kenyataannya setiap orang yang merasa memiliki bukti yang cukup masih diberi kesempatan untuk mematahkan kebenaran data yang tertuang dalam Sertifikat meskipun masa 5 tahun sudah terlampaui. Tujuan penelitian ini, untuk menemukan argumentasi hukum mengenai kepastian hukum hak atas tanah dalam sistem pendafataran tanah negatif berdasarkan PP 24 Tahun 1997. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dengan pendekatan deskriptif analisis dan menggunakan metode analisis data secara yuridis kualitatif. Hasil pembahasan daripada penelitian ini adalah (1) Penegakan lembaga rechtsverwerking di Indonesia belum dapat dilaksanakan sesuai dengan tujuannya, ini terbukti dengan dijumpainya gugatan-gugatan terhadap sertifikat dipengadilan negeri atau pun pembatalan sertifikat di Pengadilan Tata Usaha Negara, namun bukan berarti sertifikat hak atas tanahtidak menjamin kepastian hukum, karena sertifikat diakui sebagai alat bukti hak yang kuat, sepanjang tidak ada putusan hakim yang mematahkan kebenaran data yuridis dan data fisik yang tercantum dalam Sertifikat. (2) Sistem pendaftaran negatif sesungguhnya memberikan perlindungan hukum kepada pemilik hak yang sejati tidak akan kehilangan haknya, sehingga secara sepintas lembaga rechtsverwerking tidak berpengaruh terhadap kepastian hukum hak atas tanah.Kata kunci: Kepastian Hukum Hak atas Tanah, Lembaga Rechtsvewerking, Sertifikat.ABSTRACTAccomplishment The legal certainty of land rights is the aim of the objective of every rightsholder, and to achieve the legal certainty has been established rechtsverwerking institutions in Government Regulation No.24 of 1997 which gives a time limit of up to 5 years Certificate can still be sued by other parties. But in reality, every person who is able has sufficient evidence is still given a chance to argue and deny the correctness of the data contained in the Certificate despite the 5-year period has been exceeded. The purpose of this research, to find legal arguments on legal certainty of land rights in a negative land registration system based on Government Regulation No. 24 of 1997. The method used in this research is the normative juridical method with descriptive analysis approach and using data analysis methods qualitatively juridical. The results of this research are (1) Enforcement of rechtsverwerking institutions in Indonesia has not been implemented in accordance with its objectives, as evidenced by the finding of lawsuits against the certificate in the district court or the cancellation of certificates in the Administrative Court, but it does not mean that land title certificates do not guarantee legal certainty,because the certificate as a strong evidence of rights, as long as there is no judge’s verdict that disproves the truth of the juridical data and the physical data of the certificate. (2) The negative registration system that actually provides legal protection to the true owner of the right will not lose their rights. so in other words, at a glance the rechtsverwerking institution does not affect the legal certainty of land rights.Keywords: Legal Certainty, Rechtsvewerking Institution, Certificate.
